Bulkhead Construction
1) In order to ensure compliance with the Town of Sunset Beach Land Use Plan, the proposed bulkhead
must be redesigned so that all portions of the bulkhead are located landward of any area of coastal
marsh.
2) The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will
require the alignment to be restaked by DCM within a maximum of 30 days prior to the new
expected start of construction.
3) The bulkhead must be constructed prior to any backfilling activities.
(See attached sheet for Additional Condition:
This permiLaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims tide
to the affected properties. - If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger, plats are acceptable only if an
adequate number of,quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be. sufficiently detailed to
guide agency personnel,unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for

Recommendations for State Permit - Dave Nelson
In the past, I have objected to the small loss of coastal wetlands on a property that could be developed
without the wetland loss, noting an inconsistency with the management objectives for the Coastal
Wetlands AEC in section 711.0205 of our regulations. However, in an effort to obtain consistency and
fairness in the application of our rules (ie. Sewell 21-96), I assume our permit policy is to allow small
wetland losses, under the major permit review, when adverse impacts are not considered to be
significant. If project review is favorable, I recommend the following conditions be included in the
permit:
[1] The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline
by adverse weather conditions, will require the alignment to be re -staked by DCM within a
maximum of thirty (30) days prior to the new expected start of construction.
[2] The bulkhead must be constructed prior to any baclriilling activities.
[3] The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
[4] The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles,
or other suitable materials approved by Department personnel. No excavation is permitted,
except for that which may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
[5] The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
[6] All backfill material will be obtained from a highground source and confined behind the
permitted bulkhead.

This permit consistency opinion is based on my review of the Nelson permit application,
the Field Investigation Report (EF Brooks, 9/10/96), and my understanding and
interpretation of the policies presented in the Town of Sunset Beach Land Use Plan.
The applicant proposes construction of a bulkhead along the waterward side of his
property. The bulkhead will facilitate residential construction and would incorporate
approximately 495 square feet of mixed coastal and "404" wetlands. The location and
complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Developed; Conservation
CLASSIFICATION DESCRIPTION: 7B.0204 (d)(7) "...and the primary intent of the
conservation class is to provide protection for the resources included therein."
RELATED POLICIES AND IMPLEMENTATION MEASURES:
A. Resource Protection
1 a. (1) Coastal Wetlands (p.52)lt shall be the policy of Sunset Beach to restrict land uses
in coastal wetlands to those that guarantee wetlands conservation and which do not affect
their delicate balance. Sunset Beach shall permit water dependent uses such as docks,
boat ramps, piers, ... Each proposed use will be evaluated for water dependency.
Unacceptable land uses may include, but would not be limited to restaurants,
businesses, residences,...
1.a.(4) Estuarine Shorelines (p.53)Suitable land uses within the estuarine shorelines are
those compatible with both the dynamic nature of the estuarine shoreline and the value of
the estuarine system...
Within the Estuarine Shoreline Area, the Town of Sunset Beach believes that certain
developed uses should only be allowed to take place which are consistent with 15 NCAC
7H and as further defined by the Town's building and development ordinances, and which
satisfy the following requirements: 1) natural barriers to erosion are not weakened or
eliminated; ...3) the amount of runoff is unchanged; ...6) the construction of impervious
surfaces and areas not allowing natural drainage is limited to that necessary for
development.
2.d. Wooded Swamps and 404 Wetlands (p.58) The Town supports the preservation of
wetlands through the enforcement of 404 regulations [by the US Army Corps of Engineers].
7. Marina, Bulkhead, and Floating Structure Development (p.62) The development of
bulkheads and private boat slips in Sunset Beach are permitted uses in the Town's zoning
ordinance and must meet CAMA regulations. Damage to existing marshes or beaches
by bulkhead installation or replacement, groins, or seawalls will not be permitted.
CONSISTENCY OPINION:
The Town of Sunset Beach policy does not permit damage to existing marshes or beaches
by bulkhead installation. In consultation with the Town of Sunset Beach, this policy is
intended to apply to both coastal marsh and freshwater marsh. It is my opinion that the
Nelson project is inconsistent with the Land Use Plan. There is sufficient high ground
available to place both septic tank and a dwelling without compromising the natural
estuarine system of mixed coastal marsh and delineated "404" wetlands. No demonstration
has been made that there is "...no suitable alternative site or location outside of the
AEC ... for the use and development and, further, that the applicant has selected a
combination of sites and design that will have a minimum adverse impact upon the
productivity and biological integrity of coastal marshland,... nursery areas..., and natural
erosion barriers (cypress fringes, marshes...). 15A NCAC 7H.0208(a)(2)(B).

wetlands.

9. PROJECT DESCRIPTION September 10, 1996
The project site is an undeveloped residential lot (Lot 26, Blk 40E), located at 509 North Shore
Drive, on Sunset Beach, NC, in southeastern Brunswick County. The lot is bordered on it's
north side by a large expanse of salt marsh which runs from the backside of Sunset Beach to the
Atlantic Intracoastal Waterway (approx. 3300 ft.). The lot is fifty (50) feet wide and
approximately 120 feet in depth, from North Shore Drive. The southern and central portions
of the lot consists of a high sand ridge, 12-20 feet elevation at mean sea level (MSL), and the
vegetation is primarily Wax Myrtle. The elevation drops sharply at the shoreline and the
northern third (1/3) of the lot consists of high coastal marsh and "404 type" wetlands. The
applicant has had the wetland line delineated and approved by the US Army Corps of Engineers,
Regulatory Branch. Along and at the base of the slope that transitions highground to marsh, the
vegetation includes Groundsel-tree (Baccharis halimifolia), Marsh -elder (Iva frutescens) and Sea
Ox-eye (Borrichia frutescensl, intermixed with coastal wetlands species; Salt Meadow Grass
(Snartina patens), Spike Grass (Distichlas spicata), Black Needle -rush (Juncus roemarianusl, and
Sea Lavender (Limoniun. W.. Preceding waterward, the frequency and dominance of coastal
wetland species increases, until reaching the vast Smooth Cordgrass (Spartina alterniflora) marsh
behind the island.
The waters adjacent to the project site are classified SA, by the NC Division of Environmental
Management, and are CLOSED to the harvest of shellfish. -These waters have also been
designated as a primary nursery area (PNA) by the NC Division of Marine Fisheries.
The applicant and his neighbor (Lynch, Lot 25) have both submitted CAMA Major Permit
applications to construct straight line bulkheads along the irregular shaped shoreline of their lots.
Both are requesting this bulkhead alignment to accommodate the design of subsequent residential
construction. The applicant's proposed bulkhead would be approximately 55 feet long and four
feet high. It would be located at the wetland line, on the east and west sides of the lot, but
would be approximately 19 feet waterward of a wetland indention into the center of the lot.
Backfill material for the bulkhead would be obtained from the highground portion of the lot
during clearing and grading. The applicant would subsequently obtain required permits for the
construction of his residence.
10. ANTICIPATED IMPACTS
The construction of the proposed bulkhead would incorporate approximately 495 square feet of
high marsh, coastal and "404 type" wetlands.

side of his property. The proposed straight alignment of the bulkhead to facilitate residential
construction would incorporate approximately 495 square feet of mixed coastal and "404 type"
wetlands.

9. PROJECT DESCRIPTION September 10, 1996
The project site is an undeveloped residential lot (Lot 26, Blk 40E), located at 509 North Shore
Drive, on Sunset Beach, NC, in southeastern Brunswick County. The lot is bordered on it's
north side by a large expanse of salt marsh which runs from the backside of Sunset Beach to the
Atlantic Intracoastal Waterway (approx. 3300 ft.). The lot is fifty (50) feet wide and
approximately 120 feet in depth, from North Shore Drive. The southern and central portions
of the lot consists of a high sand ridge, 12-20 feet elevation at mean sea level (MSL), and the
vegetation is primarily Wax Myrtle. The elevation drops sharply at the shoreline and the
northern third (1/3) of the lot consists of high coastal marsh and "404 type" wetlands. The
applicant has had the wetland line delineated and approved by the US Army Corps of Engineers,
Regulatory Branch. Along and at the base of the slope that transitions highground to marsh, the
vegetation includes Groundsel-tree (Baccharis halimifolia), Marsh -elder Qva frutescensl and Sea
Ox-eye (Bordchia fiutescens), intermixed with coastal wetlands species; Salt Meadow Grass
(Snartina patensl, Spike Grass (Distichlas Wicata), Black Needle -rush (Juncus roemarianus), and
Sea Lavender (Limoniun. W.). Preceding waterward, the frequency and dominance of coastal
wetland species increases, until reaching the vast Smooth Cordgrass (Spartina alterniflora) marsh
behind the island.
The waters adjacent to the project site are classified SA, by the NC Division of Environmental
Management, and are CLOSED to the harvest of shellfish. -These waters have also been
designated as a primary nursery area (PNA) by the NC Division of Marine Fisheries. '
The applicant and his neighbor (Lynch, Lot 25) have both submitted CAMA Major Permit
applications to construct straight line bulkheads along the irregular shaped shoreline of their lots.
Both are requesting this bulkhead alignment to accommodate the design of subsequent residential
construction. The applicant's proposed bulkhead would be approximately 55 feet long and four
feet high. It would be located at the wetland line, on the east and west sides of the lot, but
would be approximately 19 feet waterward.of a wetland indention into the center of the lot.
Backfill material for the bulkhead would be obtained from the highgmund portion of the lot
during clearing and grading. The applicant would subsequently obtain required permits for the
construction of his residence.

The construction of the proposed bulkhead would incorporate approximately 495 square feet of
high marsh, coastal and "404 type" wetlands.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
