Eure Construction Company, dated June 11, 1996, concerning your desires to modify your CAMA Permit. According to the letter, you wish to modify the configuration of the permitted pier by rotating the floating dock section of the pier by 90 degrees. This rotation would not change the permitted footprint and would not extend any further out into Gallants Channel. Additionally, the structure(s) would not be located any closer to the adjacent property owners areas of riparian access. I also understand from your contractor that with the approval of this modification you wish to withdraw your request to use explosives to remove material from the bottom of Gallants Channel. Please be advised that CAMA Permit No. 2-96 is hereby refined to allow for the relocation of the structure as described in your contractors letter (and accompany plat) dated June 11, 1996. By telephone conversation of May 21, 1996, the National Marine Fisheries Service objected to the use of explosives at this site due to the potential adverse impacts to Federally threatened and/or endangered sea turtles, and to marine and estuarine species which may be inhabiting the area. Based on this objection, we recommend denial of the modification request. Eure Construction Company, Inc., contractor for Mr. John Hines, requesting CAMA Permit #2-96 be modified to allow emulsion gel explosive material to be used to break up a hardpan layer encountered at the site. The hydraulic dredge working on the project ran into a layer of hardpan material, measuring approximately 40' long x 40' wide, and were unable to cut through. The contractor is proposing to hire an underwater demolition expert to place emulsion gel explosives to break up the hardpan material and then dredge the area to its permitted depth. Mr. Hines has consulted an explosives expert regarding this problem and proposes to impact the hardpan with a 10 lb. emulsion gel explosive. The charges will be placed on a grid approximately 6' on centers; drilled into the hardpan which is 2' - 3' thick. Charges will be detonated one at a time. Current water depth in this area is -2 MLW. Mr. Hines proposes to set one charge to monitor the effects of the explosive, which should be very minor in terms of overall impact and noise. The loosened material will then be removed by hydraulic dredge. Your consideration of this request is appreciated. DATE: May 1, 1996 SUBJECT: Beaufort Dredging Project As mentioned in our telephone conversation yesterday, the Division of Marine Fisheries' principal concern in removing the area of "hardpan" material from the project site with explosives is the unknown effect the concussion may have on fish, marine mammals and sea turtles present in the area. Not being an explosives expert, I am unable to determine the impact of the explosion on tha surrounding area or the marine life. sea turtles are present in the vicinity of Beaufort Inlet during this time of year as are dolphins, which are calving at this time, We relaved those concerns to Vickie Thayer, a National Marine Fisheries Service (NMFS) Research Biologist with the Marine Stranding Network, and she contacted Ron Sechler with NMFS, and a "marine mammal person" in St. Petersburg, FL.' They too are most concerned that the contractor obtain tha proper federal permits and protect the endangered species present. That is the present situation.
