Bulkhead Construction and Batch File

alignment, except in the vicinity of the 30 foot wide boat ramp, where it will average 55 feet
waterward of the NWL.
2) The bulkhead must be constructed prior to any backfilling activities.
3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.

other suitable materials approved by department personnel. No excavation is permitted, except
for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables,
etc. This permit does not authorize any excavation waterward of the approved alignment.
5) The fill material will be clean and free of any pollutants, except in trace quantities.
6) All backfill material will be obtained from a highground source and confined landward of the
permitted bulkhead.

7) Because the proposed project is located in the Washington National Register Historic District,
the building exterior, color, final landscaping plans, and any changes to the exterior plans and
specifications of the building shall be approved by the Division of Archives and History prior to
construction.

8) Prior to any construction which is authorized by this permit, a pre -construction meeting must be
held between the perittee, contractor, and a representative of the DCM.
9) The Division of Environmental Management approved a Stormwater Management Permit for
this project on April 26, 1996. Any violation of that permit will be considered a violation of
CAMA Permit No. 69-96.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan
must be filed at least thirty (30) days prior to the beginning of any land -disturbing
activity. Submit this plan to the Department of Environment, Health and Natural
Resources, Land Quality Section, 1424 Carolina Avenue, Washington NC 27889.
NOTE: The Division of Environmental Management approved this project under General Water
Quality Certification No. 3025.

Dear Sir:
Reference your application for a Department of the Army (DA) permit
to construct a bulkhead, boardwalk, and dock, on property located off
Water Street, adjacent the Pamlico River, Washington, Beaufort County,
North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore,
you may commence construction activity in strict accordance with applicable
State authorization and the enclosed plan. Failure to comply with the
State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or
altered conditions or for any other reason, plans revised to show the
change must be sent promptly to this office and the North Carolina Division
of Coastal Management prior to performing any such change or alteration.
Such action is necessary as revised plans must be reviewed and the
authorization modified.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An scarrate, dated work plat (including plan view
and cross-sgcdonai drawings) drawn to scale in black
ink on an 8 1/2' by I1" white paper. (Refer to
Coastal Resources Commission Rule 7I.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use :of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal

means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150E with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning

This will respond to your letter of December 18 and subsequent telephone inquiry on
behalf of Mr. & Mrs. J. M. Swanner. As you will recall, the project review was on hold most of
the winter because it was determined late in the process that, with public money involved, an
Environmental Assessment (EA) was required.
The EA went through the State Clearing House with a favorable review. More recently, the
Stormwater Management Permit was issued. All of this clearing the way for final action on the
CAMA permit. Staff and review agencies have found favorable on this public interest project and
the permit has been issued. A copy is enclosed for your review. We trust the lengthy review and
numerious permit conditions would remove some of the concerns of your client, keeping in mind
that his primary concern described in his earlier letter is beyond the purview of this Division.

Attached is the application by the City of Washington to construct the North Carolina
Estuarium. I have reviewed the application in regards to NCAC 7H, specifically .0208(b)(6) -
Docks and Piers and .0208(b)(7) - Bulkheads and Shore Stabilization Measures and have found
that the city's proposal is consistent with these regulations. Therefore, I recommend that the
permit be issued with the following conditions:
2 (1) The bulkhead must be constructed prior to any backfilling activities.
3 (2) The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
(3) The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles or other suitable materials approved by department personnel.
No excavation is permitted except for that which may be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
5 (4) The fill material will be clean and free of any pollutants except in trace quantities.

(5) All back fill material will be obtained from a highground source and confined
behiuti the permitted bulkhead.
(6) All fill material to be placed below normal water level will be confined behind
the permitted bulkhead.
(7) Prior to any construction which is authorized by this permit, a pre -construction
meeting must be held between the permittee, contractor, and a representative of
the DCM.

This application is for a CAMA Development permit to construct bulkheading, floating dock,
piers, boardwalk and a 15,000 square foot building at the Estuarium site on Steward Parkway
and Water Street in downtown Washington and comes under the auspices of the March 1991
CRC certified Washington Land Use Plan update. Public Trust AECs are involved and the
proposed site is apparently in the local historic district.
The plan offers the following guidance on proposals of this type:
City policy on AECs (page 29-30) notes the importance of these resources and "The
policy shall be to support current federal, state and local restrictions with regard to
development in areas of environmental concern. Only "water dependent" uses are
permitted by the State in wetlands, estuarine waters or public trust areas."
City policy on other hazardous or fragile areas (page 30) includes "Historic resources,
as mentioned under Item b above, are regulated by the Historic District Commission and
the policy shall be to support locally adopted restrictions in the historic district."
City policy on tourism (page 41-42) notes the importance that tourism plays and can plan
in the city's economy and states "The overall policy shall be to promote the city and to
maintain orderly development and attractiveness through application of local ordinances."
The site for this proposal is included in the Developed land classification on the city's
land classification map. That class acknowledges urban development with the provision
of services necessary to support those uses.
My opinion is if this proposal can be accomplished within applicable AEC standards and local
historic district standards it will not hP ;ornncictent with city policy nor land classification and
therefore is not inconsistent with the city's land esu plan.

As an agency involved in the Division of Coastal
Management's major permit application review process, we have
determined that more than one acre will be disturbed by the
activities as described. Therefore, in addition to a permit from
the Division of Coastal Management, an erosion and sedimentation
control plan must be submitted to and approved by this office
before development begins.
The requiring of an erosion and sedimentation control plan
is based on a mandatory standard for land -disturbing activity of
the. Sedimentation Pollution Control Act of 1973 [NCGS 113A-57(4)
and 113A-54(d)(4)], which states:
No person shall initiate any land -disturbing activity, if at
least one acre is to be uncovered, unless an erosion and
sedimentation control plan for the activity is filed with
the'agency_having jurisdiction and approved.
The plan must be submitted at feast thirty (30) days prior
to project commencement. The plan must include, but is not
limited to, the following:,
1. A scaled plat plan of the site, showing the affected.
areas as well as adjacent properties which may be
affected. Include contours if available.
2. Indicate critical areas such as wetlands, creeks,
streams, drainageways, marsh, etc.

3. Include a brief narrative describing the activities to
be undertaken and a construction schedule.
4. Indicate on the plat the measures to be utilized to
prevent sediment from entering adjacent properties,
such as location of silt fences, silt basins, diversion
ditches, areas to be seeded, etc.
5. Include seeding and mulching specifications for both
temporary and permanent stabilization.
6. Include any other pertinent information directed at
controlling offsite sedimentation, slope degradation,
and erosion.
Please be advised that the plan will be considered
incomplete, and the statutory review period will not begin,
unless a non-refundable plan review processing fee, payable by
check or money order made out to the Department of Environment,
Health and Natural Resources, is included. The amount of the fee
is based on $30 for the first disturbed or affected acre, plus
$20 for each additional whole or fractional acre of land to be
disturbed (including offsite borrow or waste areas).
To begin this project without the approval of an erosion/
sedimentation control plan will be considered a violation of the
Act and may lead to the assessment of a civil penalty of up to
$500.00 per day for each day the project is deemed in violation.
For your convenience, we are enclosing a guideline for
developing a plan. If you should have any questions, feel free

Thank you for your letter of September 7, 1995, concerning the above project. We
have also received the CAMA permit application for the North Carolina Estuarium.
We have reviewed the revised drawings for the estuarium building, as well as the
proposed landscape plan. Based upon the building plan and elevations dated
August 15, 1995 and the landscape plan dated August 20, 1995, we believe the
project will have no adverse effect upon the National Register -listed Washington
Historic District if the following conditions are incorporated into any permits for the
project and are carried out by the applicant:
The trees along Water Street shall be similar to those throughout the remainder
of the district. Please note that sycamore trees are quite messy when their fruit
and leaves drop.
2. The northwest corner of the site shall be more formal to reflect the urban
context of the site. The paving in this area shall be concrete.
3. The colors of the exterior materials of the estuarium building shall be compatible
with the color palette of historic industrial buildings along the waterfront. Color
samples shall be provided to us for review and approval as well as any changes
to the exterior plans and specifications that may arise.
We also have some concerns about using crushed oyster shells or marl for the
pathways. What are the maintenance requirements for a pathway of these
materials? As an alternative, we suggest using concrete with an aggregate surface
of shells and other natural materials since it would be more durable.
We look forward to reviewing the revised landscaping plan and color samples for
the estuarium in the near future..

Thank you for your letter of February 2, 1996, transmitting the two proposed color
schemes for the estuarium building.
We have reviewed scheme "A" illustrating the terne roof painted metallic aluminum,
the reverse board -and -batten siding stained light grey, the metal trusses and
columns painted white, and a galvanized metal handrail. Scheme "R" shows the
terne roof painted red, the reverse board -and -batten siding stained light grey, and
the metal trusses, columns, and handrails painted dark green. Given the color
palette of the historic industrial buildings along the waterfront, we believe that
scheme "A" is compatible with the historic buildings and would not have an
adverse effect on the district. The colors shown in scheme "R" are not appropriate
to Washington's historic waterfront. Also, we recommend that the grey stain for
the siding closely resemble the cool grey of metal siding commonly found on
industrial buildings rather than a warm grey tone.
The above comments are made pursuant to Section 106 of the National Historic
Preservation Act and the Advisory Council on Historic Preservation's Regulations
for Compliance with Section 106 codified at 36 CFR Part 800.

Dear Mr. Parker:
Reference the application of the City of Washington for a
Department of the Army (DA) permit to construct a bulkhead, boardwalk,
and dock, on property located off Water Street, adjacent the Pamlico
River, Washington, Beaufort County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditie4p be included in the
State authorization:
1. All work authorized by this permit must be performed in strict
ccz4liance with the permit plans.
2. The bulkhead will not be positioned farther waterward than
2 feet from the existing bulkhead alignment, except in the vicinity
of the 30 foot wide boat ramp, where it will average 55 feet waterward
of
the NWL.
3. All backfill materials will be obtained from a highground
source and confined landward of the permitted bulkhead.
4. The fill material will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials, or
unsightly debris will not be used.
5. No attempt will be made by the permittee to prevent the full
C and free use by the public of all navigable waters at or adjacent to
the authorized work. Use of the permitted activity must not interfere
with the public's right to free navigation on all navigable waters of
the United States.

6. If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate
the required State/Federal coordination.

Stormwater Application for the subject project on April 23, 1996.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7960204 dated April 26, 1996 to Partnership for the
Sounds.
This permit shall be effective from the date of issuance until
April 25, 2006, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of
the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and
binding.

This letter is in reference to your application request for a permit under the Coastal Area
Management Act (CAMA) to develop the N. C. Estuarium. In a recent review of the file
preparatory to a final action, it was determined that information had not been presented to to
appropriate agencies for stormwater management and sedimentation and erosion control. In
keeping with guidance of the Rules of the Coastal Resources Commission, this Division has
developed a position that the CAMA permit should not be let until stornwater management
controls have been approved by the Division of Environmental Management. We have agreed,
however, to cover the need for a sedimentation and erosion control plan by the Division of Land
Quality under a note on any permit issued. Under Rules of the CRC, it is necessary to place
application processing in abeyance until the above matters are resolved.
In addition, I would be remiss not to indicate that it is my understanding that the
perparation of an environmental document may be necessary. Department staff are reviewing
this matter at this time. A final position should be available in a matter of days and the City
would be so notified.

This is a follow-up to Your phone conversation with Mike Ortosky of the Partnership for
the Sounds Design Team on July 31, 1995 and a project summary for the N. C. Estuarium.
The Partnership for the Sounds is a non-profit organization which has undertaken the
development of four environmental education centers and regional master plan within the
Albemarle -Pamlico Peninsula. The first of these centers will be known as the North
Carolina Estuarium and will be located on the waterfront in Washington, N. C.. State
monevs have been appropriated as partial funding for this efPott and a CAMA major
permit will be required for the project.
The design process for the proposed project has been underway for some time and site
plans, appropriate for the LAMA permit application submittal, have recently been
developed, and the permit application has been made. In early discussions with CAMA
representatives concerning the CAMA permit application and compliance with NCEPA, it
was suggested that the multi -agency comment period for the CAMA review might serve
to develop scoping comments relative to compliance with NCEPA. We understand that
these are two separate processes but feel that this may be an efficient way to address
specific concerns as voiced by various agencies during the review. We will cooperate with
CA -MA and your office to appropriately address any concerns and ensure compliance with
the N. C. Environmental Policv Act.

8. PROJECT SUMMARY: The applicant is proposing to develop the North Carolina Estuarium which
involves the construction of a bulkhead, boardwalk and dock.

Environmental setting
The City of Washington is the owner of a 1.1 acre tract of land on which, in conjunction
with the Partnership for the Sounds, the North Carolina Estuarium is being constructed. The
site is located within the historic district of the City of Washington, on Water Street, adjacent
to the Pamlico River in Beaufort County. The site until recent years was used as a boat repair
facility. Located on the site is a frame building, a concrete boat ramp and two piers which were
utilized by a travel lift. The ramp and piers appear to be located within a manmade basin.
Also, various pilings are located near the piers and the shoreline is bulkheaded. The facility is
served by the city's municipal sewage and water systems. The upland property is developed
with gravel parking areas, and also areas of vegetated lawn grasses are present. No wetland
vegetation is present.
Project proposal
The applicant is proposing the following:
(1) The construction of a 15,000 sq. ft. building to serve as the Public Estuarium for
visitors.
(2) The construction of 200' of bulkhead which will average 2' waterward of the
existing bulkhead, except in the vicinity of the 30' wide boat ramp, where the
bulkhead will average 55' beyond the NWL.
(3) Starting at the west property line, the construction of a 135' long by 10' wide
boardwalk on highground approximately 15' landward of and parallel to the
proposed bulkhead. The boardwalk will turn in a southern direction with a 65'
long by 8' wide section which will terminate with a 25' long by 18' wide
platform at the bulkhead. (See plat L-2 for details.)
(4) The construction of a 15' long by 4' wide floating dock adjacent to the bulkhead.
This platform will be used as a canoe launching area. (See plat L -2 for details.)
(5) The extension of the two existing piers in a landward direction for a distance of
181. These extensions will be 7' wide and will connect to the proposed
boardwalk.

Environmental impacts
The project as proposed should have the following environmental impacts:
(1) Approximately 1,990 sq. ft. of open water area will be filled landward of the
proposed bulkhead. Approximately 1,650 sq. ft. of this area will be in the
vicinity of the boat ramp. This area is within a manmade cut and not adjacent
to a natural shoreline.
(2) Some short term turbidity will exist during project construction.

successors and assigns shall be, -deemed beneficiaries of the covenants provi-
ded in Section 1-A and 1-C(1) hereof, and the United States shall be deemed,
a beneficiary of the covenant provided in Section 1-C(1) hereof, both for and
their'br its own right and afso for the purposes of protecting the interests of
the community and other parties, public or private, in whose favor or for
whose benefit such covenant have been provided. Such covenant shall run in
favor of the Agency and the United'States, for the entire period during which
such covenants shall be in force and effect, without regard to whether the
Agency or the United States'has at any time been, remains, or is an owner of
any land or interest therein to or in favor of which such covenants relate.
The Agency shall have the'right, in the event of any breach of any such cove-
nants, and the United States shall have the right in the event of any breach of
the covenant provided in Section 1-C(1) hereof, to exercise all the rights and
remedies, and to maintain any actions or suits at law or in equity or other
proper proceedings to enforce the curing of such breach of covenant, to which
it or any other beneficiaries of such covenants may be entitled.
TO HAVE AND TO HOLD the said premises unto the purchaser
together with all singular the rights, members and appurtenances thereof to
the same in any manner, belonging or appertaining to the only proper use,
behoof of the Purchaser forever, in FEE SIMPLE.
And the Local Public Agency will warrant and defend forever
the right and title thereof in the Purchaser against the claims of all persons
whomsoever.
