This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. DAVIS Director This letter is in response to our recent conversations and emails regarding your concerns about the Coastal Area Management Act (CAMA) permit issued to Christopher and Jennifer Shue for the construction of an observation pier located within Chadwick Bay in Sneads Ferry, North Carolina. Permit No. 28-14, which was issued on March 25, 2014, was granted a two-year extension on September, 27, 2017, Based upon my conversations with you, it appears that it is possible that incorrect notice may have been provided to you during the original application process in late 2012 and early 2013, possibly impacting onyourability to appeal the issuance of the original permit. Due to this circumstance, the Division of Coastal Management suggests that, if you are so inclined, you appeal the decision to issue the original permit, and in addition to explaining why you believe that the original permit should not have been issued, offer an explanation as to why the appeal was not filed sooner. If you choose to contest our permit actions in this case, you may file a request for a Third -Party Appeal. The Chairwoman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days of the date of this letter. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. This permit does not authorize the interference with anyexisting or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. JUL 10 2017 General DCM- MHD CITY The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. DTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. DTE Future development of the permittee's property may require a modification of this permit. I researched the deeds for my lot 13 and have enclosed. A boat slip was never issued to this lot. Also of interest, lot 13 never had a CAMA restriction placed on it not to build into the waters of Chadwick bay through 3 changes of hands. The other lots shown in the CAMA permit for Pelican Point Dock Association had boats slips issued and the restriction was placed on their deeds. When I bought the lot is was separate deed but included as a combined deed with lot 14 and boat slip 8 assigned to 14 when I bought them. This must be why Jim Gregson said if I had no slip I could have a dock. Also, I don't know if it makes a difference or not, but I included Brian Shepards deed to the shellfish beds with a section circled about not affecting littoral rights. This will briefly cover the chain of events which led to the issuance of my CAMA permit. I bought this lot, as well as Lot number 14, from a gentleman named Dennis Buonocore. Mr. Buonocore wanted to sell both lots at the same time. It has been mentioned that these lots were deeded together but in fact were not. Mr. Buonocore purchased Lot 14 in 1993 and Lot 13 in 1998. 1 have enclosed the deed history report for each lot that was provided by Onslow county register of deeds. Shortly after my purchase, I contacted CAMA in regard to doing fill work on Lot 13. Mr. Jim Gregson of CAMA and I met at my lot for him to do the delineation. I asked about the process of obtaining a dock permit for Lot 13. He told me at that time that as long as I had a slip in the association (lot 14) that CAMA would not approve. He said that he was a part of the original process of the CAMA permit for the dock association and it was decided as a mitigation factor for people to not be able to have both an association dock and a personal dock. He also stated that any lot that had an association slip would have a deed restriction placed on their lot. Lot 13 never had an association slip and thus no restriction was ever placed on the lot. Since my ultimate dream was to have a personal dock, I asked if I sold Lot 14 with the dock, could I then obtain a pier permit, He told me yes and also gave me an application for a general permit and included his phone number on it. I told him that before I sold lot 14, 1 wanted to make sure I could fill Lot 13 to be suitable for home construction. Page 1 Mr. Gregson told me that after I sold, I should obtain a letter from the association stating that I had no ownership of a slip in the association. I went through the process of filling, and the lot sat untouched for a number of years, as this is to be my retirement home. In 2012, 1 contacted CAMA in Wilmington to discuss the process to obtain a pier permit. At this time, I still did not know there was a conflict with another CAMA permit. I met with Jason Dail to discuss the process. He told me that part of the process included having a current survey, of which I obtained. I also supplied a letter from the association dated February 07, 2006 stating that I had no interest in the association as was suggested by Mr. Gregson in our original meeting. Mr. Dail said that I needed to write a personal letter stating that I had no interest in the dock association. I did so in a letter dated June 30, 2012. Mr. Dail then said I needed something legal stating that I had no interest. I obtained the service of Mr. Wray, an attorney in Morehead City, to provide the letter showing no ownership. Sometime later, Mr. Dail contacted me and stated that I would have to request a CAMA Major permit application because of a conflict with another CAMA permit. This turned out to be the permit issued for the dock association. I was dismayed because the water depth requirement for a slip on a major is different than for a general. I was told the Major required 24" while the General required 18". The water depth, as measured by Jason Dail, was between 19 and 22 inches which is less than required for a slip under a Major permit. Shortly after, Mr. Dail told me that I was probably going to be denied due to the association permit. That is when I contacted you. We set up a meeting in Morehead City. At that meeting I provided you with all deeds pertaining to Lot 13. The deeds showed that there was never a restriction placed on Lot 13 as no dock was assigned to Lot 13 all the way back to the original purchase by Ms. Copain from the developer. This coincides with what Mr. Gregson originally told me. While in our meeting, I stated that my action of selling Lot 14 was a result of the information and belief that I could obtain a personal dock. Why else would I get rid of the only access to the water that I had. It was also noted that the association permit was old and that my dock would have little impact of environmental concern. Page 2 We then had a discussion on the tie pilings for a slip. You told me that under the terms of a CAMA Major permit, that I did not have the water depth for a slip, but you could issue me a permit for an observation platform. It was discussed that if sometime in the future the water depth changed, I could then apply for the slip. I agreed to the terms. Now we have reached this point. Due to a family illness, I needed more time to construct the walkway and platform so I filled out an extension request. I talked with Mr. Jason Dail and he said it was forwarded to Morehead City. I then received a call from you, stating that a shellfish lease holder was balking and said he never knew that a permit was issued even though I sent him notification as required by CAMA. During our meeting, you stated that this matter arose through no fault of mine and that I operated in good faith. You also stated that CAMA was not designed to prevent someone from enjoying their water rights but to protect the environment from over development. Since my observation deck posed little impact the permit would be issued. During our phone conversation, I asked if it was common place to notify others of the extension. You told me it was not. If it is not customary to notify other parties, then how was the shellfish lease holder aware of the fact I was even applying for the extenstion so he gets "a second bite at the apple."? I operated in good faith, I followed the rules of CAMA, I negotiated a mitigating factor by removing the slip and came to an agreement with CAMA. I went through this entire process with close coordination with CAMA, starting with Mr. Gregson. I also had considerable expense as well as disposing of the only water access I may have had. I researched the deeds for my lot 13 and have enclosed. A boat slip was never issued to this lot. I researched the deeds for my lot 13 and have enclosed. A boat slip was never issued to this lot. Also of interest, lot 13 never had a CAMA restriction placed on it not to build into the waters of Chadwick bay through 3 changes of hands. The other lots shown in the CAMA permit for Pelican Point Dock Association had boats slips issued and the restriction was placed on their deeds. When I bought the lot is was separate deed but included as a combined deed with lot 14 and boat slip 8 assigned to 14 when I bought them. This must be why Jim Gregson said if I had no slip I could have a dock. Also, I don't know if it makes a difference or not, but I included Brian Shepards deed to the shellfish beds with a section circled about not affecting littoral rights.
