1) This permit authorizes only the filling of the "404" wetland area indicated on the 1/9/96 workplan
drawing. The excavation and backfilling of the berm, as indicated on the 1/9/96 workplan drawing,
is not authorized by this permit.
EXCAVATION AND FILL
2) No marsh grass shall be excavated or filled.
3) All back fill material will be obtained from a highground area.

This permit action may be appealed by the pemtittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Dear Mr. and Mrs. Williams:
Reference your application for a Department of the Army permit to place
fill material in approximately 0.2 acre of vegetated wetlands adjacent to
Tucker's Creek, at 101 Jericho Drive, in Beaufort, Carteret County, North
Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not

from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by I V white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to

The Williams' property is located at the end of East Fairview Drive, adjacent
to Turner's Creek, near the Town of Beaufort, Carteret County. They propose
to grade and fill a portion of their property which includes an area of 1404,
wetlands. The applicants plan to build a residence on the property in the
future, although it will be located outside the Estuarine Shoreline AEC.
The Estuarine Shoreline AEC will be impacted by the work, as well as 1404'
wetlands. Waters at the project site are classified as SA and are closed tc
the harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1990 Town of Beaufort
Land Use Plan (LUP) Update and offer the following comments.
The general area of the project is classified as Limited Transition, while
the Estuarine Shoreline AEC impacted by the work is classified as
Conservation.
Applicable policies contained in the LUP include Resource Protection Policies
regarding physical limitations for soils. It is the policy of the Town of
Beaufort to "co-operate with the U.S. Army Corps of Engineers in the
regulation/enforcement of the 11404" wetlands permit process" (Page IV-2). No
additional restrictions upon development in 1404' wetlands beyond the federal
requirements is imposed by the Town.
Policies adopted by the Town of Beaufort for development in Conservation
classified AECs are summarized on Page V-2. Development in the estuarine
system is restricted to uses which satisfy the 15A NCAC 7H Use Standards,
with the exception of the location of floating homes, which has no
applicability to this proposal. Resource Production and Management Policies
for Residential, Commercial, and Industrial Development Impacts on Resources
(Page IV-7) states the Town's intent of allowing residential development in
Estuarine Shoreline areas which is consistent with local zoning and the 7H
minimum use standards.
Based on the above policies, this project appears to ��t with the
1990 Town of Beaufort Land Use Plan, provided all loca , state, tate, and federal
requirements can be satisfied.

The Division of Environmental Management, Water Quality Section has review our
plans for the discharge of fill material into 0.2 acres of waters and/or wetlands located at Turners
Creek and East Fairview Drive in Carteret county for earth and trash fill. Based on this review,
we have identified problems with your proposed plan. Furthermore, insufficient evidence is
present in our files to conclude that your project must be built as planned in waters and/or
wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A
NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this
letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management
place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your project with clean fill and not use the
berm/trash material to fill the site? The N.C. Division of Solid Waste Management staff have
stated that the berm/trash material would be inappropriate fill. Any documentation such as maps
and narrative that you can supply to address alternative designs for your project may be helpful
in our review of your 401 Certification. Please respond within two weeks of the date of this
letter by sending a copy of this information to me and one copy to Ms. Stephanie Petter at the
Wilmington Regional Office at 127 Cardinal Drive Ext., Wilmington, NC 28405-3845. I can

in regards to the fate of the trash and debris currently on the
site. A site visit revealed only household trash, particularly

debris should also be specified prior to project approval.

Dear Mr. and Ms. Williams:
You have our approval to place fill material in 8,500 square feet of wetlands or waters for the
purpose of preparing a lot for residential use at 101 Jericho Drive, as you described in your application
dated 31 January 1996. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. The berm along
Turner's Creek shall not be disturbed. In addition, you should'get any other federal, state or local
permits before you go ahead with your project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C.27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require

The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
Below is a revision of our recommendations for conditions to be for
included in State authorizations.
a. All work authorized by this permit must be performed in strict
compliance with the permit plans-.
b. The berm will be removed from its waterward toe landward 12 (twelve)
feet from mean high water (MHW) for its entire length. The berm will be
removed to an elevation equal to that of adjacent undisturbed wetlands.

disposal area.
d. Clean earthen fill material may be placed in the wetlands from high
ground to a point twelve feet landward of MHW.
fie. Prior to beginning work, an onsite meeting between the contractor

and excavation will be delineated at this meeting.

In accordance with Part II, Section 4 of the current Memorandum of
Agreement between the Departments of Commerce and the Army, I am
offering the following comments on permit application 199602830(GP)
dated January 29, 1996. The applicants, Roger and Sara Williams,
propose to remove a berm and fill wetlands adjacent to Turner's
Creek near Beaufort, Carteret County, North Carolina.
The proposed project consists of the removal of a 180-foot-long by
12-foot-wide by 5-foot-high berm. The berm consist of debris
material that was placed on the site when it was used as a land
fill by the Town of Beaufort. The applicant proposes to excavate
the berm and place the material in a 175-foot-long by 10-foot-wide
by 4-foot-deep trench to be excavated in adjacent uplands. The
material excavated from the trench would be used to fill
approximately 0.2 acre of scrub shrub wetlands located between the
upland portion of the site and the adjacent tidal marsh in Turner's
Creek.
Based on a February 12, 1996, on -site inspection of the project
area, we are concerned that several aspects of this project would
be detrimental to National Marine Fisheries Service trust
resources. We do not object to the proposed removal of the berm,
however, the berm material is of unknown origin and could include
pollutants that could leach into adjacent estuarine waters and
adversely impact fishery resources. Therefore, we believe that all
material excavated from the berm should be removed from the site
and disposed of in an approved upland area.
We are also concerned that approximately 0.2 acre of wetlands would
be filled. Fill material would be placed directly adjacent to
tidal marsh where it would be subject to erode into the marsh and
adjacent estuarine waters. Although a silt fence is planned during
project construction, no permanent erosion control measures are
proposed by the applicant.
Although most of the wetland vegetation at the site has been cut,
our observations indicate that project area wetlands are vegetated
with irregularly flooded scrub shrub species. These wetlands
function to remove sediments and pollutants from stormwater run-off
and thereby assist in the maintenance of good water quality
necessary for continued fishery production. In addition, Turner's
Creek, located adjacent to the project site, functions as a primary
nursery area for a variety of estuarine dependent species including
Atlantic croaker (Micro 0 onias undulatus), spot (Leiostomus
xanthurus), bluefish (Pomatomus saltatrix), flounders (Paralichthvs
spp.), and striped mullet (Mugil ceohalus).
In view of the above, we recommend that federal authorization of
this work not be granted unless the following
modifications/conditions are incorporated.
1. The excavated berm material shall be removed from the site and
disposed of in an acceptable upland area.
2. The portion of the site proposed for fill shall extend no
further than 12-feet landward of the mean high water line.
3. The waterward side of the fill shall be permanently stabilized
in a manner to prevent the erosion of the fill material into
adjacent tidal wetlands.

According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by March 29, 1996, the District Engineer will deem that
waiver has occurred.

On February 11, 1991, we renewed general permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received January 22, 1996, for Department of
the Army authorization to 8,500 square feet of vegetated wetlands adjacent to
Turner's Creek, at 101 Jericho Drive, in Beaufort, Carteret County, North
Carolina, indicates it to be a candidate for Federal authorization under this
general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MCA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.

b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by February 29, 1996. Also, a
copy of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.

8. PROJECT SUMMARY: The applicant plans to grade and fill an area on his property which includes
an area of 404 wetlands.

9. NARRATIVE DESCRIPTION: The applicant's property consists of an
approximately one acre tract of land located adjacent to Turner's Creek and at the very
end of East Fairview Drive, near the Town of Beaufort, Carteret County. To reach
the site one would take a right at the Gant Station (the one on US Hwy 70 just before
its intersection with NC Hwy 101 in the Town of Beaufort) and follow this road (East
Fairview Drive) to the very end. The road then becomes a narrow paved and dirt
drive and the applicants property is located on the right almost at the very end. The
property borders Turner's Creek on the south. A portion of the property adjacent to
the Creek was used as a trash site by the Town of Beaufort many years ago. The
majority of the trash was piled next to the Creek which created an approx. 180' long x
12' wide x 5' high berm. For the most part the berm is covered with soil and is
vegetated. Waterward of the berm, an approx. 10 to 50' border of Spartina alterniflora
exist before reaching the surface waters of Turner's Creek. The plat shows an area of
"404" wetlands approx. 15' to 50' wide running the width of the property which has
been mowed level with the ground leaving stumps and various weeds and grasses. The
"404" wetlands have been delineated by the US Corps of Engineers, however the plat
has not been verified by the Corps to this date. The remainder of the applicant's
property consists of a upland grassed lawn/field area. The waters of Turner's Creek
have been classified as SA and are closed to the harvesting of shellfish.
The applicant is proposing to remove the berm and to fill in the "404" wetlands which
separates the berm with adjacent high ground. Plans included with the application
indicate that the trash and other debris removed from the berm will be buried in an
approx. 175' long x 10' wide x 4' deep trench which will be located on uplands. The
spoil material from the trench excavation is proposed to be placed in the "404"
wetlands. Additional fill may have to be brought in to bring this area up to the same
grade as the adjoining property. A silt fence is proposed to be installed between the
land disturbing activity and the adjacent Coastal Wetlands to prevent any material from
entering adjacent waters or Coastal Wetlands. No Coastal Wetlands would be
disturbed by this project.
10. ANTICIPATED IMPACTS: The Town of Beaufort has used a portion of the
property as a trash dump. A visually inspection of the exposed bottles would lead one
to believe that the dump is not that old and was probably used in the 1950's or '60's.
The applicant proposes to bury the debris within a trench that will be excavated in
high ground. The spoil material from the trench excavation and other imported fill
material would be used to fill in an approximately 115' long x 200' wide area of the
applicant's property. Included within this area would be approx. 8,500 ft.2 of "404"
wetlands. A silt screen is proposed to be installed between the land disturbance and
adjacent wetland or water areas. In the future, a residence is proposed to be
constructed on the lot but it will be located outside of the Estuarine Shoreline AEC.

Creek, in Beaufort County. Although processing of the application is nearing completion,
additional time is needed for this office to complete the review and make a decision on your
request. Therefore, it is necessary that the standard review time be extended. An additional 75
days is provided by G.S. 113A-122(c) which would make June 7, 1996 the new deadline for
reaching a decision on your request. However, we expect to take action prior to that time and
will do so as soon as possible. In the interim, if you have any question on the status of your

The Division of Environmental Management, Water Quality Section has revie-wtdro-ur
plans for the discharge of fill material into 0.2 acres of waters and/or wetlands located at Tumer's
Creek and East Fairview Drive in Carteret county for earth and trash fill. Based on this review,
we have identified problems with your proposed plan. Furthermore, insufficient evidence is
present in our files to conclude that your project must be built as planned in waters and/or
wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A
NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this
letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management
place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your project with clean fill and not use the
berm/trash material to fill the site? The N.C. Division of Solid Waste Management staff have
stated that the benn/trash material would be inappropriate fill. Any documentation such as maps
and narrative that you can supply to address alternative designs for your project may be helpful
in our review of your 401 Certification. Please respond within two weeks of the date of this
letter by sending a copy of this information -to me and one copy to Ms. Stephanie Petter at the
Wilmington Regional Office at 127 Cardinal Drive Ext., Wilmington, NC 28405-3845. I can

processing at this time. The projected deadline for making a decision is March 25, 1996. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right -of --way fronting your property; or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
