With that being the goal - we would still like to know for our meeting as well if the modification we are considering is doable for the dock expansion. Since the HOA does not appear to be the legitimate riparian property owner for the project (and therefore doesn't have rights to develop under the permit as was authorized), if you and the HOA don't agree to serve as joint permittees, we will need to void the permit. Should you and the HOA agree to become joint permittees, upon notification of such agreement, we will amend the permit to add your name. As for your proposed modification, if we must void the existing permit, you would then need to apply for a new major permit for the revised plan. Hope this helps clarify somewhat. Based on this, can I get a letter from you confirming this position for our files. Also - We are still interested in knowing the possibility of the change requested that I sent for the dock layout which I know Debbie was working on but I have not heard from her so far. From: Scott Bullock [mailto:tscottbullock@amail.coml Sent: Tuesday, January 17, 2017 1:16 AM To: Coats, Heather <heather.coats@ncdenr.aov>; Wilson, Debra <debra.wilson@ncdenr.gov> Subject: Seaside Bay - Permit 63-14 Heather, I have been reviewing the issue of the dock permit and it seems that the permit has requirements of set backs from adjacent property lines of 15'. When 15' is not available a waiver can be issued if requested from the adjacent owners or if the permit is being jointly requested. Based on the permit drawing and the Brunswick Co GIS site it seems that not only are these set backs not being enforced the docks are actually overlapping or touching the property lines and the floating docks extend over 15' into my waterfront property. I need them to move these docks so my property is not obstructed. Based on this I would assume the docks were permitted to the property owners and when the property was sold the permits would have to be transferred to like property owners as co-permittees which would be me and Seaside Bay, LLC as originally requested. If I am not listed on the permits then the permit is in violation without a waiver from me or the permit is required to be listed in mine and Seaside Bay, LLC's name. Please let me know if I am missing something here but it seems our request has been correct the entire time and no more action is required on our part except to receive the jointly issue permit. Please advise as soon as possible so we may resolve this issue with developer and Seaside Bay. You was kind enough to answer my questions and send me a copy of the field investigation report which helped me outline a time line for permit 63-14. 1 do have a couple of more questions about what is written in the field report specific to permit 99-09 and 63-14 would like to ask that you give me a call when you have a chance.
