This permit, issued on Nnvemher S, 201d , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines_ imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in accordance with the attached workplan drawings (9), 1 dated 8/15/14, S1-S4 dated revised 9/15/14 and 4 dated received in the Wilmington Regional Office 9/18/14. Dockine Facility 2) Unless specifically altered herein, this permit authorizes the docks, piers, platforms and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Parker Permit #99-14 Page 2 of 3 ADDITIONAL CONDITIONS 3) NCew,whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) No portion of the authorized docking facility shall extend beyond the established pier head line. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 11) The roof of the gazebo shall not be designed for second story use. 12) No more than 4 boats shall be docked at the authorized docking facility. Bulkhead 13) The permitted bulkhead shall be constructed in the location as depicted on the attached workplan drawings. 14) The bulkhead shall be constructed prior to any backfrlling activities. 15) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 16) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. Parker Permit #99-14 Page 3 of 3 ADDITIONAL CONDITIONS 17) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 18) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 19) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 20) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt, fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 21) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative; said structure or work shall cause unreasonable obstruction to free,navigation of the navigable waters, the permittee will be required, upon 'due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 22) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. 23) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 24) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to. the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project No. 14-1026. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property travel east from Military Cut -Off Road (N.C. Highway 17) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. Highway 76) approximately 1 mile just before the bridge over Banks Channel. Turn right onto Auditorium Circle Drive and the property will be immediately on the left. The lot is approximately 0.46 acres with approximately 95' of shoreline frontage currently stabilized by a timber bulkhead, of which is located approximately 50' along the eastern end of the property and approximately 45' along the northern end of the property. The lot averages 3'-5'above normal high water (NHW). The property is currently undeveloped and no vegetation exists on the site. All previous structures on the property (including the former LaQue Center) were demolished under CAMA Minor Permit #WB05-70, which was issued by the Town of Wrightsville Beach on 12/02/05. There is currently an existing private docking facility, which was authorized to the previous property owner under the Express Review Permitting Program (State Permit No. 35-06). The existing pier (6' x 57') extends from the center of Lot #15, adjacent to the timber bulkhead and spans in an easterly direction, which terminates into a covered platform (14' x 14'). An access ramp leads onto an existing floating dock (6' x 60'), which extends in an easterly direction perpendicular to the existing bulkhead. There are two (2) mooring pilings located on the southern side of the existing floating dock. The existing docking system provides dockage/storage space for up to four (4) vessels. Water depths in the vicinity of the floating dock range from approximately —6.0' to —9.0' relative to NLW. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters of the project site as Conservation and high ground area as Developed. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new bulkhead and replace an existing private docking facility within Banks Channel. Once the existing docking facility is completed removed, the application states a new steel/concrete bulkhead would be constructed on an average of 2' waterward of the existing timber bulkhead, aforementioned. The application also states that the proposed bulkhead along the northern end of the property would be located within the same location as the existing bulkhead due to its location adjacent to the N.C. DOT right-of-way. The proposed bulkhead would also have an approximately 11' return towards the highground along the southern property line. A new access pier, measuring approximately 72' in length by 6' in width would extend from the new bulkhead towards the east into Banks Channel. The access pier would lead into a new partially covered "L-head" platform, measuring approximately 34' in length by 17' in width, which would be oriented towards the north. An access ramp would lead from the new access pier onto a new floating dock, measuring approximately 60' in length by 6' in width, which would run in the same alignment as the proposed pier. A new boatlift, measuring approximately 15' in length by 12' in width would be located on the most landward end of northern side of the floating dock. The two (2) existing mooring pilings located on the southern side of the existing floating dock would remain. The application states that the existing water depth in the location of the existing and proposed docking structures would range from approximately —6.0' to —9.0' relative to NLW. The proposed reconfiguration of the existing docking facility would continue to accommodate up to four (4) slips at this location (See Sheets DK1, DK2, S1 through S3, S1A and SIB and Project Narrative) afeflvED 10. The applicant submitted Certified Letters to the adjacent riparian property owners, without a Return Receipt Request (Green Card); However, the applicant obtained a Letter of No Objections from both the adjacent riparian property owners. Further, the adjacent riparian property owner to the north is the N.C. DOT, which is one of the review agencies for this permit application. The docking facility would extend approximately 175' into a waterbody, which measures approximately 700' across. This distance conforms to the 1/4 width rule and the locally established pier head line. Minor increases in turbidity should be expected during construction. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf. 2. Dredging is not authorized. 3. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 4. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 5. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. 6. The permittee understands and agrees that, if future operations by the United States . require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-3282 at least two weeks prior to beginning work and upon completion of work. 7. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 10. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any,other hazardous waste, the permittee shall immediately report it to the N.C. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 13. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 14. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 15. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 16. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 17. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 2 18. The construction of the new bulkhead would impact 190 square feet of estuarine, open waters. The existing docking facility will be replaced with a new docking facility, including construction of a 72' x 6' access pier, 34' x 17' platform, 60' x 6' floating dock, and a 15' x 12' boatlift. Please see the field investigation report and the application for more detailed information concerning the proposed project and how the proposed facility compares to the existing facility. A copy of the applicant's permit application and plans is attached. The second page of the document titled "Application, Bio Report, etc." is intentionally left blank. Also attached is a Google Earth (kmz) file and an image (jpg) file of the project area. This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The proposed water depths in the location of the proposed docking facility are between -6' and -9' relative to NLW. The project area is not designated as PNA. The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project may affect but is not likely to adversely affect the West Indian manatee. The use of the Manatee Guidelines will be required as a result of this project. The project will not affect any other species listed as threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area. Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected. PROJECT DESCRIPTION: The project site is located at 1 Auditorium Circle Drive, adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property travel east from Military Cut -Off Road (N.C. Highw,ay 17) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. Highway 76) approximately I mile just before the bridge over'Banks Channel. Turn right onto Auditorium Circle Drive and the property will be immediately on the left. The lot is approximately 0.46 acres with approximately 95' of shoreline frontage currently stabilized by a timber bulkhead, of which is located approximately 50' along the eastern end of the property and approximately45' along the northern end of the property. The lot averages 3'-Sabove normal high water (NHW). The property is currently undeveloped and no vegetation exists on the site. All previous structures on the property (including theformer LaQue Center) were demolished under CAMA Minor Permit #WB05-70, which was issued by the Town of Wrightsville Beach on 12/02/05. There is currently an existing private docking facility, which was authorized to the previous property owner under the Express Review Permitting Program (State Permit No. 35-06). The existing pier (6' x 57') extends from the center of Lot #15, adjacent to the timber bulkhead and spans in an easterly direction, which terminates into. a covered platform. (14' x 14'). An access ramp leads onto an existing floating dock (6' x 60'), which extends in an easterly direction perpendicular to the existing bulkhead. There are two (2) mooring pilings located on the southern side of the existing floating dock. The existing docking system provides dockage/storage space for up to four (4) vessels. Water depths in the vicinity of the floating dock range from approximately —6.0' to —9.0' relative to NLW.. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters of the project site as Conservation and high ground area as Developed. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary NurseryArea (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a new bulkhead and replace an existing private docking facility within Banks Channel. Once the existing docking facility is completed removed, the application states a new steel/concrete bulkhead would be constructed on an average of 2' waterward of the existing timber bulkhead, aforementioned. The application also states that the proposed bulkhead along the northern end of the property would be located within the same location as the existing bulkhead due to its location adjacent to the N.C. DOT right-of-way. The proposed bulkhead would also have an approximately 11' return towards the highground along the southern property line. A new access pier, measuring approximately 72' in length by 6' in width would extend from the new bulkhead towards the east into Banks Channel. The access pier would lead into a new partially covered "L-head" platform, measuring approximately 34' in length by 17' in width, which would be oriented towards the north. An access ramp would lead from the new access pier onto a new floating dock, measuring approximately 60' in length by 6' in width, which would run in the same alignment as the proposed pier. A new boatlift, measuring approximately 15' in length by 12' in width would be located on the most landward end of northern side of the floating dock. The two (2) existing mooring pilings located on the southern side of the existing floating dock would remain. The application states that the existing water depth in the location of the existing and proposed docking structures would range from approximately —6.0'to —9.0' relative to NLW. The proposed reconfiguration of the existing docking facility would continue to accommodate up to four (4) slips at this location (See Sheets DKI, DK2, SI through S3, S1A and SIB and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed new bulkhead would incorporate approximately 190 sq. ft. of Estuarine Waters and Public Trust Areas and approximately 1,900 sq. ft. of highground for associated tie -back anchor system and backfill material. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. The applicant submitted Certified Letters to the adjacent riparian property owners, without a Return Receipt Request (Green Card); However, the applicant obtained a Letter of No Objections from both the adjacent riparian property owners. Further, the adjacent riparian property owner to the north is the N.C. DOT, which is one of the review agencies for this permit application. The docking facility would extend approximately 175' into a waterbody, which measures approximately 700' across. This distance conforms to the 1/4 width rule and the locally established pier head line. Minor increases in turbidity should be expected during construction. The new bulkhead along the north property boundary will be located just outside of the existing bulkhead at the east end of the wall and inside of the existing bulkhead at the west end of the existing wall to create additional buffer between the adjacent bridge structure. The new bulkhead along the east property boundary is proposed to be located three feet east of the existing bulkhead to allow for the existing bulkhead to remain in place to facilitate construction of the'new wall. The average distance waterward of NHW will be two feet. The entire section of the new bulkhead is proposed to be built two feet above the existing bulkhead elevation and per the enclosed structural documents. (access credit through platform included) Total = 374 sq. ft. It is the staff's recommendation that the shoreline stabilization along the project site is CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (D)(ii) Use Standards for Bulkheads and Shore Stabilization Measures states "the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to allow recovery of an area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from unusual geographic or geologic features". It appears through on - site visits that the majority of the impacts for these proposed structures along the existing basin would be located along a shoreline currently usurped by existing and structures. The replacement of the existing docking facility would provide docking space for the total up to four (4) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the'% width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement. The applicant submitted Certified Letters to the adjacent riparian property owners, without a Return Receipt Request (Green Card); however, the applicant obtained a Letter of No Objections from both the adjacent riparian property owners. Further, the adjacent riparian property owner to the north is the N.C. DOT, which is one of the review agencies for this permit application. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include the following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third -party. At no time shall more than four (4) vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. 9. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorization which may be required. 10. The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 11. The bulkhead must be constructed prior to any backfilling activities. 12. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 13. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 14. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 15. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. 16. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 17. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 18. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure orwork, or injurywhich may be caused from existing or future operations undertaken by the United States in the public interest. 19.
