Boatramp and Bulkhead Construction
1) The dock platform and double boat ramp shall not exceed a length of 30 feet waterward of the
normal water level, and shall not extend more than one third of the way across the waterbody. The
location of the boat ramp(s) and dock shall be approved by a represntative of the Division of Coastal
Management prior to inititation of construction.
Excavation and Fill
2) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted
between February 15 and June 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the Division of Marine Fisheries.

wetlands behind adequate dikes or other retaining structures to prevent spill -over of solids into any
marsh or surrounding waters.
4) The riprap bulkhead shall not extend more than 6 feet beyond the normal water level at any
point along its alignment.
5) All riprap material must consist of clean rock or masonry materials such as, but not limited to,
granite or broken concrete. The riprap must be of sufficient size to prevent its movement from
the site by wave action.
6) The temporary placement or double handling of excavated or fill material within waters or
vegetated wetlands is not authorized.
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction must not visibly increase the amount
of suspended sediments in adjacent waters.
8) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain
erosion within thirty days of project completion.
General
9) The authorized struture and associated activity must not cause an unacceptable interference with
navigation.
NOTE: The pemuttee will maintain the authorized work in good condtion and in conformance
with the terns and conditions of this permit. The pemrittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third

construct two public boat ramps and a floating dock, on property located off
NC 343, adjacent Sawyers Creek, near Camden, Camden County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore,
you may commence construction activity in strict accordance with applicable
State authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil
and/or administrative penalties.
If any change in your work isrequiredbecause of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action
is necessary as revised plans must be reviewed and the authorization modified.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then

which the owner claims title, plus written permission
from the owner to carry out the project.
An accurate dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 710203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of Engineers
regarding that agency's use of larger drawings.) A site
or location map is part of plat. requirements and it
must be sufficiently detailed to guide agency personnel
unfamiliar with the area to the site. Include highway

decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require

Site Description
The proposed boat ramp site is in Camden County adjacent to SR 343 and Sawyer's Creek,
approximately 180 ft. down stream from the Sawyer's Creek Bridge. Sawyer's Creek is a
tributary to the Pasquotank River, upstream from the US 158 Elizabeth City - Camden
Causeway.
The water depth at mid -channel is approximately 11 ft. at NWL. The creek as
approximately 90 ft. wide at the proposed site. The waters of Sawyer's Creek are classified
by the Wildlife Resources Commission as Inland waters. The waters of Sawyer's Creek are
classified as Public Trust Waters by the Division of Coastal Management and are part of the
Estuarine System Area of Environmental Concern.
The shoreline is vegetated in a hardwood canopy of Acer rubrum (red maple), Liquidambar
styraciflua (sweet gum) and Taxodium distichum (bald cypress) with an understory of Myrica
cerifera (wax myrtle). There is little or no groundcover vegetation. A ten foot '404'
wetland band is located between the NWL and the adjacent upland area.
Proposed Work
The applicant proposes to develop a boat ramp facility at the above described site on
Sawyer's Creek. The proposed work includes two 14 ft. wide by 76 ft. long concrete launch
ramps. The ramps will extend 40 ft. beyond the NWL. The two ramps will be divided by a
64 ft. long by 8 ft. wide floating dock. The dock will be divided into four 16 ft. sections.
The shoreline adjacent to the ramp structure will be stabilized with Class A erosion control
stone return walls. The applicant will also construct a 30,000 sf. parking area surfaced with
crushed stone.
Anticipated Impacts
The proposed work will not impact any Coastal Wetlands or Estuarine Shoreline. The
proposed work will cross a 10 ft. wide wooded wetland (520 sf.) and impact 1672 sf. (0.039
acre) of Public Trust Waters. These impacts to the AEC include the shading of 336 sf. of
Public Trust Waters. The upland portion of the boat ramp structure and the parking area
will impact approximately 32,184 sf. (0.739 acre).
The proposed work will also result in increased turbidity in the adjacent waters and
downstream until the work is complete and the site is stabilized and re -vegetated.
Currently, there are no public boating access facilities located in Camden County. The
proposed project will result in an improvement in access and an increase in use of Public
Trust Waters in the Camden County/Elizabeth City vicinity of the Pasquotank River and
those waters which connect to the River and Albemarle Sound.

CAMA Review
The implementation strategy in the Camden LUP Update states that the County relies on the
NC DEH & NR to regulate development within Public Trust Waters of the County. It is the
policy of the County to support all private and public water front access projects which have
private or grant resources. The proposed structure would be funded through WRC monies.
The proposed development is consistent with the Camden County 1993 Land -Use Plan
Update.

Permit Recommendations

The applicant proposes to construct a boat ramp and associated
parking facility on Sawyers Creek near the Camden County Court
House.
There are currently no public boat ramp facilities in Camden
County. The proposed facility will improve Public Trust Waters
access to the Pasquotank River and Sawyer Creek vicinity.
I recommend the proposed project be permitted with the
following conditions.
1] The rip rap bulkhead not extend more than 5 ft. beyond
the NWL at any point along its alignment for shoreline
stabilization.
2] The rip rap material must be free from loose dirt or any
other pollutants. The stone material must be sufficient size to
prevent its movement from the site by wave action.
3] All excavated material will be confined above the mean
high water level and landward of any wetlands behind adequate
dikes or other retaining structures to prevent spill -over of solids
into any wetland or surrounding waters.
4] The site is to be properly graded and provided a ground
cover sufficient to restrain erosion within thirty days after the
completion of work.
5] The dock platform shall not exceed an area of 500 sf. and
shall not exceed a length of 30 ft. waterward of the NWL or one-
third the width of Sawyer Creek at the vicinity of the boat ramp
construction.
✓6] The double -ramp structure shall be constructed as per the
subfiitted plats dated January 22, 1996 with the exception that the
concrete ramp structure shall not extend more than 20 ft. waterward
of the NWL.
7] All dredge activity must cease between February 15 and
October 1 of each year.

The following comments by the North Carolina Division of Marine Fisheries is
provided pursuant to General Statute 113-131.
Sawyer's Creek functions as a spawning and nursery area for blueback herring and
alewife. White perch, yellow perch, catfishes and other commercially and recreationally
important species also utilize the area.
The Division expresses the following concerns with the proposed application. The
field investigation report states that 360 sq. ft. of Public Trust Waters will be dredged. This
/dredging is not addressed in the Bio-report. The Division does not see the need for ramps
extending 40 ft. beyond NWL. The width of the creek is only 90 ft., and according to the
Bio-report the water depth at mid -channel is 11 ft.
The proposed width (8 ft.) of the floating dock is rather excessive. This agency
realizes that the facility is to be handicap accessible. However, it seems the floating docks

This agency requests a construction moratorium associated with in water activities.
The moratorium time frame is 15 February through 30 June. This will ensure the
environmental integrity of the area is protected during critical times of usage by the
previously mentioned species.

1. The area be properly graded.
2. A permanent ground cover,sufficient to restrain erosion
be provided on all exposed areas within the shorter of
30 working or 120 calendar days after project comple-
tion.
3. The exterior slopes of the disposal area dikes be at an
angle no steeper than 1 1/2 H: 1 V.
4. Appropriate erosion and sedimentation control devices,
measures, or structures be used to prevent sediment
from entering the adjacent wetlands/watercourses/
property (e.g., silt fence, diversion swales/berms,
sand fence, etc.).
5. A ground cover sufficient to restrain erosion be
provided within 30 working days of completion of any
phase of grading on cut or filled slopes.
6. An erosion and sedimentation control plan be submitted
at least 30 days prior to initiation of land -disturbing
activities.
7. Additional information concerning the area of the land-
ward disturbance be submitted to determine if an
erosion control plan is required.

of constructing two boat ramps, a pier and parking lot at NC 343. as you described in your application
dated 20 March 1996. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

Reference the application of the NC FJildli.fe Resources Commission for
a Department of the Army (DA) permit to construct two public boat tamps and
a floating dock, on property located off NC '43, adjacent Sawyers Creek, near
Camden, Camden County, North Carolina,
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. No vegetated wetlands will -be excavated or filled outside of the
permitted area.
3. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
4. The fill material will be clean and free of any pollutants except =n
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
5. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
6. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.

On February 11, 1991, we renewed General Permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received March 22, 1996, for Department of
the Army (DA) authorization to construct two public boat ramps and a floating
dock, on property located off NC 343, adjacent Sawyers Creek, near Camden,
Camden County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will
be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. only after receiving such
confirmation should you begin work.

Enclosed is the application of the North Carolina Wildlife Resources
Commission for Department of the Army (DA) authorization and a State Water
Quality Certification to construct two public boat ramps and a floating dock,
on property located off NC 343, adjacent Sawyers Creek, near Camden, Camden
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable
for State action. Therefore, if you have not acted on the request, or asked
for an extension of time, by May 25, 1996, the District Engineer will deem
that waiver has occurred.

THAT WHEREAS, the Department of Environment, Health & Natu-
ral Resources, Wildlife Resources 'Commission, has requested and
approved the execution of this instrument for the purposes herein
specified;.and,
WHEREAS, the execution of this agreement for and on behalf
of the State of North Carolina has been duly approved by the Gov-
ernor and Council of State at a meeting held in the City of
Raleigh, North Carolina, on the 6th day of June, 1995; and,
WHEREAS, the parties hereto have mutually agreed to the
terms of this Lease Agreement as hereinafter set. out;

promises and covenants contained in the terms and conditions

ditions hereinafter set forth, those premises or office space,
with all rights, privileges and appurtenances thereto belonging,
lying and being in Sawyers Creek, County of Camden, North Caro-
lina, and more particularly described as follows:
BEING a parcel of land in Courthouse Town-
ship, Camden County, North Carolina, bounded
on the North by NC 343; on the Southeast by
Sawyers Creek; on the Southwest by Tom
Nobilett and on the West by the Camden County
Board of Education. Beginning at an iron rod

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located adjacent SR 343, Camden, Sawyer's
Creek. It was received on February 26, 1996 , and appears to be ad quate for processing at
this time. The projected deadline for making a decision i r Q 1996. An additional
75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
