1) The foundation piling of the structure must be located landward of the first line of stable natural
vegetation, a distance of 120 feet. This must be established by Division of Coastal Management
representatives from the Wilmington District Office, immediately prior to any structural piling
placement. The line must be re-established if construction is not initiated within sixty (60) days
and/or if there is a major shoreline change prior to commencement of construction.
2) The local government should advise as to the project's consistency with local building height and/or
density requirements.
3) Sand held in storage in any dune, other than frontal dunes, may be moved laterally in order to
strengthen existing primary frontal dunes if the work would enhance the protection to the proposed
development activity and the sand is immediately stabilized.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) ' Sand used to strengthen dunes must be brought in from an outside source and must be of the same
nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot.
5) Structural pedestrian access ways over frontal dunes must not exceed 6' in width and may not be for
commercial or motor -powered vehicular use. The access way shall be constructed over the frontal
dune without any alteration of the dune beyond the driving of pilings. Any vegetated areas that are
disturbed shall be re -vegetated as soon as feasible. No gazebo or deck is authorized by this permit.
6) All disturbed areas shall be vegetated and mulched within fourteen days of construction completion.
7) Any structure shall be relocated or dismantled when it becomes imminently threatened by changes
in shoreline configuration. The structures shall be located or dismantled within two years of the time
when it becomes imminently threatened, and in any case upon its collapse or subsidence. However,
if natural shoreline recovery or beach renourishment takes place within two years of the time the
structure becomes imminently threatened so that the structure is no longer imminently threatened,
then it need not be relocated or dismantled at that time. This condition shall not affect the permit
holder's right to seek authorization of temporary protective measures allowed under Rule .0308(a)(2)
of this section.
8) The Division of Water Quality approved the project on November 22, 1996 under Storm water
Management Permit No. S W8961001. Any violation of the S WMP will be considered a violation
of this CAMA permit.
9) Facility lighting shall be of a design that will not affect nesting or hatching activities of sea turtles.
NOTE: Contact officials at the Brunswick County mosquito control office to discuss mosquito
breeding prevention on the track.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must
be filed at least thirty (30) days prior to the beginning of any land -disturbing activity.
Submit this plan to the Dept. of Environment, Health and Natural Resources, Land Quality
Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2' by ll' white paper. (Refer to
Coastal Resources Commission Rule 7I.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Through coordination with the North Carolina Division of
Coastal Management, we have learned of your proposal to modify
your existing permit to include the construction of an additional
8 unit condominium and associated parking adjacent to the
Atlantic Ocean at the Windjammer II development, located at
23 Ocean Isle West Boulevard, in Ocean Isle Beach,
Brunswick County, North Carolina.
I have reviewed your proposed modification and have
determined that this work will not result in any impacts to
jurisdictional waters or wetlands. Therefore, no Department of
the Army authorization will be required. Please be advised that
this does not relieve you of the necessity to obtain all required
State and local authorization prior to beginning work.

OCEAN ISLE BEACH; Density
rules lead to suit

BOLIVIA - A Brunswick County developer has sued the town of Ocean
Isle Beach, saying island officials won't allow the company to build the
second phase of its condominium project.
Three Island Partners claims the Town Board didn't follow state laws
when creating new density rules and temporarily halting high -density
development for six months, according to the suit filed in Brunswick
County Superior Court.
The Ocean Isle Beach developer also claims it has vested rights to build
the second phase of its Windjammer Resort Condominiums because the
commissioners accepted the project request in August 1996. Three
Island's first phase - 48 units - has already received state and local
approval.
The town commissioners in October imposed a moratorium on new
high -density housing, giving the town a chance to.study expected
growth and put density rules in place.

In February, during the moratorium, the commissioners put in place
rules limiting single-family developments to six units per acre and
multi -family developments and motels to 8.2 units per acre.
On the same day, the board rejected Three Island Partners' claim that it
should be allowed to build the additional 33 units even though it would
amount to 11.7 units per acre and exceed the density limit.
The suit notes that the board accepted the preliminary plan for Ocean
Isle West - a high -density project planned by Odell Williamson, the
island's original developer.
Mr. Williamson had Ocean Isle West's original sketch redrawn to meet
the new limit of 8.2 units per acre.
Three Island contends the town acted "arbitrarily, capriciously and
unreasonably in enacting the moratorium," the suit says.
Elva Jess, the town's attorney, could not be reached for comment
Wednesday.
Three Island wants the court to rule the moratorium and new zoning
rules invalid because the town didn't give advance notice of the
temporary halt and didn't hold a public hearing on the issue.
Otherwise, the developer wants more than $10,000 in damages, the suit
says.
The Windjammer project was in the midst of another controversy with a
town commissioner in November 1996.
Kendall Suh, the mayor pro-tem, asked the director of the Division of
Coastal Management to turn down Three Island Partners' application to
build the four-story 4&unit condominium building.
Mr. Suh argued the tall structure would block wind flow and hamper
formation of dunes that protect the oceanfront.
But Coastal Management allowed the condo to be built.

Act permit is scheduled for completion for early December. The point you raise about
wastewater treatment capacity will be carefully reviewed with key review agencies. This office
will also advise you as to the final action.
Incidentally, the high-rise to which you referred was not authorized. That decision,
however, may be appealed by the applicant.

The Wilmington Regional Office received the Stormwater Management Permit Application for Windjammer Condominiums
on October 3, 1996, with final information on November 12, 1996. Staff review of the plans and specifications has determined
that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 961001 dated November 22, 1996, for the construction of Windjammer Condominiums.
This permit shall be effective from the date of issuance until November 22, 2006, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an ajudicatory
hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 2761 I-7447. Unless such demands are made this permit shall be final and binding.

from 60,870 square feet of impervious area.

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.
5. Deed restrictions mast be recorded prior to the sale of any outparcel or future area shown on the approved
plans to ensure that future owners are made aware of the built -upon area limitations. The following
statement must be recorded:
"To ensure continued compliance with the NCDWQ Stormwater Management Permit Regulations,
15A NCAC 2H.1000, future arras as shown on the approved plans are limited to 18,996 square
feet of built -upon area, inclusive of that portion of the right-of-way between the front lot line and
the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including
wood decking or the water surface of swimming pools."
"All built -upon area from the outparcel or future area must be directed into the permitted
stormwater control system."
"Additional built -upon area will require a permit modification."
"The connection into the stormwater control shall be made such that short-circuiting of the system
does not occur."
6. The penmittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
8. The Director may notify the penmittee when the permitted site does not meet one or more of the minimum
requirements of the pennit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.

H. SCHEDULE OF COMPLIANCE
1. The pennittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational
for it's intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion sh !1 be kept to a minimum and any eroded areas of the system will
be repaired immediately.
C. All connections into the stounnvater system from future areas/outparcels shall be made such that
short-circuiting of the system does not occur.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in it's entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities mist be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation
of this permitted facility, a certification trust be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications mast be noted on the Certification.
6. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the
recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book
number and page, and bear the stamp of the Register of Deeds.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.

III. GENERAL CONDITIONS
This permit is not trrnsfemble. In the event there is a desire for the facilities to change ownership, or
there is a name change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved.
Failure to abide by the conditions andJimitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6(a) to 143-215.6(c).
The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall tale immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance or termination does not stay any permit condition.

After every runoff producing rainfall event, or at least monthly, whichever comes fast
1. Inspect the infiltration pond(s) for erosion, trash accumulation, grass coverage, and general
condition of the facility.
2. Repair eroded areas immediately, re -seed as necessary, keep side slopes and bottom
mowed, and remove trash.
3. Check any inlet piping, swales and catch basins. Repair broken piping, reseed swales, and
remove trash.
4. Inspect the bypass/overflow structure for blockage and deterioration. Remove blockage
and repair structure to originally approved design specifications.
5. Check the depth of the pond(s) every six months. If siltation has occurred to the point that
only 75 % of the original design depth is provided, remove the excess silt to the original
depth. Do not over -excavate, as this may cause the required water table separation to be
reduced, and may affect the ability of the system to perform as designed.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Recommendations for State Permit - Windjammer Condominiums/Three Island Partners
I have no objection to the proposed project subject to the following comments and conditions:
The foundation piling of the stricture must be located landward of the first line of stable
natural vegetation, a distance of 120 feet. This must be established by Division of
Coastal Management representatives from the Wilmington District Office, immediately
prior to any structural piling placement. The line must be reestablished if construction
is not initiated within sixty (60) days and/or if there is a major shoreline change prior to
commencement of construction.

height and/or density requirements.
s Sand held in storage in any dune, other than frontal or primary dunes, may be moved
laterally in order to strengthen existing primary or frontal dunes if the work would
enhance the protection to the proposed development activity and the sand is immediately
stabilized.
Sand used to strengthen dunes must be brought in from an outside source and must be
of the same nature as the sand in the area in which it is to be placed. No sand is to be
removed from the lot.
- Structural pedestrian accessways over frontal dunes must not exceed 6' in width and may
5 not be for commercial or motor -powered vehicular use. The accessway shall be
constructed over the frontal dune without any alteration of the dune beyond the driving
of pilings. Any vegetated areas that are disturbed shall be re -vegetated as soon as
feasible. No gazebo or deck is authorized by this permit.
6 - All disturbed areas shall be vegetatively planted and mulched within fourteen days of
constrction completion.
- Any structure shall be relocated or dismantled when it becomes imminently threatened
by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two years of the time when it becomes imminently threatened, and in any case
upon its collapse or subsidence. However, if natural shoreline recovery or beach
renourishment takes place within two years of the time the structure becomes imminently
threatened so that the structure is no longer imminently threatened, then it need not be
relocated or dismantled at that time. This condition shall not affect the permit holder's
right to seek authorization of temporary protective measures allowed under Rule .0308
(a)(2) of this section.

The proposed project site is located at 23 Ocean Isle West Blvd., on the west end of Ocean Isle Beach,
in Brunswick County, North Carolina. The 2.66 acre, oceanfront site is approximately 265 feet wide,
along Ocean Isle West Blvd., and approximately 438 feet deep to the vegetation line on the oceanfront
side (south) of the property. The site is bordered on the east and west sides, by existing multi -family
developments. There are two distinct dune systems on the oceanfront side (south) of the property .The
most landward dune system reaches heights of 22 feet mean sea level, on the southeast corner of the
property. The frontal dune system was re -constructed in 1989, after hurricane Hugo, and stabilized with
American Beachgrass (Ammophila brebili ug latal. During the past seven years, the dune system has
continued to build naturally, in height and width, and natural dune'plant species have re -colonized its
vegetation, including: Sea Oats, (Uniola paniculata), Bitter Panecum anecum spp.), yucca, and Dune
Elder (Iva imbricata). Recent storm tides from tropical storm Josephine have eroded approximately 5-10
feet of the seaward face of the frontal dune system, leaving an 8-12 ft. vertical erosion escarpment. A
post -storm site visit, confirmed that the surveyed, first line of natural, stable vegetation, that is shown
on the project drawing, was not impacted and was located at or slightly landward of the erosion
escarpment on 10/9/96. However, subsequent erosion events may have an impact on the vegetation line,
and any future building setback determination. Landward of the two oceanfront dune systems, the
remainder of the property consists of typical, Newhan fine sand, dunes and vegetation, with an average
elevation of 7-8 feet MSL.
The waters of the Atlantic Ocean are classified SB, by the N.C. Division of Environmental
Management. The tract is within the Ocean Erodible and High Hazard Flood areas of the Ocean Hazard
Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission.
The Long Term Average Annual Erosion Rate is 2 ft./yr. in this area of Ocean Isle Beach (LTAAER
1986, pg. 1 of 14). The large structure building setback is 120 feet from the first line of natural. stable
vegetation.
The applicant proposes to construct a four-story building, 245 feet long by 85 feet wide, located 120
landward from the first line of stable, natural vegetation. The proposed multi -family structure would
contain 48 residential units. The structure would be raised on concrete pilings, and parking would be
provided under the building. The remainder of the area, north of the building, would consist of
additional asphalt parking, and a combination swimming pool area/stormwater infiltration basin. A
wooden beach accessway, 6 feet wide, is proposed from the west side of the building to the beach. The
northwest comer of the property will remain vacant at this time, and has been designated for future
development.
10. ANTICIPATEID IMPACTS
The proposed project would create approximately 81,457 square feet of ground disturbance, and 49457
square feet of impervious surface. Subsequent future development would increase the amount of built
upon area and impervious surface.

We are property owners in Ocean Isle Beach in Brunswick County. It has come to our
attention that an application for a development permit in an Area of Environmental
Concern, as designated under the CAMA, was received by your office on October 3, 1996.
The application proposes that Three Island Partners, LLC construct a four story, 48 unit
condominium building, to include a swimming pool, parking area and beach accessway, at
23 Ocean Isle West Blvd. at the west end of Ocean Isle Beach in Brunswick County.
We would like to bring to the director's attention the fact that construction of a 75 unit
high-rise building has recently been approved for Ocean Isle Beach in the same general
area of the island as the project described above.
We recommend that serious attention be paid to the capacity of the island's existing
infrastructure prior to any approval to proceed with the condominiums. Our understanding
of the situation is that existing sanitary sewer and water supply systems are insufficient to
deal with such large construction projects as those described here which are concentrated
in the same general geographical location on the island.
Examination of these systems may require that an upgrade to them be made in order to
accommodate the new construction. If such is the case, we strongly believe that the
system upgrade costs should be borne by the developers of the two projects and not the
citizens and property owners of Ocean Isle Beach at large. Other developers pay for such
upgrades elsewhere; the same should be true for Ocean Isle Beach. Property owners
should not help pay the investment costs of developers.

I am an absentee owner of property at Ocean Isle Beach, planning to retire to my condo within five
or six years. Periodically I have the opportunity to read the Brunswick Beacon, the only available
means to keep informed of the county and local activities. A couple recent articles relating to
actions taken by the Ocean Isle Beach Town Board has caused me GRAVE CONCERN ABOUT 3 Ts4
THE CONTINUED QUALITY OF LIFE AND ENVIRONMENT ... 1) the approval of a 48 unit
condominium building referenced above and 2) the approval of Ocean Pointe East tower with 75
units. The Ocean Isle Beach Town Board has, according to the newspaper article, approved the
construction permits noting that the Town SEWER SYSTEM WELL EXCEED THE ALLOWABLE
CAPACITY LIMITS with the completion of the two projects and the ongoing single unit
developments.
I do not know if your agency is the appropriate forum to express these concerns, but you are a
division of the Department of Environment, Health, and Natural Resources. I am hoping that the
review process for the CAMA permit will insure that a thorough ENVIRONMENTAL IMPACT
STATEMENT will be completed prior to approval. Construction of these and any future single or
multiple units without upgrading the sewer system will have, to say the least, a clear impact on the
island and surrounding waterways.
I do not understand how State, County and Local jurisdictions can approve construction if the
project, simply stated, "meets the immediate written zoning and ordinance regulations." All aspects
of a project should be reviewed in its entirety, which should include all basic services such as water,
sewer, emergency, ingress/egress, utilities, etc.
\ I appreciate any assistance your agency can provide to assure the coastal communities will be
preserved for the future. I would like notice of the permit decision forwarded to me at 3215D

BEFORE YOU BUILD
Setting Back for Safety: A Guide to Wise Development Along the Oceanfront
When you build along the oceanfront you take calculated
risk. Natural forces of water and wind collide with tons of
force, even on calm days.
Man-made structures cannot be guaranteed to survive the
force of a hurricane. Long-term erosion (or barrier island
migration) may take from two to ten feet of the beach each
year and, sooner or later, will threaten oceanfront struc-
tures. These are the facts of life for oceanfront property
owners.
The Coastal Resources Commission (CRC) has adopted
rules for building along the oceanfront. The rules are in-
tended to avoid an unreasonable risk to life and property
and to limit public and private losses from storms and
long-term erosion. These rules lessen but do not eliminate
the element of risk in oceanfront development.
As you consider building along the oceanfront, the CRC
wants you to understand the rules and the risks. With this
knowledge you can make a more informed decision about
where and how to build in the coastal area.
The Rules
When you build along the oceanfront, coastal manage-
ment rules require that the structure be sited to fit safely
into the beach environment.
Structures along the oceanfront must be behind the frontal
dune, landward of the crest of the primary dune and set
back from the first line of natural stable vegetation a dis-
tance equal to 30 times the annual erosion rate (a minimum
of 60 feet). Large structures (multi -family residential struc-
tures greater than 5,000 square feet and non-residential
structures greater than5,000 square feet) must be setback
from the first line of natural stable vegetation a distance
equal to 60 times the annual erosion rate or 120 feet,

whichever is greater. If the erosion rate is greater than,

feet/year, the setback is 30 times the erosion rate plus 105
feet.
The Reasons
The beachfront is an ever -changing landform. The beach
and the dunes are natural "shock absorbers", taking the
beatings of the winds and waves and protecting the inland
areas. By setting back 30 or 60 times the annual long-term
erosion rate; you have a good chance of enjoying the full
life of the structure. At first, it seems very inviting to build
your dream house as close to the beach as possible, but in
five years you could find the dream has become a
nightmare as high tides and storm tides threaten your
investment.
The Exception
The Coastal Resources Commission recognized that these
rules, initially passed in June of 1979, might prove a
hardship for some property owners. Therefore, they estab-
lished an exception for lots which cannot meet the setback
requirement. The exception allows buildings infrontof the
setback line if the following conditions apply:
(1) the lot must have been platted as of June 1,1979, and
not capable of being enlarged by combining with adjoining
land under the same ownership, (2) development must be
as far back on the property as possible andinno case less
than 60 feet landward of the vegetation line, (3) rn
development can take place on the frontal dune (4) spe
construction standards on piling depth and square footage
must be met and (5) all other CAMA, state and local
regulations must be met.
The exception is not available in the Inlet Hazard Area.
To determine eligibility for the exception, the Local Permit
Officer will make these measurements and observations:

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alteration are designed to minimize, but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
Vonero rate for the arch where your property is located is

photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as

Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for developmentin this
area expire on December 31 of the third year following the

Dear Mr. Schecter,
I am writing regarding the Major CAMA Development Permit application by Alit:
island Partners, LLC for a four story, 48 unit condominium project at 23 Ocean Isle West
Boulevard, Ocean Isle Beach, NC.
I serve as Mayor pro-tem and am a member of the Town of Ocean Isle Beach Board
of Commissioners. My opinion is that this project is a great detriment to Ocean Isle Beach
and to coastal North Carolina. This proposed project will be a potentially adverse structure
harming the oceanfront of our fragile barrier island. At a proposed 54 feet 10 inches, the
height of this structure will disturb the wind flow patterns that have formed dunes to protect
the ocean front. The high and medium rise structures at Myrtle Beach and North Myrtle
Beach are examples of similar structures which should not be allowed on the oceanfront of
any beach given the fact that these large structures have blocked the natural wind flows and
have eliminated the protective dune structures on the ocean fronts of these respective beaches.
I would hate to see a precedent set which would open the flood gates for similar destruction
of the natural dunes which protect our barrier island's ocean front.
I believe it is the duty of the Division of Coastal Management to ensure that our
fragile coastline is not being abused or over -developed. It would be a travesty of justice and
a dereliction of duty, in my opinion, if your division allows 48 condominium units with 126
total bedrooms on a piece of oceanfront land consisting of only 2.6 acres. Please turn down
this application since it is diametrically opposed to the welfare of the fragile coastline and
ocean front. Your division has held a strong stance against many of the negative structures
which would set a detrimental precedent to the North Carolina coastline, and I vigorously
urge you to make the correct decision in denying this dangerous project.
May I also add that immediately after this project was presented to our Town Board,

The Wilmington Regional Office received a Stonnwater Management Permit Application for
Windjai n der Condominiums on October 3, 1996. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater
review:
1. Please type in the name of the applicant on the second page of the application, I am unable
to read it.
2. The soils report indicates that the groundwater elevation is 3.85', but it does not report the
elevation of the seasonal high water table, which is different. The SHWT is determined by
the mottling of the soil., not the current elevation of the groundwater. This may cause some
difficulty in meeting the 2' separation.
3. Please add the dimensions of the building, parking, and infiltration basin to the plans.
Major 4. Note the locations of the accesses. Provide at least 2, one on each side. I hope the owner
is aware that maintenance will be a challenge, since access to the pond will be limited. Any
indication of system failure, and it may be necessary to dismantle the wood decking to gain
adequate access to the system for repair/routine maintenance.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the

point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.
