This permit, issued on March 4.2014 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Dockin¢ Facility
i) Unless specifically altered herein, this permit authorizes only the additional dock and uses located in
or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over public trust waters without permit modification.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

waters at or adjacent to the authorized work.
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) This permit authorizes two formalized boat slips at the authorized facility.
Boat Ramp
6) Unless specifically altered herein, this permit authorizes the construction of the new boat ramp as
indicated on the attached workplan drawings.
7) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
Excavation
8) Unless specifically altered herein, the dimensions of the area to be excavated shall not exceed the area
that is expressly and specifically set forth in the attached permit application and workplan drawings.
9) Excavation shall not exceed -4.0 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
10) The temporary, placement or double handling of excavated materials within waters or vegetated wetlands
is not authorized.
Svoil Disposal
11) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
12) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.

Shoreline Stabilization
13) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall
and deadmen cables, etc.
16) All backfill material shall be clean and free of any pollutants except in trace quantities.
17) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
18) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
19) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
General
20) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
22) The permittee and/or contractor shall meet on site with a represensatiDivision prior to project
initiation.

approvals or authorizations that may be required.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many development or
land disturbing activities are not allowed within the Environmental Management Commission's
Tar Pamlico. Contact a representative of the Division of Water Resources at (252) 946-6481 for
more information concerning allowable uses within the Tar Pamlico Buffer.
The N.C. Division of Water Resources has authorized the proposed project under Project No. 14- -
0023.
The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2014-00026.

irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.

waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all,project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit

From time to time, Department personnel will visit the project site. To facilitate this review, we request that you

The t0.4 acre project site is a partially developed parcel located off SR 1712 at 197 Gum
Neck Road in the Community of Leechville adjacent a man made canal and the Pungo River near
Belhaven in Beaufort County, North Carolina. The parcel is a long (382') narrow (t50') tract
bordered to the north by the man made canal and to the south by Jordan lane. The project site is
situated near the confluence of the man made canal and the Pungo River in a residential
community. The opening of the canal to the Pungo River is ±40' wide. The canal narrows as
you travel upstream of the project site and varies in width from 12' to t25' wide. The project
site canal shoreline is stabilized with a wooden bulkhead for a distance of 32' from the eastern
(Younger) property upstream with the remaining (majority) shoreline as a cut bank. The canal
width in this area of existing bulkhead constricts to 18' for a short distance (5'). There is a 16' x
24' boathouse in an existing basin on the southern canal bank adjacent to the project site on the
east side. There is a ±20' x 45' boat basin directly across (North) the canal from the project site.
The Younger property was recently the subject of Major CAMA/Dredge and Fill Permit No. 25-
13 issued on 21 February 2013 for the partial filling of the aforementioned boat basin. Although
there is the potential for mooring facilities upstream of the project site, currently there is none
other than some temporary "side to" mooring to existing bulkheads.
The property is mostly uplands vegetated with maintained lawn grasses, mainly
centipede. There is an area of Coastal Wetlands adjacent to and upstream of the project site, on
the same parcel, vegetated mainly with giant cordgrass S artina cynosuroidesl but also includes
some Phra igm'ties W. There are some hardwood trees on the upstream of the side of the Coastal
Wetland. The uplands are 2.5' to 3' in elevation above the normal water level (NWL).
The canal has a water depth of 3.5' to 4.0' at the confluence with the Pungo River and
shallows up from 3' to 1.5' in the center as the canal transitions upstream. Due to the lack of
boating use, the canal shallows to 1' near the cut bank. The Pungo River and canal are
designated as SB NSW by the Environmental Management Commission and Coastal Waters by
the Marine Fisheries Commission and this area is closed to shellfishing.
Project Description
The primary applicant (Sawyer) proposes to improve small boat (boats less than 20')
access by undertaking maintenance excavation in the canal, widening the canal by 5' and
constructing a 12'wide x 20'long boat ramp. The widening of the canal will result in a new
canal width of +30'adjacent to the project area. The applicant proposes to excavate a 12' x 18'
cut in this widened area to support the construction of the 12' x 20' boat ramp. The applicant
also proposes to construct a 6' wide dock landward of the existing bulkhead contouring the
shoreline up the widen cut to the landward edge of the boat ramp and up the other side of the
ramp contouring the new cut. A total of 94' of dock will be constructed. The applicant proposes
to replace the existing 32' of bulkhead and construct a new bulkhead around the new cut. The
co -applicant (Charles Younger) to the east is also proposing to excavate in his existing boat basin
(with the 16' x 24' boathouse) to a final depth of minus 5' below the NWL. The spoil material

will be placed on uplands adjacent the new bulkhead and if necessary placed across Jordan Lane
on a separate 3.0 acre upland parcel owned by Sawyer.
Anticipated Impacts
The maintenance excavation activities will disturb 2,940 ft' of canal bottom. The
excavation of the existing Younger boat basin to minus 5' below NWL will impede basin
flushing due to shallower (minus 4') surrounding connecting water depths. The proposed dock
will shade 564 ft2 of uplands. The canal widening will convert 230 ftz of uplands to open water.
The resultant spoil from the excavation activities will fill and grade t 15,000 ft' of uplands. The
project will increase small boat traffic in the area and their associated impacts.

Community of Leechville, Beaufort County, North Carolina.
LUP Consistency Determination: The proposal is Consistent With & Not in Conflict with the
1997 Beaufort County Land Use Plan certified by the CRC on January 13, 2010.
Overview:
The Areas of Environmental Concern (AECs) impacted by the proposal include Coastal Shoreline,
Public Trust Area, and Estuarine Waters. The waters are classified as SB NSW, are closed to the
harvesting of shellfish, and are not classified as primary nursery area.
Development within the designated AECs is limited by CAMA regulations and development
guidelines. Applicable or related policy includes the following:
"Local governments in the planning area consider boating access to be an important
component of the economy and water access system. However, they recognize the need
for land use and development guidelines to prevent negative impacts on the area's
natural resources and land areas. Marinas and other docking facilities are allowed,
provided guidelines contained in 2.0 Policies on Development and Use of Natural
Resources are met. " (Policies for Public Access, P. 1.6, pg. III-9)
"Only development and land/water use activities that are consistent with the use
standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC
07H.0208) are allowed in this classification... " (Policies for Land Use Compatibility —
Conservation I, Policy 2.1.3, pg. III-12)

SUBJECT: CAMA Dredge/Fill Permit Application for Tom Sawyer and Charles Younger,
Beaufort County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located off SR
1712 Gum Neck Road adjacent a manmade canal off the Pungo River. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicants propose to improve small boat access by undertaking maintenance excavation of a
manmade canal to a final depth of -5' NWL, construct a dock, and replace and construct a new bulkhead
and a 12' by 20' boat ramp. Connecting water depths of the canal are -4' NWL. The Environmental
Management Commission has classified the project waters as SB NSW.
The NCWRC has reviewed the permit application and does not believe the project would have
significant impacts to aquatic resources if the final water depth is lessened from -5' NWL to the
connecting water depth of -4' NWL. The deeper -5' depth would impede water flushing and is
inconsistent with NC Division of Coastal Management rule. Adjusting the project proposal would
alleviate our concerns.

The applicant is proposing to widen a man-made canal by 5', construct a 12' wide x 20' long boat ramp, construct a 6' x
94' long wide dock landward of the existing bulkhead and replace 32' of existing bulkhead in a manmade canal. The
applicant also proposes to excavate in an existing boat basin to -5' NWL while existing water depths in the Pungo River
are -3.5' to-4.0'NWL.
There are concerns regarding the impacts to water quality due to the proposed excavation to-5'NWL. The proposed
depths are deeper than the connecting water depths potentially degrading water quality. Degradation of water quality can
have adverse impacts to fishes. To avoid these impacts the applicant's dredging should not exceed the connecting water
depths.

Application
Attached is a Major CAMA permit application submitted for development of small boat
access to a man made canal off the Pungo River located off SR 1712 at 197 Gum Neck Road in
the community of Leechville in Beaufort County near Belhaven, North Carolina. The
development activities proposed in this application package include maintenance excavation,
widening of a man made canal, bulkhead, dock and boat ramp construction. Each proposed
activity could have been authorized through the CAMA/Dredge and Fill General permit process,
however, when the total cost for each GP was realized the applicant chose to pursue
authorization through the Major CAMA permit process at a savings of $800. Staff has reviewed
the project proposal per the development standards as found in 7H.0206 Estuarine Waters, .0207
and .0208 Public Trust Area, and 7H.0209 Coastal Shorelines and have found the project to be
consistent with the exception of the excavation activities proposed by Mr. Charles Younger. Mr.
Charles Younger was included in the application package at the end of pre -application guidance
and is requesting to undertake excavation in an existing 30' x 50' man made basin to a final
depth of minus 5' below the normal water level (NWL). This is 1' to 1.5' deeper than the
connecting water depth. Therefore Staff recommends that all excavation authorized by the
permit be conditioned to a maximum of minus 4' below the NWL. Also there is an existing
"pinch point" where the canal narrows to 18' in width for a short distance (5') before widening
out. Mr. Sawyer is proposing a 6' wide dock landward of the existing bulkhead in this location.
A boat tied to the bulkhead in this location could inhibit but not necessarily block navigation. I
am available to discuss this issue with you (252) 402-4015 (cell). Otherwise Staff recommends
issuance of the permit with the standard conditions for maintenance excavation, bulkhead, boat
ramp and dock construction.

The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of your property located off SR 1712, Gum Neck
Road, adjacent a man made canal off the Pungo River in' the community of Leechville near
Belhaven in Beaufort County, North Carolina. It was received on 20 December 2013, and
appears to be adequate for processing at this time. The projected deadline for making a decision
is 6 March 2014. An additional 75-"y review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the 20 December
2013, you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a 'Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

Dear Mr. Trowell
Enclosed is a Major CAMA/Dredge and Fill permit application for maintenance
excavation of a man made canal, enlargement of an existing boat basin, construction of a new
bulkhead and boat ramp and construction of a boat dock on my property located off SR 1712,
Gum Neck road, adjacent a man made canal off the Pungo River in the community of Leechville,
near Belhaven in Beaufort County, North Carolina. The purpose of the proposed improvements
is to provide small boat (20' or less) launching and dockage for my personal use. I could have
obtained a CAMA/Dredge and Fill General Permit for the aforementioned activities, but the
application fees would have been triple ($1,200.00) the cost of the Major application fee.
I am also acting as agent for my neighbor, Mr. Charles Younger, to authorize under this
permit, maintenance excavation of an adjoining existing boat basin to a final depth of minus 5'

assigns, that said GRANTORS are seized of the above described
