ADDITIONAL INFORMATION In addition to the completed application form, the following items must be submitted: • A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale in black ink on an 8 1/2" by 11" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03/95 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary • A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. Such landowners must be advised that they have 30 days in which to submit comments on the proposed project to the Division of Coastal Management. The property is approximately 170' wide along Gallant's channel with a fringe of Coastal Wetlands measuring approximately 50' wide along the shoreline. A General Permit has been issued to the applicant which authorizes the construction of a pier but has not yet been built. Water depths at the project site range from -3' to -6' at the end of the permitted pier. Waters at the project site have been classified as SC and are closed the harvesting of shellfish. The property is located within the Beaufort Historic District which is listed on the National Register of Historic Places. The applicant now wishes to excavate an approximately 140' long x 50' wide to -6' deep mean low water (MLW) boat basin. The excavation would begin approximately 30' offshore of the fringe of Coastal Wetlands. The spoils material would be placed on a barge by a clam shell type bucket and disposed of on high ground away from the site. Major Permit #38-91 was issued to the adjacent property owner to the north of this site and authorized basically the same type of excavation which the applicant is now proposing. 10. ANTICIPATED EUPACTS: The applicant proposes to excavate an approx. 7,000 ft.z of bottom area of.Gallant Channel with approx. 778 cubic yards of sandy mud material being removed. The material would be placed directly on a barge and disposed of on high ground. An increase in turbidity should be expected during the periods of excavation but this should be short term in duration. I have reviewed this proposal for consistency with the 1990 Town of Beaufort Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as Developed, while the AECs impacted by the work are classified as Conservation. Page III-2, Land Classification System, discusses uses allowed by the Town of Beaufort in conservation classified Estuarine Waters and Public Trust Areas. Uses consistent with the 7H Use Standards will be allowed in these areas. The only exception to this policy is the prohibition of floating structures, which does not appear to be applicable to Mr. Hines' proposal. The Town's concurrence with the 7H Use Standards for development in Estuarine Waters and Public Trust Areas, is reiterated on Page IV- 7, Resource Production and Management Policies for Marine Resource Areas, where this policy is also discussed. Fragile Areas, Historic and Archaeological Sites are discussed on Page I-37 of the LUP. The Plan notes that in addition to the Historic District, there are potentially significant historic and archaeological sites scattered along Beaufort's shoreline areas. The Town recommends that the North Carolina Division of Archives and History be contacted prior to any land or water bottom disturbing activities. Based on the above policies, this project appears to be consistent with the 1990 Town of Beaufort Land Use Plan, provided all state requirements can be satisfied. We recommend that the following condition(s) be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans. 50' A All excavated materials will be confined landward of the mean high water T (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. Any flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. X — No vegetated wetlands will be excavated. Excavation will not exceed 6 feet below MLW. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement.
