Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The bulkhead will not extend waterward more than an average of 5 feet and a maximum of 10 feet from the normal water level at any point along its alignment at the time of construction. 2) The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be re -staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. 3) The bulkhead must be constructed prior to any backfilling and grading activities. (See attached sheets for Additional Conditions) This permil_action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Metal products, organic materials, or unsightly debris will not be used. 7) No vegetated wetlands will be excavated or filled outside of the permitted area. 8) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. Your proposal has been reviewed and found to be consistent with the provisions and objectives of General Permit No. 198000291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. Nelson, Banks and Manning Holiday Island/Perquimans County Bio Report Page Two Site Description The applicants propose shoreline stabilization on a man-made canal that connects directly to the Albemarle Sound at Holiday Island in Perquimans County. Holiday Island is a several hundred lot subdivision with Sound or canal access on the Albemarle Sound, east of Yeopim Creek and west of Harvey Point. The proposed work site consists of four residential lots and is along the Estuarine Shoreline of a man-made canal that ranges between 70 and 100 feet in width. The residential lots have been combined to create 3 building sites, each of which is developed with a single family structure. Approximately 50 ft. of the existing shoreline where work is proposed is currently stabilized with a failing wooden bulkhead. Most of the site is vegetated in lawn grasses and ornamental shrubs and trees. A small area of the shoreline (approximately 190 sf.) is vegetated in Taxodium distichum, Peltandra virginica and various sedges and has been delineated by the US COE as 404 wetlands. The waters of this canal are classified by the Division of Marine Fisheries as Joint Waters. The waters are classified by the Division of Coastal Management as both Public Trust and Estuarine Waters and are part of the Estuarine System Area of Environmental Concern. Proposed Work The applicants propose to construct a 362 ft. long wooden bulkhead on a man-made canal and the grading of Estuarine Shoreline. To straighten the current shoreline alignment, the applicants have requested an average waterward alignment of 5 ft. and a maximum distance waterward of the NWL of 10 ft. Currently two small pier platforms are along the shoreline. The applicants at this time do_ not wish to replace these, but individually may request so at a later date. The applicants also wish to grade and terrace as necessary the Estuarine Shoreline to fill miscellaneous upland areas and backfill the proposed bulkhead. This grading area is less than 1 acre. Anticipated Impacts The proposed work will impact approximately 1,860 sf. of Public Trust Waters and 7456 sf. (0.172 A.) of Estuarine Shoreline. The proposed work will not directly impact any Coastal Wetlands but will impact a small freshwater wetland area. The proposed construction would also result in temporary turbidity of the adjacent waters. The applicants propose to install erosion control structures prior to commencing the proposed work until the site is vegetated. The applicant (Mr. Nelson represents himself, Dick Banks, and Jay Manning in this matter) proposes to straighten, stabilize, and landscape the shoreline of a canal in the Holiday Island subdivision, in the Town of Hertford, Perquimans County, North Carolina. The proposed activities would include constructing a 362 foot long wooden bulkhead along the canal to replace an existing wooden bulkhead in need of rehabilitation. The straightened alignment would move the shoreline waterward an average of five feet, filling between four one -hundredths of an acre and one acre of aquatic habitat. This is the report of the Service submitted pursuant to, and in accordance with, provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C. 1531 et seq.). The Service recommends the District Engineer seek modification of this permit application such that all proposed activities occur landward of the Plane of Ordinary High Water (OHW) . It is our opinion that the proposed activities would impose avoidable adverse impacts on fish and wildlife resources and are inconsistent with Federal wetland policies (i.e., the proposed activities represent a net loss of aquatic habitat and are only a small part of a spatially and temporally large and complex activity). Further, we believe that the present shoreline is an artificial landscape created by excavating and filling hydric soils and wetlands. The applicant's shoreline is, in all likelihood, fastland. The shoreline was previously altered to provide non- hydric landscaping, boat access, and flood protection. The activities that created the canal (Sunset Waterway) in this portion of the Holiday Island subdivision were, and are, inadvisable, principally because of the degradation of habitat and the need for continued and frequent maintenance. The Service believes that historical and proposed activities (even when modified so that the shoreline is stabilized landward of the OHW), have had, and will have, significant cumulative adverse impacts on fish and wildlife resources. We base this determination on either of two baseline conditions (the pre -subdivision wetland boundaries or, the present shoreline). We cannot accept the proposition that the baseline condition includes fastland reclaimed by erosion or structural degradation. The proposed activities are temporary, stopgap measures. They will ultimately be ineffectual, and additional structural rehabilitation and maintenance activities will continue to be necessary on the applicant's shoreline. In the interests of the applicant(s), the public, and the fish and wildlife resources, we encourage the Corps to provide the applicant(s) with material that will assist them in evaluating the probable project life so that the individuals may conduct a realistic cost -benefit assessment prior to initiating the proposed activities. Should the applicant(s) decide to pursue the shoreline rehabilitation, we recommend that all work be landward of the OHW. We appreciate this opportunity to comment on the proposal. PROJECT SUMMARY: Construction of wooden bulkhead on man-made canal and grading of Estuarine shoreline. Nelson, Banks and Manning Holiday Island/Perquimans County Bio Report Page Two Site Description The applicants propose shoreline stabilization on a man-made canal that connects directly to the Albemarle Sound at Holiday Island in Perquimans County. Holiday Island is a several hundred lot subdivision with Sound or canal access on the Albemarle Sound, east of Yeopim Creek and west of Harvey Point. The proposed work site consists of four residential lots and is along the Estuarine Shoreline of a man-made canal that ranges between 70 and 100 feet in width. The residential lots have been combined to create 3 building sites, each of which is developed with a single family structure. Approximately 50 ft. of the existing shoreline where work is proposed is currently stabilized with a failing wooden bulkhead. Most of the site is vegetated in lawn grasses and ornamental shrubs and trees. A small area of the shoreline (approximately 190 sf.) is vegetated in Taxodium distichum, Peltandra virginica and various sedges and has been delineated by the US COE as 404 wetlands. The waters of this canal are classified by the Division of Marine Fisheries as Joint Waters. The waters are classified by the Division of Coastal Management as boih Public Trust and Estuarine Waters and are part of the Estuarine System Area of Environmental Concern. Proposed Work The applicants propose to construct a 362 ft. long wooden bulkhead on a man-made canal and the grading of Estuarine Shoreline. To straighten the current shoreline alignment, the applicants have requested an average waterward alignment of 5 ft. and a maximum distance waterward of the NWL of 10 ft. Currently two small pier,platforms are along the shoreline. The applicants at this time do. not wish to replace these, but individually may request so at a later date. The applicants also wish to grade and terrace as necessary the Estuarine Shoreline to fill miscellaneous upland areas and backfill the proposed bulkhead. This grading area is less than 1 acre. Anticipated Impacts The proposed work will impact approximately 1,860 sf. of Public Trust Waters and 7456 sf. (0.172 A.) of Estuarine Shoreline. The proposed work will not directly impact any Coastal Wetlands but will impact a small freshwater wetland area. The proposed construction would also result in temporary turbidity of the adjacent waters. The applicants propose to install erosion control structures prior to commencing the proposed work until the site is vegetated.
