1) Along the 840 feet of natural shoreline, the riprap shall not extend waterward more than three feet
from the normal water level at any point along its alignment.
2) Along the 192 feet of shoreline in the area of the existing bulkhead, the riprap shall not extend
waterward of the base of the existing bulkhead.
3) The alignment of the proposed riprap must be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require
the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start
of construction.

• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger

or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for

Dear Mr. Parker:
Reference the application of MI for a Department of
the Army (DA) permit to place riprap material along an eroding shoreline, on
property located off State Road 1349 and Shorey Drive, adjacent the Neuse
River, Oriental, Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. Riprap material will not be positioned farther waterward than 3 feet
from the normal water level elevation contour at any point along its
alignment.
3. All backfill materials will be obtained from a highground source and
confined landward of the permitted riprap alignment.
4. No vegetated wetlands will be excavated or filled.
5. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
6. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
7. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.

SUBJECT: Field Recommendation and Conditions for the Miles C. Shorey, III Major
Permit Application
DATE: April 25, 1996
The applicant proposes to place rock rip rap along 1102 feet of estuarine shoreline
adjacent the Neuse River. For approximately 840' of shoreline, the proposed alignment is 3'
waterward of the normal water line (NWL) and along 192' of shoreline the alignment is
established by the base of the old bulkhead and averages 6.5' waterward of the NWL. The
remaining 70' of shoreline is already stabilized with rip rap, but would be repaired (i.e.
additional rock placed on existing rock). As stated in the bioreport, conditions at the site do
indicate severe erosion.
The project is consistent with the Use Standards for Bulkheads and Shore Stabilization
Measures as stated in 7H.0200(b)(7)(D) by meeting the required five standards. Therefore, I
have no objections to the proposed project, given the following conditions:
1. This permit authorizes riprap installation along 1102 feet of shoreline as shown on the
workplat dated 2/8/96.
2. Along the 840 feet of natural shoreline, the riprap will not extend waterward more
than 3 feet from the normal water level at any point along its alignment at the time of
construction. While along the 192' of shoreline in the area of the existing bulkhead,
the rip rap will not extend waterward of the base of the existing bulkhead.
3. The riprap alignment is to be staked and flagged by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start
of construction. Failure to initiate construction within thirty (30) days, or erosion of
the shoreline by adverse weather conditions, will require the alignment to be re -staked
by DCM within a maximum of thirty (30) days prior to the new expected start of
construction.
4. The riprap shall be of sufficient size and weight to prevent movement by wave or
current action.
5. The riprap material must be free from loose dirt or any other
quantities.

6. The riprap material must consist of clean rock or masonry materials such as, but not
limited to, granite or broken concrete. Materials such as tires, car bodies, scrap
metal, paper products, tree limbs, wood debris, organic material or similar material,
are not considered riprap.
7. The riprap must be installed prior to any backfilling activities.
8. All fill material will be clean and free of any pollutants, except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.

The Field Investigation Report for this project and my previous
Consistency Determination, dated April 29, 1996, identify this
project as being within the Town of Oriental. The Town of Oriental
received a copy of my consistency determination for this project
and subsequently notified this office that the project site is in
an area outside the Town's planning authority. We have determined
that this project is located in an area of Pamlico County which is
surrounded on three sides by the Town of Oriental and is adjacent
the Neuse River. Mr. Shorey's proposal should be reviewed for
consistency with the County Land Use Plan, not the Oriental plan as
was done in my April 29 memo. Please consider this current memo in
your consideration of this application.
The 1992 Pamlico County Land Use Plan (LUP) classifies the project
area as Rural with Services. The Estuarine Shoreline AEC is
classified as Conservation I and the Estuarine Waters and Public
Trust Areas AEC are classified as Conservation IV.
Pamlico County strictly limits development activities in the
Conservation I class. However, allowed work includes shoreline
stabilization activities, such as Mr. Shorey's project. Uses
allowed by the 7H Use Standards are allowed by Pamlico County in
Estuarine Waters and Public Trust Areas.
Applicable policies contained in the Pamlico County LUP include
those for Marine Resource Areas (Page IV-14). These policies also
state the County's support for the 7H Use Standards for Estuarine
Waters and Public Trust Areas as specified in 15A NCAC 7H. Bulkhead
Construction Policies are discussed on Page IV-10 and state that
the County does not oppose bulkhead construction that fulfills the
7H Uses Standards and the North Carolina State Building Code.
Based on the above policies, Mr. Shorey's proposal appears to be
Consistent with the 1992 Pamlico County Land Use Plan, provided all
state requirements can be satisfied.

9. NARRATIVE DESCRIPTION:
Project Setting
The applicant owns an approximate 80-acre tract of land off SR 1349, adjacent
the Neuse River in the Town of Oriental and Pamlico County. According to the
applicant, the original deed describes almost 105 acres, but only 80 acres remain above
the normal water level. There is approximately 2800' of shoreline along the Neuse
River and is aligned from north to south. Most of the northern section is high ground
and was previously farmed. Erosion is severe along this section as evidenced by the 3'
to 5' high bank. The southern section forms a peninsula that extends out into the
mouth of Whittaker Creek. Most of this section is marsh, although there are several
high hummocks scattered along this narrow spit of land. Erosion is less severe along
this stretch of shoreline.
The applicant's home, the old family house, and several sheds exist on the site in
the northern section. An existing pier, 192' of deteriorating bulkhead, and 70' of rock
rip rap are located immediately waterward of the house. Over the years, erosion has
cut away much of the bank and created somewhat of a "bump" in the shoreline
configuration. Severe erosion is evident along much of this section as is evidenced by
the erosion behind the old bulkhead. Several eroded pockets exist behind the bulkhead
and range between 8' and 12' landward of the old bulkhead. A side section stabilized
by rock is experiencing no erosion. And although a sandy beach is evident in the
southern section, much of the shoreline along the northern section is of a clayey base.
There is an extensive marsh system in the southern portions of the applicant's property,
but only a 33'-wide wetland area adjacent the mouth of a drainage ditch within the
project site itself. There are no wetlands located behind the deterioratimgbulkhead.
This section of the Neuse River is classified as SA NSW and is open to
shellfishing. It is not a Primary Nursery Area and no SAVs are evident.
Project Description
The applicant proposes to place rock rip rap along 1102 linear feet of estuarine
shoreline adjacent the Neuse River. The proposed alignment for 840 feet of natural
shoreline is essentially at the base of the erosion escarpment with a maximum distance
3' waterward of the NWL. The proposed alignment along this section is set by the
landward base of the bulkhead. Several open water pockets ranging between 8' and
12' along this stretch of shoreline would be backfilled. The average alignment along
this section of shoreline would be approximately 6.5' waterward of the NWL. The
filter fabric, stone lining and rock rip rap would be trenched in along the alignment. A
1:1 slope is proposed.

Anticipated Impacts
As proposed, approximately 4,220 fe of Estuarine Waters and shallow water
habitat (clay substrate) would be lost as a result of the placement of the 1,102 linear
feet of rock along the proposed alignment (an average of 3' waterward of the NWL
along the natural shoreline and an average of 6.5' waterward of the NWL along the old
bulkheaded shoreline). Since the rock would be placed at the toe of the escarpment,
limited backfill material would be required. According to the applicant, only 30 yds3
of material would be placed below the NWL. And this would be in the area behind
the existing bulkhead. Bank sloping and rock placement would disturb approximately
6,820 W of high ground.
It is expected that localized turbidity would increase during trenching in of the
rock, but the impacts to the estuarine system along this stretch of the Neuse River
should be minimal. It could also be hypothesized that the benefits gained by placement
of the rock and the subsequent reduction of sediment entering the system due to the
erosion, could balance any temporary construction -related impacts. The project as
proposed would involve the filling of no wetlands.
