Any violation of or deviation from the plan approved by the DEM will be considered a violation of this CAMA permit. Sedimentation and Erosion Control 2) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. (See attached sheet for Additional Conditions) This permiLaction may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. This Plan must be filed at least thirty (30) days prior to the beginning of any land -disturbing activity. Submit this Plan to the Department of Environment, Health and Natural Resources, Land Quality Section, 127 Cardinal Drive, Wilmington, NC 28405-3845. PROJECT DESCRIPTION The project site is located adjacent to Kings Lynn Drive (SR 1828), at the west end of Long Beach, in Brunswick County, North Carolina. The 9.04 acre tract is situated on the northern side of the island, adjacent to Lockwood Folly Sound (also known as Eastern Channel). There is approximately 850 feet of road frontage along the existing Kings Lynn Drive, which runs through the northern edge of the property. There is an existing 12 inch water line within the Kings Lynn Drive right-of-way which continues to the west, under Lockwood Folly Inlet to Holden Beach. The road right-of-way separates the tract from MHW on the northwestern side of the property, but a narrow band of highground separates "road from the sound through the middle and northeast portion of the tract. The depth of the tract varies from approximately 390 feet on the west side to 750 feet on the east side. The property lies approximately 400-600 feet landward (north) of the first line of stable vegetation of the Atlantic Ocean and approximately 400-800 feet east of the same vegetation line along the shoreline of the Lockwood Folly Inlet. The topography consists of rolling sand dunes (Newhan fine sand), with typical dune vegetation, predominately., Sea Oats, Smilax, Yucca, other dune grass, and an occasional Red Cedar and Dune -Elder (Iva imbricata). A small shrub thicket occupies a low area on the northwest portion of the property. Wax Myrtle is the most prevalent species, but Yaupon, Red Cedar, and Cherry were also observed. The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Environmental Management, and are OPEN to the harvest of shellfish. Portions of the tract are within the Ocean Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate is 2 ft./yr. on the west end of Long Beach. Historically, the west end of Long Beach has experienced significant erosion. Originally, the road made a complete loop around the end of the island. The road was over -washed a number of times during the 1960's and 1970's. After it was washed out by a storm in 1979, NCDOT never rebuilt the road. In recent years, Lockwood Folly Inlet has been migrating west, and the west end of Long Beach has been accreting, with dune development and natural vegetation colonization, 800 to 1200 feet west and south of it's 1979 location. The applicants have subdivided to property into 14 single-family lots, creating the Harbor at Kings Lynn subdivision. The lots are oriented north/south and are approximately 50 feet wide and 400-600 feet long. All of the lots are located south of Kings"Lynn Drive. The portion of the tract on "the north side of Kings Lynn Drive (.65 acres), is designated as common area, and will be subsequently deeded to the subdivision's homeowners association. Individual septic tank systems would provide wastewater disposal for each residence. The applicants propose to construct a potable water line to serve eight (8) of the fourteen (14) individual lots. The existing Brunswick County/Long Beach 12-inch waterline ends at a valve box, within the Kings Lynn Dr. right-of-way, at Lot 8 of the new subdivision. The applicants propose to establish a utility easement, adjacent to the road, 20 feet wide, along the north side of Lots 1-8. A waterline extension would be installed to provide potable water to those lots which could not hook-up directly to the existing line. The waterline would be approximately 400 feet long and six (6) inches in diameter. A fire hydrant would also be installed at the end of the new waterline. The waterline would be installed by the applicant and ownership subsequently transferred to the subdivision property owners for long term maintenance and/or repair. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind the frontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate is greater than 3.5 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protectin the inland areas. By setting back 30 or 60 times the annual long-term erosion rate, you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for some property owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in frontof the setback line if the following conditions apply: (1) the lot must have been platted as of June 1, 1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation line, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other LAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as feet landward in a major storm. The flood waters in amajor storm are predicted to beabout - feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. CONSISTENCY OPINION: This proposal is consistent with the land use plan when all recommended conditions placed on the permit by the Division of Coastal Management are met. Staff biologists with the Wildlife Resources Commission have completed a review of the project and associated impacts on wildlife and fishery resources in the area. A site visit was made on August 30, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicant proposes to install a potable water line to serve 14 currently undeveloped lots on the west end of Oak Island adjacent to Lockwood Folly Inlet. This end of the island experienced significant erosion during the 1960's and 1970's, but has been accreting in recent years. Still, the Long Term Average Annual Erosion Rate is 2 ft./yr. Portions of the tract are within the Ocean Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern. As proposed, individual septic tanks would be used for wastewater disposal. Area waters are classified SA and are open to shellfishing. The project site is adjacent to excellent waterbird habitat. Brown pelicans and several gull and shorebird species were observed during our visit. Lots 1-4 (closest to the inlet) are located in a low area densely vegetated with wax myrtle, yaupon, yucca, and red cedar and suitable for use by rabbits and songbirds. The project has.potential for disturbing feeding and nesting waterbirds and would likely cause the loss of some shrub habitat. However, our greatest concern is the volatile nature of Lockwood Folly Inlet and the possibility that septic systems will be undermined by an eroding shoreline. Resulting discharge of wastes into Lockwood Folly Sound would degrade sensitive estuarine waters and may cause shellfishing closures. The purpose of this memo is to bring you current with information obtained and sought concerning Council's consideration of the preliminary plat for "The Harbor at King's Lynn". Enclosed, so that the information will be close at hand, are the following: 1. Copy of letter and attachment to Mr. Cooke and Mr. Sutton 2. Copy of plat submitted for review (attached to Brooks letter) 3. Copies of Planning Board meeting minutes when this development was considered. CAMA Review Role - DCM employee has identified the first line of stable vegetation on the entire McLendon tract (4-5). Because the development will require a short waterline extension to serve a portion of the development, a major CAMA permit will be required for at least_ a portion of the development which will result in a consistency review. Initial indications from DCM are that the subdivision will pass this review. PRIN. E-D -Nit- YC'---D PAPER Memo to Mayor and Council Members April 7, 1995 Page 2 Local Land Use Plan Review - The Town should use its Land Use Plan policy statements 'as aguide in evaluating any development activity. In this case, the policy statements refer to the development constraints imposed by CAMA regulations in inlet hazard areas (page IV-6) and recognizes the importance of the dune system. The Land Use Plan is very specific in its emphasis on single-family residential development, as well, and matches the Town's zoning classifications when looking at future development. Page IV-7 speaks to development in AECs. Provision for Future Relocation of a Portion of King's Lynn Drive - The question has been raised as to whether the Town can require the developer to make future arrangements of this nature. Staff is continuing to research this question. Application of the Subdivision Regulations - The Town has broad authority in reviewing development and its effect on the health, safety and welfare of the community. The Town cannot act arbitrarily; therefore, the Land Use Plan and specific, provable measures of impacts are important. There is a general presumption that if someone follows the regulations established by the Town, then the development can proceed with whatever reasonable conditions the regulations and statutes allow the Town to prescribe. Again, the Town's regulations center on and should be based on the health, safety and general welfare of the community. The application of the Town's regulations in this case is amplified by the public's attitudes toward the total McLendon tract and not just the 14-lot subdivision. The questions Council has raised are valid in making certain that the public's interests are served by a thorough examination of the issues that this development raises. Location of the Town's leased interest in the McLendon property - The Town's leased parking area and access are west of the 14 lots proposed for development. The lease expires at the end of this calendar year. I will be meeting with the developers on Monday, April loth, and will report to you their progress in addressing the issues raised in. the March 30th letter. In the meantime, if there are other questions concerning this development proposal which you would like investigated, please let me know. As you recall, the Council had some questions concerning the preliminary plat and directed that each Council Member develop his list of questions and concerns for submittal to you. The purpose of this letter is to share these items with you which will require modifications to the preliminary plat previously submitted and which should be addressed. The items are listed as follows: 1. Location and size of existing water lines should be shown on plat. 2. Ocean Hazard Areas should be shown on plat. 3. Inlet Hazard Areas should be shown on plat. 4. Areas of Environmental Concern should be shown on plat. 5. Issue of increased setback for future relocation of King's Lynn Drive should be addressed. 6. The policies are based on the dbjecaves or the citizens of Long Beach and' satisfy the objectives of the Coastal Resources Commission. It is emphasized that the policy statements are extremely important and have a day-to- day impact. an individual citizens within Long Beach's planning jurisdic-ion. Areas in which the statements have an impac include: CAMA minor and major permitting as required by N.C.G.S. 113A-118 prior to undertaking any development in any area of environmental concern. Establishment of local planning policy. Review of proposed projects requiring state or federal assistance or approval to determine consistency with local policies. Based on the analysis of existing conditions and trends, and discussion with the town's Planning Board and Town Council, the policies outlined in the following secion have been formulated to provide a guide for advising and regulating development of available land resources in Long Beach throughout the current planning period, i.e... 2000. Policies which were considered, but not adopted, are provided in Appendix I. A. RESOURCE PROTECTION POLICY STATEMENTS 1. Physical Limitations Soils: To mitigate existing septic tank problems and other restrictions an development posed by soil limitations, Long Beach will: (a) Enforce all current regulations of the N.C. State Building Code and support the Brunswick County Health [Department for all matters relating to septic tank installation/replacement in areas with sails restrictions. (b) Coordinate all development activity with appropriate county and state regulatory personnel. (c) Cooperate with the U.S. Army Corps of Engineers in the regulation/ enfcrcement of the 404 wetlands oermit process. IV-1 (d) In conformance with state and county health regulations, growth anc development will not be allowed in areas where septic tanks wiil not function and sewer services are not available. (e) The Town of Long Beach opposes the discharge of sewage from septic tanks or package treatment plants in any areas classified as coastal wetlands or 404 wetlands. Division of Environmental Management stormwater runoff regulations, and by coordinating local development activities involving chemical storage. or underground storage tank installation/abandonment with Brunswick County Emergency Management personnel and the. Groundwater Section of the North Carolina Division of Environmental Management. During the planning period, the town shall review the local zoning ordinance with regard to underground chemical and gasoline storage regulations to ensure a minimum of risk to local groundwater resources. -Grounawaters wniw.. are at or lust belaw the surface. j k I j IV-2 Manmade Hazards: (a) Long Beach will support the technical requirements and state program approval for underground storage tanks (Chapter 40 of the Code of Federal Regulations, parts 230 and 281), and any subsequent state regulations concerning underground storage tanks adapted during the planning period. (b) The town opposes the temporary or permanent storage or disposal of any toxic wastes within its planning jurisdiction. (c) The town will coordinate and maintain cr ract vrith the Brunswick County Emergency Management Office to ensure safe preparation and evacuation in the event of a disaster at the CP&L nuclear power plant. (d) The town will cooperate with management at both the Sunny Point Military Terminal and the CP&L nuclear power plant to support safe operation at both facilities. (e) Long Beach is opposed to the establishment of toxic waste dump sites within Brunswick County or operation of incineration facilities for hazardous wastes. Starmwater Runoff (a) Long Beach recognizes the value of water quality maintenance to the protection of fragile areas and to the provision of clean water for recreational purposes. The town will support state regulations relating to stormwater runoff resulting from development (Stormwater Disposal Policy 15A NCAC2H.001-.1003). (b) Long Beach will seek funding through the Coastal Area Management program- to conduct a comprehensive town -wide drainage study. If sufficient funds are not available for a town -wide study, the town will seek funding within the planning period for a study of the most serious problem areas. (c) The town will apply for grant funds improve stormwater drainage systems associated with existing rights-cf-way. Solid Waste: (a) Long Beach supports efforts by Brunswick County to undertake a site selection study for the location of a new landfill site. IV-3 except for public shoreline access inducing dune crossover str.:ct::res and boarawaiks. (b) Long Beach supports the preservation and development of environmentally acceptable estuarine and ocean shoreline access areas to ensure adequate shoreline access within all areas of the town. (c) Long Beach supports the development of off-street parking facilities in both commercial and residential areas to serve shoreline access facilities. The town will review the impact of off-street parking on adjacent areas on a case -ay -case basis. (d) Long Beach will implement the shoreline access site improvements as recommended by the 1991 Ocean and Estuarine Access Plan. (e) It is the policy of the town to hire a full-time recreation staff with added summertime help to provide . a recreation building for a variety of recreational and other community. uses, to operate a town park for children's passive activities, to provide canoe trail and boating access to Davis Creek/Canal at the Recreation Building, to render access to the marshlands of Davis Creek for human/environmental interface via boardwalks and a gazebo, and to maintain Middleton Park adjacent to the Town Municipal Building. It is the policy of the town to promote the usage of these facilities through activities reports and events announcements and through conspicuous signage. (f) The Town of Long Beach will seek funding for the development of shoreline access sites through the state shoreline access grant program. (g) During the ten-year planning period, the town will improve the fallowing recreational facilities with funding support fram. local tax dollars: parking for shoreline access. jogging and walking paths, bikeways. public boat access, and picnic facilities. i (h) Long Beach will maintain an environment where cultural and recreational activities can flourish for the benefit of permanent residents, the seasonal population, and vacationing visitors by: Continuing operation of -the Recreation Center with added emphasis on youth activities. Encouraging the establishment of a senior services center. Productive Agricultural Lands: There are no productive agricultural lands found ;n Long Beach's planning jurisdiction; therefore, no polio statement is necessary. Productive Forest Lands: There are no significant productive forest lands found in Long Beach's planning jurisdiction. However, if commercial production occurs. Long Beach supports utilization of the Forest. Best Management Practices Manual, 1989. North Carolina Division of Forest Resources, for all forestry operations. Aguaculture Activities: Aquaculture is considered the cultivation of aquatic plants and animals under controlled conditions. The fallowing polio shall apply: (a) Long Beach opposes aquaculture activities in the Town of Long Beach. The town will not oppose aquaculture in its extraterritorial jurisdiction when the activity will not result in discharge of water which will degrade receiving waters in any way. Residential Commercial. and Industrial Develooment Imoacts an Resources: (a) In recognition of the importance of estuarine and public trust waters for the fisheries and related industries as well as aesthetics. recreation, and education. Long Bead shall promote the conservation and quality of estuarine and public trust waters. Residential and commercial develcoment which meets 15A NCAC 7H minimum use standards. Long Beach zoning requirements, and the policies contained in this plan will be allowed in estuarine shoreline, estuarine water, and public trust areas. Industrial development will be prohibited within Long Beach. Marinas and bulkheads shall be allowed when consistent with other policies containea in this plan. (b) Long Beach opposes the construction of any signs, except far regulatory signs, in the coastal wetlands, estuarine waters, and public trust areas. Marine Resource Areas: (a) With the exception of the construction of signs (excluding regulatory signs), Long Beach supports the use standards for estuarine waters and public trust areas as specined in 15A NCAC 7H.0206 and .0207. However. it is understood that such review and comment may not have any effect on establishment of poiiaes and regulations by the North Carolina Division of Marine Fisheries. (c) The Town of Long Beach supports the designation of its beach area as a sea turtle sanctuary by the State of North Carolina. (d) The use of gill nets for fishing within 300 yards of the beach between 79' Street East (town limits) and Lockwood's Folly Inlet is prohibited between May 15 and September 15. Peat or Phcsohate Mining: There are no peat or Phosphate deposits located within Long Beach's planning jurisdiction. However, it any mining activity is proposed within the area of Long Beach, the town would oppose any project which would result in aquifer drawdown or damage to the manmade hazard facilities identified in Section I, page 1-70. Off -Read Vehicles: In May 1978, Long Beach passed an ordinance prohibiting the use of all vehicles an the beach strand and dune areas. The only exceptions to the ordinance are for the use of emergency vehicles, handicapped 'vehicles, and town - authorized vehicles. C. ECONOMIC AND COMMUNITY DEVELOPMENT POLICY STATEMENTS General: It is the policy of Long Beach to manage,its growth to ensure the adequate provision of municipal services. To accomplish this, the town wijl: Prepare for a population growth that will continue at about the current rate with a permanent residency of 5,419 and peak summer weekday population of 44,259 by the year 2003. Maintain a continuous land use program which will be effec5vely enforced through zoning, subdivision, and building codes. Approve development only when and where adequate facilities and services to support it are available. Promote .and preserve the town's "family" oriented. retirement -resort atmosphere. Water Sucolv.' There are no significant constraints to development or land development issues relating to the town's potable water supply. The Brunswick County water system should continue to provide adequate water supply throughout the planning period. However. the town does support the following water supply issues: IV-10 J i a (b) The town will continue to succort the operation of a • cluntary recycling , canter for the .acceptance of recyclable materials. (c) The town will support local and expanded county effcrs to educate people and 'businesses on waste reduction and recycling. < (d) The town will support acions to increase the town's capabilities to keep the beach and town proper free of litter and trash to improve the cleanliness and image of the community. (e) The town will supply more signs and receptacles in problem areas to -5 encourage cleanliness.. Cultural/Histbrical Resources: Conservation of coastal archaeological resources which have been identified as having more than local significance to history or prehistory should be protected. These sites constitute important scientific .sites, or provide valuable educational, associative, or aesthetic resources. There are 76 such sites in Long Beach recognized by the N.C. Department of Cultural Resources. Wherever there is question of protection of these, the town will seek assistance and determination from the Division of Archives and History before proceeding to issue permits. Specific i ,objectives for each of these functions shall be related to the following polity statements either singly or in combination: (a) Advise the N.C. Division of Archives and History of all housing code ertforcementiredeveiopment projecs, to ensure that any significant architectural details or buildings are identified and preserved. (b) Advise the N.C. Division of Archives and History of all county and town s projects. to ensure the identification major land disturbing public work and preservation of significant archaeological sites. Marina and Fioatina Home Develaoment: Long Beach wiil enforce the following poiic,es to govem floating homes and 'both open water and upland marina development. Marinas are considered to be any publicly or privately owned dock consavcted to accommodate more than ten boats, as defined by 15A NCAC 7H.208 (b) (5). (a) Long Beach will permit the construction and expansion of both open water and upland marinas (for both general public and private use) which meet local zoning ordinance requirements, and the recuirements of :he 15A NCAC 7H minimum use standards. However, marina =ns-" ,. Xr; and associated dredging shall not result in the loss of or damage to coastal wetlands or subaquatic vegetation. (b) Long Beach will allow the construction of dry stack storage facilities for boats associated with or independent of marinas, which are consistent with the Town of Long Beach Zoning Ordinance. (c) Long Beach supports the restricdcn of floating structures in all public trust areas and estuarine waters. Floating structures are defined as any structure or vessel used, designed, and occupied as a permanent dwelling unit, business, office, or source of any occupation or any private or social club, which floating structure or vessel is primarily immobile and out of navigation or which funcions substantially as a land structure while moored or docked on waters within town jurisdiction. Floating structures shall not be used =mmercially or inhabited. The town will develop and adopt an ordinance designed to enforce this polio. The ordinance should set a specific time limit for the location of those structures. Develaoment of Sound and Estuarine Islands: Long Beach will restrict any development on sound or estuanne islands. The town will review its zoning ordinance to incorporate- controls to regulate development on sound and estuarine islands. - Ocean Hazard Areas: (a) Long Beach will support only uses within the ocean hazard areas which are allowed by 15A NCAC 7H and are consistent with the town's zoning and dune protection ordinances. (b) Long Beach supports beach nourishment and relocation as the preferred erosion control measures for ocean hazard areas. IV (c) Long Beach objects to the construction of permanent shoreline stabilization structures in ocean hazard areas and any changes in ste standards which would allow such structures. ta Inlet Hazard Areas. With the exceotict or On of shoreline stabilization structures, the Town Long Beach will allow uses within the infer hazard areas which, are consistent with the town's zoning ordinance, and the 15A NCAC 7H minimum use standards. In all cases, development shall only be permitted if it meets other applicable 15A NCAC 7H minimum use standards; is landward of the vegetation line; involves no significant alteration or removal of primary or frontal dunes or the dune vegetation has overwalks to protect any existing dunes; is not essential to the continued existence andInr use ar an associated principal develcipment; is not required to me3isfy minimum requirements Of local zoning, subdivision or health regulations; and meets all 15A NCAC 7H non - setback requirements. Coastal Wetlands: The Town of Long Beach supports the construction of those water - dependent structures within coastal wetlands which meet the 15A NCAC 7H minimum use standards. Estuarine Shoreline: (a) The Town of Long Beach will support construction within the estuarine shoreline areas which meets the 15A NCAC 7H minimum use standards and the Town of Long Beach Zoning Ordinance. (b) Long Beach will use all available means of law to restrict the use of estuarine shoreline areas for purposes where there is a substantial chance of pollution Occurring. Bulkhead Construcaon: Long Beach does not oppose the construction of bulkheads along estuarine shorelines which meet 15A NCAC 7H minimum use standards. i ne town opposes the construction of bulkheads in ocean hazard. and inlet hazard areas. Sea Level Rise; (a) Long Beach will continuously monitor sea level rise and revise as necessary all local building and land use related ordinances to establish setback standards, long-term land use plans, density controls, buffer vegetation protection requirements, and building designs which will facilitate the movement of structures. (b) Long Beach will allow the construction of bulkheads along estuarine shorelines which satisfy 15A NCAC 7H minimum use standards to protect IV-3 structures and property from rising sea level. The :own opposes the construction of bulkheads in ocean hazard'and inlet hazarc areas. Natural and Cultural Resource Areas: Long Beach will support the following aeons regarding these irreplaceable resources: t Protection of unique habitat conditions that are necessary to the survival of threatened and endangered native plants and animals inc:uding control of negative land use impacts that might jeopardize their environment. Permit development in Areas of Environmental Concern (AEC—s) provided that the proposed design and location will cause no major or irrsversole damage to the AECs and the development meets 15A NCAC 7 H minimum use standards. One or more of the following values must be considered depending upon the stated significance of the resource: Development shall preserve the values of the AEC at its functions as a critical component of a natural system. • Development shall not adversely affect the values of the AEC as a unique scientific, associative, or educational resource. No reasonable altemative sites are available outside the designated AEC. Reasonable mitigation measures have been considered and incorporated into the project plan. These measures shall include consultation with recognized authorities and with the Division of Coastal Management staff. • The project will be of equal or greater public benefit than those benefits lost or damaged through development. Maritime Forests: The town will review its local codes and ordinances to consider amendments designed to protect any remaining maritime forest areas. B. RESOURCE PRODUCTION AND MANAGEMENT POLICIES Recreation Resources: (a) All lands classified as conservation areas are considered valuable passive recreation areas. Mr. Christenbury stated that consideration of the preliminary plat for 'The Harbor at Kings Lynne would be the first item that had been continued. He asked Jay Houston if the problem with the parcel in question across the street from Kings Lynn Drive had been resolved. Mr. Houston presented a revised plat that showed the parcel to be deeded to the Homeowner's Association. The Board was given the final checklist that had been signed off by the Zoning Administrator and the Public Works Director: Mr. Christenbury asked Mr. Clemmons if he had, on file, a copy of the overall planned development for this area. Mr. Clemmons stated that he did. There was some discussion as to the' subdivision being in an Inlet Hazard area as defined by CAM. The Board was assured that before any land disturbing activity could begin in this area, the orooer CAMA permits would have to be obtained. Lewis Riddle made a motion to recommend acceptance of the preliminary plat for "The Harbor at Kings Lynn' to the Town Council. A second was made by Horace Duncan and the vote was unanimous. Jay Houston respectively requested that the final plat be out on the agenda for the next Planning Board meeting. The Board reminded him that the preliminary plat had to be submitted to the Town Council and approved before the final plat could be submitted to the Planning Board., The next item on the agenda was the final plat consideration for St. James Plantation, Section E. Mr. Christenbury asked if the final plat checksheet had been signed off by the members of staff and he was assured that it had. Homer Wright presented the deed for the dedicated land to the Town Manager. Walter Hill made a motion to recommend final plat approval to the Town Council for St. James Plantation, Section E. A second was made by Lewis Riddle and the vote was unanimous. The next item that was continued from the last meeting was consideration of the ordinance changes concerning the fire prevention code. David Clemmons explained that these were not actual changes concerning the code but clarifications. Some of the members had some concerns with the ordinance dealing with fireworks. Mr. Clemmons stated that this was already allowed but for clarification, the Town Council would now have to issue approval before fireworks could be ignited within the Town limits. Charles E. Terry Wilson, Off the Streets Youth Canter, explained the reason for requesting a modification of his conditional use permit. He explained that the arcade would not be open in the mornings during school hours but would like to utilize the building for 3-5 year olds for preschool activities such as arts, crafts, and dance. He requested a favorable recommendation from the Planning Board. The first order of business to come before the Board was_the minutes of the February 1, 1995. There was a correction to the minutes. Sheila Bell stated that Jerry Walters was not present as stated in the minutes under Staff Present. Willie Williams made a motion to approve the minutes as typed. A second was made by Charles E. Derrick and the vote was unanimous. The next item on the agenda was consideration of the preliminary plat for 'The Harbor at Kings Lynn'. Mr. Christenbury stated that at the .previous meeting, the Board had some questions concerning the parcel of land being subdivided across Kings Lynn Drive. Mr. Walters stated that the Institute of Government had been contacted and their opinion was that generally our ordinance does not permit a single lot to continue across a road. Several solutions were discussed including changing our ordinance to allow the lots as they were shown on the original submittal of the preliminary plat. The second option was to deed ownership of the parcel in question to the Homeowners Association or to the Town which would only allow one access point from the waterway, as allowed by CAMA. Willie Williams questioned the subdividers as to which way they wished to proceed. Jay Houston who represented the subdividers presented a revised preliminary plat showing the parcel in question deeded to 'The Harbor at Kings Lynn• Homeowners Association. Mr. Houston stated that their main concern was to get the preliminary plat approved and worry about the parcel across Kings Lynn Drive at a later data. Bill Christenbury questioned the common area shown on the plat. There were questions from the Board concerning whether the lots were considered to be oceanfront. The deed restrictions and the letter of intent to dedicate 0.14 acres of land to the Town of Long Beach, adjacent to property already owned by the Town, were presented to the Board. Frontal and primary dunes were discussed and the subdivider was reminded that CAMA permits would be required before any development could occur within a Inlet Hazard Area or any other area of concern as defined by Coastal Management. It was the consensus of the Board to continue this meeting on Monday, March o, 1995 at 7:00 pM so that the Zoning Administrator and the Public Works Director could sign off on the preliminary checklist and the land across Kings Lynn Drive could be designated as whatever the subdividers have planned for it. Mr. Rabon assured them that it was not economically feasible to board animals unless they were convalescing animals and that most of these would be transferred to the animal hospital in the County. Lewis Riddle made a motion to recommend approval of a conditional use permit for Brunswick Animal Hospital at 55ZO E. Oak Island Drive. A second was made by Charles E. Derrick and the vote was unanimous. The next order'of business before the Board was consideration of a modification for the conditional use permit for 'Off the Streets' Youth Center. Willie Williams made a motion to recommend to the Town Council that the request to modify the centers operating hours in order to serve preschool children from 7:30 am to 11:30 am be granted. Mr. Christenbury asked if there were any comments from the citizens concerning any of the agenda items and asked if there were any amendments to the agenda. Mayor Altman stood and explained the two items on the agenda which the Council had brought to the Planning Board. One was the Town's Thoroughfare Plan, the other the discussion of above versus below ground fuel tank storage. She also reminded the Board of the Wastewater -Study meeting every two weeks. The first order of business to come before the Board was consideration of the corrected minutes of the November 2, 1994 regular meeting and the minutes of the regular meeting on December 7,'1995. Lewis Riddle made a motion to accept both minutes as typed. Willie Williams seconded the motion and the vote was unanimous. The next item on the agenda was consideration of a sketch plan submittal by Jay Houston for 'The. Harbor at Kings Lynn'. Mr. Clemmons stated to the Board that there were roads showing on some of the Town's maps that ran through this subdivision but that they did not show on the tax maps. He stated that the Town had checked with the Town .Attorney and this matter would be cleared before the preliminary could be submitted. There were questions from the Board concerning the intentions of the subdivider for the whole parcel of land, rather than by dividing in small sections as other• subdivisions had been done. The owners of the property stated that the entire parcel would be used for single family - dwellings and open space. There was some questions concerning platting the lots across Kings Lynn Drive. Mr. Clemmons stated this was another question for the Town Attorney since this situation had never occurred with a subdivision within our jurisdiction. It was the consensus of the Board to accept that the entire parcel would be documented as being proposed single family dwellings when the preliminary plat was submitted. Horace Duncan made a motion to accept the sketch plan design for The Harbor at Kings Lynn which is located vest of 59th Place West, providing a plan for the entire parcel be given to the Inspections Department and the problems with the streets be cleared with the Town Attorney. A second was made by Charles E. Derrick and the vote was unanimous. The next item an the agenda was discussion of the Town Thoroughfare Plan. Lewis Riddle made a motion to table this item until the next meeting so that a copy of this plan could be provided to each of the Planning Board members. PAvE 2 MINUTES LONG BEACH PLANNING BOARD FEBRUARY 1. 1995 The next item on the agenda was discussion of underground vs. above ground fuel storage. There was some discussion among the members concerning eliminating underground storage and requiring all new tanks to be above ground. It was the consensus of the Board to give an option of either method. Dike requirements around the above ground tanks were discussed as were requirements of 'EPA and Fire Code. Charles E. Derrick made a motion 4a recommend the folloyi::g ...dj change to the Town Council: Section 4-23 Change to read: Above ground or underground fuel storage tanks will be allowed in both the CA and CB Zoning Districts as long as they meet NFPA regulations and all other state, federal, and local requirements. For above ground storage, the containment area required to hold Leaking tanks shall be designed by a NC RegisteredEngineer along with tie downs in flood prone areas. The dike area shall be of precast concrete or solid masonry with fill dirt around the outside perimeter with low growing shrubs planted on top of the fill dirt and approved by the: Zoning Administrator.
