Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. This permit action may be appealed by the perminee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not require a stormwater management permit. PROJECT SUMMARY: Replacement of 612 ft. of wooden bulkhead along the Albemarle Sound near the Holiday Island Clubhouse facility. HOLIDAY ISLAND PROPERTY OWNERS ASSOCIATION BIO REPORT Page Two Proposed Work The applicant, Holiday Island property Owners Association, proposes to construct 612 ft. of wooden bulkhead along Estuarine Shoreline of the Albemarle Sound. The applicant proposes a new bulkhead average alignment of 4 ft. waterward of the existing bulkhead. A length of the existing bulkhead structure of about 50 ft. has completely failed. The proposed maximum alignment at this area is about 20 ft. Recent hurricane damage to this shoreline since this applications preparation may have increased this distance. The applicants propose to replace the entire bulkhead alignment and then backfill and grade 600 ft. by 20 ft. area of the adjacent Estuarine Shoreline. Site Description The applicant proposes to replace over six hundred feet of wooden bulkhead at its clubhouse facility at Holiday Island in Perquimans County, east of Yeopim Creek along the Albemarle Sound. The Holiday Island POA facility includes several hundred feet of Estuarine Shoreline. A clubhouse, pool, asphalt parking lot and tennis court are located greater than 75 ft from the NWL and are outside the Estuarine Shoreline AEC. The shoreline adjacent to the existing bulkhead is an elevation of about six ft. above the NWL and is vegetated in lawn grasses. The waters of the Albemarle Sound are classified by the Division of Marine Fisheries as Joint Waters. These waters are classified by the Division of Coastal Management as both Public Trust and Estuarine Waters and are part of the Estuarine System of Environmental Concern. Anticipated Impacts The proposed work will not impact any vegetated wetlands but will impact 3,240 sf. of Public Trust Waters. Bulkhead construction will result in a temporary increase in turbidity of adjacent waters. The current bulkhead wall is allowing significant erosion to occur each day. So that turbidity and erosion can be reduced, the bulkhead should be replaced or repaired as soon as possible. Staff biologists with the Wildlife Resources Commission have completed a review of the project with regards to associated impacts on wildlife and fishery resources in the area. A site visit was conducted on August 19, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act (G. S. 113A-100 through 113A-128). The applicant proposes to construct 612 ft. of bulkhead an average of 4 ft. waterward of an existing deteriorating bulkhead. During the site visit the biologist with the Wildlife Resources Commission met with two officers of Holiday Island Property Owners Association. During the meeting the individuals expressed an interest in using rip -rap instead of a wooden bulkhead. We have provided the applicant with additional information pertaining to rip -rap and recommend that DCM encourage the use of rip -rap for shoreline stabilization. Bulkheads and the associated backfill usually eliminate the intertidal or transition zone, producing an abrupt change from the subtidal to the upland. In coastal estuaries and reservoirs 1D V tf- these shallow transition zones are commonly known to function as feeding and spawning areas for ? -1`7 51 numerous species of fish and crustaceans. In Lake Conroe, Texas, fish sampling near natural and rip -rapped shorelines yielded 3-4 times more juvenile and adult fish than from bulkheaded shorelines. Based upon data such as this, COE in Texas has recognized the value of shallow water habitat and supports the use of rip -rap instead of bulkheads. In addition to physical losses of habitat, bulkheads also create a high energy zone in the shallow water directly in front of the structure. Bottom substrates may be significantly altered by the scouring action of wave energy reflected from bulkheads. Reflected wave energy from bulkheads constructed in shallow waters may scour existing submerged aquatic macrophytes or prevent their establishment. Bulkheads are the least desirable option for shoreline erosion control and should be used only when other options are not possible. When bulkheads are used, rip -rap should be added to the water -ward face to restore habitat diversity and mitigate losses of fishery habitat. No. 199604908. The applicant, the Holiday Island Property Owner's Association, proposes to construct a 612 linear foot bulkhead along the estuarine shoreline of Albemarle Sound. The proposed bulkhead is desired because a portion of the existing bulkhead has failed, and severe erosion is eliminating the artificial shoreline. The proposed bulkhead is to be constructed four feet waterward of the existing bulkhead, and backfilling would be used to landscape the fastland. The site of the proposed activities is east of Yeopim Creek at the Holiday Island community clubhouse, Perquimans County, North Carolina. This is the report of the Service submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). The Service recommends that the District Engineer seek modification of the proposed activities such that the bulkhead will be constructed landward of the plane of ordinary high water (OHW), and in an alignment which mimics, to the extent practicable, the natural shoreline. Constructing the replacement bulkheads as recommended will minimize adverse cumulative fish and wildlife impacts by limiting extent of filling activities, avoiding any loss of nearshore habitat, and reducing the magnitude and frequency of in -water repairs which can be anticipated from the proposed activities. <<n Shallow nearshore areas are important for primary producti for wave energy dissipitation. Constructing bulkheads wate -.r OHW eliminates that shallow nearshore habitat directly (by filling) and indirectly (by redirecting wave energy in an erosive manner). Bulkhead alignment should follow the shoreline (the shoreline's irregular shape is a function of wave energetics, shoreline stability, and bottom configuration). This alignment is consistent with patterns of energy transfer from the water to the shore, and following that pattern will reduce impact burdens on the bulkhead. This means it will keep its' integrity for a longer period, requiring less frequent maintenance, and less frequent in -water work or other disturbances to the aquatic environment. Additionally, the Service recommends that when considering the alignment of bulkheads, the applicant should not use historically filled areas, or fastland, as the baseline condition. In general, bulkheads were placed waterward of OHW and backfilled. It is reasonable to assume that a similar pattern occurred at Holiday Island. This altered shoreline contributed to energetics which ultimately caused the bulkheads to fail. We believe that the pattern of bulkhead construction, failure, and landward erosion is a trend in which waves are creating an energetic equilibrium between the shore and estuary, in effect, reclaiming aquatic habitat and other nearshore functions. The proposed activities will temporarily deflect the wave energy and disturb local aquatic habitats, adversely affecting fish and wildlife resources in the future. HOLIDAY ISLAND PROPERTY OWNERS ASSOCIATION BIO REPORT Page Two Proposed Work The applicant, Holiday Island property Owners Association, proposes to construct 612 ft. of wooden bulkhead along Estuarine Shoreline of the Albemarle Sound. The applicant proposes a new bulkhead average alignment of 4 ft. waterward of the existing bulkhead. A length of the existing bulkhead structure of about 50 ft. has completely failed. The proposed maximum alignment at this area is about 20 ft. Recent hurricane damage to this shoreline since this applications preparation may have increased this distance. The applicants propose to replace the entire bulkhead alignment and then backfill and grade 600 ft. by 20 ft. area of the adjacent Estuarine Shoreline. Site Description The applicant proposes to replace over six hundred feet of wooden bulkhead at its clubhouse facility at Holiday Island in Perquimans County, east of Yeopim Creek along the Albemarle Sound. The Holiday Island POA facility includes several hundred feet of Estuarine Shoreline. A clubhouse, pool, asphalt parking lot and tennis court are located greater than 75 ft from the NWL and are outside the Estuarine Shoreline AEC. The shoreline adjacent to the existing bulkhead is an elevation of about six ft. above the NWL and is vegetated in lawn grasses. The waters of the Albemarle Sound are classified by the Division of Marine Fisheries as Joint Waters. These waters are classed by the Division of Coastal Management as both Public Trust and Estuarine Waters and are part of the Estuarine System of Environmental Concern. Anticipated Impacts The proposed work will not impact any vegetated wetlands but will impact 3,240 sf. of Public Trust Waters. Bulkhead construction will result in a temporary increase in turbidity of adjacent waters. The current bulkhead wall is allowing significant erosion to occur each day. So that turbidity and erosion can be reduced, the bulkhead should be replaced or repaired as soon as possible.
