Authorizing development in Pasquotank County adi. to the Little River at 211 Poplar Drive, in
Elizabeth City , as requested in the permittee's application dated 9/3/14 including the
attached workplan drawings (2) 1 dated 9/16/14 and 1 dated 9/30/14.
This permit, issued on November 25 2014 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) The authorized bulkhead and associated wingwalls shall adhere to the alignment depicted on the
attached workplan drawings.
2) The alignment of the authorized bulkhead shall be staked by the permittee and approved by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of any construction.
3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall
and deadmen cables, etc.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) All backfill material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
10) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
11) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation in order to discuss the conditions set forth in this permit.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management,
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No SAW-
2014-02155.
Bulkhead Replacement 211 Popldr-Driv,

Introduction:
The property is located in Little River Retreat Subdivision adjacent to property of James
Brinkley (South Side) and Tina Paul (North Side). The application proposes to replace the
existing bulkhead on this property. New bulkhead will extend out 14 ft. toward water from
existing bulkhead on north property boundary to connect with existing riprap structure on
property owned by Tina Paul. New bulked will terminate on south property boundary at existing
bulkhead adjacent to property owned by James Brinkley. The maximum distance water ward of
new bulkhead from the existing bulkhead is 20 ft. Wing walls will be installed at both ends of the
new bulkhead. The south wall will extend 12 feet inland from new bulkhead. The north wall will
extend 10 feet inland from the existing bulkhead. The new bulkhead will finish at 15" above the
existing bulkhead height.
Project Description:
Project consists of the following elements:
• Remove a portion of the existing pier
• Construct new bulkhead
• Backfill area behind new bulkhead
• Grade property to new bulkhead height
Existing Conditions:
The site currently has a pier, a covered boatlift, and set of steps attached. There is no submerged
aquatic vegetation along the shoreline of the property and no coastal wetland in front of the
bulkhead.
Methods of Construction:
New bulkhead will be constructed of vinyl material with wooden waler, backboard, and top cap.
Vinyl wall will be anchored to wooden deadmen using steel tiebacks. Area behind bulkhead will
be backfilled with sand obtained from local sand distributor.
Project Schedule:
Construction will begin as when CAMA permit is issued and County building permit is obtained.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 1I3A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty (20) days.
. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

8. PROJECT SUMMARY: Applicant proposes to install a new 87' vinyl bulkhead
located an average distance of 14' water ward of normal water level.
Project Setting
The site of the proposed development is located on the Little River, in Pasquotank
County, at 211 Poplar Drive, SR#1119 Elizabeth City.
The property is approximately 20,037 sq. ft. (0.46 acres) in size and is elevated
approximately 5' above. Normal Water Level (NWL). Existing manmade features on the
property consist of a single family dwelling with an attached garage and paved driveway, a
maintained yard vegetated with indigenous grasses, a small storage shed, existing
bulkhead, existing pier and platform, and an existing covered boatlift.
The adjacent riparian properties to the south and north are similarly developed lots
with single family dwellings with stabilized shorelines. The property to the north has existing
rip rap that extends approximately 14' out past the applicants existing bulkhead.
The Division of Environmental Management classifies the waters within the project
area,of the Little River as SC and these waters are closed to shellfish harvest. The average
depth of water where the development is being proposed is approximately 3' with muddy
sand substrate with no SAV present.
Development Proposal
The applicant proposes to construct a new 87' vinyl bulkhead to replace the existing
failing wooden bulkhead. The new bulkhead has an alignment extending out a maximum of
20' with an average of 14' water ward of the existing bulkhead. The new bulkhead
alignment will result in a straight structure that aligns with the riprap on the adjacent
property to the north and with the bulkhead on the adjacent property to the south. Wing

walls will be installed on both ends of the bulkhead. The wing wall on the south end of the
bulkhead will extend 12' inland. The wing wall on the north end of the bulkhead will extend
10' inland. The new bulkhead will have an elevation 15" above the existing bulkhead's
height. The applicant is proposing this new alignment in hopes that the new straight
bulkhead will be a more secure structure and will not catch as much debris along the
shoreline.
Anticipated impacts
1.The new bulkhead alignment will result in 1,218 sq. ft. of Public Trust and, Estuarine
Waters, Areas of Environmental Concern (AFC's) to be filled.
2. The new bulkhead will result in 1,740 sq. ft. of Estuarine Shoreline (AEC) to be filled and
graded.
3.158 cubic yards of fill will be placed below Normal Water Level (NWL).

Introduction:
The property is located in Little River Retreat Subdivision adjacent to property of James
Brinkley (South Side) and Tina Paul (North Side). The application proposes to replace the
existing bulkhead on this property. New bulkhead will extend out 14 ft. toward water from
existing bulkhead on north property boundary to connect with existing riprap structure on
property owned by Tina Paul. New bulked will terminate on south property boundary at existing
bulkhead adjacent to property owned by James Brinkley. The maximum distance water ward of
new bulkhead from the existing bulkhead is 20 ft. Wing walls will be installed at both ends of the
new bulkhead. The south wall will extend 12 feet inland from new bulkhead. The north wall will
extend 10 feet inland from the existing bulkhead. The new bulkhead will finish at 15" above the
existing bulkhead height.
Project Description:
Project consists of the following elements:
• Remove a portion of the existing pier
• Construct new bulkhead
• Backfill area behind new bulkhead
• Grade property to new bulkhead height
Existing Conditions:
The site currently has a pier, a covered boatlift, and set of steps attached. There is no submerged
aquatic vegetation along the shoreline of the property and no coastal wetland in front of the
bulkhead.
Methods of Construction:
New bulkhead will be constructed of vinyl material with wooden waler, backboard, and top cap.
Vinyl wall will be anchored to wooden deadmen using steel tiebacks.. Area behind bulkhead will
be backfilled with sand obtained from local sand distributor.
Project Schedule:
Construction will begin as when CAMA permit is issued and County building permit is obtained.

Consistency Determination: The request is consistent with/not in conflict with the
Pasquotank County/Elizabeth City 2004 Advanced Core Land
Use Plan (LUP) certified by the CRC on February 9, 2012.
Overview: The subject property is a .46 acre lot with 91.5 linear feet of shoreline along the
Little River. The property is approximately 5 feet above Normal Water Level (NWL). Water
depths are approximately 3 feet at a distance of 20 feet waterward of NWL. Shoreline areas
are located within the AE Floodzone, with Shaded X and areas outside of the floodzone
located further inland on the site.
Existing site improvements consist of a single family residential structure with attached
garage, a small storage shed, and paved driveway. Existing shoreline improvements consist
of a failing wooden bulkhead and a pier with terminus platform and covered boatlift.
Installation of 87 linear feet of vinyl bulkhead with a 12 foot wing wall to the north and a 10 foot
wing wall to the south is proposed. The bulkhead will extend a maximum of 20 feet and an
average of 14 feet waterward of the existing bulkhead. The bulkhead will be 15 inches above
the existing bulkhead height. The bulkhead will align with riprap on the adjacent property to
the north and with the bulkhead on adjacent property to the south.
The waters of the Little River in this area are classified as SC and are closed to shellfish
taking.
No Submerged Aquatic Vegetation (SAV) was observed at the project site. A review of
historic or archaeological sites or geological formations was not provided.

Plan Map (FLUPM).

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at 211
Poplar Drive in the Little River Subdivision adjacent the Little River. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to install a new vinyl bulkhead an average 14' waterward the existing
wooden bulkhead. This alignment would connect to the vertical structure on the left and riprap to the
right. Currently the shape of the bulkhead is in a "W' and according to the applicant collects debris. The
Little River at this location is classified SC by the Environmental Management Commission.
The NC WRC has reviewed the permit application and is concerned with the proposed bulkhead
alignment. Bulkhead alignments are generally at the normal water line or at a minimal distance to allow
installation around an existing structure. This minimizes the impacts to or loss of shallow water habitats.
We believe the project should either be modified by reducing the distance the bulkhead is installed
waterward the normal water level or use riprap to stabilize the shore, much like the adjacent property.
Riprap dissipates wave energy, eliminates scour at the toe of the structure, and as noted in a study
conducted by the NC WRC, provides increased fish abundance and diversity when compared to bulkhead
sites. Riprap could be placed along the front of the current bulkhead, minimizing yard disturbance and
likely reducing project cost in addition to providing increased habitat benefits.

adverse impacts to the resources;

of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted 12 project
involving excavation from a non -upland source, the material so obtained may be contained behind the
bulkhead;

(D) Bulkheads shall be permitted below normal high water or normal water level only when the
following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
features, e.g. steep grade bank, which will cause the applicant unreasonable hardship
under the other provisions of this Rule;

Project Setting
The site of the proposed development is located on the Little River, in Pasquotank
County, at 211 Poplar Drive, SR#1119 Elizabeth City.
The property is approximately 20,037 sq. ft. (0.46 acres) in size and is elevated
approximately 5' above Normal Water Level (NWL). Existing manmade features on the
property consist of a single family dwelling with an attached garage and paved driveway, a
maintained yard vegetated with indigenous grasses, a small storage shed, existing
bulkhead, existing pier and platform, and an existing covered boatlift.
The adjacent riparian properties to the south and north are similarly developed lots
with single family dwellings with stabilized shorelines. The property to the north has existing
rip rap that extends approximately 14' out past the applicants existing bulkhead.
The Division of Environmental Management classifies the waters within the project
area of the Little River as SC and these waters are closed to shellfish harvest. The average
depth of water where the development is being proposed is approximately 3' with muddy
sand substrate with no SAV present.
Development Proposal
The applicant proposes to construct a new 87' vinyl bulkhead to replace the existing
failing wooden bulkhead. The new bulkhead has an alignment extending out a maximum of
20' with an average of 14' water ward of the existing bulkhead. The new bulkhead
alignment will result in a straight structure that aligns with the riprap on the adjacent
property to the north and with the bulkhead on the adjacent property to the south. Wing

walls will be installed on both ends of the bulkhead. The wing wall on the south end of the
bulkhead will extend 12' inland. The wing wall on the north end of the bulkhead will extend
10' inland. The new bulkhead will have an elevation 15" above the existing bulkhead's
height. The applicant is proposing this new alignment in hopes that the new straight
bulkhead will be a more secure structure and will not catch as much debris along the
shoreline.
Anticipated Impacts
1.The new bulkhead alignment will result in 1,218 sq. ft. of Public Trust and, Estuarine
Waters, Areas of Environmental Concern (AFC's) to be filled.
2. The new bulkhead will result in 1,740 sq. ft. of Estuarine Shoreline (AEC) to be filled and
graded.
3.158 cubic yards of fill will be placed below Normal Water Level (NWL).

Reference the application of Mr. Clarence Roichards, to construct an 89 linear foot
bulkhead approximately 14 feet below normal water level, adjacent to the Pasquotank River, at
211 Poplar Drive, Elizabeth City, Pasquotank County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, .
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

(D) Bulkheads shall be permitted below normal high water or normal water level only when the
following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it
results from natural causes or adjacent bulkheads, or it has unusual geographic or
geologic features, e.g. steep grade bank, which will cause the applicant
unreasonable hardship under the other provisions of this Rule;
Consistent: The proposed development is consistent with the intent of this rule. The
presence of an existing bulkhead is evidence of an identifiable erosion problem.
(ii) the bulkhead alignment extends no further below normal high water or normal
water level than necessary to allow recovery of the area eroded in the year prior to
the date of application, to align with adjacent bulkheads, or to mitigate the
unreasonable hardship resulting from the unusual geographic or geologic features;
Consistent: The proposed development is consistent with the intent of this rule. The
proposed bulkhead will align with an adjacent bulkhead and an adjacent riprap structure.
(ill) the bulkhead alignment will not adversely impact public trust rights or the property
of adjacent riparian owners;
Consistent: The proposed development is consistent with the intent of this rule.
(iv) the need for a bulkhead below normal high water or normal water level is
documented by the Division of Coastal Management; and
Consistent: The proposed development is consistent with the intent of this rule.
(v) the property to be bulkheaded is in a non -oceanfront area.
Consistent: The proposed development is consistent with the intent of this rule.
(E) Where possible, sloping riprap, gabions, or vegetation shall be used rather than bulkheads.
Consistent: The proposed development is consistent with the intent of this rule.
Based on this rule review, it is recommended that the development proposal be approved as
requested with standard conditions.

The NC Division of Coastal Management hereby acknowledges receipt of your
