Issued to Terry & Joy Kelly, authorizing development in the Estuarine Shoreline (AEC) at 110 Tarpon Drive, in Holden
Beach NC, as requested in the permittee's application, dated November 28, 2022, time extended December 23, 2022.
This permit issued on January 4, 2023, is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms
may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: CONSTRUCT A SINGLE FAMILY RESIDENCE, GRAVEL DRIVEWAY AND UNDERGROUND
STORMWATER RETENTION DITCHES. NO FILL MATERIAL HAS BEEN PERMITTED FOR THIS LOT,
(1) Ali proposed development and associated consinadon must be done In accordance with the permitted work plat
drawings(s) dated received December 30, 2022 and signed by Everett G. Graham, dated 1229-2022,
(2) All construction must oonform to the N.C. Buflding Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use acivtdes will require a re-evaluation and
modification of this permit. S

The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of mean high water. In this

Unless specifically allowed in 15A NCAC 07H. 0209(d)(10) and shown on the permitted plan drawing, all
development1construction including the overhangs shall be located a distance of 30 feet landward of normal high
water measured tram the landward face of the existing bulkhead.
This permit is being issued based on 15A NCAC 07H.0209 (d)(10)(J)(I).

All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of oonstrucbon
completion.
(9) Artificial grass is not permitted.
(10)Be advised that an as built final survey will be required prior to final inspection with all impervious calculations
and overhang locations shown to verify town setback requirements. The setbacks are measured from the platted
property line as shown on the survey.
(11)FII material has not been approved for this property. The concrete slab is approved at an elevation of 5.9.

(11)The (3)10' x 20' parking spaces shall remain accessible for the life of the structure.
(12) The underground stormwater retention shall not be located within the 3D-foot buffer area and shall be
inspected prior to being covered up by the engineer that will provide the letter of compliance.
(13)There shall not be any impervious fabric — product placed until the gravel placed in the driveway that will
not allow water to infiltrate through. (Marl, coquina, or ABC rock material is not allowed)
(14)No structure including the HVAC unit, stairs, steps shall not be located within the 5 foot side yard setbadc area
measured from the property line.
(15) The primary intent of these regulations in chapter 158.09 in part, is to satisfactorily control stormwater on
individual parcels of land, and to control runoff onto adjacent property, or water induces soil erosion in any form. r
(16) Overhangs are not permitted within any of the town's setbacks that are measured from the platted property line.
(17) This lot is located in a flood zone AE elevation 12' with a DFE of 14'.
(18) Elevated buildings with enclosed areas which are below the lowest floor shall not be designed or used for human
habitation, but shall only be used for parking of vehicles, building access, or limited storage of maintenance
equipment used in connection with the premises. The interior portion of such enclosed area shall not Ix finished
or partitioned into separate rooms, except to enclose storage areas. FLOOD VENTS AND BREAK -A-WALLS
ARE REQUIRED. This areas shall not prevent access to all (3)10'x20' required parking spaces.
