Catawba Avenue Cornelius NC 28301 Authorizing development in Brunswick County at Lockwood Folly River, off Stone Chimney Road at the end of Levees Landing, Supply , as requested in the permittee's application dated 04/07/15 including attached workplan drawings (4), 3 dated reed in the MHC office on 2/17/14 and 1 dtd reed in the MHC office on 6/11/14. This permit, issued on October 6, 2015 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie suoijeci io rmes, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the above referenced property, including the concrete walkway and fixed access boardwalk, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (916) 796-7215 for this determination. The permittee is further advised that non -water dependent activities are not authorizes within 30 feet of the normal high water level. 2) Any portion of the walkway built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2017 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Seaside Bay Homeowners Association Permit No.'63=14 Page 2 of 3 ADDITIONAL CONDITIONS Sedimentation & Erosion Control 3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales, etc.). 4) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 5) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Docking Facility 6) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses that are expressly and specifically set forth in the permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The pennittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 12) This permit authorizes (10) formalized boat slips in association with this docking facility. 3 !-k Seaside'Bdy Homeowners Association Permit No. 63-14 Page 3 of 3 ADDITIONAL CONDITIONS Army Corps of Engineers Conditions 13) The pilings associated with all of the floating docks shall be placed between the floating docks and the river bank. 14) The 10' X 10' swim platform/canoe launch must not extend more than 10 feet water -ward from the normal low water line. General 15) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or'alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the State of North Carolina on account of any such removal or alteration. 16) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas t6 be crossed. The temporary mats shall be removed immediately upon completion of construction. 17) No wetlands shall be excavated or filled, even temporarily, without permit modification. 18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permit was issued on July 21, 2014 and is due to expire on December 31, 2017. Mr. Bragg is requesting that the permit be transferred to the Seaside Bay Homeowners Association in care of Timothy S. Bullock. Mr. Bragg states that the transferred permit will be used for the same purposes, for which it was issued; that there will be no substantial change in the conditions, circumstances, or facts affecting the project; and the transferred permit will not result in substantial change or modification of the project as proposed in the original application. The applicant has submitted a check (ck. N2602) in the amount of $100.00 for the transfer request, as well as a copy of the deed to the property and a copy of the permit.
