be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, all as expressly and specifically set forth in the
attached permit application and workplan drawings. Any additional land disturbing activities and/or
construction may require a modification of this permit. Contact a Division of Coastal Management
representative at (252) 264-3901 for this determination.

Ocean Hazard Area
2)" Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of
Coastal Management shall stake the first line of stable, natural vegetation and the appropriate graduated
setback in accordance of the total floor area of the structure. These setback determinations shall replace
those done at the time the permit application was processed and approved. Construction shall begin
within sixty days of this determination or the measurement is void and shall be re-established. In the
case of a major shoreline change within that period, a new setback determination shall be required
before construction begins.
3) . Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, and in any case, upowits
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC Rules.

4) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive standard shall apply.
Sedimentation and Erosion Control
5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
6),. All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.

7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

This project is located on a 10.59 acre property at the intersection of Audubon Drive and Ocean
Trail (NC 12) in Corolla, Currituck County. The existing site contains a beach club/pool and
parking lots. The subject property is adjacent to the Atlantic Ocean to the east and Ocean Trail
(NC 12) to the west. In general, elevations rise from the ocean's mean high water (mhw) line to
a natural dune, then slope down to elevations along NC 12. There is an existing wet detention
basin located on Phase 9 and permitted under NCDENR Stormwater Permit No. SW7020721.
The project also has a large natural infiltration basin along the east side of Audubon Dr.
The adjacent lot to the south of Phase 9 is Lot 2R in Phase 5a of Pine Island PUD. On Lot 2R,
a residential dwelling is proposed to replace the existing diner and parking lot. Lot 2R (PI Diner,
LLC) consists of a 3.4 acre parcel and is not part of this CAMA permit request.
Proposed Work
The proposed subdivision will consist of six (6) residential lots, a beach club open space and
three (3) additional open spaces. This will include relocation (demolition and rebuild) of the
existing parking lots to the beach club open space lot. The CAMA Major Plan includes all
proposed new work. Also included with this submission is a reduced sized set of the Existing
Conditions/ Demolition Plan, Grading and Drainage Plan and SESCP Plan. It is understood that
the need for a CAMA Major Permit is that other state permits (Stormwater and SESCP) are
required and this project is on the oceanfront where some land disturbance is within the Ocean
hazard Srea of Environmental Concern (AEC) and new improvements are within the VE zone
on the oceanfront.
This project includes modification to the existing Stormwater Permit No. SW7020721 dated
September 30, 2002. In the existing permit, the Pine Island Hotel, Flyway Grill, Beach Club &
all associated parking are included in the impervious coverages. The primary method of
stormwater collection and treatment from runoff of the impervious surfaces from the proposed
project will be via overland flow and a pipe network to a wet detention basin and an infiltration
basin. The wet detention basin will capture the stormwater runoff for the 6 proposed residential
lots and the right of way while the infiltration basin will capture runoff from the beach club/pool,
future building and parking lot. Lot 2R has been demonstrated to generate no stormwater
runoff, but is included within the Stormwater Permit modification.
These improvements will create additional stormwater runoff that the original permit does not
cover. To accommodate the additional required amount of stormwater runoff, the existing wet
detention basin is proposed to be expanded and an infiltration basin is proposed to be added.

The total existing impervious coverage on the subject property is 89,112 sq.ft. (19.31 %) and the
proposed impervious coverage associated with this permit request is 79,111 sq.ft. (17.14 %).
The reduction in coverage has to do with the area of the existing parking and roadway asphalt
and sub -base demolition being greater than the new parking area. Eventually, each of the 6
residential lots will be built upon and separate CAMA Minor Permits will be requested by
individual owners. There are no specific residential development proposals at this time and the
stormwater plan assumes maximum allowable coverage on each lot.

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an,AEC Hazard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened by
changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is _ 2 feet per year.
The rate was established by careful analysis of aerial photographs
of the coastline taken over the past 50 years.
Stuthes also indicate that the shoreline could move as much as
feet landward in a major storm.
The flood waters in a major storm are predicted to be about
12 feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins,jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and requirements
by signing this notice in the space below. Without the proper
signature, the application will not be complete.

SPECIAL NOTE: This hazard notice is required for development
in areas subject to sudden and massive storms and erosion. Permits
issued for development in this area expire on December 31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation line and
setback distance at your site. If the property has seen little change
since the time of permit issuance, and the proposed development
can still meet the setback requirement, the LPO will infori you
that you may begin work. Substantial progress on the project
must be made within 60 days of this setback determination, or
the setback must be remeasured. Also, the occurrence of a major
shoreline change as the result ofa storm within the 60-day period
will necessitate remeasurement of the setback. It is important
that you check with the LPO before the permit expires For official
approval to continue the work after the permit has expired.
Generally, iffoundationpilings have been placed and substantial
progress is continuing, permit renewal can be authorized. It is
unlawful to continue work after permit expiration.

'Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfront, you take a calculated risk.
Natural forces of water and wind collide with tons of force, even
on calm days.
Man-made structures cannot be guaranteed to survive the face
of a hurricane. Long-term erosion (or barrier island migration)
may take from two to ten feet of the beach each year, and,
sooner or later, will threaten oceanfront struchlres. These are the
facts of life for oceanfront property owners.
The Coastal Resources Commission (CRC) has adopted rules
for building along the oceanfront. The rules are intended to avoid
an unreasonable risk to life and property, and to limit public and
private losses from storms and long-term erosion. These niles
lessen but do not eliminate the element of risk in oceanfront
development.
As you consider building along the oceanfront, the CRC wants
you to understand the rules and the risks. With this knowledge,
you can make a more informed decision about where and how to
build in the coastal area.
The Rules
When you build along the oceanfront, coastal management rules
require that the structure be sited to Ft safely into the beach
environment.
Structures along the oceanfront must be behind the frontal dune,
landward of the crest of the primary dune, and set back from the
first line of stable natural vegetation a distance equal to 30 times
the annual erosion rate (a minimum of 60 feet). Large structures
(multi -Family residential structures greater than 5,000 square feet
and nonresidential structures greater than 5,000 square feet) must
be set back from the first line ofnatural stable vegetation a distance
equal to 60 times the annual erosion rate of 120 feet, whichever

is greater, if the erosion rate is greater than 3.5 feet/year, the V
setback is 30 times the erosion rate plus 105 feet.
The Reasons
The beachfront is an ever -changing landfor m. The beach and the
dunes are natural "shock absorbers," taking the beating of the
wind and waves and protecting the inland areas. By setting back
30 or 60 times the annual long-term erosion rate, you have a
good chance of Ojoying the full life of the structure. At first, it
seems very inviting to build your dream house as close to the
beach as possible, but in ffveyears you could find the dream has
become a nightmare as high tides and storm tides threaten your
investment.
The Exception
The Coastal Resources Commission recognized that these rules,
initially passed in June 1979, might prove a hardship for some
property owners. Therefore, they established an exception for
lots that cannot meet the setback requirement. The exception
allows buildings in front of the setback line if the fallowing
conditions apply:
(1) the lot must have been platted as of June 1, 1979, and is not
capable ofbeing enlarged by combining with adjoining land under
the same ownership; (2) development must be as far back on the
property as possible and in no case less than 60 feet landward of
the vegetation line; (3) no development can take place on the
frontal dune; (4) special construction standards on piling depth
and square footage must be met; and (5) all other CAMA, state
and local regulations must be met.
The exception is not available in the Inlet Hazard Area.

8. PROJECT SUMMARY: The applicant proposes to create a subdivision consisting of
six residential lots and three open space areas. Existing parking lots will be removed
and a new parking lot and access way will be constructed to service an existing beach
club and pool.
Project Setting
Brian Rubino with Quible & Associates, on behalf of Pine Island Beach Club, LLC, has
requested the attached application be processed, for the redevelopment of a beach club, pool
and parking area.
The project site is located 2.2 miles north of the Currituck/Dare County line at 351 Ocean Trail
(NC Highway 12) in Corolla adjacent the Atlantic Ocean in Currituck County, North Carolina.
The site has 669' of ocean front shoreline. A portion of the existing parking area and sidewalks
to be removed are located within the Ocean Hazard Area (OHA) of Environmental Concern
(AEC) as identified in North Carolina Administrative Code 15A NCAC 07H.0304(1) and (2). All
development within this. AEC is subject to authorization by the Division of Coastal Management.
The 10.59 acre (461,492 ftz) ocean front site is currently developed with a community beach
club building, pool, beach access, wooden decks, stormwater pond, and an asphalt access
road with a parking area and connecting concrete sidewalks. The existing development covers
89,112 ft2 or 19.31 % of the property. Base Flood Elevation for this area is 12' above sea level
creating a primary dune height of 18'. A primary dune runs the width of this property and has a
crest of ±20' that is located just landward of the FLSNV. The properties to the north are single
family residential lots with houses. To the south is a restaurant with an asphalt parking area
that is scheduled'to be removed and converted to a single family lot with a house authorized
under CAMA Minor Permit No. OB2014-69 issued on September 5, 2014. Immediately south
of the restaurant site is the Hampton Inn. Vegetation on the site consists of Spartina patens,
eastern red cedar, golden rod, live oak, wax myrtle and sea oats.
According to the 2011 long term erosion rate and setback factors, the erosion rate for this area
is 2 ft/yr. The Ocean Erodible AEC extends 145' landward of the FLSNV and the High Hazard
Flood AEC extends ±203' to ±353' landward of the FLSNV. The waters of the Atlantic Ocean in
this area are classified as SB by the Division of Environmental Management, and are open to
shellfish taking.
The existing stormwater system on the property was permitted via Stormwater Permit No.
SW7020721 dated 30 September, 2002. Site elevations range from 5' to 25' above sea level.
Water to the site is provided by the Currituck County Water Distribution System. Wastewater
treatment is provided by the Pine Island-Currituck, LLC Collection System, Permit No.
WQ0018170.
Development Proposal
The applicant proposes to relocate the existing asphalt parking area to a location immediately
landward of the existing pool and clubhouse. A portion of the access road will be relocated as
well, and the remaining 2/3 of the property will be subdivided into six residential lots varying in

size from 0.51 to 0.78 acres. Three common areas will be created, two adjacent to NC
Highway 12 (one containing the existing stormwater pond and one for a proposed stormwater
pond), and a third encompassing the dry sand beach waterward of the first line of stable and
natural vegetation along the oceanfront. A portion of the relocated parking lot as well as the
new concrete sidewalks will be located in the OHA AEC. Total land disturbance associated
with the proposed development will be 3.97 acres (172,971 ft2). Total impervious surface
proposed will be 79,111 ft2 or 17.14% of the site. This represents a reduction of 10,001 ft2 of
impervious surface. No new impervious surface is proposed within the OHA AEC.
Anticipated Impacts
The project as proposed will result in the disturbance of 3.97 acres as a result of the
development.

General
This project is located on a 10.59 acre property at the intersection of Audubon Drive and Ocean
Trail (NC 12) in Corolla, Currituck County. The existing site contains a beach club/pool and
parking lots. The subject property is adjacent to the Atlantic Ocean to the east and Ocean Trail
(NC 12) to the west. In general, elevations rise from the ocean's mean high water (mhw) line to
a natural dune, then slope down to elevations along NC 12. There is an existing wet detention
basin located on Phase 9 and permitted under NCDENR Stormwater Permit No. SW7020721.
The project also has a large natural infiltration basin along the east side of Audubon Dr.
The adjacent lot to the south of Phase 9 is Lot 2R in Phase 5a of Pine Island PUD. On Lot 2R,
a residential dwelling is proposed to replace the existing diner and parking lot. Lot 2R (PI Diner,
LLC) consists of a 3.4 acre parcel and is not part of this CAMA permit request.
Proposed Work
The proposed subdivision will consist of six (6) residential lots, a beach club open space and
three (3) additional open spaces. This will include relocation (demolition and rebuild) of the
existing parking lots to the beach club open space lot. The CAMA Major Plan includes all
proposed new work. Also included with this submission is a reduced sized set of the Existing
Conditions/ Demolition Plan, Grading and Drainage Plan and SESCP Plan. It is understood that
the need for a CAMA Major Permit is that other state permits (Stormwater and SESCP) are
required and this project is on the oceanfront where some land disturbance is within the Ocean
hazard Srea of Environmental Concern (AEC) and new improvements are within the VE zone
on the oceanfront.
This project includes modification to the existing Stormwater Permit No. SW7020721 dated
September 30, 2002. In the existing permit, the Pine Island Hotel, Flyway Grill, Beach Club &
all associated parking are included in the impervious coverages. The primary method of
stormwater collection and treatment from runoff of the impervious surfaces from the proposed
project will be via overland flow and a pipe network to a wet detention basin and an infiltration
basin. The wet detention basin will capture the stormwater runoff for the 6 proposed residential
lots and the right of way while the infiltration basin will capture runoff from the beach club/pool,
future building and parking lot. Lot 2R has been demonstrated to generate no stormwater
runoff, but is included within the Stormwater Permit modification.
These improvements will create additional stormwater runoff that the original permit does not
cover. To accommodate the additional required amount of stormwater runoff, the existing wet
detention basin is proposed to be expanded and an infiltration basin is proposed to be added.

The total existing impervious coverage on the subject property is 89,112 sq.ft. (19.31 %) and the
proposed impervious coverage associated with this permit request is 79,111 sq.ft. (17.14 %).
The reduction in coverage has to do with the area of the existing parking and roadway asphalt
and sub -base demolition being greater than the new parking area. Eventually, each of the 6
residential lots will be built upon and separate CAMA Minor Permits will be requestedby
individual owners. There are no specific residential development proposals at this time and the
stormwater plan assumes maximum allowable coverage on each lot.

8. PROJECT SUMMARY: The applicant proposes to create a subdivision consisting of
six residential lots and three open space areas. Existing parking lots will be removed
~ and a new parking lot and access way will be constructed to service an existing beach
\ club and pool.
Project Setting
Brian Rubino with Quible & Associates, on behalf of Pine Island Beach Club, LLC, has
requested the attached application be processed, for the redevelopment of a beach club, pool
and parking area.
The project site is located ±2.2 miles north of the Currituck/Dare County line at 351 Ocean Trail
(NC Highway 12) in Corolla adjacent the Atlantic Ocean in Currituck County, North Carolina.
The site has 669' of ocean front shoreline. A portion of the existing parking area and sidewalks
to be removed are located within the Ocean Hazard Area (OHA) of Environmental Concern
(AEC) as identified in North Carolina Administrative Code 15A NCAC 07H.0304(1) and (2). All
development within this AEC is subject to authorization bythe Division of Coastal Management.
The 10.59 acre (461,492 ft2) ocean front site is currently developed with a community beach
club building, pool, beach access, wooden decks, stormwater pond, and an asphalt access
road with a parking area and connecting concrete sidewalks. The existing development covers
89,112 ft2 or 19.31 % of the property. Base Flood Elevation for this area is 12' above sea level
creating a primary dune height of 18'. A primary dune runs the width of this property and has a
crest of ±20' that is located just landward of the FLSNV. The properties to the north are single
family residential lots with houses. To the south is a restaurant with an asphalt parking area
that is scheduled'to be removed and converted to a single family lot with a house authorized
under CAMA Minor Permit No. OB2014-69 issued on September 5, 2014. Immediately south
of the restaurant site is the Hampton Inn. Vegetation on the site consists of Spartina patens,
eastern red cedar, golden rod, live oak, wax myrtle and sea oats.
According to the 2011 long term erosion rate and setback factors, the erosion rate for this area
is 2 ft/yr. The Ocean Erodible AEC extends 145' landward of the FLSNV and the High Hazard
Flood AEC extends ±203' to ±353' landward of the FLSNV. The waters of the Atlantic Ocean in
this area are classified as SB by the Division of Environmental Management, and are open to
shellfish taking.
The existing stormwater system on the property was permitted via Stormwater Permit No.
SW7020721 dated 30 September, 2002. Site elevations range from 5' to 25' above sea level.
Water to the site is provided by the Currituck County Water Distribution System. Wastewater
treatment is provided by the Pine Island-Currituck, LLC Collection System, Permit No.
WQ0018170.
Development Proposal
The applicant proposes to relocate the existing asphalt parking area to a location immediately
landward of the existing pool and clubhouse. A portion of the access road will be relocated as
well, and the remaining 2/3 of the property will be subdivided into six residential lots varying in

size from 0.51 to 0.78 acres. Three common areas will be created, two adjacent to NC
Highway 12 (one containing the existing stormwater pond and one for a proposed stormwater
pond), and a third encompassing the dry sand beach waterward of the first line of stable and
natural vegetation along the oceanfront. A portion of the relocated parking lot as well as the
new concrete sidewalks will be located in the OHA AEC. Total land disturbance associated
with the proposed development will be 3.97 acres (172,971 ft2). Total impervious surface
proposed will be 79,111 ft2 or 17.14% of the site. This represents a reduction of 10,001 ft2 of
impervious surface. No new impervious surface is proposed within the OHA AEC.
Anticipated Impacts
• The project as proposed will result in the disturbance of 3.97 acres as a result of the
development.

General
This project is located on a 10.59 acre property at the intersection of Audubon Drive and Ocean
Trail (NC 12) in Corolla, Currituck County. The existing site contains a beach club/pool and
parking lots. The subject property is adjacent to the Atlantic Ocean to the east and Ocean Trail
(NC 12) to the west. In general, elevations rise from the ocean's mean high water (mhw) line to
a natural dune, then slope down to elevations along NC 12. There is an existing wet detention
basin located on Phase 9 and permitted under NCDENR Stormwater Permit No. SW7020721.
The project also has a large natural infiltration basin along the east side of Audubon Dr.
The adjacent lot to the south of Phase 9 is Lot 2R in Phase 5a of Pine Island PUD. On Lot 2R,
a residential dwelling is proposed to replace the existing diner and parking lot. Lot 2R (PI Diner,
LLC) consists of a 3.4 acre parcel and is not part of this CAMA permit request.
Proposed Work
The proposed subdivision will consist of six (6) residential lots, a beach club open space and
three (3) additional open spaces. This will include relocation (demolition and rebuild) of the
existing parking lots to the beach club open space lot. The CAMA Major Plan includes all
proposed new work. Also included with this submission is a reduced sized set of the Existing
Conditions/ Demolition Plan, Grading and Drainage Plan and SESCP Plan. It is understood that
the need for a CAMA Major Permit is that other state permits (Stormwater and SESCP) are
required and this project is on the oceanfront where some land disturbance is within the Ocean
hazard Srea of Environmental Concern (AEC) and new improvements are within the VE zone
on the oceanfront.
This project includes modification to the existing Stormwater Permit No. SW7020721 dated
September 30, 2002. In the existing permit, the Pine Island Hotel, Flyway Grill, Beach Club &
all associated parking are included in the impervious coverages. The primary method of
stormwater collection and treatment from runoff of the impervious surfaces from the proposed
project will be via overland flow and a pipe network to a wet detention basin and an infiltration
basin. The wet detention basin will capture the stormwater runoff for the 6 proposed residential
lots and the right of way while the infiltration basin will capture runoff from the beach club/pool,
future building and parking lot. Lot 2R has been demonstrated to generate no stormwater
runoff, but is included within the Stormwater Permit modification.
These improvements will create additional stormwater runoff that the original permit does not
cover. To accommodate the additional required amount of stormwater runoff, the existing wet
detention basin is proposed to be expanded and an infiltration basin is proposed to be added.

The reduction in coverage has to do with the area of the existing parking and roadway asphalt
and sub -base demolition being greater than the new parking area. Eventually, each of the 6
residential lots will be built upon and separate CAMA Minor Permits will be requested by
individual owners. There are no specific residential development proposals at this time and the
stormwater plan assumes maximum allowable coverage on each lot.

of-way; on an oceanfront property located at 351 Ocean Trail, in the community of
Corolla, Currituck County.

Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC
on May 18, 2007; as amended through June 24, 2009.
Overview: The subject property is a 10.59 acre site with 669 linear feet of oceanfront shoreline.
A primary dune with a crest of 20 feet runs the length of the shoreline, just landward of the First
Line of Stable Natural Vegetation (FLSNV). Site elevations range from 5 feet to 25 feet above
sea level. The eastern side of the property is within the VE Floodzone and the western side is
within the AE Floodzone.
Existing site improvements consist of a community beach club building, wooden decks, a pool,
asphalt access road and parking area, sidewalks, and a stormwater pond. Water service to the
site is provided by the Currituck County Water Distribution System. The site receives
wastewater service from the Pine Island-Currituck, LLC Collection System. Existing shoreline
improvements consist of an unimproved beach access road and a wooden walkway connecting
the building to the beach.
Relocation of asphalt parking and a portion of the asphalt access road, installation of concrete
walkways, creation of stormwater ponds, and subdivision to include six (6) residential lots, a lot
for the beach club and associated parking, three (3) open space areas, and a 45 foot wide road
right-of-way are proposed. The beach access road will be removed. A 20 foot wide access
easement for county emergency beach access will be provided along the northern property line
on a residential lot. Residential lots will vary from .51 to .78 acre in size. Stormwater ponds will
be located in open space areas.

The waters of the Atlantic Ocean are classified as SB in this area and are open to shellfish
taking.
A review of potential archaeological sites on or near the property was not provided.
Anticipated impacts resulting from this project are expected to include: the disturbance of .70
acre of Ocean Hazard Area of Environmental Concern (AEC) and 3.27 acres of Highground
outside of the Ocean Hazard AEC.
Basis for Determination:
The site located within the "Corolla Sub -Area" and is designated as "Full Service Areas (Areas
Preferred for Community Centers)" on the Currituck County Future Land Use Map (FLUM).
Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated
on Page 11-1.
As indicated on Page 11-10 for the Corolla Sub -Area, "(t)he policy emphasis of this plan is to
allow for predominantly medium density residential development (2 to 3 units per acre) with
minimal commercial development arranged in clusters... Development and redevelopment
should be capable of being supported by the area's infrastructure and services —particularly
drinking water, sewage treatment, road capacity, parking areas, and required fire suppression
capabilities."
As indicated on Page 11-3, "Areas designated as Full Service are those parts of the county
where a broad range of infrastructure and service investments have been provided or will be
made available by the public and/or private sectors... With respect to residential development,
base development density is contemplated to be 2 units per acre but could be increased to 34
units per acre through overlay zoning depending upon services available and the potential
impact on the surrounding area... With respect to nonresidential uses, it is essential that the
existing community character be preserved..."
As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-
term management and protection of significant, limited, or irreplaceable areas. Proper
management is needed to conserve the natural, cultural, recreational, scenic or biologically
productive values of these areas. The Conservation class should be applied to areas that
should not be developed at all (preserved), or if developed, done so in a very limited manner
characterized by careful planning and cautious attention to the conservation of environmental
features."

Dear Mr. Huggett:
Reference the application of Mr. Harry Hiestand to salvage submerged logs and cribbing
piles in five different areas from the Pasquotank River, in the Knobbs Creek area, Elizabeth City,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application andyour field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation, of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

SUBJECT: P.I. Beach Club, LLC Major Permit Recommendations
The applicant proposes to create a subdivision consisting of six residential lots and three open
space areas. Existing parking lots will be removed and a new parking lot and access way will be
constructed to service an existing beach club and pool.
The site of the proposed development is located ±2.2 miles north of the Currituck/Dare County
line at 351 Ocean Trail (NC Highway 12), Corolla, Currituck County, adjacent to the Atlantic
Ocean.
The development proposal involves the Ocean Hazard (Ocean Erodible & High Hazard Flood
Areas) Area of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0203 Management Objective of the Estuarine and Ocean System
It is the objective of the Coastal Resources Commission to conserve and manage estuarine
waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an
interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic,
and aesthetic values and to ensure that development occurring within these AECs is compatible
with natural characteristics so as to minimize the likelihood of significant loss of private property
and public resources. Furthermore, it is the objective of the Coastal Resources Commission to
protect present common-law and statutory public rights of access to the lands and waters of the
coastal area.
Consistent: The proposed development is consistent with the intent of this rule.

07H. 0303 MANAGEMENT OBJECTIVE OF OCEAN HAZARD AREAS
(a) The CRC recognizes that absolute safety from the destructive forces indigenous to the
Atlantic shoreline is an impossibility for development located adjacent to the coast. The loss of
life and property to these forces, however, can be greatly reduced by the proper location and
design of structures and by care taken in prevention of damage to natural protective features
particularly primary and frontal dunes. Therefore, it is the CRC's objective to provide
management policies and standards for ocean hazard areas that serve to eliminate unreasonable
danger to life and property and achieve a balance between the financial, safety, and social factors
that are involved in hazard area development.
(b) The purpose of these Rules shall be to further the goals set out in G.S. 113A-102(b), with
particular attention to minimizing losses to life and property resulting from storms and long-term
erosion, preventing encroachment of permanent structures on public beach areas, preserving the
natural ecological conditions of the barrier dune and beach systems, and reducing the public
costs of inappropriately sited development. Furthermore, it is the objective of the Coastal
Resources Commission to protect present common-law and statutory public rights of access to
and use of the lands and waters of the coastal area.
Consistent: The proposed development is consistent with the intent of the management
objectives.
07H. 0306 GENERAL USE STANDARDS FOR OCEAN HAZARD AREAS
(a) In order to protect life and property, all development not otherwise specifically exempted or
allowed by law or elsewhere in the CRC's Rules shall be located according to whichever of the
following is applicable:
(1) The ocean hazard setback for development is measured in a landward direction
from the vegetation line, the static vegetation line or the measurement line,
whichever is applicable. The setback distance is determined by both the size of
development and the shoreline erosion rate as defined in 15A NCAC 07H .0304.
Development size is defined by total floor area for structures and buildings or
total area of footprint for development other than structures and buildings. Total
floor area includes the following:
(A) The total square footage of heated or air-conditioned living space;
(B) The total square footage of parking elevated above ground level; and
(C) The total square footage of non -heated or non -air-conditioned areas
elevated above ground level, excluding attic space that is not designed to be load
bearing. Decks, roof -covered porches and walkways are not included in the total
floor area unless they are enclosed with material other than screen mesh or are
being converted into an enclosed space with material other than screen mesh.
(2) With the exception of those types of development defined in 15A NCAC 07H
.0309, no development, including any portion of a building or structure, shall
extend oceanward of the ocean hazard setback distance. This includes roof
overhangs and elevated structural components that are cantilevered, knee braced,
or otherwise extended beyond the support of pilings or footings. The ocean
hazard setback is established based on the following criteria:

(A) A building or other structure less than 5,000 square feet requires a
minimum setback of 60 feet or 30 times the shoreline erosion rate, whichever is
greater;
Consistent: The proposed development is consistent with the intent of this rule.
(3) If a primary dune exists in the AEC on or landward of the lot on which the
development is proposed, the development shall be landward of the crest of the
primary dune or the ocean hazard setback, whichever is farthest from vegetation
line, static vegetation line or measurement line, whichever is applicable. For
existing lots, however, where setting the development landward of the crest of the
primary dune would preclude any practical use of the lot, development may be
located oceanward of the primary dune. In such cases, the development may be
located landward of the ocean hazard setback but shall not be located on or
oceanward of a frontal dune. The words "existing lots" in this Rule shall mean a
lot or tract of land which, as of June 1, 1979, is specifically described in a
recorded plat and which cannot be enlarged by combining the lot or tract of land
with a contiguous lot(s) or tract(s) of land under the same ownership.
Consistent: The proposed development is consistent with the intent of this rule.
(4) If no primary dune exists, but a frontal dune does exist in the AEC on or landward
of the lot on which the development is proposed, the development shall be set
landward of the frontal dune or landward of the ocean hazard setback whichever
is farthest from the vegetation line, static vegetation line or measurement line,
whichever is applicable.
Consistent: The proposed development is consistent with the intent of this rule.
(7) Established common-law and statutory public rights of access to and use of public
trust lands and waters in ocean hazard areas shall not be eliminated or restricted.
Development shall not encroach upon public accessways nor shall it limit the
intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
(b) In order to avoid weakening the protective nature of ocean beaches and primary and frontal
dunes, no development is permitted that involves the removal or relocation of primary or frontal
dune sand or vegetation thereon which would adversely affect. the integrity of the dune. Other
dunes within the ocean hazard area shall not be disturbed unless the development of the property
is otherwise impracticable, and any disturbance of any other dunes is allowed only to the extent
allowed by 15A NCAC 07H .0308(b).

(c) Development shall not cause irreversible damage to historic architectural or archaeological
resources documented by the Division of Archives and History, the National Historical Registry,
the local land -use plan, or other sources.
Consistent: The proposed development is consistent with the intent of this rule.
(d) Development shall comply with minimum lot size and set back requirements established by
local regulations.
Consistent: The proposed development appears consistent with the intent of this rule.
(e) Mobile homes shall not be placed within the high hazard flood area unless they are within
mobile home parks existing as of June 1, 1979.
Consistent: The proposed development is consistent with the intent of this rule.
(f) Development shall comply with general management objective for ocean hazard areas set
forth in 15A NCAC 07H .0303.
Consistent: The proposed development is consistent with the intent of this rule.
(g) Development shall not interfere with legal access to, or use of, public resources nor shall such
development increase the risk of damage to public trust areas.
Consistent: The proposed development is consistent with the intent of this rule.
(h) Development proposals shall incorporate measures to avoid or minimize adverse impacts of
the project. These measures shall be implemented at the applicant's expense and may include
actions that:
(1) minimize or avoid adverse impacts by limiting the magnitude or degree of the action,
(2) restore the affected environment, or
(3) compensate for the adverse impacts by replacing or providing substitute resources.
Consistent: The proposed development is consistent with the intent of this rule.
(i) Prior to the issuance of any permit for development in the ocean hazard ABCs, there shall be a
written acknowledgment from the applicant to DCM that the applicant is aware of the risks
associated with development in this hazardous area and the limited suitability of this area for
permanent structures. By granting permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no liability for future damage to the
development.
Consistent: The applicant has submitted a signed Ocean Hazard AEC Notice form that
acknowledged the special risks and conditions associated with development within these
areas.

15ANCAC 07H.0601 No Violation ofAny Rule
No development shall be allowed in any AEC which would result in a contravention or violation
of any rules, regulations, or laws of the State of North Carolina or of local government in which
the development takes place.
Consistent: The proposed development is consistent with the intent of this rule.
15A NCAC 07H.0602 Pollution of Waters
No development shall be allowed in any AEC which would have a substantial likelihood of
causing pollution of the waters of the state in which shellfishing is an existing use to the extent
that such waters would be officially closed to the taking of shellfish. This rule shall also apply to
development adjacent to or within closed shellfish waters when a use attainability study of those
waters documents the presence of a significant shellfish resource in an area that could be
expected to be opened for shellfishing given reasonable efforts to control the existing sources of
pollution.
Consistent: The proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application, and plans, I recommend a Major Permit be issued to P.I. Beach Club,
LLC with the standard permit conditions associated with development within the Ocean Erodible
AEC.

Dear Mr. Blizzard:
The Washington Regional Office received a complete Stormwater Management Permit
Modification Application for Pine Island Hotel, Phase 5a Modifications Including Phase 9
on September 26, 2014 and additional information on October 24, 2014. Staff review of
the plans and specifications has determined that the project, as proposed, will comply with
the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7020721 Modification, dated October 27, 2014, for the construction of the
subject project. The Modification is to include 6 residential lots, changes to layout of Beach
Club and to incorporate the proposed single family residence lot 211 that replaced existing
Flyway Grill as originally permitted.
This permit shall be effective from the date of issuance until October 27, 2022, shall void
permit SW7020721 issued on September 30, 2002 and shalt be subject to the conditions
and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequatesystem for
operation and maintenance of the storinwater management system will result in future
compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714.
Unless such demands are made this permit shall be final and binding.

1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division.
2. The permittee is responsible for verifying that the proposed built -upon area for
the entire lot does not exceed the maximum allowed by this permit. Once the lot
transfer is complete, the built -upon area may not be revised without approval
from the Division, and responsibility for meeting the built -upon area limit Is
transferred to the individual property owner.
3. If an Architectural Review Board or Committee Is set up by the permittee to
review plans for compliance with the BUA limit, the plans reviewed must include
all proposed built -upon area. Any approvals given by the Board do not relieve the
homeowner of the responsibility to maintain compliance with the permitted BUA
limit.

4. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specked in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
6. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
bulk -upon surface.
6. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of all or part of the project area.
The project area is defined as all property owned by the permittee, for
which Sedimentation and Erosion Control Plan approval or a CAMA Major
permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
7. The permittee shall submit for approval, final site layout and grading plans for
any permitted future development areas shown on the approved plans, prior to
construction.
8. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
9. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be 'repaired immediately.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an to
designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
Spec
ifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
11. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
12. The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, .but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowin.9 and re -vegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans.

f. Debris removal and unclogging of structures, orifice, catch basins and
piping.
g. Access to all components of the system must be available at all times.
13. Records of maintenance activities must be kept by the permittee. The records will
indicate the date, activity, name of person performing the work and what actions
were taken.
14. The permittee shall submit to the Division of Water Quality an annual summary
report of the maintenance and inspection records for each BMP. The report shall
summarize the inspection dates, results of the inspections, and the maintenance
work performed at each inspection.
15. This permit shall become void unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data.
16. Prior to transfer of the permit, the stormwater facilities will be inspected by
DEMLR personnel. The facility must be in compliance with all permit conditions.
Any items not in compliance must be repaired or replaced to design condition
prior to the transfer. Records of maintenance activities performed to date will be
required.
17. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the deepest
part of the pond.
c. The falling water from the fountain must be centered in the pond, away from
the shoreline.
d• The maximum horsepower for the fountain's pump is based on the
permanent pool volume. The maximum pump power for a fountain in south
pond is 3/4HP and north pond is 1/3HP.
20. If permeable pavement credit is desired, the permittee must submit a request to
modify the permit to incorporate such language as required by the Division of
Energy, Mineral, and Land Resources. The request to modify must include a
soils report identifying the type of soil, the Seasonal High Water Table elevation
and the infiltration rate. Upon the successful completion of a permit modification,
the individual lot owners that request to utilize permeable pavements must
submit the necessary forms and documentation to the permittee and receive
approval prior to construction of the permeable pavement.
Ill. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change form signed by both parties, to the
Division, accompanied by the supporting documentation as listed on page 2 of
the form. The approval of this request will be considered on its merits and may or
may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves a request to transfer the permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.

4. The issuance of this permit does 'not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and. federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, .
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility:
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit'may be modifled, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the Quidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9: Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit..
.10. The issuance of this permit does. not prohibit the Director from reopening and
modifying the permit,. revoking and reissuing the permit,: or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2008-
211; Title.15A NCAC 2H.1000, and CGS 143-215.1 et.'al.. ..
11. The permittee.shall notify the Division in writing of any name, ownership or .
mailing address changes at least 30'days prior to making such changes.
12.. This permit shall be effective from the date'of issuance until June 4, 2019.
Application for permit renewal shall. be submitted 180 days prior to the expiration.
date of this permit and must be accompanied by the processing fee.

application for a development permit in an AEC as designated under the CAMA was

during normal business hours. Comments mailed to Braxton Davis, Director, DCM, 400

making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public,

The NC Division of Coastal Management hereby acknowledges receipt of the
application submitted on behalf of P.I. Beach Club, LLC for State approval for
development of their property located at 351 Ocean Trail in Corolla,
Currituck County. It was received complete on October 6, 2014, and
appears to be adequate for processing at this time. The projected deadline
for making a decision is December 20, 2014. An additional 75-day review
period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October
6, 2014, you may request a meeting with the Director of the Division of
Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the
location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of the
proposed development. You should post this notice at a conspicuous point
along the property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting the property, or at a point along the road
right-of-way where a private road would lead one into the property. Failure
to post this notice could result in an incomplete application.

This letter is to notify you as an adjacent riparian landowner that Quible & Associates, P.C., on behalf of
the landowner, PI Beach Club LLC, has applied for a CAMA Major Permit for the oceanfront property
located adjacent to your property in Pine Island P.U.D. The proposed project consists of six residential
lots, a beach club open space and three additional open spaced. This will include relocation (demolition
and rebuild) of the existing parking lot to the beach club open space lot. The beach club itself will remain
in its' existing location, but the parking lot will be relocated to the area in front of (to the west) of the beach
club. The six residential lots will be located to the north of the beach club. This work is depicted on the
enclosed CAMA Major Plan the Existing Conditions/Demolition Plan.
Should you have no objections to this work, please check the appropriate statement below, sign and date
where indicated and return this letter, in the self-addressed envelope, as soon as possible.
