Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization l) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings and shall be constructed in a straight line between the corners of the two adjacent bulkheads. 2), The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheet for Additional Conditions) W "This ''permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date;, An appeal requires resolution prior to work initiation or continuance as the case may be. Mayo Seaf d Permit # 7-14 Page 2 of 2 ADDITIONAL CONIDITIONS 3) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved, by department personnel. No excavation landward of the authorized ' alignment is permitted except for that which may be required for the construction of the bulkhead wall and deadmen cables, etc. -: ;4). , All backfill material shall be clean and free of any pollutants except in trace quantities. 3) All. backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Sedimentation and Erosion Control ' -6) - In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 7), Appropriate sedimentation and erosion control devices measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. p 8)j .-All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. The permittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Neuse River Buffer. Objective Here at Re Mayo seafood are objective is to construct a bulkhead Of applicable materials including wood pilings, Whalers and vertical vinyl sheeting. Our intent is consolidate this proposed bulkhead to an existing bulkhead to the South'and to a existing bulkhead to the North. After completion of said bulkhead we intend to backfill with imported material such as sand and or clean fill dirt. To finalize the project we also would apply a top dressing of topsoil and plant applicable vegetation / Grass for erosion control and stabilization. Supplement Through the years of constant Pounding from Boat traffic on the Intracoastal waterway and from water levels raising and falling we have experienced a fair amount of erosion and damage to our property at the waters edge. We are also concerned with safety issues due to unstable bank conditions. We would like to keep our dock and surrounding area safe for we provide public access for boaters as well as fisherman and their children who frequent our establishment. Conclusion In conclusion I would like to add in my opinion, I feel this would not only protect our property from further damage from boat wakes, rising and falling water levels, It will decrease any negative impact on our waterway and environment from erosion and silt entering our waterways. Our intent is to construct a bulkhead With no negative impact on our environment or waterways. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H,1000 and SL 2008-211. For this reason, we are informing you by way of this letter that your project will not require a State Stormwater management permit at this time. Skvarla, III Secretary SUBJECT: Comments and Recommendations - CAMA Major Permit —Carol Potter, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal fills 1,900 square feet of Public Trust Waters and 5,120 square feet of high ground. This proposed bulkhead is within the Federal Channel (ICW) setback and will extend more than 5' waterward of the shoreline. These waters of the ICW are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. This proposal meets the five criteria established under 15A NCAC 07H .0208 (b)(7)(D) for constructing a bulkhead below the normal water level. The property has an identifiable erosion problem. The proposed bulkhead extends no further waterward than is necessary to tie into the existing bulkheads on either side and due to its great distance from the adjacent properties, it will not have any adverse impact on the adjoining property shorelines. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) The bulkhead will not extend waterward more than 12 feet from the normal water level at any point along its alignment at the time of construction; 2) The bulkhead must be constructed prior to any backfilling activities; 3) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure; 4) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment; Potter November 19, 2013 Page 2 of 2 5) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used; 6) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead; 7) All fill material to be placed below the normal water .level shall be confined behind the permitted bulkhead. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area, of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Field Investigation Report: R E Mayo Seafood Page 2 Narrative Description: The property is located in Hobucken at 183 Mayo Road (SR 1240), off of NC hwy 33 and hwy 304 in Pamlico County. This site is developed with a commercial fish house, driveway, rip rap and bulkheads, boat ramp, and docks. The parcel is 4.01 acres. The adjacent area to the north is the NCDOT highway, and the adjacent surrounding property to the south and west is undeveloped, owned by the NC Goose Creek Island Game Preserve. Both of the adjacent properties are owned by the state of North Carolina. The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are Coastal Wetlands towards the southern end of this property. This lot has approximately 780' of continuous shoreline along the ICW and Jones Bay. Immediate offshore water depths adjacent to the parcel range from —3' to —12' nwl. The subaqueous substrate is firm with shell. There is an identifiable erosion escarpment between two existing bulkheads of approximately 250 linear feet along the shoreline. The existing rip rap rubble at this location has failed to adequately prevent this erosion of the high ground. This erosion is due to wave action from passing boat traffic along the ICW. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 200 feet across at this location. These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SA; HQW, Nutrient Sensitive Waters. There is a defined Federal Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules. 10. Proposed Development: The applicant is proposing to replace existing rip rap rubble with a vinyl bulkhead adjacent to the ICW just north of Jones Bay, near Hobucken. The proposed development will take place at 183 Mayo Road (SR 1240), off of NC HWY 304 and NC HWY 33. The purpose of the proposed improvement is to protect the shoreline from erosion and scouring as a result of boat wake on the ICW. The project area lies between two existing sections of bulkhead, thus exposing the shoreline to greater erosion. This proposed bulkhead will tie into the two existing bulkheads to the north and south sides. The proposed bulkhead will be 256' long. It will connect to two existing bulkheads on either side of the project area. Due to erosion of the exposed area and in order to connect to the other existing bulkheads, the proposed bulkhead will average approximately 7' waterward of the nwl. The proposed bulkhead will extend a maximum of 12' waterward from the nwl, at its greatest extent waterward. This will necessitate approximately 1,900 ft2 of backfill for the bulkhead to be placed below the nwl. There is evidence of shoreline erosion and scouring during the past year from wave action caused by boat wake and the high traffic volume on the ICW. This proposed development activity will be accomplished via traditional marine construction techniques. The work will take place from the high ground. An excavator and bull dozer will be utilized to construct the bulkhead and place backfill. In order to install the dead men and tie back rods, a 20'-wide work corridor will occur on the high ground immediately landward of the proposed bulkhead. 10. Anticipated Impacts: The proposed bulkhead appears to fall within the Federal Channel ICW Setback, but this proposal will not encroach into the channel. The proposed bulkhead will extend an average of 7' waterward in order to connect to the existing bulkheads on either side of the project area. This proposed bulkhead will fill 1,900 fe of Public Trust Waters. This proposed bulkhead will fill 5,120 fC of high ground. There is an existing. adjacent side -to dock just waterward of the proposed bulkhead alignment. The ICW is 200' wide at this location. This proposed vinyl bulkhead will protect a vulnerable area of eroding shoreline that is subject to constant wave action as a result of boat wake against the applicant's property. Traditional marine construction methodology (i.e. sheet pile driven with vibratory hammer, dozers and backhoes will place backfill behind the bulkhead) will be utilized during the construction of this bulkhead.. Temporary, short-lived turbidity impacts are anticipated during the setting of the sheet piles. The temporary high ground area of impact for the bulkhead installation will be approximately 256' long and 20' wide along the Estuarine Shoreline AEC. The existing rip rap rubble along this area of shoreline has settled to such an extent, that the applicant wishes to bury it beneath the backfill (as opposed to excavating and removing the debris). There is no known cultural resource in the nearby vicinity of the project area. This project area is subject to the Neuse River Riparian Buffer Rules. Water depths within the proposed bulkhead are up to -3' deep nwl. These waters of the ICW are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. There are no Coastal Wetlands within the proposed project area. This area is closed to shellfish harvest and is classified as SA; HQW, Nutrient Sensitive Waters. It will not pose a hazard to navigation due to the fact that the proposed bulkhead will be landward of an existing side -to commercial fish house dock. This site is developed with a commercial fish house, driveway, rip rap and bulkheads, boat ramp, and docks. The parcel is 4.01 acres. The adjacent area to the north is the NCDOT highway, and the adjacent surrounding property to the south and west is undeveloped, owned by the NC Goose Creek Island Game Preserve. Both of the adjacent properties are owned by the state of North Carolina. The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are Coastal Wetlands wards the southern end of this property. This lot has approximately 780' of continuous shoreline ng the ICW and Jones Bay. Immediate offshore water depths adjacent to the parcel range from — to —12' nwl. Supplement Through the years of constant Pounding from Boat traffic on the Intracoastal waterway and from water levels raising and falling we have experienced a fair amount of erosion and damage to our property at the waters edge.
