HomeMy WebLinkAbout28-14 Minor Mod 2017 Shue, Christopher & JenniferPermit Class MODIFICATION/MINOR STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Permit Number 28-14 Issued to Christopher and Jennifer Shue 2987 Jack Whitener Road, Newton, NC 28658 Authorizing development -in Onslow County Chadwick Bay, 159 Big Hammock Point Road, Pelican S/D, as requested in the permittee's application e-mail dated 11/6/17 This permit, issued on November 16, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Observation Platform Reconfiguration 1) Unless specifically altered herein, this Minor Modification authorizes the reduction in the overall length of the permitted observation pier. As authorized under this Minor Modification, the overall length of the observation pier, including the 16' x 16' platform, shall not extend waterward of the permittee's property line more than a maximum of 40'. NOTE: By issuing this Minor Modification, the originally authorized dimensions and alignment of the observation platform are hereby superseded by the alignment and dimensions referenced in Condition No. 1 of this Minor Modification. (See attached sheet for additional conditions) qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program.. Signature of Permittee and Jennifer Shue ADDITIONAL CONDITIONS Permit No.14-28 Page 2 of 2 FE: This modification request by the Permittee is intended to address the concerns of Mr. Brian Shepard who holds a recognized shellfish franchise in the submerged lands of Chadwick Bay. Those concerns were expressed in Mr. Shepard's Third -Party Hearing Request (CMT-17-09) filed pursuant to G.S. 113A-121.1(b), which was granted by the Coastal Resources Commission on October 3, 2017. This Minor Modification does not authorize the creation of any formalized boat slips at the authorized observation pier. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15,A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation ..within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General The pemvttee and/or his or her contractor shall meet on site with a representative of the Division prior to project initiation. This Minor Modification shall be attached, to the original Permit No. 28-14, which was issued on '3/25/14, as well as the renewal issued on 9/27/17, and copies of all documents must be readily available on site when. Division personnel inspect the project for compliance. All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2013-01398. The Division of Water Resources assigned the proposed project DWR Project No. 13-0761. This length will essentially mirror the length of a permit issued to lot number 11 in the Pelican Point subdivision. The general location on my lot does not change in relation to the side lot lines. I would like to keep the 16x16 platform as previously permitted. This modification will serve to address the concerns of Mr. Brian Shepard regarding his shellfish lease remain consistent with a neighboring permit. I look forward to hearing from you. DAVIS Director The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time,to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
