General 6) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 7) No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the work plans. 8) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Erosion Control 9) The area will be properly graded. 10) A permanent ground cover sufficient to restrain erosion will be provided on all exposed areas within the shorter of 15 working or 60 calendar days after project completion. 11) Appropriate erosion and sedimentation control devices, measures, or structures shall be used to prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence, diversion swales/berms, sand fence, etc.). 12) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. NC Wildlife Resources Commission Bio Report Page Two PROJECT SETTING The applicant, NC Wildlife Resources Commission, recently acquired from the County of Dare, a 9.08 acre forested tract at the western end of SR 1129 (Bowsertown Road) near Manteo, in Dare County. The 580' long northern boundary of the rectangular -shaped parcel fronts a 50' wide, 3,500' long canal off Croatan Sound. Lying across the canal north of this site is additional Dare County land, approximately 15 acres of which is being used as a landfill. Lying west of this site are undeveloped forested lands also owned by the County. The eastern boundary of the subject property abuts land owned by the Town of Manteo, which operates its new municipal sewage treatment plant within a 5-acre clearing located 200' from the common property line. West of and parallel this common property line is a 60' wide access easement retained'by Dare County. Within this easement is an old pathway which has recently been improved with a 22' wide clay/soil base. At the southern end of the soil road there is a privately owned parcel currently being developed for single family residential use. The northern end of the soil road intersects Bowsertown Road. The elevation of the 9 acre tract is approximately 2' - 3' above mean sea level. Representatives of the US Army Corps of Engineers have delineated 3.83 acres of Section 404 jurisdictional wetlands within 2 separate areas. All of the highground is contiguous and comprises approximately 5.25 acres. Highground vegetation includes loblolly pine and various species of oak. Wetland vegetation consists of sweet gum (Liquidambar styraciflua), loblolly pine (Pinus taeda), red maple.(Acer rubrum), red bay (Persea borbonia) and bald cypress (Taxodium distichum). Waters of the Croatan Sound in the vicinity of this project are classified SA by the NC Division of Environmental Management and are closed to shellfishing. PROJECT DESCRIPTION The applicant proposes to develop a public boating access facility on the highground area by constructing the following: • Two 14' x 50' concrete launch ramps in a narrow area of highground adjacent the canal and within canal waters about 6.5' deep. • Three 6' wide wooden courtesy docks approximately 50' long (on the outsides of each ramp and in the middle of the two ramps). 9 Approximately 110 linear feet of wooden bulkhead adjoining the outside docks. • A 22' wide access road, parking for 30 vehicles/trailers and a maneuvering area. The road, parking spaces and maneuvering area will be surfaced with aggregate base course. r NC Wildlife Resources Commission Bio Report Page Three • A 10' x 48' concrete apron to connect the ramps to the maneuvering area. ANTICIPATED IMPACTS Approximately 280 square feet of shallow water habitat will be lost by the construction of the two concrete ramps 10' beyond existing NWL. Approximately 228 square feet of public trust waters will be shaded by the wooden docks. Four thousand square feet of area within the Estuarine Shoreline Area of Environmental Concern will be covered by impervious surfaces. Approximately 37,000 square feet of highground located outside the Estuarine Shoreline will be covered by stone surfacing. Some localized turbidity will result from the bulkheading and other construction activities in and adjacent the canal. The project will provide small boat access from the west side of Roanoke Island to Croatan Sound. No archeological/historical significance has been associated with this site. The 580' long northern boundary of the rectangular -shaped parcel fronts a 50' wide, 3,500' long canal off Croatan Sound. Lying across the canal north of this site is additional Dare County land, approximately 15 acres of which is being used as a landfill. Lying west of this site are undeveloped forested lands also owned by the, County. The eastern boundary of the subject property abuts land owned by the Town of Manteo, which operates its new municipal sewage treatment plant within a 5-acre clearing located 200' from the common property line. West of, and parallel this common property line is a 60' wide access easement retained by Dare County. Within this easement is an old pathway which has recently been improved with a 22' wide clay/soil base. At the southern end of the soil road there is a privately owned parcel currently being developed for single family residential use. The northern end of the soil road intersects Bowsertown Road. The elevation of the 9 acre tract is .approximately 2' - 3' above mean sea level. Representatives of the US Army Corps of Engineers have delineated 3.83 acres of Section 404 jurisdictional wetlands within 2 separate areas. All of the highground is contiguous and comprises approximately 5.25 acres. Highground vegetation includes loblolly pine and various species of oak. Wetland vegetation consists of sweet gum (Liquidambar styraciflua), loblolly pine (Pinus taeda), red maple (Acer rubrum), red bay (Persea borbonia) and bald cypress (Taxodium distichum). Waters of the Croatan Sound in the vicinity of this project are classified SA by the NC Division of Environmental Management and are closed to shellfishing. PROJECT DESCRIPTION The applicant proposes to develop a public boating access facility on the highground area by constructing the following: • Two 14' x 50' concrete launch ramps in a narrow area of highground adjacent the canal and within canal waters about 6.5' deep. • Three 6' wide wooden courtesy docks approximately 50' long (on the outsides of each ramp and in the middle of the two ramps). • Approximately 110 linear feet of wooden bulkhead adjoining the outside docks. • A 22' wide access road, parking for 30 vehicles/trailers and a maneuvering area. The road, parking spaces and maneuvering area will be surfaced with aggregate base course. NC Wildlife Resources Commission Bio Report Page Three • A 10' x 48' concrete apron to connect the ramps to the maneuvering area. ANTICIPATED IlVIPACTS Approximately 280 square feet of shallow water habitat will be lost by the construction of the two concrete ramps 10' beyond existing NWL. Approximately 228 square feet of public trust waters will be shaded by the wooden docks. Four thousand square feet of area within the Estuarine Shoreline Area of Environmental Concern will be covered by impervious surfaces. Approximately 37,000 square feet of highground located outside the Estuarine Shoreline will be covered by stone surfacing. Some localized turbidity will result from the bulkheading and other construction activities in and adjacent the canal. The project will provide small boat access from the west side of Roanoke Island to Croatan Sound. No archeological/historical significance has been associated with this site. Salisbury Street Raleigh, N.C. 27611 A Environmental Assessment Bowsertown Boating Access Area Croatan Sound off SR 1129 near Manteo Dare County, North Carolina This document is prepared as an Environmental Assessment (EA) in compliance with Section .0500 of the North Carolina Environmental Policy Act of 1971 (1 NCAC 25; G.S. 113A- 1 et seq., as amended). The purpose of this EA is to analyze the environmental impacts associated with the proposed construction of a new boating access area on western Roanoke Island, in Dare County, North Carolina (Figure 1). PROJECT DESCRIPTION The North Carolina Wildlife Resources Commission (NCWRC) is proposing construction of a new boating access area off SR 1129 (Bowsertown Road) on Roanoke Island west of Mantco (Figure 1). The access area would be located on an existing 50 ft. wide canal and include twin boat ramps, 3 fixed pier treated lumber courtesy docks, vehicle/trailer parking and maneuvering area, and an entrance road. The area would provide needed small boat access from Roanoke Island to Croatan Sound. Current land uses for properties adjoining the proposed project site are under public and private control. Dare County owns property on the 2 western sides of the site. Dare County's land is forested to the southwest, but includes a landfill and wastewater treatment facility to the northwest. The Town of Manteo has property to the northeast that is largely forested with some government buildings. Low density residential development is currently underway on the M.K. Fearing tract to the southeast. PROJECT NEED Increasing demands for public recreational boating and sport fishing opportunities underscores the need for the NCWRC to develop additional public boating access areas. Requests for new access areas are received on a regular basis in addition to requests for modification of existing facilities to alleviate congestion and overcrowding. The Boating Safety Act (G.S. 75A -1 et seq.) contains provisions for funding expenditures to purchase or lease areas for construction of new boating access facilities [G.S. 75A-3(c)]. The proposed Bowsertown Boating Access Area is located on a tract of land off SR 1129 (Bowsertown Road) providing access to Croatan Sound via an existing canal. The project site can be easily reached from U.S. highway 64/264 (Figure 1). Land for the project has been deeded to the NCWRC by Dare County. The NCWRC plans to construct a new boating access facility at this site to enhance public access to boating, fishing, and hunting opportunities in Croatan Sound: Currently, there are no NCWRC boat ramps on western Roanoke Island. ALTERNATIVES The project objective is to construct a facility providing enhanced public boating access to Croatan Sound from Roanoke Island. The NCWRC neither owns nor leases land elsewhere on western Roanoke Island. Consequently, alternatives to the proposed project were not considered as none were available that would accomplish the project objective. ENVIRONMENTAL DESCRIPTION The project site totals 9.08 acres in area. Of this total, .94 acres are proposed for development. The site is entirely wooded except for a 24 ft. wide unimproved county road that traverses the the property within a 60 ft. wide Dare County easement. The easement area coverage is adjacent to the northeast property boundary High rg ound: The highground area of the property is shown in Figure 1 and comprises 5.25 acres. Most of the dirt path traversing the property occurs on highground. Vegetation includes loblolly pine (Pinus taeda) and various oak (Quercus) species. Wetlands: The U.S. Army Corps of Engineers (COE) has delineated 3.83 acres of Section 404 jurisdictional wetlands as shown in Figure 1. "Wetland A" is crossed by the existing dirt path. "Wetland B" is separated from "Wetland A" by highground. Site wetland vegetation includes red bay (Persea borbonia), sweet gum (Liquidambar styracii lua), red maple (Acer rubrum), loblolly pine (Pinus taeda), and bald cypress (Taxodium distichum). Fisheries Resources: Waters of Croatan Sound adjacent to the project site are classified SA by the North Carolina Division of Environmental Management. Some freshwater fish species are expected to occur in the upper reaches of the canal near the site and may include pumpkinseed (Lepomis gibbosus), largemouth bass (Micropterus salmoides), yellow perch (Perca flavescens), and white perch (Moron americana). Estuarine species known to occur in Croatan Sound include spot (Leiostomus xanthurus), croaker (Micropogonias undulatus), bay anchovy (Anchoa mitchilli), southern flounder (Paralichthys lethostigma), summer flounder (P. dentatus), weakfish (Cynoscion regalis), spotted seatrout (C. nebulosus), and red drum (Sciaenops ocellatus). Commercially important invertebrate species include the Penaeid shrimps, blue crab (Callinectes sapidus) and eastern oyster (Crassostrea virginica). The .common rangia clam (Rangia cuneata) is very abundant in the project area. Wildlife Resources: The presence of relatively undisturbed wooded wetlands and highground near surface water (canal) combine to form high quality wildlife habitats at the project site. Mammalian species expected to use the area include; raccoon (Procyon lotor), opossum (Didelphis virginianus), rabbit (Sylvilagus spp.), muskrat (Ondatra zibethica), mink (Mustela vison), gray squirrel (Sciurus carolinensis), and white-tailed deer (Odocoileus virginianus). Reptiles utilizing the site might include diamondback terrapin (Malaclemys terrapin), snapping turtle (Chelydra serpentina), mud turtles (Kinosternon spp.), pond turtles (Clemmys spp.), and assorted snakes such as the copperhead (Agkistrodon contortrix), water moccasin (A. piscivorus), rat snake (Elaphe obsoleta), and various water snakes (Nerodia spp.). In addition to a number of songbirds, avian species may include the red -shouldered hawk (Buteo lineatus), great horned owl (Bubo virginianus), barred owl (Strix varia), screech owl (Otus asio), and American woodcock (Philohela minor). Waterfowl such as the mallard (Anas platyrhynchos), black duck (A. rubripes), and wood duck (Aix sponsa) may also occasionally use the area. Cultural Resources: So far as is known, no cultural or archaeological resources occur on the access area site. The North Carolina Department of Cultural Resources, Division of Archives and Historyis being consulted to determine whether the site is of historical significance. DESCRIPTION OF THE PROPOSED ACTION Access road, parking, and maneuvering area: Sheets 1 and 2 provide an overall view of the project area. Figure 2 emphasizes the access road, parking, and maneuvering area. The access road is to be routed in such a way as to minimize impacts to surface waters and wetlands. The road will be superimposed on an existing path as much as possible. The access road, the parking area, and the maneuvering area will all be located on highground. Both "Wetland A" and "Wetland B" will be avoided altogether. Parking for 30 vehicles with trailers, including 2 handicapped parking spaces, will be provided. The parking and maneuvering areas will also be surfaced with crusher run stone. Boat ramps: Two 14 ft. by 50 ft. concrete launch ramps are to be located in a constricted area of high ground next to the canal (Figure 1). Cypress trees adjacent to the canal will be left standing if at all possible. Three courtesy docks are proposed, 2 on the outsides of each ramp and 1 in the middle (Figure 3). Approximately 110 linear ft. of bulkhead would adjoin the outside docks. A 10 ft. by 48 ft. concrete apron would connect the boat ramps to the maneuvering area. PERMITS REQUIRED Since Dare County is a coastal county, a State dredge and fill and CAMA major permit will be required prior to commencement of construction activities. Wetlands are involved, so 401 Water Quality Certification will be necessary from the N.C. Division of Environmental Management as well as Section 404 permit authorization from the U.S. Army Corps of Engineers. A stormwater management plan must be submitted and approved. ENVIRONMENTAL IMPACTS FROM THE PROPOSED ACTION Highground: A total of .94 acres of highground would be affected by clearing and grading for access road, parking area, and boat ramp construction. Tree removal will be held to a minimum by limiting cutting to areas where actual construction will take place. Project size is not considered great enough to significantly impact wildlife species using the area, although a net loss in total available habitat would be realized if the project is completed. Wetlands:. Both "Wetland A" and "Wetland B" will be avoided altogether. We anticipate impacts to fish and wildlife resources from this small, unavoidable amount of wetland fill to be negligible. Fisheries Resources: Proposed construction may cause short-term increases in sedimentation and turbidity in the adjacent canal. These impacts will be minimized by erosion control measures and stormwater management features described in their respective plans. Once the access area is constructed, increased boat wakes in the canal may over time erode banks and cause shoaling, which in turn would induce secondary impacts in the form of elevated turbidity associated with maintenance dredging. Wildlife Resources: Of 9.08 acres comprising the project site, .94 acres or 10% of the total project area would be developed. A portion of the area to be developed already exists as a dirt path, but a net loss of wildlife habitat would occur. Cultural Resources: Cultural or archaeological resources are not known to occur on the site. Consequently, no impacts are anticipated. MITIGATION FOR UNAVOIDABLE ENVIRONMENTAL IMPACTS Highground: The project would use the footprint of an existing dirt path for access road construction to the greatest extent possible. Tree removal will be limited to the immediate access road, parking, and boat ramp areas. No mitigation is proposed for the remaining, unavoidable impacts. Wetlands: The project was designed to avoid wetlands wherever possible. Parking and boat ramp construction are to occur on highground areas. Access road construction is to be superimposed upon an existing county road at the point where wetlands are crossed to minimize wetland impacts. No mitigation is proposed. Fisheries Resources: Implementation of erosion and sedimentation control measures and prior to construction will minimize adverse impacts to area water quality. The project's only impervious surfaces that will drain directly into the adjacent canal are the concrete launch ramps. All other runoff will be directed via sheet flow away from th adjacent canal. No further mitigation is proposed. SUMMARY The NCWRC is proposing to construct twin boat ramps, 3 courtesy docks, a parking and maneuvering area, and access road on a canal leading to eastern Croatan Sound, near Manteo in Dare County. Measures have been incorporated into the project design to minimize adverse environmental impacts Benefits from the proposed boating access area include enhanced public utilization of the estuarine resources of eastern Croatan Sound. Use of the access area may also benefit the local economy in the form of increased retail traffic through commercial establishments. The NCWRC believes that even though the project will have some adverse impacts to highground, wetland, and shallow water habitats, these impacts have been minimized through prudent design measures. We consider public benefits to be sufficiently balanced with adverse impacts to justify addressing the proposal through this environmental assessment.
