be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
EXCAVATION AND SPOIL DISPOSAL
In order to protect juvenile shrimp and finfish populations, no excavation will be permitted
between June 1 and September 30 of any year without the prior approval of the Division
of Coastal Management, in consultation with the Division of Marine Fisheries.
Excavation shall not exceed 6 feet below the elevation of the normal water level.

This permit action may be appealed by the perminee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

BULKHEADS
7. The basin bulkhead shall be positioned no farther waterward than 13 feet from the normal
water level elevation contour at any point along.its alignment. The bulkhead adjacent to
Mill Landing Creek shall be positioned no farther waterward than 9 feet from the normal
water level elevation contour at any point along its alignment.
8. The alignment of the bulkheads must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline
by adverse weather conditions, will require the alignment to be restaked by DCM within
a maximum of 30 days prior to the new expected start of construction.
9. The bulkheads must be constructed prior to any backfilling activity.
10. The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
11. The bulkhead must be solid and constructed of treated wood; concrete slabs, metal sheet
piles, or other suitable materials approved by Department personnel. No excavation is
permitted waterward of the normal water line except for that which may be required for
the construction of the bulkhead walls, deadmen cables, etc.
12. The fill material will be free and clean of pollutants, except in trace quantities. Metal
products, organic material, or unsightly debris shall not be used.

13. All fill material to be placed bel al water level will be confined behind the

of this requirement if he abandons the project without having the permit transferred to a
third party.

interference with navigation.

under General Water Quality Certification No. 3025, (DEM Project No. 960064),
which was issued on 2/20/96.

following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn_ to scale in black
ink on an 8 1/2" by II" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.

Reference your application for a Department of the Army (DA) permit to
construct two bulkheads and undertake maintenance dredging activities within a
manmade basin, on property located off NC 345, adjacent Mill Landing Creek, in
Wanchese, Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of General Permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Reference the application of the Wanchese Seafood Company for
a Department of the Army (DA) permit to construct two bulkheads and
undertake maintenance dredging activities within a manmade basin, on
property located off NC 345, adjacent Mill Landing Creek, in Wanchese,
Dare County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following condition(s) be included in the
State authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. The bulkhead will not be positioned farther waterward than
-feet from the normal water level elevation contour at any point along
its alignment.
3. All excavated materials will be confined landward of the mean
high water (MHW) elevation contour within adequate dikes or other
retaining structures to prevent spillover of solids into any vegetated
wetlands or surrounding waters.
4. No excavated or fill materials will be placed at any time in
any vegetated wetlands or waters.
5. Excavation will not exceed 6 feet below the elevation of mean
low water (MLW).
6. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
7. The fill material will be clean and free of any pollutants except
in trace quantities. Metal products, organic materials, or unsightly debris
will not be used.

8. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.
9. The authorized structure and associated activity will not cause
an unacceptable interference with navigation.
10. The activity will -be conducted in such a manner as to prevent
a significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters
by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's
or less in all saltwater classes and in all lakes and reservoirs, and
10 NTU's or less in trout waters, are not considered significant.

of shoreline of Mill Landing Creek. Within the basin the applicant proposes to dredge a 6,044
square foot area with existing depth of 3.3' below NWL to a final depth of 6' below NWL and
replace 3 piers.

Site Description
The applicant, Wanchese Seafood Company, owns a total of 1.1 acres of land lying on
both sides of a 100' x 200' basin on the east side of NC 345 in the Village of Wanchese, Dare
County, adjacent Mill Landing Creek. At the landward end of the basin is a 15' x 30' public
boat ramp owned and operated by Dare County, which owns property north of this project and
a 20' - 80' wide strip lying between the western boundary of this site and NC 345. Elevation
of the land within the site averages approximately 4' above MSL.
Within the 35,000 square foot parcel lying to the north is a fish processing house and
restaurant. The western walls of these structures lie along the NWL of Mill Landing Creek.
A 6' x 170' wooden dock parallels the shoreline and lies approximately 8' waterward of NWL.
The restaurant's west wall noticeably bulges out in several places.
The 15,000 square foot triangular -shaped parcel lying south of the basin supports no
buildings but approximately 160 linear feet of shoreline has been protected by the installation
of sheet pile bulkhead, as authorized by General Permit #14911A issued in the fall of 1995.
Under the same authorization, a 3,200 square foot area of the basin near the connecting channel
has been dredged to a depth of 6' below NWL. On the southern side of the basin just east of
the recently dredged area are the remnants of three 5' wide wooden piers each with a length of
25' to 42'. As verified by a site visit on December 4, 1995, basin depths range from 1.5' NWL
to 6' NWL and connecting channel depths range from 7' NWL to 12' NWL.
Approximately 15 square feet of cord grass S artina alternifloral lies on a sand shoal
just waterward of the new sheet pile bulkhead and near the remains of the easternmost pier.
Along the 4' tall eroded bank at the southwest corner of the basin are a few small clumps of salt
meadow grass S artina atens located high enough to escape flooding. Atop the bank one finds
a scattering of sea myrtle accharis halimifolia) and goldenrod. Just landward of the 6' wide
band of vegetation are extensive areas devoid of vegetation with soils compacted by heavy
vehicular traffic accessing the Moon Tillet Fish Company site.
No beds of submerged aquatic vegetation were noted within the basin or in the affected
area of Mill Landing Creek.
Proposed Development
The applicant proposes to construct 129 linear feet of sheet pile bulkhead a maximum
distance of 9' waterward of NWL of Mill Landing Creek along the area immediately waterward
of the restaurant building. From the southeast comer of the building the bulkhead would
continue in essentially the same alignment for 50 linear feet along the fish house wall and tie into
an existing sheet pile bulkhead. Average water depths are 2 feet below NWL along the
proposed bulkhead alignment.

Also proposed is the construction;of a sheet pile bulkhead a maximum distance of 13'
waterward of NWL along 77 linear feet of shoreline at the southwest corner of the basin. Both
segments of bulkhead will be constructed an average distance of 8.25' waterward of NWL.
Within the southwest comer of the basin the applicant proposes to dredge by dragline a
6,044 square foot area with existing bottom contour 3.3' below NWL to a final depth of 6'
below NWL. The 604 cubic yards of material generated would be placed within a 2,943 square
foot high ground disposal area located 5' - 10' landward of an existing sheet pile bulkhead. The
applicant proposes to place the dewatered spoil behind the existing and proposed sheet pile
bulkheads.
Also proposed is the replacement of two 5' x 25' long piers and one 5' x 42' pier.
Anticipated Impacts
Approximately 1,750 square feet of shallow water habitat will be lost as a result of the
proposed bulkheading and backfilling. A temporary increase in turbidity is anticipated as a
result of dredging within the 6,044 square foot area. Approximately 2,943 square feet of
uplands will be disturbed by the placement of dredge material. Approximately 460 square feet
of shallow water habitat will be shaded by the proposed construction of three piers.
Access to public trust waters will be improved for boaters using the Dare County Public
Boat Ramp.
CAMA Review
Dare County calls for estuarine shoreline development to be managed to protect and
preserve the natural resources of the estuarine waters, and requires that "development in
estuarine waters be water -dependent, related to development on the estuarine shoreline, or an
accessory use to a structure located on the estuarine shoreline" (pg. 53). As to the installation
of estuarine bulkheads the County agrees "that properly permitted estuarine bulkheads are a well
established and accepted feature of the estuarine shoreline" (pg. 55).
For public trust areas the County "supports the CAMA use standards" and seeks to
"provide for maintenance of existing waterways and harbors and to provide for additional access
to public trust waters" (pg. 55).
The proposed bulkhead and piers are water -dependent uses. The proposed dredging will
maintain an existing waterway and provide additional access to public trust waters. So long as
the proposal is found to otherwise satisfy applicable CAMA permit standards, it will be
consistent with the Dare County Land Use Plan.

Prior to the submittal of the Major CAMA application currently under consideration
3,200 square feet of the basin was dredged and approximately 160 linear feet of bulkhead was
installed under authorization of General Permit #14911A issued in the fall of 1995. I
recommend approval of the request with the following conditions:

1) In order to protect juvenile shrimp and finfish populations, no excavation will be
permitted between February 15 and October 31 of any year without the prior
approval of the Division of Coastal Management, in consultation with the
Division of Marine Fisheries and the Wildlife Resources Commission.
2) All excavation will be conducted below the normal water line.
3) The temporary placement or double -handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
4) Excavation shall not exceed 6 feet below the elevation of mean low water
(MLW)•

7) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction -related
discharge. Increases such that the turbidity in the waterbody is 25 NTUs or less
in all saltwater classes are not considered significant.
8) Appropriate erosion and sedimentation control devices, measures, or structures
must be used to prevent sediment from entering the adjacent
wetlands/watercourses/property (e.g., silt fence, diversion swales/berms, sand
fence, etc.).
(9 A ground cover sufficient to restrain erosion must be provided within 30 working
days of completion of any phase of grading on cut or filled slopes.
Piers
10) The piers and associated structures shall have a minimum setback distance of 15'
between any part of the structure and the adjacent property lines as extended
perpendicular to the channel into the water where they intersect at the shoreline.
11) No attempt will be made by the permittee to prevent the full and free use by the
public of all navigable waters at or adjacent to the authorized work. Use of the
permitted activity must not interfere with the public's right to free navigation on
all navigable waters of the United States.
12) The replacement piers shall be constructed in the location shown on the plat by
Environmental Professionals, Inc., dated 12/11/95 and received December 21,
1995 by the Division of Coastal Management.
Bulkheads
13) The bulkheads shall not extend more than 8.25' waterward of the normal water
line at any point along their alignment at the time of construction.
14) The alignment of the bulkhead must be staked by a representative of the Division
of Coastal Management (DCM) within a maximum of thirty (30) days prior to the
start of construction. Failure to initiate construction within thirty (30) days, or
erosion of the shoreline by adverse weather conditions, will require the alignment
to be re -staked by DCM within a maximum of thirty (30) days prior to the new
expected start of construction.
15) The bulkhead must be constructed prior to any backfilling activity.
16) The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
17) The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles, or other suitable materials approved by Department personnel.
No excavation is permitted waterward of the normal water line, except that which
may be required for the construction of the bulkhead wall, pier, gazebo, platform,
and moorings.
18) The fill material will be clean and free of any pollutants, except in trace
quantities. Metal products, organic material, or unsightly debris will not be used.
19) All fill material to be placed below the normal water line will be confined behind
the permitted bulkhead.
20) No excavated or fill material will be placed in surrounding water or outside of the
alignment of the fill area indicated on the workplat drawings.
21) No vegetated wetlands will be excavated or filled.
22) The backfill material will be properly graded and provided with a ground cover
sufficient to restrain erosion within thirty (30) working days of the project
completion.
NOTE: The N.C. Division of Environmental Management has assigned the
proposed project DEM Project No.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project

This agency approves of this project with the following modification. The Division is
concerned with the proposed dredging of 6,044 sq. ft. of shallow water habitat. Due to
previous activities that have occurred in the area which have resulted in metals, solids, and
other materials going into the waters, the main concern is from the suspension and resulting
turbidity of these materials. In an effort to ensure that the work be accomplished during a
period with the least amount of biological productivity, a dredging moratorium is requested.
The requested time period is 1 June through 30 September. However, if some type of boom
system or turbidity curtain could be utilized this agency maybe able to remove the dredging
moratorium.

of NC 345, Dare County.
Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. In order to further assess
project impacts on fish and wildlife resources, an onsite inspection was conducted on January 24,
1996. Our comments are provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct bulkhead in two separate locations on his property. A
total of 206 linear feet of sheet pile bulkhead will be constructed an average distance of 8.25 ft.
waterward of the NWL. Within the southwest comer of the basin the applicant proposes to
dredge by dragline a 6,044 W area with existing bottom contour 3.3 ft. below NWL to a final
depth of 6 ft. below NWL. The spoil material will be placed on an upland site. Also proposed is
the replacement of two 5 ft. x 25 ft. piers and one 5 ft. x 42 ft. pier. Waters and sediments at the
site are polluted from many decades of commercial fish house and shipyard activities.
Our main concerns are turbidity and the reintroduction of pollutants into the water column
as a result of dredging. In order to contain turbidity and potential pollution problems we
recommend a silt curtain/boom be installed around the area to be dredged. The silt curtain/boom

should be installed prior to dredging and should remain in place for 72 hours after dredging is
complete.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Ed Harrell with the North Carolina Division of Coastal Management called today and
requested justification for the 8.25 distance offshore of the proposed bulkhead at the
Wanchese Fish Company. I informed him that the distance was necessary in order to
utilize the existing pilings as shoulder pilings for the sheet piles, that the sheet piles
would be driven into place, and provided a $ufficient distance to install tiebacks, These
extraordinary conditions for sheet pile construction are necessary because of the
potential failure of the restaurant and fish 99Mpanyl 0 tha Wilding wall bridges out at
the waterline. Therefore, a tremendous surge may result from the continued settling of
this structure. There is also a concern that installation of the sheet pile too close to the
structure may result in an instantaneous failure.

The Division of Coastal Management hereby a wledges receipt of your application
for State approval for development of your property loco ast of NC 345, in the Village of
Wanchese, adjacent Mill Landing Creek in Dare County. It was received on December 22,
1995, and appears to be adequate for processing at this time. The projected deadline for
making a decision is M. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit FilMg" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received January 23, 1996, for Department
of the Army (DA) authorization to construct two bulkheads and undertake
maintenance dredging activities within a manmade basin, on property located
off NC 345, adjacent Mill Landing Creek, in Wanchese, Dare County, North
Carolina, indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should You begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199601218.
It will be coordinated by Mr. Raleigh Bland in the Washington Regulatory Field
Office, at telephone (919)975-1616, extension 23.
