1) No vegetated wetlands will be excavated or filled outside of the permitted area.
2) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
3) The fill material will be clean and free of any pollutants, except in trace quantities.
4) A silt fence shall be placed around fill material adjacent to 404 wetlands and water to prevent
erosion into thos areas during construction of the dwelling.
5) The fill material shall be seeded or other ground cover provided within thirty (30) days of
project completion sufficient to prevent erosion.

Dear Mr. and Mrs. Haag:
Reference your application for a Department of the Army (DA) permit
to place fill material in wetlands and construct a single family dwelling,
at Lot 324, Brigands Bay Subdivision, located off Kings Point Drive, adjacent
manmade canal to the Pamlico Sound, Frisco, Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of General Permit No. 198000291. Therefore, you
may commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be sent
promptly to this office and the North Carolina Division of Coastal Management
prior to performing any such change or alteration. Such action is necessary as
revised plans must be reviewed and the authorization modified.

other instrument under which the applicant claims title.

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2' by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary:
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed..project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally

PROJECT DESCRIPTION
The property is in question is located on a man-made canal off Kings Point Drive in Brigands
Bay, Frisco, Dare County. The applicants propose to fill a 5,168 square foot area of their 8,428
square foot lot and construct dwelling. The application indicates that the dwelling and septic
system are included in the permit request. The septic system will be place along the front of the
lot adjacent to Kings Point Drive. The septic tank will located inside the estuarine shoreline
AEC, while the field lines will be located outside of the AEC. The dwelling will also be located
within 75' of the estuarine shoreline, but no closer than 40' at any point. The placement of the
dwelling is such that land disturbing activity will occur within 40' of the shoreline as a result
of construction. The footprint of the dwelling, including a proposed deck will be 1,280 sq. ft.,
while the total impervious surface located in the AEC will be 1,260 sq.ft. (including the drive).
Impervious lot cover will not exceed 16% of the lot area located within the AEC.
Approximately 1,110 square feet of the property in question has been delineated as 404
wetlands. Site evaluation verified that there is no coastal wetlands present on the applicants
property. The area to be filled will include two "isolated" pockets of 404 wetlands within 75'
of the estuarine shoreline. The smallest of the two wetland pockets consist of approximately 99.6
sq. ft. and the second is approximately 481.9 sq. ft. According to the application and the site
plan a small area of wetlands 303 sq. ft. in size, located outside of the AEC, will also be filled.
Approximately 225 sq. ft. of 404 wetland located along the northwest corner of the lot will not
be disturbed. The average natural grade of the property is 3. P and the proposed finish grade of
the fill area will be 6.1'. The fill will be sloped at a 30 degree angle. Fill dirt will be placed up
to the side property lines and within 10' feet of a man-made canal.
SITE DESCRIPTION
The property is situated along a man-made canal off the Pamlico Sound and is located in a flood
zone with a base flood elevation of T-0". The natural grade of the lot is approximately 1'- 0"
above the normal water line. Vegetation located on the lot includes, but is not limited to, Red
Cedar (Juniperus virginiana), Wax Myrtle (Myrica cerifera) and upland grasses. The isolated
pockets of wetlands, although cut over, consist of a variety of wetland species including
Pennywort (Hydrocotyle umbellata) and Saw Grass (Cladium jamaicense). The largest wetland
pocket extends into an adjacent lot and appears to be less than one acre in size. The property
in question has no outstanding physical characteristics.
The 404 wetlands located on the applicants property extend into the adjacent property to the
north, which is vacant. The property located to the south of the applicant has been developed
for private residential use.

ANTICIPATED IMPACTS
A result of the fill activity will be a net loss of approximately 581.5 sq.ft. of 404 wetlands. The
fill activity will raise the elevation of the property and increase storm water runoff into the
adjacent canal and onto adjacent lots. The intent of the project is to increase the elevation of the
lot for the placement of a dwelling and a septic system.
CAMA REVIEW AND LAND USE PLAN CONSISTENCY
No unique remnant species, geologic formations or archeological sites are known to be involved
with this site. No activity will be conducted in the adjacent canal or involve any coastal
wetlands.
The freshwater wetlands that the applicant proposes to fill are normally classified by the Dare
County Land Use Plan as "limited conservation" based on the fact that the area constitutes an
isloated pocket. The wetlands in question being located within the estuarine shoreline AEC are
classified as conservation. The Land Use Plan states: "It is important to note that Dare County's
position is to promote the preservation of existing expanses of freshwater wetlands, but to accept
occasional losses of isolated pockets of freshwater wetlands when the level of alteration is
minimal." The plan goes further to classify "isolated pockets of wetlands" as being less than one
contiguous acre in size. Permits consistent with the U.S. Army Corps of Engineer's Nationwide
Permit Program that involve less than one acre are also considered consistent with the Dare
County Land Use Plan.

that receive authorization from the State of North Carolina.

construct a single family dwelling, at Lot 324, Brigands Bay Subdivision,

The applicants proposal to fill property within the estuarine
shoreline AEC appears to be consistent with the specific use
standards found in 7H .0209, but I am concerned that the depth of
the fill being proposed may cause increased storm water runoff in
to the canal and on to adjacent properties. I am also concerned
that there may be difficulty stabilizing a 30% slope on three feet
of fill. If the permit is issued I recommend that the following
additional standards be included:
1. Fill material will be clean and free of any
pollutants, except in trace quantities. Metal
products, organic materials or unsightly debris
will not be used.
2. No material shall be placed outside of the alignment
of the fill area indicated on the workplat.
/1 3. A silt fence shall be placed around fill material
adjacent to 404 wetlands and water to prevent erosion
during construction of the dwelling.
4. The fill material shall be seeded or a ground cover
planted sufficient to prevent erosion within thirty (30)
days of project completion.
S. All construction shall conform to the North Carolina
Building Code requirements and all other local, state
and federal regulations.

You have our approval to place fill material in 582 square feet of wetlands or waters for
purpose of developing a residential lot at Lot 324, Kings Point Drive, as you described in your
application dated 18 January 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
