Project Deletion
1) Due to the extensive coverage of the Sound area immediately adjacent the project with submerged
aquatic vegetation (SAV), primarily eelgrass and shoalgrass, and due to the sensitivity of the SAV
to impacts by boat traffic; and due to the shallowness of the sound in this area, the boat ramp, launch
pier and boat slips are hereby deleted from the project.

line (MHW).

4) Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or
burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas,
until such time as the area has been properly stabilized with a vegetated cover.
5) The Division of Environmental Management approved a Low Density Subdivision Stormwater
Permit for this project on October 28, 1996. Any violation of Permit No. SW8960813 will be
considered a violation of this CAMA permit.
6) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
7) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The pemuttee is not relieved of this requirement if he abandons
the project without having the permit transferred to a third party.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance *of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Dear Mr. Singleton:
Reference your application for a Department of the Army permit to
construct a community boatramp with dock and access pier with ten (10)
boatslips on Bogue Sound, Waters Edge Campground, Carteret County, North
Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal

DATE: April 12, 1996
I have reviewed the proposed project and find no inconsistencies
with the 7H Use Standards. I support issuance of the necessary
LAMA only permit that will authorize construction of an elevated
wooden boat ramp, a loading dock, a bridge/pier, and an access pier
with 10 boat slips.
Nevertheless, consideration can be given to minimizing the
shadowing effects on coastal wetlands and the overall occupation of
the public trust value on the estuarine surface waters of Bogue
Sound: 1) The combined width of the boat ramp and loading dock
can be reduced from 19 feet to 13 feet without lose of function.
2) the overall length of the access pier as measured from the
marsh edge can be reduced from 310 feet to 200 feet without lose of
functional water depths at -5 inches MLW.
The shallow water depths in this section of Bogue Sound coupled
with the extensive coverage of Submerged Aquatic Vegetation
suggests that a definitive condition should be made a part of the
final permit that clearly states "no future excavation will be
' authorized".
The following standard conditions are provided for your
consideration:
#1 All proposed development and associated construction must be
done in accordance with the permitted workplat drawing(s) as
originally submitted, or as revised on march 18, 1996.
#2 All construction must conform to the North Carolina Building
Code requirements and all other Local, State and Federal

Thomas M. Singleton, d/b/a Waters Edge Campground, proposes to

boat slips at Waters Edge Campground, located about 4.5 miles west
of Morehead City at 1891 Hwy 24 on Bogue Sound, Carteret County.
AECs impacted by the work include the Estuarine Shoreline, Coastal
Wetlands, and Estuarine Waters. The waters of Bogue Sound at the
site are classified as SA and are closed to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this project for consistency with the 1991 Carteret
County Land Use Plan (LUP) Update, as amended September 24, 1993,
and offer the following comments.
The general area of the project is classified as Limited
Transition, while the AECs impacted by the proposed work are
classified as Conservation.
The Carteret County LUP discusses allowed uses in Conservation
classified areas in the Resource Protection and Resource Production
and Management Policy sections.
Applicable policies include those for Marine Resource Areas (Page
IV-11). Carteret County supports the 7H Use Standards for Estuarine
Waters, with a few exceptions, none of which appear to be
applicable to this project.
Marina and Floating Home Development policies are included on Pages
IV-6 and IV-7 of the Plan. These policies also address construction
of docks and piers, but do not appear to preclude Mr. Singleton's
proposal.
Policies for Residential, Commercial, and Industrial Development
Impacts on Resources are discussed on Pages IV-10 and IV-11. These
policies specify that only commercial and industrial uses which are
water dependent and which cannot function elsewhere or are
supportive of commercial fishing will be allowed in estuarine
shoreline areas. Development such as the roadways associated with
the water dependent boat ramp, docks and piers seem to be
consistent with the intent of the Plan regarding commercial
development in estuarine shoreline areas. The Plan reiterates that
where zoning exists, all uses must be consistent with established
'Zoning. (While Carteret County zoning does not allow commercial M
campgrounds at the Waters Edge site, the Carteret County Planning °x
Department has confirmed that this campground was approved before F�
the area was zoned, and as such, is "grandfathered" and can
continue to operate as a campground.) -----------
The Coastal Wetlands Conservation classification is discussed on
Pages V-2 and V-3 of the amended Plan. While Carteret County does
place some restrictions on development which affects coastal
wetlands, this discussion notes that except as prohibited in the
policy section of the Plan, development which is consistent with
the 7H Use Standards will be allowed in Coastal Wetlands. I can
find no policy regarding coastal wetlands in the amended Plan which
would appear to prohibit this project, provided the 7H requirements
can be satisfied.
Based on the above policies, this project appears to be consistent
with the amended 1991 Carteret County Lan se an, provide all
state and local requirements can be met.

The North Carolina Division of Marine Fisheries (NCDMF) has reviewed the
application for work proposed by Water's Edge Campground/Thomas M. Singleton,
reviewed the Field Investigation Report compiled by CAMA, and conducted a site
visit. The following comments by the NCDMF are provided pursuant to General
Statute 113-131.
This agency erects to this project because of the direct and indirect
impact and subsequent degradation of submerged aquatic vegetation (SAV) in the
project area. The presence of shoalgrass, Halodule wrightii, and eelgrass,
Zostera marina, on the project site is extensive with moderate to high densities.
Degradation of the ecological role of this SAV will occur as a result of the
planned uses.
The impact of the boat slips will eventually destroy a minimum of 2500 sq.
ft. of SAV through a combination of shading by the platform and finger piers,

increased turbidity due to concentrated boat activity, and direct damage from
boat skegs and propellers. The vessel activity will cause suspension and
deposition of bottom sediments throughout the immediate area and on the periphery
of the boat slips. Indirect and direct destruction of portions of this extensive
SAV habitat will occur. The cumulative impacts of the smothering of seagrass
beds with displaced sediment, increased turbidity from suspended sediments
reducing light penetration resulting in diminished growth of SAV, and the
sunburning of leaves because of increased bottom elevation from sediment
deposition and subsequent exposure of grasses to excessive direct sunlight, will
together reduce the productivity and water quality of this area.
The ramp/dock will destroy SAV by direct coverage at its waterward
terminus. The SAV waterward of the terminal end of the ramp will be destroyed
through the launching and loading of boats, as a well as damage to SAV between
a channel access to the west of the ramp and damage to SAV between the ramp and
proposed dock.
Through shading, the ramp/dock and access pier will degrade the 665 sq. ft.
of saltmeadow cordgrass, Spartina patens, and smooth cordgrass, Spartina
alterniflora, mix of coastal wetland vegetation. The eventual result will be
increased shore turbidity and subsequent SAV losses.
Areas of SAV are extremely productive areas. They function as habitat for
many species of juvenile finfish and crustaceans, such as the blue crab,
Callinectes sapidus; spot, Leiostomus xanthurus; pink shrimp, Penaeus duorarum;
and pigfish, Orthopristis chrysoptera, which are important to commercial and
recreational fisheries. The existence of some species, like the bay scallop,
Argopecten irradians is entirely dependent upon this habitat.
This agency recommends denial of the project because of the unavoidable
degradation of SAV habitat and water quality standards. This recommendation is
based on the direct losses of SAV from dock and ramp coverage and subsequent
losses of SAV by skeg and propeller damage through utilization of the dock/ramp
and pier slips. The SAV losses from direct and indirect impacts from
construction and use of this project are due to the extremely shallow water in
the area. We do not oppose simple access via the dock, but the ramp and 10-slip
facility will cause significant degradation of the area.

Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regards to associated impacts on wildlife and fishery resources in the area. A site
visit was conducted on April 17, 1996. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et.
seq.) and the Coastal Area Management Act (G. S. 113A-100 through 113A-128).
The applicant proposes to construct a 120 ft. x 6 ft. elevated walkway, a 85 ft. x 15 ft.
elevated wooden boat ramp, and a 400 ft. x 6 ft. pier/boat dock. The pier/boat dock includes a 50
ft. by 10 ft. platform and a series of 4 finger piers and 4 mooring pilings that will provide 10
designated boat slips. Each slip measures 20 ft. long by 10 ft. wide. The boat ramp will be
elevated 2.5 ft. over the 45 ft. wide marsh. Waters at the project site are classified as SA but are
closed to shellfishing.
Between the applicants' shoreline and the Atlantic Intracoastal Waterway there is 1,000 ft.
of shoal and sandbars. The proposed pier and 10 boat slips will be located on this shoal. Water
depths at the proposed project range from 4 to 6 inches at mean low tide. Without dredging the
proposed boat slips and an access channel through the shoal, the dock will be inaccessible. The
Morehead City DCM office has reported thick beds of submerged aquatic vegetation (SAV),
predominately eel grass, immediately adjacent to the proposed boat slips. We recommend the pier
and boat slips be deleted from this project.
To minimize the loss of marsh due to shading we recommend the boat ramp be elevated at
least 3 ft. above the ground and that spacing be left between the planking boards to allow light
penetration beneath the structure. The width of the ramp should also be reduced to 12 ft.

Dear Mr. Parker:
Reference the application of Waters Edge Campground, represented by
Mr. Thomas M. Singleton for a Department of the Army (DA) permit to construct
a community boatramp with dock and access pier with ten (10) boatslips on
Bogue Sound, Waters Edge Campground, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be done in strict compliance
with the permit plans.
b. This permit does not authorize the interference with any existing or
proposed Federal project. The permittee will not be entitled to compensation
for damage or injury to the authorized structure or work that may be caused
from existing or future operations undertaken by the United States in the
public interest.
c. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or next to the authorized work.
Use of the permitted activity must not interfere with the publics right to
free navigation on all navigable waters of the United States.
d. The permittee must install and maintain, at his expense, any signal
lights and signals prescribed by the U.S. Coast Guard, through regulations or
otherwise, on authorized facilities.
e. The permittee will maintain the authorized work in good condition and
in concordance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
f. This permit does not grant any property rights or exclusive
privileges.
g. Approval of the structure was based on determination that there would
be no obstruction to navigation. Under conditions existing in the Atlantic
Intracoastal Waterway (AIWW), a possibility exists that the structure may
damaged by wave wash from passing vessels. Unreasonable slowing of vesse
traffic cannot be required because it would nullify the navigational ben s RECEIVED

construed as relieving the permittee of taking proper steps to insure the
structure and moored boats will not be damaged by wave wash normally to be
expected in the AIWW.

Dear Mr. Singleton:
This letter is in reference to your application for a Coastal Area Management Act
(CAMA) Permit to develop a campground with water access on Bogue Sound. Review by state
and Federal agencies is essentially complete and action was scheduled to take place within the
next several days. However, this office learned this week that the required stormwater
management plan had never been filed with the Division of Environmental Management (DEM).
Under Rules of the Coastal Resources Commission and long standing policy, this
Division stops permit processing when a key review agency needs additional information from
the applicant to complete the review; or when such agency has related statutory requirements
affecting the project. Because of the findings by DEM, application processing is in abeyance
until information is submitted to that agency. This letter supercedes the extension letter of May
30.
Should there be any question on this matter, do not hesitate to contact me or Charles
Jones in Morehead City.

Dear Mr. Jones:
While working on the CAMA Application very closely with Mr.
Jim Mercer, it was Mr. Mercer's thoughts that the high water
mark (H.W.M.) actually came up in the project as shown on
the CAMA Drawing currently being reviewed by your agency.
At the time .I realized that the H.W.M. would be a worst case
scenario and therefore left it as was.
Recently we have been made aware of a violation at the
Campground by a letter from your office to Mr. Tom
Singleton. Mr. Singleton has since asked as how we
determined the H.W.H. Our response was visual inspection
and Mr. Mercer's observations as indicated on the original
CAMA Drawing by +/- H.W.M.
Enclosed is a copy of the Revised CAMA drawing with the
actual high water mark shown based on a 1.4' elevation as
established by North Carolina Geodetic Survey.
We hope this clears up the violation and more clearly
represents actual field conditions.- If we need to provide
you with more copies please let us know.

8. PROJECT SUMMARY: The applicant proposes to construct a community boat ramp
with dock and an access pier with 10 boat slips in Bogue Sound at Waters Edge
Campground.
9. NARRATIVE DESCRIPTION: The project site is located about 4.5 miles west of
Morehead City at 1891 Highway 24 on Bogue Sound in Waters Edge Campground,
Carteret County. Barnsfield, a single family subdivision is adjacent to the east
property line and the Vernon Taylor Subdivision is adjacent to the west sideline. The
campground, now close to completion, has been under construction for the past 2 years
in areas landward of the CAMA Estuarine Shoreline Area of Environmental Concern.
The new 1995 color, aerial photography referenced on the front page of this report
shows clearly the project site and its surrounding. The site is zoned by the county as
MC which allows for development of mobile homes and campgrounds. Drinking water
is supplied to the property by the West Carteret Water Company. Mr. Thomas M.
Singleton, the owner of the 15 acre property, proposes to develop a water access
facility for the patrons of the 109 unite campground. On the west side of the property,
construction will involve a rock covered driveway and turn -around area leading to an
elevated, wooden, boat ramp and loading dock. The boat ramp will measure 85 feet
long by 15 feet wide. It will cross a fringe of saltmarsh cordgrass about 45 feet wide
before it slopes into the waters of Bogue Sound. The loading dock will be located on
the east side of the ramp and will measure 120 feet long by 4 feet wide. A pedestrian
bridge and access pier to Bogue Sound will be constructed near the center of the 194
foot waterfront property. The 6 foot wide bridge/pier will measure 120 feet long as it
spans an 80 foot wide pocket marsh and tidal gut. The 6 foot wide access pier will
measure a total of 400 feet long as it extends some 72 feet over a fringe of saltmarsh
cordgrass. From the edge of the marsh, the pier measures 310 feet long. This figure
includes a 50 ft. by 10 ft. platform and a series of 4 finger piers and 4 mooring pilings
that will provide 10 designated boat slips. Each boat slip measures about 20 feet long
by 10 feet wide. The boat basin at 50 feet long by 50 wide is determined by the extent
of the platform and the finger piers. The water depths in this section of Bogue Sound
are shallow at mean low tide and range from -0.3 ft. (4 inches) to -0.5 ft. (6 inches) in
and around the project area. The inshore of the designated boat basin the firm sandy
bottom of the sound is thickly covered with submerged aquatic vegetation, dominated
by eel grass, Zostera marina. As illustrated on the workplat drawing, the terminal end
of the proposed pier will be about 700 feet from the leading edge of the AIWW.
10. ANTICIPATED IMPACTS: The 3 individual piers, 4 to 6 feet wide will traverse
approximately 1,145 sq. ft. of coastal wetlands, dominated by saltmarsh cordgrass.
The 15 foot wide elevated, wooded, boat ramp will shadow another 675 square feet of
marsh. The proposed piers and boat ramp will occupy approximately 4,290 square feet
over the estuarine waters of Bogue Sound. The SA surface waters are permanently

closed to the harvesting of shellfish. The lack of deep water (-6 inches) at mean low
tide should preclude large boats from using either the boat ramp or the access pier.
The proposed rock covered driveway and turn -around will create about 8,530 square
feet of impervious surfaces on the highground property. Within the CAMA Estuarine
Shoreline AEC, approximately 6,135 square feet roadway will cover about 23 percent
of the AEC.

We are writing in regard to an application by Thomas M. Singleton to further develop the Water's
Edge Campground located on Bogue Sound in Carteret County. In addition to the non -point pollution
problems inherent in the crowded campground proposed, the project is anticipated to affect 13,965
square feet of waterfront. We presently have some of the last undisturbed marsh here, but jet -skis
and associated watercraft would undoubtedly take a toll on this critical habitat bordering our SA
waters.
The proposed dock and marina would also dramatically after the solitude of our quiet residential
neighborhood. We saw it happen at Cedar Point: once such projects are approved, they lead to more
insidious "development' and undermine the health of the coastal waters we all want to enjoy.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7.1.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

Dear Mr. Singleton:
On April 8, 1996, the Wilmington Regional Office sent you a certified letter requesting a
Stormwater Management Permit Application for your project, Waters Edge Campground, located off
Highway 24, near Hall Road, south of Morehead City in Carteret County, North Carolina. The letter was
signed for by Ms. Debra F. Willis on April 9, 1996. A Stormwater Management Permit application or
information regarding the expected submittal date for the project was required to be received in this Office
by May 8, 1996. No response has been received to date. This Office is considering enforcement action be
taken against you for failing to apply for and receive the required Stomwater Management Permit.
The project is in violation of 15A NCAC 2H.1000 which states that any site which requires either
a Sedimentation Erosion Control permit or a CAMA Major permit must also obtain a Stormwater
Management Permit. It is also in violation of NCGS 143-215.1 (a)(1), which requires a permit for any
activity that makes an outlet into waters of the State. Any timely response you make to this Notice will
be forwarded with the enforcement package to the Director for his consideration.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation and a time frame for completion of those actions, on or before June 15, 1996. The
"Plan of Action" must include the expected date of application for a Stormwater
Management Permit.

Failure to provide the "Plan of Action" by June 15, 1996, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in
the initiation of additional enforcement action which may include recommendations for the assessment of
civil and criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Carteret County Building Inspector, this Office is requesting that
the Building Inspector consider withholding building permits and Certificates of Occupancy for this
project until this matter is satisfactorily resolved.

In my report dated March 25, 1996, I made the statement under the
Anticipated Impacts section that indicated the surface waters in
and around the project site are permanently closed to the
harvesting of shellfish. My use of the word "permanently" was a
poor chose. With regards to shellfishing, the 612 acres of SA
waters around the project site are "closed". The point is, from
time to time, the designated area on the enclosed map is opened to
shellfishing. This usually occurs during periods low rain fall and
low coliform counts. Please distribute my disclaimer to the
appropriate agencies, if you think they may have a problem with the
field investigation report. Thanks.

Dear Mr. Singleton:
The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located @ 1891 Hwy. 24, Newport, off Bogue Sound, in
Carteret County. It was received on March 15, 1996, and appears to be adequate for processing at this
time. The projected deadline for making a decision is May 30, 1996. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point
along the road right -of --way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me
in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
