Town of Holden Beach MODIFIED 2021-039 M Local Government Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment Quality and the Coastal Resources Commission for development In an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management" Coastal Managemenr ENWROMMEWAL OUAUry Issued to Dwayne Black an authorizing development in the Ocean Hazard Area (AEC) at 285 Ocean Boulevard West, in Holden Beach NC 28462, as requested in the pennittee's application, dated received August 17, 2021. This permit, issued on September 9,2021, modified on January 6, 2023 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: CONSTRUCT A SINGLE-FAMILY RESIDENCE, A IN THE GROUND POOL WITH 253 SQUARE FEET OF GROUND LEVEL WOODICOMPOSITE DECKING -- 89 SQUARE FEET OF CONCRETE COPING, GRAVEL DRIVEWAY AND STORMWATER RETENTION DITCHES. (6) This development is in the ocean hazard area shall be set back on a minimum of 60 feet from the first line of stable natural vegetation, as determined by the DCM, the LPO, or another assigned agent of the DCM. (7) The permittee is required to contact the Local Permit Officer 910-842-6080, shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redone. (8) All buildings constructed within the ocean hazard area shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Cade, and the Local Fkmod Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall control. (9) All construction shall be above the Design flood elevation. The flood elevation is AE 13' with a design elevation of 15'. (10) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. Shall meet all requirements of the NC Building Code. (11) Dune disturbances will not be allowed because the dune's protective value could be weakened or reduced. All disturbed areas will be immediately stabilized. (12) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and mulched) within 14 days of construction completion. (13) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two ears of the time when it becomes imminently threatened and in any case u on its collapse or subsidence. However, if natural shoreline recovery or beach renourishment takes place within two years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holders right to seek authorization of temporary protective measures allowed under CRC rules. (14) (5) 9'X20' parking spaces shall remain for life of the structure in order to meet town ordinances. (15) Any pool constructed adjacent to a coastal building must be structurally independent of the building and its foundation. (16) (D) Elevated buildings. Enclosed areas of new construction and substantially improved structures, which are below the lowest floor: (1) Shall not be designed or used for human habitation, but shall only be used for panting of vehicles, building access, or limited storage of maintenance equipment used in connection with the premises. Access to the enclosed area shall be the minimum necessary to allow for parking of vehicles (garage door) or limited storage of maintenance equipment (standard exterior door), or entry to the living area (stairway or elevator). The interior portion of such enclosed area shall not be finished or partitioned into separate rooms, except to enclose storage areas; (17) Prior to walkway installation it shall be delineated by LPO where the 4' walkway shall end on the beach side so that it will meet the town's regulations.
