The original (buff - colored form) is retained by you and it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. . The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. Eure Construction Company, Inc., contractor for Mr. Hines, requesting CAMA Permit #2-96 be modified to allow hydraulic dredging at the project site. The excavated material would be pumped to a high ground disposal site owned by Mr. Charles King which is located on the south side of US Highway 70 (Cedar Street) in the Town of Beaufort. Because of the preparation required for the spoil disposal site (i.e. a building will be demolished which is located within the Estuarine Shoreline AEC) Mr. King has applied for a CAMA Minor Permit. His permit application requests authorization for the demolition of the building, the construction of the dike for the spoil disposal area and the construction of a new building at the site. During the review of the request, we determined that the proposed work would occur within the Town of Beaufort Historic District as defined by the National Register of Historic Places. Presently, the Division of Archives and History are evaluating Mr. King's proposal and will inform us of any problems which might be caused by this project. I have no objections to the issuance of this permit if Archives and History have no objections and the following additional conditions apply: 1. The proposed project site is within the boundaries of the Beaufort Historic District, a property listed in the National Register of Historic Places and subject to Section 106 of the National Historic Preservation Act. Based on the information provided and my visit to the site on January 25, 1996, we believe the proposed building demolition, dike, and disposal area will not adversely affect the historic district. The building is not a contributing element in the historic district and the diking and disposal are compatible uses in the area. However, we are concerned about the design and buffering of the proposed new structure. We, therefore, recommend that any permit for the proposed undertaking include the following condition to ensure that the new construction does not adversely affect the historic district: Prior to construction of a new building and parking lot, the permittee will consult with the North Carolina State Historic Preservation Office on the design for the metal building and a planting and driveway plan compatible with the historic district's character. The size, massing, and color of the new building are of particular concern in deterring compatibility.
