Bulkhead Construction and Backfill 1) The bulkhead will not be positioned farther waterward than 34 feet from the normal water level elevation contour at any point along its alignment. 2) The bulkhead must be constructed prior to any backfilling or shoreline grading activities. The bulkhead must be structurally tight so as to prevent the seepage of backfill materials through the structure. 3) All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. (See attached sheet for Additional Conditions) This permiLaction may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Metal products, organic materials, or unsightly debris will not be used. Excavation 6) No excavation within PublicTrust Waters shall occur between February 15th and September 30th of any calendar year without written authorization from the Division of Coastal Management, in consultation with the NC Division of Marine Fisheries. Alternatively, a sediment curtain completly confining the excavation area may be acceptable within the moratorium. The permittee must request a determination from DCM and DMF. 7) Excavation will not exceed 5.5 feet below the elevation of normal water level (NWL). 8) No excavated or fill materials will be placed'at any in any vegetated wetlands or waters outside of the permitted area. 9) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 10) All dredge spoil will be placed landward of Public Trust Waters and wetlands. All dredge spoil will be de -watered behind a suitable retention structure. Spoil material shall not be used as bulkhead backfill until it has been completely de -watered. Other Project Activity 11) Erosion and sediment control devices and measures shall be used as necessary to prevent the discharge of any dredge spoil or sediment runoff into any adjacent wetland or Public Trust Waters. 12) The culvert crossing shall be installed in accordance with US COE and NC Sediment Control Rules and the plats dated February 19, 1996. The filling of this man-made ditch other than work specified on these referenced plats is not authorized. 13) The boat lift structure shall be constructed as per the plats dated February 19, 1996. The structure shall not interfere with the public's use or access to the man-made canal. The lift structure, in no case, shall extend beyond one-third the canal width at NWL. This authorization does not provide for any dock or pier to access the boat lift structure. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) Scott Harrell, Sr. Edenton Bin Report Page Two Site Description The proposed development is on a vacant waterfront lot in the subdivision, Queen Anne's Place, in Edenton. Specifically, the proposed development is on an undeveloped lot located on a man-made canal which connects to Pembroke Creek. The adjacent waterfront lots are bulkheaded and single family residences are located on the adjacent properties. Current roadfront access to the lot is restricted by an adjacent neighbors driveway and a drainage ditch. A significant portion of the lot has been delineated as '404' wetlands. The current shoreline configuration includes a small shallow basin or slip area approximately 20 ft. by 12 ft. in size. The remaining shoreline includes a zigzag alignment of approximately 60 ft. of failing and deteriorating wooden bulkhead. The water depth offshore adjacent to the failing bulkhead is approximately 2.5 ft. at NWL. The canal depth is 5.5 ft. at NWL a distance of 15 ft. from the shoreline. The waters of Pembroke Creek are classified by the Wildlife Resources Commission as Inland Waters. However, the Fisheries boundary line is approximately 700 ft. downstream. The waters of Pembroke Creek are classified as Public Trust Waters by the Division of Coastal Management and part of the Estuarine System Area of Environmental Concern. The shoreline is vegetated in lawn grasses and sedges and littered with concrete, bulkhead and block debris. The landward portion of this lot is vegetated in a canopy of Taxodium distichum (bald cypress) . The upland portion of the lot was filled several years prior. A gravel driveway and easement run across the front end of the lot. A 6.5 ft wide drainage ditch runs parallel to the high ground portion of the lot adjacent to this driveway. The ditch is vegetated in wetland species including 7ypha spp. and Juncus roemerianus. Proposed Work The applicant proposes to replace the existing deteriorating zigzag bulkhead alignment with a straight alignment. The proposed bulkhead will be 65 ft. in length. This alignment requires filling the existing basin/slip and bulkheading waterward of the existing alignment an average distance of 11 ft. The applicant also proposes to construct a 24 ft. by 12 ft. boat lift adjacent to the new bulkhead. Due to the shallow water depths in the man-made canal, the applicant also proposes to excavate 720 cf. of spoil in the vicinity of the proposed lift to the connecting water depth of 5.5 ft. NWL. The spoil will be dewatered on the applicant's lot and then later graded out. The applicant then would backfill the bulkhead and lot with acceptable fill. To access the lot, the applicant proposes to construct a 24 ft. wide driveway across a man-made drainage ditch. ,i J. The proposed bulkhead alignment, including the basin fill will require the filling of 1200 sf. of Public Trust Waters. The proposed maintenance dredging of the adjacent man-made canal will require the excavation of approximately 300 sf. within Public Trust Waters and 288 sf. of Public Trust Waters would be allocated for the proposed boat lift. The proposed lift structure would be well within the current 1/3 rule in 7H.1200. The applicant will also impact 0.1 acre of other wetlands landward of CAMA jurisdiction so that the applicant could construct a SFR structure on the subject lot. The applicant has also requested authorization to construct a driveway across a man- made ditch. This ditch connects to Pembroke Creek. Coastal wetlands (mostly 7ypha spp.) have established up this ditch. The proposed crossing is less than 200 ft. from Pembroke Creek and would impact about 100 sf. of coastal wetland plant species. CAMA Review The site is not within the Edenton Historical District. The proposed project will impact some 1500 sf. of public trust waters. The driveway crossing will impact 100 sf. of coastal wetland vegetation. The Town of Edenton 1991 Land -Use Plan Update supports CRC and USCOE resource protection and management policies. The Plan suggests revising the Zoning Ordinance to establish a Conservation Zone in areas where hydric soils or "404" wetlands are present along Pembroke Creek and encourage the development of vegetative buffers between development and Public Trust Waters (pg. 42). Currently, there is not an Estuarine Shoreline AEC or required vegetative buffer along Pembroke Creek. It would appear that the LUP would support such a designation. Submitted by Dennis W. To accomplish this, to access the lot, the applicant proposes to construct a culvert crossing over a small man-made ditch which connects to Pembroke Creek. To create a larger lot, and to straighten and stabilize the shoreline, the applicant proposes to fill 1200 sf. of Public Trust Waters and 4356 sf. of 1404' wetlands. The applicant also proposes to dredge 300 sf. of Public Trust Waters and construct a boat lift on the same man-made canal. A small Coastal Wetland stand of mostly Typha 1. is currently present in the ditch and crossing area. The proposed '404' area to be filled is between two previously filled lots. The existing bulkhead is in serious need of replacement. The existing slip area contains debris and is of little use in its current condition. The area where the applicant proposes to dredge and construct a boat lift is also shallow and littered with debris. Although the proposed development will directly impact a small Typha stand and the proposed bulkhead alignment exceeds the 7H Rules for shoreline stabilization, the proposed development will improve access and use of the adjacent Public Trust Waters. White perch, yellow perch, catfishes and other commercially and recreationally important species also utilize the area. This agency is concerned with the loss of 4,356 square feet of wetlands and 100 square feet of coastal wetlands. Wetlands are of great importance serving as sources of biological productivity and providing food directly and indirectly. Finally, wetlands perform important roles in modifying acute impacts of hydrologic events, moderating stormwater flows, trapping sediments, and providing nutrients for incorporation into resident plants. Based on the width (6.5 feet) of the drainage ditch, the Division would recommend a culvert larger than 2 feet in width. Constricting the flow to a two foot width could result in stormwater backup, resulting in flooding. The proposed excavation for the boat lift should not exceed the connecting depth in the canal (5.5 feet). This agency would recommend a moratorium associated with the proposed excavation of 720 cubic feet for the boat lift. The moratorium period would be 15 February through 30 September. This will ensure the environmental integrity of the area is protected during critical times of usage by the previously mentioned species. However, if some type of turbidity curtain or boom could be utilized, the work could be conducted within the moratorium time frame. P.O.
