1) This permit modification authorizes changing the method of excavation from. clamshell to
hydraulic dredge. Spoil from such dredging shall be pumped to the site depicted in the attached
site plan which was authorized under Minor Permit No. 0496 for spoil containment.
2) All excavated meterials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
3) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or
beyond the mean low water level to prevent gully erosion and unnecessary siltation.

This permiCaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An.appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

covered hereunder requires further Departmental approval.

'The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Dear Mr. Hines:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of the modification of your State permit that
authorizes you to excavate a basin on Gallants Channel, Taylor's Creek,
Carteret County, North Carolina. This modification authorizes your use of a
hydraulic dredge in lieu of a clamshell dredge.
Your revised proposal is consistent with the provisions and objectives of
general permit No. CBSAW-0080-N-000-0291. Therefore, you may commence
construction activity in strict accordance with your modified State
authorization. Failure to comply with the State authorization or conditions
of the general permit could result in civil and/or administrative penalties.
If there is a need to extend the duration of this Federal authorization,
or if any change in your work is required because of unforeseen or altered
conditions or for any other reason, a written request for renewal of
authorization or plans revised to show any change must be sent promptly to
this office and the North Carolina Division of Coastal Management before
continuing work or doing any change or alteration. Such action is necessary
as specific renewal of authorization must be obtained or revised plans must be
reviewed and the authorization modified. A request for extension of
authorization must be received no later that thirty (30) days before
expiration of the permit.

Minor modification request to CAMA Permit #2-96 issued to John
Hines/Carteret County

Enclosed, please find a request and a drawing from T.D. Eure Construction Company, Inc.,
contractor for Mr. Hines, requesting CAMA Permit #2-96 be modified to allow hydraulic
dredging at the project site. The excavated material would be pumped to a high ground
disposal site owned by Mr. Charles King which is located on the south side of US Highway
70 (Cedar Street) in the Town of Beaufort. Because of the preparation required for the spoil
disposal site (i.e. a building will be demolished which is located within the Estuarine
Shoreline AEC) Mr. King has applied for a CAMA Minor Permit. His permit application
requests authorization for the demolition of the building, the construction of the dike for the
spoil disposal area and the construction of a new building at the site. During the review of
the request, we determined that the proposed work would occur within the Town of Beaufort
Historic District as defined by the National Register of Historic Places. Presently, the
Division of Archives and History are evaluating Mr. King's proposal and will inform us of
any problems which might be caused by this project.
I have no objections to the issuance of this permit if Archives and History have no objections
and the following additional conditions apply:

regularly or irregularly flooded marsh behind adequate dikes or other retaining
structures to prevent spill -over of solids into any marsh or surrounding waters.

Thank you for providing us a co �r� o-15 y p g copy of Mr. Charles King per application to \9.�
demolish an existing building, dike his site, use it for dredge disposal, and at some
time in the future erect a new one-story steel building. The proposed project site is
within the boundaries of the Beaufort Historic District, a property listed in the
National Register of Historic Places and subject to Section 106 of the National
Historic Preservation Act.
Based on the information provided and my visit to the site on January 25, 1996,
we believe the proposed building demolition, dike, and disposal area will not
adversely affect the historic district. The building is not a contributing element in
the historic district and the diking and disposal are compatible uses in the area.
However, we are concerned about the design and buffering of the proposed new
structure.
We, therefore, recommend that any permit for the proposed undertaking include the
following condition to ensure that the new construction does not adversely affect
the historic district:
Prior to construction of a new building and parking lot, the permittee will
consult with the North Carolina State Historic Preservation Office on the
design for the metal building and a planting and driveway plan compatible
with the historic district's character. The size, massing, and color of the
new building are of particular concern in deterring compatibility.
The above comments are made pursuant to Section 106 of the National Historic
Preservation Act and the Advisory Council on Historic Preservation's Regulations
for Compliance with Section 106 codified at 36 CFR Part 800.
