1) This modification authorizes the platting of 32 additional single-family lots, the extension of
water lines and the construction of a cul-de-sac to serve the Harbor at King's Lynn Phase II
development. This major modification must be attached to the original of permit No. 14-96,
which was issued on 1/26/96, and all documents must be readily available on site when a
Division representative inspects the project for compliance.
Stormwater Management
2) The Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission on June 20, 1996. Any violation of or deviation from
the plan approved by the D. W.Q. will be considered a violation of this CAMA permit
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel wherf the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the ppermit expires on
December 31. 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

3) In order to protect water quality, runoff from construction must not visibly increase the amount
of suspended sediments in adjacent waters.
4) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.
General
5) No public funds may be utilized for the construction or perpetual maintenance of the water line
'and associated facilities. This condition shall remain in force throughout the life of this project.
6) Prior to the initiation of construction, the permttee shall contact the NC Department of
Transportation at (910) 251-5727 to ensure that any required NCDOT approvals are obtained.
NOTE: Subsequent residential development of individual lots within any Areas of Environmental
Concern will require additional permitting. Contact a representative of the Division at
(910) 395-3900 prior to any such development for this determination.
NOTE: Plans and specifications for all water system improvements must be approved by the
Division of Environmental Health prior to the reward of a contract of the initiation of
construction (as required by 15A NCAC 18A.0300, et. seq.). For information, contact the
Public Water Supply Section at (919) 733-2460.
NOTE: The applicant is advised to contact the local health department regarding their
requirements for septic tank installations (as required by 15A NCAC 18A.1900, et. seq.).
For information concerning septic tank and other on -site waste disposal methods, contact
the Brunswick County Health Department.
NOTE: The permiee is requested to contact the Public Health Pest Management Section at (919)

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a

only high quality copies will be accepted. Blue -line

AEC HAZARD NOTICE

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
erosion rate for the area where your property is located is
2 feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as
much as,J�Sfeet landward in a major storm.
The flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.
Without the proper signature, the application will not be
SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for developmentin this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require

9. PROJECT DESCRIPTION
The project is the proposed Phase II of Harbor at King's Lynn Subdivision that was previously
permitted by State Permit #14-96, in January 1996. The project site is located adjacent to Kings Lynn
Drive (SR 1828) and West Beach Dr., at the west end of Long Beach, in Brunswick County, North
Carolina. The 15.16 acre tract is situated, both east and west of the fourteen (14) Phase I lots. The
property is bordered by the Lockwood Folly Sound (also known as Eastern Channel) to the north,
Lockwood Folly Inlet to the west, and the Atlantic Ocean to the south. The existing Kings Lynn Drive
runs through the eastern portion of the property, and adjacent to the northern edge of the western
section of the proposed subdivision expansion. There is an existing 12 inch water line within the Kings
Lynn Drive right-of-way which continues to the west, under Lockwood Folly Inlet to Holden Beach.
The road right-of-way separates the tract from MHW on the northwestern side of the property, but the
highground widens to both sides of Kings Lynn Drives in the eastern section. Topography in the eastern
section consists of large dunes on the north side of the road, with elevations up to 29 feet mean sea
level (MSL). On the north side of the property, these dunes drop sharply to the shoreline of Eastern
Channel/Lockwood Folly Sound. Along the shoreline, there is a border of coastal wetland vegetation.
High coastal marsh species observed along this transition from highground were; Groundsel Bush
(Baccharris halimifolial, Marsh Elder (Iva fmtescens), Salt Meadow Grass (Spartina patensl, Spike
Grass (Distichlas spicata), Sea Ox-eye Borrichia frutescensl, Sea Lavender (Limonium spp.), and
Saltwart (Salicornia spp.). The high marsh transitions into regularly flooded, Smooth Cordgrass
(Snartina alterniflora) marsh, which is approximately 400 feet wide. On the south side of the road, the
topography is relatively low and flat, at approximately 6-10 feet elevation MSL. This area may have
been used as a sand barrow sight at some time in the past. Both areas appear to be typical Newhan fine
sand/dune systems, with typical dune vegetation, predominately, Sea Oats, Smilax, Yucca, other dune
grasses, Wax Myrtle and an occasional Red Cedar and Dune -Elder (Iva imbricatal.
The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Environmental
Management, and are OPEN to the harvest of shellfish., Portions of the tract are within the Ocean
Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated
by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate
is 2 ft./yr. on the west end of Long Beach. Historically, the west end of Long Beach has experienced
significant erosion. Originally, the road made a complete loop around the end of the island. The road
was over -washed a number of times during the 1960's and 1970's. After it was washed out by a storm
in 1979, NCDOT never rebuilt the'road. In recent years, Lockwood Folly Inlet has been migrating
west, and the west end of Long Beach has been accreting, with dune development and natural vegetation
colonization, 800 to 1200 feet west and south of it's 1979 location.
The applicants have subdivided the Harbor at Kings Lynn subdivision, Phase H property, into 32
additional single-family lots (15-46). Lots 15-39 are located east of the Phase I tract. Lots 40-46 are
located west of the original Phase I section (Lots 1-14). Individual septic tank systems would provide
wastewater disposal for each residence. The applicants propose to extend the potable water line that
was approved for Lots 8-14, to also, serve Lots 40-46. The established utility easement, adjacent to
the road, 20 feet wide, along the north side of Lots 1-8, would continue through Lots 40-46. The
waterline extension would be approximately 200 feet long and six (6) inches in diameter. Similarly, a
waterline extension is proposed for Lots 25-29, on West Beach Drive. This line would be 130 feet long
and 4 inches in diameter. The water lines would be installed by the applicant and ownership

subsequently transferred to the subdivision property owners for long term maintenance and/or repair.
A paved cul-de-sac, (King's Lynn Court), off King's Lynn Drive, is proposed to access Lots 15-18. A
two (2) inch waterline would be installed within this right-of-way to serve these lots.
10. ANTICIPATED IMPACTS
The installation of the proposed waterline extensions and cul-de-sac would disturb approximately 12,410
square feet of highground area. Additional soil disturbance and creation of impervious surface area
would occur with the subsequent construction of single-family houses, by individual lot owners. There
may be substantial loss of the high dune area north of Kings Lynn Drive, as the area is outside of the
Ocean Hazard AEC, and lot owners will be able to modify their landscapes as they so choose.

Phase II of The Harbor at King's Lynn is proposed to have 32 lots which
will be numbered in compatibility with the Phase I section of the subdivision.
The proposed Phase II lots vary in width dimension from approximately 51 feet
to approximately 104 feet and in depth from 520 feet to approximately 136 feet.
The proposed lots are located adjacent to each end of Phase I, directly across
the roadway (north) of the Brunswick County Water Booster Pumping Station,
and north of West Beach Drive. The project for Phase II consists of the
addition of three six-inch waterlines, an extension of the asphalt roadway at
the west end of King's Lynn Drive, and the construction of an asphalt cul-de-
sac roadway, King's Lynn Court. It is our intent, with the submittal of
NCDEHNR forms DCM-MP-1 and DCM-MP-3, that a modification be made to
Permit Number 1496, issued on January 26, 1996 by the NCDEHNR for the
project associated with Phase I of The Harbor at King's Lynn, to include Phase
II. A brief description of each of the items associated with the project for Phase
II is listed below:
A. Six-inch waterlines
A six-inch waterline approximately 420 feet in length and located within
the Department of Transportation (D.O.T) Right of Way, will be connected to
the existing six inch line at the west end of West Branch Drive. A Right of Way
Encroachment Agreement has been submitted to the D.O.T. for this area.
A second six-inch waterline will be a continuation of the six-inch water
line that was previously permuted for Phase I of The Harbor at King's Lynn.
Approximately 400 feet of six-inch waterline will be added to the 360-foot water
line described in the Coastal Area Management Act (C.A.M.A.) Permit # 1496 for
The Harbor at King's Lynn. This additional waterline will be located at the
west end of King's Lynn Drive and will be constructed within the 20 foot
easement located on the north east end of Lots 40 through 46.
A third six-inch waterline will connect to the existing twelve -inch
waterline located within the D.O.T. Right of Way for King's Lynn Drive and will
be used to service lots 15 through 19. The six-inch line will be constructed
within a twenty -foot easement located on the north-east end of lots 15 through
19.
B. Roadway extension
The asphalt roadway of King's Lynn Drive will be extended westerly
approximately 210 feet in order to provide paved access to Lots 44 through 46
of Phase II of The Harbor at King's Lynn. The roadway extension will be 20
feet in width and will be located in the approximate center of the D.O.T. Right \ j
of Way.
C. Roadway construction
King's Lynn Court will be an asphalt roadway 20 feet in width,
approximately 190 feet in length, originating from King's Lynn Drive and
terminating with a 45-foot radius cul-de-sac. King's Lynn Court will be located
approximately 400 feet north west from the intersection of 69th Place West and
King's Lynn Drive and will intersect the southern edge of King's Lynn Drive.
The roadway will be constructed in accordance with the current construction
standards as defined by the NCDOT.
A site development plan for Phase I and Phase II of The Harbor at King's
Lynn was submitted to the Division of Environmental Management on April
30, 1996 for approval.

Recommendations for State Permit - Cooke/Sutton - The Harbor at Kings Lynn Subdivision
The applicant proposes to overcome the project's inconsistency with 711.0306(c), by assuming the cost
of water line installation, and subsequently transferring perpetual maintenance to the property owners
association. Provided this is accomplished, and adequate documentation provided to satisfy DCM
requirements, I have no objection to the project subject to the following conditions:
1. Adequate sedimentation and erosion control measures shall be implemented and maintained to
prevent erosion of unconsolidated soil into adjacent wetlands and/or waters.
�/2. Subsequent residential development of individual lots within any area(s) of Environmental
Concern will require additional permitting through the Division which implements the Long
Beach Minor CAMA Permit Program.
3. NOTE: Plans and specifications of all water system improvements must be approved by the
Division of Environmental Health prior to the award of a contract or the initiation of
construction (as required by 10 NCAC, 10D.0900, et. seq). For information, contact the Public

This permit consistency opinion is based on my review of the Stuart Cooke & John Sutton/The Harbor
at King's Lynn Subdivision application for a major modification of permit #14-96, the Field
Investigation Report (EF Brooks, 9/12/96), and my understanding and interpretation of the policies
presented in the Town of Long Reach 1993 Land iie Plan.
The applicant is requesting a modification to his existing State Permit #14-96 to add Phase II of the
Harbor at Kings Lynn Subdivision. Phase 11 would include the platting of 32 additional single-family
lots and the extension of water lines and construction of a cul-de-sac to serve the development. The
location and complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation; Developed Residential
CLASSIFICATION DESCRIPTION:
Conservation areas include all Ocean Hazard Areas of Environmental Concern. King's Lynn is in
FEMA VE and AE Zones according to a 1991 FEMA map. From the Plan:
Development shall be permitted which is allowed by the policies contained in this plan, the Long Bach Zoning Ordinance,
and 15A NCAC 7H.0306.
Developed Residential areas are defined as those areas where utilities and urban services are provided
and the major land use is residential.
RELATED POLICIES AND IMPLEMENTATION MEASURES:
*The Town of Long Beach is concerned about flood hazard areas, and will coordinate any
development within the special flood hazard area with NC-DCM, FEMA and US COE.
*The Town will support state regulation relating to stormwater runoff resulting from
development.
•The Town of Long Beach Land Use Plan supports only uses within Ocean Hazard Areas of
Environmental Concern (includes Inlet Hazard Areas) which are consistent with 15A NCAC
7H, and the Town's zoning and dune protection ordinances.
CONSISTENCY OPINION:
This proposal is consistent with the land use plan when all recommended conditions placed on the
permit by the Division of Coastal Management are met. Development restrictions may vary from lot
to lot and over time as the inlet migrates and the ocean shoreline changes. It should be noted that the
hazard areas in which this development is situated are dynamic. Recent controversy about the accuracy
of Inlet Hazard Areas as mapped by the Division of Coastal Management suggests that the delineation
of the Inlet Hazard area in question be carefully reviewed before this permit modification is issued.

The Wilmington Regional Office received the Stormwater Application for The Harbor at King's Lynn on
April 24, 1990', with final information oil June 3, 1996. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in 'Title 15A
NCAC 211.1000. We are forwarding Permit No SWH 951211 Modification dated June 20, 1996, to you.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions
and limitations as specified therein, and does not supersede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this pennit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit.
This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina
General Statutes, and tiled with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC
21611-7447. Unless such demands are matte this pennit shall be final and binding.

construction, operation and maintenance of a 25 % low density development in compliance with the provisions
of 15A NC _AC 2H .1000 (hereafter referred to as the "vorinwater rides") and the approved stormwater
management plans and specifications, and other supporting data as attached and on file with and approved by
the Division of Environmental Management and considered a part of this permit for The Harbor at King's
Lynn.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following
specific conditions and limitations:
L DESIGN STANDARDS
1. Each of the 46 lots in the subdivision is limited to 5,500 square feet of built -upon area. Lots
within CAMA's Area of Environmental Concern may have the allowable built -upon area reduced
due to additional LAMA Permit requirements.
2. The overall tract built -upon area percentage for the project must be maintained at 25%, per the
low density requirements for projects that drain to SA waters.
3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable carts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with
minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the storm water rules and
approved by the Division.

5. No piping shall be allowed except:
a, That minimum amount necessary to direct runoff beneath an impervious surface such as
a road.
b. That minimum amount needed under driveways to provide access to lots.
6. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between
all impervious areas and surface waters.
7. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be
revised without approval from the pernittee, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner,
8. Deed restrictions are incorporated into this permit by reference and must be recorded with the
Office of the Register of Deeds prior to the sale of any lot. A copy of the recorded restrictions
must be received by this Office within 30 days of the date of recording. Recorded deed
restrictions must include, as a minimum, the following statements related to stormwater
management:
a. A statement of the allowable built -upon area per lot in the following form:
"The allowable built -upon area per lot is 5,500 square feet, inclusive of that portion of the
right-of-way between the front lot line and the edge of the pavement, structures, pavement,
walkways of brick, stone, slate, but not including wood decking."
b. Items related to stormwater management must remain in the deed restriction, and this
must be indicated by including the following:
"The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
C. To assure that vegetated conveyances are not piped (in accordance with item 5) deed
restrictions must indicate that:
"Pilling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings, is strictly prohibited by any persons."
9. The Engineer/ Owner/Developer/Pernittee must certify in writing that the project's stormwater
controls, and impervious surfaces have been constructed within substantial intent of the approved
plans and specifications. Any deviation from the approved plans must be noted on the
Certification.

10: The followhlg items will require a modification to the permit. Revised plans, specifications and
Calculations must be permitted prior to the pennittee beginning construction on the modification:
a• t'•ny revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
11. The Director may notify the pernittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director for modifying the site to meet
minimum requirements. The permittee shall provide copies of revised plans and certification in
writing to the Director that the changes have been made,
H. SCHEDULE OF COMIPLIANCE
The permittee shall comply with the following schedule for construction and maintenance of the
I.ow Density Option stormwater systems:
a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated,
and be Operational for their intended use prior to the construction of any built -upon
surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the
stvales or other vegetated conveyurcea will be repaired immediately.
2. The perrnittee shall at all times provide the operation and maintenance necessary to operate the
permitted stormwater management systems at optimum efficiency to include:
a. Inspections
b. Sediment removal,
C. Mowing, and revegetating of the side slopes.
d. Immediate, repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications
3. The permittee shall submit recorded deed restrictions Limiting built -upon area per lot in
accordance with Part I item 10 within 30 days of the date of recording,
4- The penuittee shall submit the Engincer/Owner, Designer,'pernrittee Certification in accordance
with Part I Item 1 I within 30 days of completion of the project.
5. The pertnittee shall submit all information requested by the Director or his representative within
the time frame specified in the written information request.

III. GEN RAL CONDITIONS
I. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management, in
accordance with North Carolina General Statutes 143.215.6A to 143-21.5.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revol':ed and reissued or terminated for cause. The filing of a
request for a permitt modification, revocation and reissuance, or termination does not stay any
Permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revolting and reissuing the permit, or terminating the permit as allowed by the laws,
rules, and regulations contained in Title 15A of the North Carolina Administrative Code,
Subchapter 213.1000; and North Carolina General Statute 143-215.1 et, al.
S. The permit is not transferable to any person except after notice to and approval by the Director.
The Director may require modification or revocation and reissuance of the permit to change the
name and incorporate such other requirements as may be necessary. A formal permit request
must be submitted to the Division of Environmental Management accompanied by the
appropriate fee, documentation from both parties involved, and other supporting materials as
may be appropriate. The approval of this request will be considered on its merits, and may or
may not be approved.
6. The Permittee grants permission to Regional Office Staff to enter 111e property for the purpose
Of inspecting all components of the permitted stormwater facility.
7. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes. rules. regulations, or ordinances which may be imposed by other government agencies
(local, state and federal) which have jurisdiction.

9. PROJECT DESCRIPTION
The project is the proposed Phase H of Harbor at King's Lynn Subdivision that was previously
permitted by State Permit #14-96, in January 1996. The project site is located adjacent to Kings Lynn
Drive (SR 1828) and West Beach Dr., at the west end of Long Beach, in Brunswick County, North
Carolina. The 15.16 acre tract is situated, both east and west of the fourteen (14) Phase I lots. The
property is bordered by the Lockwood Folly Sound (also known as Eastern Channel) to the north,
Lockwood Folly Inlet to the west, and the Atlantic Ocean to the south. The existing Kings Lynn Drive
runs through the eastern portion of the property, and adjacent to the northern edge of the western
section of the proposed subdivision expansion. There is an existing 12 inch water line within the Kings
Lynn Drive right-of-way which continues to the west, under Lockwood Folly Inlet to Holden Beach.
The road right-of-way separates the tract from MHW on the northwestern side of the property, but the
highground widens to both sides of Kings Lynn Drives in the eastern section. Topography in the eastern
section consists of large dunes on the north side of the road, with elevations up to 29 feet mean sea
level (MSL). On the north side of the property, these dunes drop sharply to the shoreline of Eastern
Channel/Lockwood Folly Sound. Along the shoreline, there is a border of coastal wethmd vegetation.
High coastal marsh species observed along this transition from highground were; Groundsel Bush
(Baccharris halimifolia), Marsh Elder Qva frutescensl, Salt Meadow Grass (Spartina patens), Spike
Grass (Distichlas spicata), Sea Ox-eye (Borrichia frutescens), Sea Lavender (Limonium spp.), and
Saltwart Salicornia spp.). The high marsh transitions into regularly flooded, Smooth Cordgrass
(Spartina alterniflora) marsh, which is approximately 400 feet wide. On the south side of the road, the
topography is relatively low and flat, at approximately 6-10 feet elevation MSL. This area may have
been used as a sand barrow sight at some time in the past. Both areas appear to be typical Newhan fine
sand/dune systems, with typical dune vegetation, predominately, Sea Oats, Smilax, Yucca, other dune
grasses, Wax Myrtle and an occasional Red Cedar and Dune -Elder (Iva imbricatal.
The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Environmental
Management, and are OPEN to the harvest of shellfish. Portions of the tract are within the Ocean
Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated
by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate
is 2 ft./yr. on the west end of Long Beach. Historically, the west end of Long Beach has experienced
significant erosion. Originally, the road made a complete loop around the end of the island. The road
was over -washed a number of times during the 1960's and 1970's. After it was washed out by a storm
in 1979, NCDOT never rebuilt the road. In recent years, Lockwood Folly Inlet has been migrating
west, and the west end of Long Beach has been accreting, with dune development and natural vegetation
colonization, 800 to 1200 feet west and south of it's 1979 location.
The applicants have subdivided the Harbor at Kings Lynn subdivision, Phase Il property, into 32
additional single-family lots (15-46). Lots 15-39 are located east of the Phase I tract. Lots 40-46 are
located west of the original Phase I section (Lots 1-14). Individual septic tank systems would provide
wastewater disposal for each residence. The applicants propose to extend the potable water line that
was approved for Lots 8-14, to also, serve Lots 40-46. The established utility easement, adjacent to
the road, 20 feet wide, along the north side of Lots 1-8, would continue through Lots 40-46. The
waterline extension would be approximately 200 feet long and six (6) inches in diameter. Similarly, a
waterline extension is proposed for Lots 25-29, on West Beach Drive. This line would be 130 feet long
and 4 inches in diameter. The water lines would be installed by the applicant and ownership

Phase II of The Harbor at King's Lynn is proposed to have 32 lots which
will be numbered in compatibility with the Phase I section of the subdivision.
The proposed Phase II lots vary in width dimension from approximately 51 feet
to approximately 104 feet and in depth from 520 feet to approximately 136 feet.
The proposed lots are located adjacent to each end of Phase I, directly across
the roadway (north) of the Brunswick County Water Booster Pumping Station,
and north of West Beach Drive. The project for Phase II consists of the
addition of three six-inch waterlines, an extension of the asphalt roadway at
the west end of King's Lynn Drive, and the construction of an asphalt cul-de-
sac roadway, King's Lynn Court. It is our intent, with the submittal of
NCDEHNR forms DCM-MP-1 and DCM-MP-3, that a modification be made to
Permit Number 1496, issued on January 26, 1996 by the NCDEHNR for the
project associated with Phase I of The Harbor at King's Lynn, to include Phase
II. A brief description of each of the items associated with the project for Phase
II is listed below:
A. Six-inch waterlines
A six-inch waterline approximately 420 feet in length and located within
the Department of Transportation (D.O.T) Right of Way, will be connected to
the existing six inch line at the west end of West Branch Drive. A Right of Way
Encroachment Agreement has been submitted to the D.O.T. for this area.
A second six-inch waterline will be a continuation of the six-inch water
line that was previously permuted for Phase I of The Harbor at King's Lynn.
Approximately 400 feet of six-inch waterline will be added to the 360-foot water
line described in the Coastal Area Management Act (C.A.M.A.) Permit #1496 for
The Harbor at King's Lynn. This additional waterline will be located at the
west end of King's Lynn Drive and will be constructed within the 20 foot
easement located on the north east end of Lots 40 through 46.
A third six-inch waterline will connect to the existing twelve -inch
waterline located within the D.O.T. Right of Way for King's Lynn Drive and will
be used to service lots 15 through 19. The six-inch line will be constructed
within a twenty -foot easement located on the north-east end of lots 15 through
19.
B. Roadway extension
The asphalt roadway of King's Lynn Drive will be extended westerly
approximately 210 feet in order to provide paved access to Lots 44 through 46
of Phase II of The Harbor at King's Lynn. The roadway extension will be 20
feet in width and will be located in the approximate center of the D.O.T. Right
of Way.
C. Roadway construction
King's Lynn Court will be an asphalt roadway 20 feet in width,
approximately 190 feet in length, originating from King's Lynn Drive and
terminating with a 45-foot radius cul-de-sac. King's Lynn Court will be located
approximately 400 feet north west from the intersection of 69th Place West and
King's Lynn Drive and will intersect the southern edge of King's Lynn Drive.
The roadway will be constructed in accordance with the current construction
standards as defined by the NCDOT.
A site development plan for Phase I and Phase II of The Harbor at King's
Lynn was submitted to the Division of Environmental Management on April
30, 1996 for approval.

subsequently transferred to the subdivision property owners for long term maintenance and/or repair.
A paved cul-de-sac, (King's Lynn Court), off King's Lynn Drive, is proposed to access Lots 15-18. A
two (2) inch waterline would be installed within this right-of-way to serve these lots.
10. ANTICIPATED IMPACTS
The installation of the proposed waterline extensions and cul-de-sac would disturb approximately 12,410
square feet of highground area. Additional soil disturbance and creation of impervious surface area
would occur with the subsequent construction of single-family houses, by individual lot owners. There
may be substantial loss of the high dune area north of Kings Lynn Drive, as the area is outside of the
Ocean Hazard AEC, and lot owners will be able to modify their landscapes as they so choose.

8. PROJECT SUNOdARY: The applicant is requesting to modify to his existing State Permit
#14-96, to include Phase H, of the Harbor at Kings Lynn Subdivision. Phase II would include
the platting of 32 additional single-family lots, and the extension of water lines and construction
of a cul-de-sac to serve the development.

9. PROTECT DESCRIPTION
The project is the proposed Phase 11 of Harbor at King's Lynn Subdivision that was previously
permitted by State Permit #14-96, in January 1996. The project site is located adjacent to Kings N nn
Drive (SR 1828) and West Beach Dr., at the west end of Long Beach, in Brunswick County,s The
Carolina. The 15.16 acre tract is situated, both east and west of the fourteen (14) Phase
property is bordered by the Lockwood FollySound (also known as Eastern Channel) to the north,
Lockwood Folly Inlet to the west, and the Atlantic Ocean to the south. The existing Kings Lynn Drive
runs through the eastern portion of the Property, and adjacent to the northern edge of the western
section of the proposed subdivision expansion. There is anexisting12 inch water line within the Yjngs
Lynn Drive right-of-way which continues to the west, under Lockwood Folly Inlet to Holden Bach -
The road right-of-way separates the tract from MHW on the northwestern side of the propertythe eastern
highground widens to both sides of Kings Lynn Drives in the eastern but the
section. T°P° to 29 feet mean sea
section consists of large dunes on the north side of the road, with elevations up
level (MSL). On the north side of the property, these dunes drop sharply to the shoreline of Eastern
Channel/Lockwood Folly Sound. Along the shoreline, there is a border of coastal wetland eese�Bon.
High coastal marsh species observed along this transition from high Grass were;
(Baccharris halimifolia), Marsh Elder (Iva frutescensl, salt Meadow Grass /nramenspP )Spy
Grass (Distichlas spicata), Sea Ox-eye (Borricbia frutescens), Sea Lavender (1- i CP,)1 and
Saltwart Salicornia spp.). The high marsh transitions into regularly flooded,
(Spartina alterniflora) marsh, which is approximately 400 feet wide. On the south side of them ad, the
topography is relatively low and flat, at approximately 6-10 feet elevation M bUe. � � w� fine
been used as a sand barrow sight at some time in the past. Both areas appear Lucca, other dune
sand/dune systems, with typical dune vegetation, predominately, Sea Oats, Smilax,
grasses, Wax Myrtle and an occasional Red Cedar and Dune -Elder Uva imbricata).
The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of

Management, and are OPEN to the harvest of shellfish. Portions of the tract
Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated
by the North Carolina Coastal Resources Commission. The Long Term Average Annoal Erosion Rate
is 2 ft./yr. on the west end of Long Beach. Historically, the west end of Long Beach has experienced
significant erosion. Originally, the road made a complete loop around the end of the island. The road

Paved cul de -sac, (King's Lynn Court), off Ring's Lynn Drive, is proposed to access Lots 15-18. A
two (2) inch waterline would be installed within this right-of-way to serve these lots.
10. ANTICIPATED Ly1PACTS
The installation of the proposed waterline extensions and cul-de-sac would disturb approximately 12,410
square feet of highground area. Additional soil disturbance and creation of impervious surface area
would occur with the subsequent construction of single-family houses, by individual lot owners. There
may substantial loss of the high dune area north of Kings Lynn Drive, as the area is outside of the
ocean Ord AFC, and lot owners will be able to modify their landscapes as they so choose.

Introduction DIVISION OF

Phase II of The Harbor at King's Lynn is proposed to have 32 lots which
will be numbered in compatibility with the Phase I section of the subdivision.
The proposed Phase II lots vary in width dimension from approximately 51 feet
to approximately 104 feet and in depth from 520 feet to approximately 136 feet.
The proposed lots are located adjacent to each end of Phase I, directly across
the roadway (north) of the Brunswick County Water Booster Pumping Station,
and north of West Beach Drive. The project for Phase II consists of the
addition of three six-inch waterlines, an extension of the asphalt roadway at
the west end of King's Lynn Drive, and the construction of an asphalt cul-de-
sac roadway, King's Lynn Court. It is our intent, with the submittal of
NCDEHNR forms DCM-MP-1 and DCM-MP-3, that a modification be made to
Permit Number 1496, issued on January 26, 1996 by the NCDEHNR for the
project associated with Phase I of The Harbor at King's Lynn, to include Phase
II. A brief description of each of the items associated with the project for Phase
II is listed below:
A. Sig -inch waterlines
A six-inch waterline approximately 420 feet in length and located within
the Department of Transportation (D.O.T) Right of Way, will be connected to
the existing six inch line at the west end of West Branch Drive. A Right of Way
Encroachment Agreement has been submitted to the D.O.T. for this area.
A second six-inch waterline will be a continuation of the six-inch water
line that was previously permuted for Phase I of The Harbor at King's Lynn.
Approximately 400 feet of six-inch waterline will be added to the 360-foot water
line described in the Coastal Area Management Act (C.A.M.A.) Permit #1496 for
The Harbor at King's Lynn. This additional waterline will be located at the
west end of King's Lynn Drive and will be constructed within the 20 foot
easement located on the north east end of Lots 40 through 46.
A third six-inch waterline will connect to the existing twelve -inch
waterline located within the D.O.T. Right of Way for King's Lynn Drive and will
be used to service lots 15 through 19. The six-inch line will be constructed
within a twenty -foot easement located on the north-east end of lots 15 through
19.
B. Roadway extension
The asphalt roadway of King's Lynn Drive will be extended westerly
approximately 210 feet in order to provide paved access to Lots 44 through 46

of Phase II of The Harbor at King's Lynn. The roadway extension will be 20
feet in width and will be located in the approximate center of the D.O.T. Right
of Way.
C. Roadway construction
King's Lynn Court will be an asphalt roadway 20 feet in width,
approximately 190 feet in length, originating from King's Lynn Drive and
terminating with a 45-foot radius cul-de-sac. King's Lynn Court will be located
approximately 400 feet north west from the intersection of 69th Place West and
King's Lynn Drive and will intersect the southern edge of King's Lynn Drive.
The roadway will be constructed in accordance with the current construction
standards as defined by the NCDOT.
A site development plan for Phase I and Phase II of The Harbor at King's
Lynn was submitted to the Division of Environmental Management on April
30, 1996 for approval.

8. PROJECT SUMMARY: The applicant is requesting to modify to his existing State Permit
#14-96, to include Phase 11, of the Harbor at Kings Lynn Subdivision. Phase Il would include
the platting of 32 additional single-family lots, and the extension of water lines and construction
of a cul-de-sac to serve the development.

The project is the proposed Phase II of Harbor at King's Lynn Subdivision that was previously
permitted by State Permit #14-96, in January 1996. The project site is located adjacent to Kings Lynn
Drive (SR 1828) and West Beach Dr., at the west end of Long Beach, in Brunswick County, North
Carolina. The 15.16 acre tract is situated, both east and west of the fourteen (14) Phase I lots. The
property is bordered by the Lockwood Folly Sound (also known as Eastern Channel) to the north,
Lockwood Folly Inlet to the west, and the Atlantic Ocean to the south. The existing Kings Lynn Drive
runs through the eastern portion of the property, and adjacent to the northern edge of the western
section of the proposed subdivision expansion. There is an existing 12 inch water line within the Kings
Lynn Drive right-of-way which continues to the west, under Lockwood Folly Inlet to Holden Beach.
The road right-of-way separates the tract from MHW on the northwestern side of the property, but the
highground widens to both sides of Kings Lynn Drives in the eastern section. Topography in the eastern
section consists of large dunes on the north side of the road, with elevations up to 29 feet mean sea
level (MSL). On the north side of the property, these dunes drop sharply to the shoreline of Eastern
Channel/Lockwood Folly Sound. Along the shoreline, there is a border of coastal wetland vegetation.
High coastal marsh species observed along this transition from highground were; Groundsel Bush
(Baccharris halimifolia), Marsh Elder (Iva frutescens), Salt Meadow Grass '(Spartina patensl, Spike
Grass (Distichlas spicata), Sea Ox-eye (Borrichia frutescens), Sea Lavender (Limonium spp.), and
Saltwart Salicornia spp.). The high marsh transitions into regularly flooded, Smooth Cordgrass
(Spartina alternifloral marsh, which is approximately 400 feet wide. On the south side of the road, the
topography is relatively low and flat, at approximately 6-10 feet elevation MSL. This area may have
been used as a sand barrow sight at some time in the past. Both areas appear to be typical Newhan fine
sand/dune systems, with typical dune vegetation, predominately, Sea Oats, Smilax, Yucca, other dune
grasses, Wax Myrtle and an occasional Red Cedar and Dune -Elder (Iva imbricata).
The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Environmental
Management, and are OPEN to the harvest of shellfish. Portions of the tract are within the Ocean
Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated
by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate
is 2 ft./yr. on the west end of Long Beach. Historically, the west end of Long Beach has experienced
significant erosion. Originally, the road made a complete loop around the end of the island. The road
was over -washed a number of times during the 1960's and 1970's. After it was washed out by a storm
in 1979, NCDOT never rebuilt the road. In recent years, Lockwood Folly Inlet has been migrating
west, and the west end of Long Beach has been accreting, with dune development and natural vegetation
colonization, 800 to 1200 feet west and south of it's 1979 location.
The applicants have subdivided the Harbor at Kings Lynn subdivision, Phase 11 property, into 32
additional single-family lots (15-46). Lots 15-39 are located east of the Phase I tract. Lots 40-46 are
located west of the original Phase I section (Lots 1-14). Individual septic tank systems would provide
wastewater disposal for each residence. The applicants propose to extend the potable water line that
was approved for Lots 8-14, to also, serve Lots 40-46. The established utility easement, adjacent to
the road, 20 feet wide, along the north side of Lots 1-8, would continue through Lots. 40-46. The
waterline extension would be approximately 200 feet long and six (6) inches in diameter. Similarly, a
waterline extension is proposed for Lots 25-29, on West Beach Drive. This line would be 130 feet long
and 4 inches in diameter. The water lines would be installed by the applicant and ownership

subsequently transferred to the subdivision property owners for long term maintenance and/or repair.
A paved cul-de-sac, (King's Lynn Court), off King's Lynn Drive, is proposed to access Lots 15-18. A
two (2) inch waterline would be installed within this right-of-way to serve these lots.
10. ANTICIPATED EMPACTS
The installation of the proposed waterline extensions and cul-de-sac would disturb approximately 12,410
square feet of highground area. Additional soil disturbance and creation of impervious surface area
would occur with the subsequent construction of single-family houses, by individual lot owners. There
may be substantial loss of the high dune area north of Kings Lynn Drive, as the area is outside of the
Ocean Hazard AEC, and lot owners will be able to modify their landscapes as they so choose.

Phase II of The Harbor at King's Lynn is proposed to have 32 lots which
will be numbered in compatibility with the Phase I section of the subdivision.
The proposed Phase II lots vary in width dimension from approximately 51 feet
to approximately 104 feet and in depth from 520 feet to approximately 136 feet.
The proposed lots are located adjacent to each end of Phase I, directly across
the roadway (north) of the Brunswick County Water Booster Pumping Station,
and north of West Beach Drive. The project for Phase II consists of the
addition of three six-inch waterlines, an extension of the asphalt roadway at
the west end of King's Lynn Drive, and the construction of an asphalt cul-de-
sac roadway, King's Lynn Court. It is our intent, with the submittal of
NCDEHNR forms DCM-MP-1 and DCM-MP-3, that a modification be made to
Permit Number 1496, issued on January 26, 1996 by the NCDEHNR for the
project associated with Phase I of The Harbor at King's Lynn, to include Phase
II. A brief description of each of the items associated with the project for Phase
II is listed below:
A. Six-inch waterlines
A six-inch waterline approximately 420 feet in length and located within
the Department of Transportation (D.O.T) Right of Way, will be connected to
the existing six inch line at the west end of West Branch Drive. A Right of Way
Encroachment Agreement has been submitted to the D.O.T. for this area.
A second six-inch waterline will be a continuation of the six-inch water
line that was previously permuted for Phase I of The Harbor at King's Lynn.
Approximately 400 feet of six-inch waterline will be added to the 360-foot water
line described in the Coastal Area Management Act (C.A.M.A.) Permit #1496 for
The Harbor at King's Lynn. This additional waterline will be located at the
west end of King's Lynn Drive and will be constructed within the 20 foot
easement located on the north east. end of Lots 40 through 46.
A third six-inch waterline will connect to the existing twelve -inch
waterline located within the D.O.T. Right of Way for King's Lynn Drive and will
be used to service lots 15 through 19. The six-inch line will be constructed
within a twenty -foot easement located on the north-east end of lots 15 through
19.
B. Roadway extension
The asphalt roadway of King's Lynn Drive will be extended westerly
approximately 210 feet in order to provide paved access to. Lots 44 through 46
of Phase II of The Harbor at King's Lynn. The roadway extension will be 20
feet in width and will be located in the approximate center of the D.O.T. Right
of Way.
C. Roadway construction
King's Lynn Court will be an asphalt roadway 20 feet in width,
approximately 190 feet in length, originating from King's Lynn Drive and
terminating with a 45-foot radius cul-de-sac. King's Lynn Court will be located
approximately 400 feet north west from the intersection of 69th Place West and
King's Lynn Drive and will intersect the southern edge of King's Lynn Drive.
The roadway will be constructed in accordance with the current construction
standards as defined by the NCDOT.
A site development plan for Phase I and Phase II of The Harbor at King's
Lynn was submitted to the Division of Environmental Management on April
30, 1996 for approval.

describing the proposed project for The Harbor at King's Lynn Phase II,
drawings including a site map showing the location of the proposed project,
and the application for Major Development in an Area of Environmental
Concern, for Phase II of The Harbor at Kings Lynn. These items have been
submitted to the N.C. Division of Coastal Management in order to obtain a
modification to an existing CAMA Permit.
In accordance with the requirements of this application, landowners of
adjacent waterfront property must be notified of the proposed project. Please
be advised that you have 30 days from receipt of this notice in which to submit
comments to the Division of Coastal Management.

This permit, issued on X or !^G is subject to compliance with the application (when; consistent
with the permit), all applica le regulations, special conditions and totes set forth below. Any violation of these terns may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The Division of Environmental Management approved this project under stormwater management
rules of the Environmental Management Commission on 1/12/96. Any violation of or deviation
from the plan approved by the DEM will be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
2) In order to protect water quality, runoff from construction must not visibly increase the amount
of suspended sediments in adjacent waters.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

must be filed at least thirty (30) days prior to the beginning of any land -disturbing activity.
Submit this Plan to the Department of Environment, Health and Natural Resources, Land
Quality Section, 127 Cardinal Drive, Wilmington, NC 28405-3845.
General
3) No public funds may be utilized for the construction or perpetual maintenance of the water line
and associated facilities. This condition shall remain in force throughout the life of this project.
4) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
5) No excavated or fill material will be placed at any time in any marsh or surrounding waters
outside of the alignment of the fill area indicated on the work plans.
NOTE: Subsequent residential development of individual lots within the Areas of Environmental
Concern will require additional permitting through the Division or the Town of Long
Beach Minor CAMA Permit Program.
NOTE: Plans and specifications of all water system improvements must be approved by the
Division of Environmental Health prior to the award of a contract or the initiation of
construction (as required by 10 NCAC 10D.0900 et. seq.). For information, contact the
