(Refer to Coastal Resources Commission Rule 71.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue -line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are desi geed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the develo ent and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is Z, feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as _4eo feet landward in a major storm. SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront must be behind thefrontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosion rate (a minimum of 60 feet). If the erosion rate is greater than 3.3 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate; you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for someproperty owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1,1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation -line, (3) no development can take place on the frontal dune (4) special construction standards onpiling depth and square footage_ must be met and (5)' all other CAMA, state and ldcal- ' regulations must be met. The exception is not available in the Inlet Hazard Area. Bruner, DCM District Planner SUBJECT: CAMA/DREDGE & FILL Major Modification Application Review Three Island Partners, LCC/Windjammer II DATE: May 26, 1998 This permit consistency opinion is based on my review of the LCC/Windjammer II permit application, the Field Investigation Report (J Gregson, 4/24/98), and my understanding and interpretation of the policies presented in the 1991 Town of Ocean Isle Beach Land Use Plan . NOTE: The Town's 1997 Plan was certified 3/27/98, following submittal of this application. For consistency with state and federal permits, the 1990 plan will be used in my review. The Plan was locally adopted on February 10, 1998 and became the Town's plan of record on that date. The applicant proposes a major modification to State Permit #167-96 by the construction of an additional 8 unit condominium and associated parking. The location and complete description of the project are in the Field Investigation Report. My Consistency Opinion on the original project is attached, and the land classification/policies are the same for this modification. According to the application, "The applicant states that the Stormwater Permit from the Division of Water Quality as well as approved Sedimentation and Erosion Control Plan for Phase 1 also included Phase 2(current proposal)." I recommend that we contact DWQ Stormwater and Sedimentation and Erosion Control (Dan Sams, 910/395-3900), to verify this statement in writing (that the proposed development has been approved). Amy Blizzard (OIB staff) has assumed the duties of Druid Roberson for the Town, but has stated that she is not qualified to administer the Sedimentation program and has looked to the state for assistance. Bruner, DCM District Planner SUBJECT: CAMA/DREDGE & FILL Permit Application Review 23 Ocean Isle West Blvd, Ocean Isle Beach, Brunswick County Three Island Partners/Windjammer Condominium DATE: November 5, 1996 This permit consistency opinion is based on my review of the Three Island Partners, LLC/Windjammer Condominium permit application, the Field Investigation Report (E.F.Brooks, 10/11/96), and my understanding and interpretation of the policies presented in the Ocean Isle Beach Land Use Plan Update. The applicant proposes to construct a four story, 48 unit condominium, swimming pool, parking area and beach accessway. The site is 2.66 acre, oceanfront site. There are two existing dune systems; the first line of stable vegetation may be impacted by future erosion. Construction is proposed to be 120' landward of the existing first line of stable vegetation. The location and complete description of the project are in the Field Investigation Report. LAND USE CLASSIFICATION: Conservation(AEC;VE/100-year flood zones))/Urban Transition CLASSIFICATION DESCRIPTION: b. Ocean Hazard AEC's (p.69) - These areas include V-zones and ocean erodible areas and are known for their vulnerability to storms. Some limited uses are permitted within, even though subject to storm risks. Some development is permitted in these areas if it is well managed and carefully sited to minimize risks to life and property RELATED POLICIES AND IMPLEMENTATION MEASURES: Policy: Ocean Hazards Area (p.44) Generally, all land uses in the areas classified under the "ocean Hazards" category, i.e., ocean erodible, high hazard flood, and inlet hazard areas, shall be consistent with the requirements of existing State, federal, and local regulations, and the Ocean Isle Beach Zoning Ordinance, Subdivision Regulations, Dune Maintenance and Protection Plan, and the Town's requirements for the National Flood Insurance Program and the Town's and CAMA building set -back lines. I. Allowable land uses shall generally be designed and constructed so as to maximize structural protection from wind and water and to minimize damage to the protective land forms of dunes and beaches. ii. Ocean Isle Beach continues to support comprehensive shoreline management such as the Corps of Engineers beach renourishment project as a preferred control measure to combat ocean front erosion. iii. When existing dunes are "added to", this shall be accomplished in a manner which minimizes damage to existing vegetation. Any areas filled should be replanted immediately or stabilized temporarily until planting can be successfully completed. CONSISTENCY OPINION: The Town of Ocean Isle Beach allows construction in this AEC if the project meets all local, State and federal regulations. Land Use Plan policy supports those projects which are designed to "maximize structural protection from wind and water and minimize damage to protective land forms..." Although it is difficult to see how the Windjammer Condominium project minimizes damage to the dunes, if the design and land disturbance meet state regulation and local ordinances, then the project may be built. All permit conditions requested by DCM and other state agencies must be met. Special care should be taken during and after construction to protect the dunes to the maximum extent possible. It should be noted that the hazard areas in which this development is situated are dynamic. PROJECT DESCRIPTION The project site is located at 23 Ocean Isle West Blvd., on the west end of Ocean Isle Beach, in Brunswick County. The entire tract is 2.66 acres and borders the Atlantic Ocean to the south and West Second Street to the north. The average elevation of the site is approximately 8.5 feet above mean sea level. On December 11, 1996, the applicant was issued a CAMA Major Permit (#167- 96) which authorized the construction of a four story, 48 unit condominium, swimming pool, parking area and beach access way. All development authorized under Permit #167-96 has been constructed, as well as nine additional parking spaces on the south side of the existing swimming pool. All areas proposed for new development have been previously graded and disturbed. The waters of the. Atlantic Ocean are classified SB by the Division of Water Quality. The proposed development is located within the Ocean Erodible and High Hazard Flood areas of the Ocean Hazard Area of Environmental Concern. The Long Term Average Annual Shoreline Change Raie is 2ft./yr. (LTAASCR 1992, page lof 17). The large structure setback is 120 feet from the first line of natural stable vegetation. The applicant proposes to construct an additional eight unit condominium with asphalt driveway and a 13 space asphalt parking lot. The proposed building will be approximately 64' wide by 170' long. The structure will be supported by concrete pilings and will have a finished concrete slab underneath at elevation 9.6 MSL. The structure will have a finished first floor elevation of 22' MSL. The structure will be landward of the existing condominium and will be approximately 245' from the first line of natural stable vegetation. The applicant states that the Stormwater Permit from the Division of Water Quality as well as approved Sedimentation and Erosion Control Plan for Phase 1 also included Phase 2 (current proposal). 10. ANTICIPATED IMPACTS The proposed project will disturb approximately 27,500 sq. ft. of previously graded highground. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make amore informed decision about where and how to build in the coastal area. The Rules When you build along the oceanfront, coastal manage- ment rules require that the structure be sited to fit safely into the beach environment. Structures along the oceanfront mustbebehind thefrontal dune, landward of the crest of the primary dune and set back from the first line of natural stable vegetation a dis- tance equal to 30 times the annual erosionrate (a minimum of 60 feet). Large structures (multi-familyresidential struc- tures greater than 5,000 square feet and non-residential structures greater than 5,000 square feet) must be set back from the first line of natural stable vegetation a distance equal to 60 times the annual erosion rate or 120 feet, ' SETBACK ' SETBACK ! The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate; you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for someproperty owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception allows buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1,1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) d evelopment must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation -line, (3) no development can take place on the frontal dune (4) special constructionstandards onpiling depth and squarefootage must be met and (5Y all other CAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area. As you have read in Zoe Bruner's memo dated May 26, 1998, the Town of Ocean Isle Beach approved this project as a result of a consent judgement. It is only because of the consent judgement that the Town would allow a project that exceeded local development regulations. According to our records, the Town issued a Soil Erosion and Sedimentation Control Permit for 1.79 acres of disturbed area, on November 11, 1996. According to our files, this application covers Phase One and Phase Two. I have also talked with Mr. David Bowman, P.E., with East Coast Engineering, and he confirmed that the permit is for the entire site. His firm designed and submitted the Sedimentation and Erosion Control Plan for the Windjammer Project. As also stated in Ms. Bruner's memo, Mr. Druied Roberson is no longer working with the Town. He has accepted a position with the Charlotte/ Mecklenburg Inspections Department Because I have not had the proper training for administering the Soil Sedimentation and Erosion Control Program, I feel am not qualified to provide further comment or information on the designs for the permits. When I assumed the duties this office, I requested that the State provide us with concurrent jurisdiction of the Soil Erosion and Sedimentation Control Program.
