This permit, issued on 96 is subject to compliance with the application (where consistent
with the permit), all applicable r1egulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
BULKHEADS/RETAINING WALLS
Prior to beginning any upland cut and/or fill operations, the bulkhead along the White
Oak River must be installed.
2. The bulkhead alignment will approximate the mean high water level at the time of
construction.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the penmittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.
Signed by the authority of the Secretary of DEHNR and the
Chairman of the Coastal Resources Commission.

3. The alignment of the proposed bulkhead must be staked by a representative of the
Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to
the start of construction. Failure to initiate construction within thirty (30) days, or
erosion of the shoreline by adverse weather conditions, will require the alignment to be
re -staked by DCM within a maximum of thirty (30) days prior to the new expected start
4. The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
EXCAVATION
5. No vegetated wetlands will be excavated or filled.
6. Excavation will not exceed 3.4 feet below the elevation of mean low water (MLW).
7. All excavated materials will be confined landward of the mean high water (MHW) elevation
contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes or
other retaining structures to prevent spillover of solids into any vegetated wetlands or
surrounding waters.
8. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters,
other than the wetland area designated in the project plans.
9. The temporary placement or double -handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
10. In order to protect juvenile fish, shrimp and other estuarine resources channel excavation
may not take place between April 1 and September 30 of any year.
BOAT RAMP
11. Prior to the installation of the boat ramp, if it is to be poured in place, a retaining wall
shall be constructed around the perimeter of the ramp. The wall shall be of sufficient
height to contain the fill and prevent its direct contract with adjacent waters.
STORMWATER MANAGEMENT AND EROSION CONTROL
12. This project has a high potential for sedimentation runoff during construction. Extreme
care must be undertaken to prevent such impacts from effecting coastal resources.

13. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases
such that the turbidity is 25 NTU's or are not considered significant.
14. The Division of Environmental Management approved a Stormwater Management Plan for this
project on November 17, 1995. Any violation of that permit will be considered a violation of
this CAMA permit.
NOTE: The Division of Environmental Management also approved tt
Water Quality Certification No. 3027 on November 15, 1995.
NOTE: The Division of Land Resources on June 29, 1995 approved a Sedimentation and Erosion
Control Plan for the White Oak Subdivision.
GENERAL
15. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
16. The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of the permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third parry.
17. If the permittee discovers any previously unknown historic or archeological remains while
accomplishing the authorized work, he will immediately notify the Wilmington District Engineer
who will initiate the required State/Federal coordination.
NOTE: The permittee and/or his contractor is urged to meet with DCM prior to project initiation.
NOTE: Future development of the permittee's property may require a modification of this permit.

applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.

the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully

8. PROJECT SUMMARY: The applicant is proposing to excavate an access channel and construct a
boat ramp facility as an amenity for the White Oak Subdivision.

9. NARRATIVE DESCRIPTION: White Oak Subdivision is located on an approx. 170
acre tract of land located off NCSR 1444 (Swansboro Loop Road) and north of the
Town of Swansboro, in Onslow County. The property borders the west side of the
White Oak River between Cahoon Point and Holland Mill Creek. Phase 1 of the
development consist of 83 lots and the infrastructure for this phase has been installed
and three residences have been or are under construction. A clubhouse and tennis
courts have also been constructed as amenities for the development. Phase 2 consists
of approx. 33 acres but lots have not been platted nor has the infrastructure been
installed. The applicant indicates that the typical size of individual lots range from 1/2
to 1 acre is size. Potable water for the development is supplied by the County's water
system while wastewater is handled by individual septic tanks. The topography of the
tract ranges from approx 1' to 30' above mean sea level and has quite a bit of relief
along the shoreline. The majority of the property consists of woodlands vegetated by
pines, oaks, hollies, etc. and there are several fingers of wooded wetlands areas which
make up into the interior of the property. A wetland delineation of the property has
been completed and approved by the US Army Corps of Engineers (COE). A
Nationwide Permit has been issued for a minor road crossing for the subdivision and
has teen utilized. Another Nationwide Permit has been issued for the filling of a
wetland area on 1 lot in the subdivision but this filling has not taken place. The
shoreline area along the development may be characterized as either vegetated with
varying amounts of coastal and 404 wetlands or having no wetland vegetation with
varying degrees of bank erosion with fallen trees. In some of the areas which are void
of wetland vegetation, a small sandy beach area exist. The bottom area of the White
Oak River in front of the applicant's property is reportedly a sandy/silt composition
with graduated water depths to -3.4' approx. 400' offshore. A shellfish survey of the
area has not taken place but there are areas in the White Oak River where shellfish and
finfish resources are significant. The waters of the White Oak River adjacent to the
property have been classified as SA and are open to the harvesting of shellfish. There
also appears to be several archeological sites in close proximity to the project site.
The applicant is requesting a permit to develop a boat launching area as an amenity of
the subdivision. Plans included with the application package show that an approx. 120'
long x 75' wide (bottom width) basin area is proposed to excavated immediately
adjacent to and waterward of the mean high water (MHW) line with an approx. 320'
long x 35' wide (bottom width) access channel being excavated offshore in order to
reach the -3.4' mean low water (MI,W) contour. Located in the basin will be an
approx. 64' long x 15' wide concrete boat ramp with 2 parallel piers. The design of
the boat ramp will require the backfilling of an approx. 32 linear foot section of the
boat ramp area below the MHW line before the concrete ramp is poured. This filling
will raise the bottom elevations up to 2' in height and a retaining wall is proposed
along each side of the ramp to prevent the material from ,entering adjacent bottom
areas. Because of the topography along the shoreline, a great deal of high ground
excavation will be required in order to achieve the proper grade for the access road,
turn around and ramp area. Plans included with the application show that up to 7' of
elevation will be removed with cut areas being stabilized by either retaining walls or
by sloping and vegetation. The approx. 130 linear feet of sandy beach shoreline
contained on these two lots will also be stabilized with a bulkhead located at the MHW
line. Portions of the access road and turn around area will be directly adjacent to a
forested wetland area which exists on the two lots. The drive and turn around will be
surfaced with marl and impervious coverage within the Estuarine Shoreline AEC has
been calculated by the applicant at 29.8%. The applicant is not proposing any parking
areas for cars and trailers. The subdivision has been approved under the low density
stormwater requirements and some modification of this approval may be required by
the Division of Environmental Management. The excavation of the high ground areas
and the bottom area of the White Oak River immediately adjacent to the shoreline will
be accomplished by the use of a dragline and dozer. The offshore excavation will be
by a barge mounted bucket operation. The spoils from all the excavation activities will
be placed in several areas within the subdivision. One area is located on lot lit where
approx. .05 acres of 404 wetlands will be filled. The landowner has, however,
received a Nationwide Permit for the filling activity. A Sedimentation and Erosion
Control Plan has been issued for the development of the subdivision.
10. ANTICIPATED IMPACTS: The project as proposed will result in approx. 20,200
ft.2 of shallow water bottom in the White Oak River being excavated with approx.
1,400 cu. yds. of sandy/silt material being removed from below the MHW line. A
fisheries resource survey has not been conducted in the project site and will need to be
done to determine the impacts that may occur from the excavation activities. The
proposed boat -ramp will result in approx. 960 ft.2 of bottom area being filled with
approx. 35 cu. yds. of sand and concrete material. Parallel retaining walls will be
constructed along a portion of the ramp to contain the backfill material required to
raise the ramp elevation. Turbidity levels in the White Oak River will be elevated
during excavation activities but could be minimized if excavation was timed to periods
of least biological activity. The high ground excavation will result in approx. 2,250
cu. yds. of material being removed. Because of the presence of a wetland area
immediately adjacent to disturbed areas, the requirement to significantly lower
elevations and the close proximity of Estuarine Waters, extreme caution and effective
erosion control techniques must be utilized when conducting the highground
disturbances. The amount of impervious surfaces within the Estuarine Shoreline
appears to be at the 30% limitation and it is anticipated that the Stormwater
Certification (as well as the Sedimentation and Erosion Control Plan) for this
development will have to be modified. The applicant is not proposing any parking area
for cars or trailers and it is likely that such a facility would be desirable by the
homeowners in the development in the future. An approx..05 acres of 404 wetlands
will be filled on one lot but this has already received a Nationwide Permit from the
COE.

Comments & Recommendations - CAMA Major Permit
Application - White Oak Subdivision, Onslow County
November 21, 1995
It is my understanding that the Division of Marine Fisheries has
conducted a fisheries evaluation of the project site and have no
objections to the issuance of a permit for this development. Based
upon this and if the project receives the necessary 401 Water
Quality Certification and stormwater approval (the Sedimentation
and Erosion Control Plan has already been approved), I have no
objections to the issuance of this permit with the following
conditions:
1.
Prior to beginning any upland cut and/or fill operations, the
bulkhead along the White Oak River must be installed.
2.
The bulkhead alignment will approximate the mean high water
level at the time of construction.
3.
The alignment of the proposed bulkhead must be staked by a
representative of the Division of Coastal Management (DCM)
within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty
(30) days, or erosion of the shoreline by adverse weather
conditions, will require the alignment to be re -staked by DCM
within a maximum of thirty (30) days prior to the new expected
start of construction.
4.
The bulkhead must be structurally tight so as to prevent
'
seepage of backfill materials through the structure.
5.
No marsh grass will be excavated and/or filled.
6.
Excavation will not exceed 3.4 feet below the mean high water
level.
7. The temporary placement or double -handling of excavated or
9 fill materials within waters or vegetated wetlands is not
authorized.
8. All excavated materials will be confined above mean high water
V �= and landward of regularly or irregularly flooded marsh behind
adequate dikes or other retaining structures to prevent spill-
over of solids into any marsh or surrounding waters.

9. Prior to the installation of the boat ramp a retaining wall
shall be constructed around the perimeter'bf the ramp. The
wall shall be of sufficient height to contain the fill and
prevent its direct contact with adjacent waters.
�jNOTE: The permittee and/or his contractor is urged to meet with
DCM prior to project initiation.
7.4 NOTE: Permanent reflectors should be attached to the structure in
order to make it more visible during hours of darkness or inclement
weather.
NOTE: Future development on the permittee's property may require
� a modification of this permit. Contact a reprdsentative of this
Division at (919) 726-7021 prior to commencement of any such
/2� activity for this determination.
This project has a high potential for sedimentation runoff
during construction. Extreme care must be undertaken to prevent
such impacts from effecting coastal resources.

White Oak Subdivision, Onslow County
DATE: October 13, 1995
The White Oak Subdivision is located off SR 1444 and adjacent to
the White Oak River, north of the Town of Swansboro, Onslow County.
The applicant is proposing to excavate an access channel and
construct a boat ramp facility as an amenity for the subdivision.
AECs impacted by the proposal include Estuarine Waters, Public
Trust Areas and the Estuarine Shoreline. Waters at the site are
classified as SA and are open to the harvesting of shellfish. The
area is not a Primary Nursery Area. A small area of 1404' wetlands
will be filled in conjunction with this project, but the filling
activity has already received a Nationwide Permit from the COE.
I have reviewed this proposal for consistency with the 1992 Onslow
County Land Use Plan (LUP) Update and offer the following comments.
The general area of the project is classified as Limited
Transition, while the AECs and 1404' wetlands impacted by the work
are classified as Conservation.
The Onslow County LUP describes the Limited Transition
Classification as intended for primarily miderate density
residential development (Pages 253-254).
The Conservation classification is discussed on Pages 263-265 of
the LUP. Onslow County allows uses consistent with the 15A NCAC 7H
Use Standards in the Estuarine Shoreline, Estuarine Waters and
Public Trust AECs. This discussion also states that uses consistent
with the permitting requirements of the Corps of Engineers and uses
consistent with local and state regulations are allowed in 1404'
wetlands.
Resource Protection Policies for AECs and wetlands (Pages 203-208)
reiterate the County's concurrence with state and federal standards
for development in these areas.
Based on the above policies, this project appears to be consistent
with the 1992 Onslow County Land Use Plan, provided all local,
state and federal requirements can be satisfied.

I. DESIGN STANDARDS
1. The following built -upon area limitations are approved for this project:
a. The allowable built -upon area per lot is 10,249 ftz square feet, based on 83 lots. Lots 21 and
22 were revised to include a 14,535 ftz boat ramp access area. This results in lots 21 & 22
having only 2,981.5 ft2 each of impervious area remaining which is available for development.
b. The total allowable built -upon area for the tract is 23 acres, including lots, streets and common
areas.
2. The bverall tract built -upon area percentage or lot sizes for the project must be maintained at levels at
least as stringent as the low density levels specified in the stornwater rules. These levels are
summarized below (more stringent levels may apply in accordance with the rules):

at White 'Oak Subdivision off SR1444, as you described in your application dated 25 September 1995.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3027.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,

This office has reviewed the subject sedimentation and erosion control Plan. We find the plan to be
acceptable and hereby issue this letter of approval with comments as attached.
Please be advised that Title 15A, of the North Carolina Administrative Code, 48.0017(a) requires that
a copy of the approved plan be on file at the job site. Also, you should consider this letter to give the Notice
required by GS 1 13A-61(d) approved plan. The last gage(s) which lists approval comments should be copied
and attached to the sedimentation and erosion control plan that is maintained on site.
North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring protection
of the natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 1 13A-51 thru 66), this office
may require revisions to the plan and its implementation to insure compliance with the Act.
Recognizing the desirability of early coordination of sedimentation control, we believe that it would
be beneficial if a pre -construction conference could be arranged to discuss the approved plan for this project.
Please contact this office and let us know the date of construction start-up and the date of pre -construction
conference so that we may attend.

The developer is responsible for the control of sediment on -site. If the approved erosion measures
prove insufficient, the developer must take those additional steps necessary to stop erosion from
leaving this site.
2. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed
development unless otherwise noted. The removal of vegetation within any existing ditch or channel
is prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical
or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work
and is subject to the same erosion control requirements as new ditches.
3. The developer is responsible for obtaining any and all permits and approvals necessary for the
development of this project prior to the commencement of this land disturbing activity. This could
include the Division of Coastal Management under CAMA requirements, the Division of Environmental
Management under stormwater regulations, the U.S. Army Corps of Engineers under Article 404
jurisdiction, local County or Town Agencies under their local ordinances, or others that may be
required. This approval cannot supersede any other permit or approval; however, in the case of a
Cease and Desist Order from the Corps of Engineers, that Order would only apply to wetland areas.
Allhighland would still have to be in compliance with the Sedimentation Pollution Control Act.
4. If any area on site falls under the jurisdiction of Section 404 of the Clean Water Act, the developer
is responsible to the orders of the U.S. Army Corps of Engineers. Any erosion control measures that
fall within jurisdictional wetland area must be relocated to the transition point between the wetlands
and the highlands to assure that the migration of sediment will not occur. If that relocation presents
a problem or contradicts any requirements of the Corps of Engineers, it is the responsibility of the
developer to inform the Land Quality Section Regional Office so that an adequate contingency plan
can be made to assure sufficient erosion control on site. Failure to do so will be considered a
violation of this approval.
5. Any borrow material brought onto this site must be from a legally operated mine or other approved
source. A single use borrow site or an area to waste material is only permissible if it is operated
under total control of the Financially Responsible person or firm who is developing this site and a plan
modification is submitted to this office that includes the area in question.
6. This permit allows for a land disturbance, as called for on the application plan, not to exceed 13.4
acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and
additional application fee. Any addition in impervious surface, over that already noted on the
approved plan, would also require a revised plan to verify the appropriateness of the erosion control
measures and stormwater retention measures.
7. The revised plan did not address the accuracy of the scale for the proposed basins, opting instead
to give generic dimensions in the general notes. The generic dimensions will not always fit in the
area of corresponding circle. For example, the 20 cubic yard basin in front of lot 45 is generically
45 feet long and 3 feet deep. Forty-five feet in length along the right-of-way will change 8 feet in
elevation; therefore, the upper end of that basin will be 11 feet deep. Please address this issue and
accurately show the size of each basin on the plot. That revision must be submitted to this office
prior to the commencement of this land disturbing activity.

SUBJECT: CAMA/Dredge and Fill Permit Application for White Oak Subdivision/Joe C.
Beam, North of Swansboro, Onslow County.
Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regards to associated impacts on wildlife and fishery resources in the area. A site
visit was conducted on October 13, 1995. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et.
seq.) and the Coastal Area Management Act (G. S. 113A-100 through 113A-128).
The applicant is requesting a permit to develop a boat launching area as an amenity of the
subdivision. Considerable topographic alterations with a bulldozer and dragline must occur to
create vehicle access and the launching/turn-around basin. The project includes a 64 ft. long x 15
ft. wide cement ramp with two parallel piers. In order to gain deep water access a 320 ft. long x
35 ft. wide channel will be dredged. Waters at the project site are classified as SA and are open
to shellfishing.
u The proposed project is to be constructed in a ravine on lots 21 & 22. Lot 21 is
approximately 340 ft. long x 110 ft. wide. There is a 27 ft. change in elevation from the road to
the river and a 14 ft. change in elevation across the lot. Currently lots 21 & 22, the existing road
and a roadside ditch drain into the White Oak River via the ravine. Removing the natural
vegetation and altering the topography will result in unfiltered, turbid stormwater flowing directly
into the White Oak River.
We strongly recommend that the boat launching area be relocated to a more suitable site.
Lots at the eastern end of the property with relatively small changes in elevation and no deep
bf a -- np,, ravines would have considerably fewer environmental impacts. Regardless of project location,
v 901 water quality and shellfish resources should be protected by prohibiting dredging between April 1
and September 30.

The following comments by the North Carolina Division of
Marine Fisheries (NC DMF) are provided pursuant to General Statute
113-131. The proposed project off SR 1444 north of Swansboro on
the White Oak River to excavate an access channel and construct a
boat ramp meets the approval of this agency only if the recommended
changes are incorporated.
North Carolina DMF staff conducted a shellfish survey of the
project site on 9 October, 1995 and found no hard clams and only an
occasional oyster both within and adjacent to the project site.
The bottom type in the proposed channel area was primarily a muddy
sand with no "oyster rock" or submerged aquatic vegetation present.
Consequently, the biological impact of this project appears
minimal. However, turbiditylevels in the White Oak River will be
° elevated during excavation activities and should, therefore, be
--7conducted after September 1 and before April 1 to minimize impacts
on recruiting juvenile finfish and shellfish species.

Dear Mr. Parker:
Reference the application of White Oak Development for a Department of
the Army permit to construct a boat ramp facility, consisting of a boat ramp,
two piers, and the placement of fill material in approximately 960 square feet
of non -vegetated wetlands, and excavate approximately 20,200 square feet of
shallow bottom for the creation of an access channel, adjacent to the White
Oak River, in the White Oak subdivision, off SR 1444, north of Swansboro, in
Onslow County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
All work authorized by this permit must be performed in strict
compliance with the permit plans.
All excavated materials will be confined landward of the mean high water
C (MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands within adequate dikes or other retaining structures to prevent
spillover of solids into any vegetated wetlands or surrounding waters.
No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters, other than the wetland area designated in the
project plans.
No vegetated wetlands will be excavated or filled.
Excavation will not exceed 3.4 feet below the elevation of mean low
L water (MLW).
No attempt will be made by the permittee to prevent the full and free
�.� use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
If the display of lights and signals on the authorized structure is not
otherwise provided for by law, such lights and signals as may be prescribed by
Qthe U.S. Coast Guard will be installed and maintained by and at the expense of
the permittee.

It is possible that the authorized structure may be damaged by wavewash
from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the
fflf-\ permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
/ The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or

If the permittee discovers any previously unknown historic or
C- archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State/Federal coordination.
If possible, under applicable law, the permittee will incorporate this
permit as part of the documents reflecting title to or interest in the real
property affected.
This Department of the Army permit does not obviate the need to obtain
other Federal, State, or local authorizations required by law.
This permit does not grant any property rights or exclusive privileges.
In issuing this permit, the Federal Government does not assume any
liability for:
a. Damages to the permitted project or uses thereof as a result of
other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of
current or future Federal activities initiated on behalf of the general
public.
C. Damages to other permitted or unpermitted activities or structures
caused by the authorized activity.
d. Design and construction deficiencies associated with the permitted
work.
e. Damage claims associated with any future modification, suspension,
or revocation of this permit.

1� MAINTENANCE DREDGING:
The work authorized herein includes periodic maintenance which may be
performed for ten years from the date of issuance of this permit provided:
a. The permittee will advise the District Engineer in writing at least
two weeks before he intends to undertake any maintenance dredging.
b. The proposed area to be dredged, method of dredging and disposal of
dredged material will be in strict accordance with that authorized by this
permit.

Dear Mr. Beam:
On February 11, 1991, we renewed general permit No. 1980002ft(copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received September 22, 1995, for Department
of the Army authorization to excavate 20,200 square feet of material for an
access channel and fill 960 square feet of unvegetated wetlands and shallow
bottom for the construction of a boat ramp facility and piers, indicates it to
be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MCA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MCA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.

b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by November 21, 1995. Also, a
copy of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbor Act and

Dear Mr. Beam:
Reference your application of February 23, 1994 for Department of the
Army (DA) authorization to hill 0.14 acres of wetlands adjacent to the
White Oak River for the purpose of constructing two crossings for an access
road to the White Oak Racquet Club at your property located on SR 1444
(Swansboro Loop Road) near Swansboro, in Onslow County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404
of the Clean Water Act, was provided for fills for roads crossing waters of
the United States (including wetlands and other special aquatic sites)
provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a
filled area of no more than one-third acre. Furthermore, no more than a total
of 200 linear feet of the fill for the roadway can occur in special aquatic
sites, including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, :a part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the
permittee notifies the District Engineer (DE) in accordance with the
"Notification" general condition.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM) and, in the coastal area, a
consistency determination from the North Carolina Division of Coastal
Management (NCDCM). You should contact Mr. John Dorney, telephone (919) 733-
_- 1786, regarding water quality certification, and Mr. Steve Benton, telephone
(919) 733-2293, regarding consistency determination. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval.

This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
Also, this verification will remain valid for the two years if, during that
period, the nationwide permit authorization is reissued without modification
or the activity complies with any subsequent modification of the nationwide
permit authorization. If during the two years, the nationwide permit
authorization expires or is suspended or revoked, or is modified, such that
the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the
nationwide permit will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration,
modification or revocation, unless discretionary authority has been exercised
on a case -by -case basis to modify, suspend or revoke the authorization.

GENERAL CONDITIONS
1. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly
maintained, including maintenance to ensure public safety.
3. Erosion and Siltation Controls. Appropriate erosion and siltation controls
must be used and maintained in effective operating condition during
construction, and all exposed soil and other fills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life Movements. No activity may substantially disrupt the movement
of those species of aquatic life indigenous to the waterbody, including those
species which normally migrate through the area, unless the activity's primary
purpose is to impound water.
5. Equipment. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to minimize soil disturbance.
6. Regional and Case -by -case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps. '
7. Wild and Scenic Rivers. No activity may occur in a component of the
National Wild and Scenic River System; or in a river officially designated by
Congress as a "study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wild and Scenic Rivers may
be obtained from the National Park Service and the U.S. Forest Service.
S. Tribal Rights. No activity or its operation may impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty fishing
and hunting rights.
9. Water Quality Certification. In certain states, an individual state water
quality certification must be obtained or waived.
10. Coastal Zone Management. In certain states, an individual state coastal
zone management consistency concurrence must be obtained or waived.
11. Endangered Species. No activity is authorized under any NWP which is
likely to jeopardize the continued existence of a threatened or endangered
species or a species proposed for such designation, as identified under the
Federal Endangered Species Act, or which is likely to destroy or adversely
modify the critical habitat of such species. Non -Federal permittees shall
notify the District Engineer if any listed species or critical habitat might be
affected or is in the vicinity of the project and shall not begin work on the
activity until notified by the District Engineer that the requirements of

the Endangered Species Act have been satisfied and that the activity is
authorized. Information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Marine
Fisheries Service.
12. Historic Properties. No activity which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places.is
authorized, until the District Engineer has complied with the provisions of 33
CFR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe may be eligible for listing on the National Register of Historic Places,
and shall not begin the activity until notified by the District Engineer that
the requirements of the National Historic Preservation Act have been satisfied
and that the activity is authorized. Information on the location and existence
of historic resources can be obtained from the State Historic Preservation
Office and the National Register of Historic Places (see 33 CFR 330.4(g)).
13. Notification.
a. Where required by the terms of the NWP, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may proceed
under the NWP with any special conditions imposed by the District or Division
Engineer; or
(2) if notified by the District or Division Engineer that an individual
permit is required; or
(3) Unless 30 days have passed from the District Engineer's receipt of the
notification and the prospective permittee has not received notice from the
District or Division Engineer. Subsequently, the permittee's right to proceed
under the NWP may be modified, suspended or revoked only in accordance with the
procedure set forth in 33 CFR 330.5(d)(2).
b. The notification must be in writing and include the following
information and any required fees:
(1) Name, address and telephone number of the'prospective permittee;
(2) Location of the proposed project;

(3) Brief description of the proposed project; the project's purpose;
direct and indirect adverse environmental effects the project would cause; any
other NWP(s), regional general permits) or individual permit(s) used or
intended to be used to authorize any part of the proposed project or related
activity;
(4) Where required by the terms of the NWP, a delineation of affected
special aquatic sites, including wetlands; and
(5) A statement that the prospective permittee has contacted;
(a) The USFWS/NMFS regarding the presence of any Federally listed (or
proposed for listing) endangered or threatened species or critical habitat in
the permit area that may be affected by the proposed project; and any available
information provided by those agencies. (The prospective permittee may contact
Corps District Offices for USFWS/NMFS agency contacts and list of critical
habitat.)
(b) The SHPO regarding the presence of any historic properties in the
permit area that may be affected by the proposed project; and the available
information, if any provided by that agency.
14. Water Supply Intakes. No discharge of dredged or fill material may occur
in the proximity of a public water supply intake except where the discharge is
repair of the public water supply intake structures or adjacent bank
stabilization.
15. Shellfish Production. No discharge of dredged or fill material may occur
in areas of concentrated shellfish production, unless the discharge is directly
related to a shellfish harvest activity authorized by nationwide permit.
16. Suitable Material. No discharge of dredged or fill material may consist of
unsuitable material (e.g., trash, debris, car bodies, etc.) and material
discharged must be free from toxic pollutants in toxic amounts.
17. Mitigation. Discharges of dredged or fill material into waters of the
United States must be minimized or avoided to the maximum extent practicable at
the project site (i.e., on -site), unless the District Engineer has approved a
compensation mitigation plan for the specific regulated activity.
18. Spawning Areas. Discharges in spawning areas during spawning seasons must
be avoided to the maximum extent practicable.
19. Obstructions of High Flows. To the maximum extent practicable, discharges
must not permanently restrict or impede the passage of normal or expected high
flows or cause the relocation of the water (unless the primary purpose of the
fill is to impound waters).
20. Adverse Impacts from Impoundments. If the discharge creates an impoundment
of water, adverse impacts on the aquatic system caused by the accelerated
passage of water and/or the restriction of its flow shall be minimized to the
maximum extent practicable.
21. Waterfowl Breeding Areas. Discharges into breeding areas for migratory
waterfowl must be avoided to the maximum extent practicable.
22. Removal of Temporary Fills. Any temporary fills must be removed in their
entirety and the affected areas returned to their preexisting elevation.
INFORMATION
a. All crossings must be from high ground to high ground.
b. Bridging will be required in areas designated as anadromous fish spawning
areas by the North Carolina Division of Marine Fisheries (NCDMF) or the North
Carolina Wildlife Resources Commission (NCWRC) if the District Engineer (DE)
determines that use of culverts would likely preclude the continued use of the
upstream waters as spawning areas for the anadromous fish.
NATIONWIDE CONDITIONS
a. The width of the fill is limited to the minimum necessary for the actual
crossing.
b. The fill placed in waters of the U.S. is limited to a filled area of no
more than 1/3 acre.
c. No more than a total of 200 linear feet of the fill for the roadway can
occur in special aquatic sites, including wetlands.
d. Crossing is culverted, bridged or otherwise designed to prevent the
restriction of, and'to withstand, expected high flows and tidal flows and the
movement of aquatic organisms.
e. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the U.S.
f. Fills in special aquatic sites, including wetlands, require a 30-day
notification to the District Engineer (DE). The notification must include a
delineation of affected special aquatic sites, including wetlands.
g. Where local circumstances indicate the need, the District Engineer (DE)
will define the term "expected high flows" for the purpose of establishing
applicability of this nationwide permit.
STATE CONSISTENCY CONDITIONS
a. If the proposed activity is within the North Carolina Coastal Area, the
applicant must receive written concurrence from the North Carolina Division of
Coastal Management (NCDCM) that the activity is consistent with the North
Carolina Coastal Management Program.
b. All fill material authorized by this permit must be obtained from an upland
source.
c. Under this permit, bridging is required in areas designated as anadromous
fish spawning areas by the North Carolina Division of Marine Fisheries (NCDMF)
or the North Carolina Wildlife Resources Commission (NCWRC) in order to allow

the continued use of upstream waters for spawning. Use of culverts in these
situations is not authorized under this permit.
d. Should all or part of a proposed activity be located within an Area of
Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission (NCDCM), a Coastal Area Management Act (LAMA) permit is
required from the North Carolina Division of Coastal Management (NCDCM). Should
an activity within or potentially affecting an AEC be proposed by a Federal
agency, a consistency determination pursuant to 15 CFR 930 must be provided to
the NCDCM at least 90 days before the onset of the proposed activity.
GENERAL CERTIFICATION CONDITIONS
a. Proposed fill or substantial modification under this General Certification
requires written concurrence from the North Carolina Division of Environmental
Management (NCDEM).
b. If written concurrence is not issued by the North Carolina Division of
Environmental Management (NCDEM) within 45 days from receipt of a complete
application by the Division's Section 401 Certification Office in Raleigh, then
Section 401 Certification is waived for this Nationwide Permit unless additional
information is requested in writing by the Director.

C. The width of the fill is limited to the minimum needed for the actual
crossing.
d. The roadway width shall be minimized as much as practicable and that no
practicable alternative exists.
e. Established sediment and erosion control practices will be utilized to -
prevent violations of the appropriate turbidity water quality standard (50 NTU's
in streams and rivers not designated as trout waters by the North Carolina
Division of Environmental Management (NCDEM), 25 NTU's in all saltwater classes
and all lakes and reservoirs and 10 NTU's in trout waters).
f. Measures shall be taken to prevent live or fresh concrete from coming into
contact with waters of the State until the concrete has hardened.
g. Additional site -specific conditions may be added to this Certification in
order to ensure compliance with all applicable water quality and effluent
standards.
h. Concurrence from the North Carolina Division of Environmental Management
(NCDEM) that this Certification applies to an individual project shall expire
three years from the date of the cover letter from the NCDEM.

The Wilmington Regional Office received a revision for the White Oak Subdivision Boat Ramp on
September 25, 1995. A preliminary review of that information has determined that the submittal for the
subject project is not complete. The following information is needed to continue the stormwater review:
1. Will the sodded areas shown on the plans serve as grassed parking? Any surface that is
driven over or used for parking is considered impervious.
2. Please provide the built -upon area calculations for the boat ramp access and parking.
3. From the plans it appears that building on Lots 21 and 22 may still occur. Please provide
assurances that Lots 21 and 22 will not be sold and built upon. If the developer wishes to
build on Lots 21 and 22, a reallocation of the built -upon area per lot must be done to
account for the boat ramp access and parking.
4. Runoff from the impervious areas must be permanently diverted away from the surface
waters. The temporary sediment trap and diversion ditches shown should become permanent
structures. Point source discharges to SA waters are strictly forbidden.

The Wilmington Regional Office received the Stormwater Submittal for White Oak Subdivision on
May 31, 1994, with final information on July 11, 1994. Staff review of the plans and specifications,
including the statement of intent to deed restrict the allowable built -upon area to 10,249 square feet for
each of the 83 lots shown on the approved plan, has determined that the project as proposed will comply
with the Stormwater Regulations set forth in Title 15A NCAC 211.1003(a)(2).
Any modification of the plans submitted to and approved by this Office or further development of
this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area as shown on the
approved plans.
This Certification shall be effective from the date of issuance until rescinded. The project shall be
constructed and maintained in accordance with the plans and specifications approved by the Wilmington
Regional Office. This Certification does not supersede any other permit or approval. The developer is
responsible for obtaining any and all permits and approvals necessary for the development of this project.
This could include the Division of Coastal Management under CAMA requirements, the Division of
Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill
Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland Permit,
NPDFS stormwater permit if disturbing five acres or more, local County or Town Agency permits under
their local ordinances, or others that may be required.

Dear Mr. Beam:
The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located off NCSR 1444 and adjacent to the
White Oak River, north of the Town of Swansboro, in Onslow County. It was received on
September 7, 1995, and appears to be adequate for processing at this time. The projected
deadline for making a decision is November 22, 1995. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
