This permit, issued on January 9, 2014 is subject to compliance with the application (where consistent with the permit),
all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to
fines: imnrisonment or civil action: or may cause the permit to be null and void.
Dockine Facilities
1) Unless specifically altered herein, this permit authorizes only the access piers and docking facilities,
all as expressly and specifically set forth in the permit application and workplan drawings. No other
structure(s), whether floating or stationary, shall become a permanent part of these docking facilities
without permit modification. No non -water dependent uses of structures shall be conducted on/in, or
over public trust waters without permit modification. Contact a representative of the Division at
(910) 796-7215 prior to the commencement of any such activity for this determination.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.

ADDITIONAL CONDITIONS
2) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at, or adjacent to, the authorized facilities.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure(s) and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
6) This permit authorizes a maximum of three (3) formalized slips. Any request to add additional slips
shall require a modification of this permit.
7) This permit does not authorize the placement of any tie pilings in association with this structure.
General
8) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party
without the written approval of the Division of Coastal Management.
9) This permit does not authorize the excavation or filling of any wetlands or open water areas, even
temporarily.
10) The permittee shall schedule a pre -construction conference with a representative from the Division of
Coastal Management at (910) 796-7215, prior to initiation of work.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit
No.197800056, (SAW-2013-02377).

The enclosed permit constitutes authorization under the Coastal Area Management Act, for you to.proceed with
your project proposal. The original (buff -colored form) is retained by you and must be available on site when the project
is inspected for compliance. Please sign both the original, and the copy, and return the copy to this office in the enclosed
self-addressed stamped envelope. Signing the permit and proceeding means you have waived your right of appeal as
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance require additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your beneficial to ensure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

Recommendations for State Permit — Quinn Dock
I have no objections to the proposed project. The proposed development is CONSISTENT with the rules in 15A
7H .0208. Any permit issued should include the following conditions:
1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of the structure without permit modification. No non -water
dependent uses of structures may be conducted on, in, or over public trust waters without permit
modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with
navigation and shall not exceed the established pier line.
4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S.
Coast Guard, through regulations or otherwise, on authorized facilities.
5. This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
6. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project
without having the permit transferred to a third -party.
7. This permit authorizes a maximum of three (3) boat slips. At no time shall more than three (3) vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.

9. PROJECT DESCRIPTION:

Gary Ange, on behalf of Kim Quinn, has requested that the attached application be processed under the Express
Review Permitting Program. The applicant's project is located at 804 Channel Blvd., adjacent to Topsail Sound, in
Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North
from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to
the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail
Island. Turn right onto S. Topsail Dr. NC 50 and travel approximately 6.1 miles to Maritime Way and turn right.
Travel approximately 0.10 miles on Maritime Way to the first left which is Channel Blvd. Turn left onto Channel Blvd.
and travel approximately 0.2 miles and the subject property will be located on the right.
The applicant currently maintains a single-family residence on the property. Existing man-made features include a
residence, driveway, bulkhead, pier, platform and floating dock. The high ground portion is elevated approximately
4' above the normal high water (NHW) level. Vegetation on the tract consists of lawn grasses and ornamental
landscaping. There are no Coastal or "404" type wetlands, on, or adjacent to the subject property. The property has
approximately 69.5 linear feet of shoreline which is stabilized by an existing vinyl bulkhead. Currently, the
applicant maintains an elevated pier measuring approximately 28' in length by 6' in width which terminates at an
elevated fixed "T-head" platform measuring approximately 16' in length by 15' in width. An access ramp extends
waterward from the center on the fixed platform onto a floating dock measuring approximately 16' in length by 10'
in width. Water depths in the vicinity of the existing water dependent structure ranges from -2.0' to -7.01, relative
to normal low water (NLW). Residential properties border the site to the south and east, Topsail Assembly building
to the north and Topsail Sound to the west.
The previous property owner (Gary Sunderland) received a CAMA General Permit (No. 34229) on October 23,
2003 which authorized the construction of a bulkhead and CAMA General Permit (No. 54403) on November 19,
2009 for the construction of a pier, platform, floating dock and boatlift.
The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water
Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine
Fisheries, and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to remove an existing docking facility and construct a new residential docking facility. As
proposed, a new small triangular shaped elevated fixed pier measuring approximately 5' in length by 5' in width would
extend from the existing bulkhead. An access ramp would extend from this pier onto a new floating dock measuring
approximately 56' in length by 6' in width which would run perpendicular to the channel. The applicant states that this
floating dock will be designated for one (1) large (60') vessel on the south side. Located adjacent to this structure to the
north would be a new elevated fixed platform extending from the bulkhead and measuring approximately 16' - 25' in
length by 14' in width. An access ramp would extend waterward from the northwest end of this platform onto a new
floating dock measuring approximately 30' in length by 4' in width which would nm perpendicular to the channel. As
proposed, a new boatlift measuring approximately 12' in length by 12' in width would be located in between the two
floating docks. According to the application package, water depths in the vicinity of the proposed docking facility range
from approximately -2.0' to -7.0', relative to the NLW level.
As proposed, the applicant's proposal would extend a maximum distance of approximately 65' into the waterbody
which measures approximately 1200' in this location, thus, not exceeding ''/. the width of the waterbody. The proposed
docking facility would NOT extend into either of the adjacent 15' riparian corridor setbacks, would be outside of the
federal channel setback and would not exceed the established pier head alignment.

10. ANTICIPATED INIPACTS:

As proposed, the planned development would incorporate approximately 1,305 sq. ft. of Estuarine Waters and Putilic
Trust Waters. The applicant has approximately 69.5 linear feet of shoreline allowing up to 556 sq. ft. of platform or
docking space. As proposed, the total square footage of the facility (platform and floating dock) equals approximately
432 sq. ft. No impacts to Coastal or "404" wetlands would occur as a result of construction. As previously indicated,
the planned development would be located within the applicant's area of riparian access, within''/a of the width of the
waterbody and outside of the federal channel setback. The applicant indicates that the new docking facility will
accommodate three (3) large (36' - 60') vessels, however, there is potential for the facility to accommodate four (4)
vessels of smaller size. Short tern increases in turbidity could be expected due to piling installation.

The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that the following have applied for development permits in Areas of Environmental Concern as
designated under the CAMA: December 4, 2013, the Village of Bald Head Island proposed the dredging of
Lighthouse Creek, adjacent to the Cape Fear River, on Bald Head Island, Brunswick County and on
December 9, 2013, Kim Quinn proposed to construct a docking facility at 804 Channel Blvd., adjacent to
Topsail Sound, in Topsail Beach, Pender County. Copies of these entire applications may be examined or
copied at the office of Heather Coats (BR Co.) and Debbie Wilson (PN Co.), N.C. Dept. of Environment &
Natural Resources, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington, NC 28405, (910-
796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to January 3, 2014, will be considered in making the permit

The Division of Coastal Management hereby acknowledges receipt of your application, submitted on behalf of Kim
Quinn, for State approval for development of the subject property located at 804 Channel Blvd., adjacent to
Topsail Sound, in Topsail Beach, Pender County. It was received as complete on December 9, 2013 and appears to
be adequate for processing at this time. You have requested that the application be processed under the Express
Review Permitting Program. Under this expedited process, the projected date for making a decision will be
around January 9, 2014. Please note, however, that because you have not submitted the signed certified mail
receipts, indicating that you provided proper notification to the adjoining property owners, the Division will not
render a permit decision until the "green cards" have been received by our office.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed
from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road
