5. ADDITIONAL INFORMATION
In addition to the completed application form, the
following items must be submitted:
• A copy or the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule ?1.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy or the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.
6. CERTIFICATION AND PERMISSION

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office pf
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.

8. PROJECT SUMMARY: The applicant proposes to construct a public boatramp with docks on both
sides and create a parking area on the property.

Davenport Boat Ramp
Project setting
The project site is located adjacent SR 1142 on the Scuppemong River near Creswell, North
Carolina. The property is bordered on the upstream (west) side by SR 1142 and the bridge crossing
Scuppernong River. The downstream (east) side is bordered by a large expanse of wooded wetlands
vegetated with red maple, gum and cypress as well as various other wetland species. The property
measures f360' along the shoreline and is the site of an old trash dump. The site has been cleaned
up and is primarily vegetated with upland grasses. Other vegetation on the site includes broom
sedge, mimosa, china berry, sycamore, red maple, black willow and green ash. An area of
submerged aquatic vegetation exists along the shoreline in the center portion of the property and
contains water lily and duckweed. A chain link fence runs parallel to the state road on the site and
a deteriorated shed is present inside this fence. The project site is approximately T above the normal
water level.
Scuppernong River is classified as C-sw by the Environmental Management Commission.
Scuppemong River at the project site is inland water and is not open to shell fishing. This section
of the river has been channelized in previous years.
Project description
The applicant proposes to construct a 14' wide by 30' long public boat ramp by cutting back
into the existing bank to establish the desired grade. Approximately 10' of the proposed ramp will
project waterward of the existing shoreline. Adjacent to the downstream side of the proposed ramp
a 5' 6" wide by 16' long dock will be constructed. A 5' 6" wide by 16' long dock with a 5' 6" wide
by 16' L-head is proposed adjacent the boat ramp on the upstream side. The applicant proposes to
create an f 1,000 ft2 gravel entrance and turn around area on the upland portion of the site adjacent
the boat ramp. A handicap parking place with a concrete sidewalk access to the downstream dock
is also proposed. Parking is proposed on the remaining grassed portion at the northern side of the
site.
Anticipated impacts
The project as proposed will result in the excavation of f1,500 ft2 of river bottom and
adjacent bank to below the normal water level. The placement of the proposed ramp will result in
the filling of±560 ft2 of river bottom. The project as proposed will result in localized turbidity as
a result of the construction activities. The construction of the entrance and parking area will result
in the filling and/or disturbing of f 10,180 ft2 of high ground.

The applicant proposes to construct a boat ramp into the Scuppernong River and construct
docks on both sides of the ramp. A parking area with a handicapped space is proposed. The facility
will be public and is proposed to be turned over to the WRC after completion. The project appears
to be consistent with the rules found in Subchapter 7H concerning development in Public Trust
Areas. If the project is permitted, I recommend that in addition to the standard conditions, the
following conditions be added to the permit;
• 1. No vegetated wetlands will be excavated or filled.
2. No fill material will be placed at any time in any wetland or surrounding waters outside of
r the alignment of the fill area indicated on the work plat(s).

This proposal includes construction of a new public boat ramp with docks and parking at the
above location, locally known as Spruill's Bridge. It involves Public Trust Areas, Estuarine
Waters and Estuarine Shoreline AECs. The proposal comes under the auspices of the July 1994
CRC certified Washington County Land Use Plan update.
The plan offers the following limited guidance on proposals of this type:
County policy on AECs (page VIII-6) is to support development within AECs only if it
meets the standards of 7H.
County policy (page VIII-14) also supports, and encourages the county's commercial and
recreational fishing and other water based activities.
The county also supports additional river and other public trust access sites (page VIII-
19).
• By definition (page IX-9) all AECs are included in the Conservation land classes and uses
therein are governed by AECs use and performance standards. The non -water portion
of the proposal is included in the Rural land class. This class provides for low density
land uses not necessarily urban type services.
My opinion is if this proposal can be accomplished in accordance with applicable AEC
standards, it would not be inconsistent with the 1994 Washington County Land Use Plan update.

The following comments by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Scuppernong River functions as spawning and nursery areas for blueback herring and
alewife. The area also functions as a nursery area for white perch, yellow perch, catfishes and
other commercially and recreationally important species.
The Division approves of this project with the following modifications. A dredging
moratorium is requested associated with the proposed excavation of t 1500 square feet. The
requested time frame is 15 February through 30 September. This will ensure the environmental dwwllll�
integrity of the area is protected during the critical times of usage by the previously mentioned
species.

State Road 1142, adjacent the Scuppernong River, near Creswell, Washington

enclosed) that authorizes the maintenance, repair, and construction of boat
ramp facilities in navigable waters and waters of the United States in North
Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,

a decision iy96. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will
also serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day. Should there be any questions on this
procedural change, do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at
the location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result
in an incomplete application.
