This permit, issued on January 5, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation tt tnese terms may be subject to tines, imprisonment or civil action; or may cause trie permit to be nun ana vota. Enhancement and Expansion of an Existinu Revetment 1) In order to protect submerged aquatic vegetation habitat, no filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction of the authorized revetment. The revetment shall be located in areas with no SAV coverage at the time of construction, to the greatest extent practicable. (See attached sheets for Additional Conditions) This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires frvther Division approval. All work must cease when the permit expires on January 5,2028 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Piney Island Gun Club of Currituck Permit No. 4-23 Page 2 of 3 ADDITIONAL CONDITIONS 3) The toe of the revetment shall provide, to the greatest extent practicable, a 10 foot buffer from any submerged aquatic vegetation and shall not exceed the alignment as depicted in the attached permit application and workplan drawings. 4) The alignment of the authorized revetment shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 5) No living shoreline material shall be staged within 30 feet of the normal water line. 6) The height of the permitted revetment shall not exceed the heights as depicted on the attached workplans. 7) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved revetment alignment. 8) This permit does not authorize any excavation waterward of the approved alignment. 9) The fill material shall be clean and free of any pollutants except in trace quantities. 10) The offshore sill material shall consist of clean granite, marl, or broken concrete with no exposed rebar. Sill materials shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes.dislodged or moves outside the authorized alignment. 11) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. USACE Conditions 14) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. Piney Island Gun Club of Currituck ADDITIONAL CONDITIONS General Permit No. 4-23 Page 3 of 3 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-02542). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification No. 005423 and assigned the project DWR Project No. 1987-0254 v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The proposed development is located on an island addressed as Parcel ID Number 006900000540000 Piney Island Road, Coinjock, Currituck County, adjacent to Coinjock Bay connecting to the Currituck Sound. It is known locally as Piney Island and is the location of a historic waterfowl hunt and management club. The island is adjacent to Coinjock Bay which connects to the Currituck. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 1 SA NCAC 0711.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to service the primary purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation shall be permitted if impervious areas are not increased and the applicant designs the project to comply with the rule to the maximum extent feasible." Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall propose an angle for graded slopes or fill that is greater than an angle that can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs that involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; unless the project involves clearing land for the purpose of forming a reservoir later to be inundated." DATE: September 29, 2022 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through December 7, 2021. Overview: The 925 acre subject property has approximately 4.4 miles of shoreline along Coinjock Bay, 1.7 miles of which is along the Atlantic Intracoastal Waterway (AIWW). Coinjock Bay connects to the Currituck Sound. The site primarily consists of Coastal Wetlands and Section 404 Wetlands, with some upland areas. The project area is located along the west side of the property, just south of the terminus of Piney Island Road along approximately 715 feet of shoreline that parallels Coastal Wetlands and the AIWW. Water depths within the project area range from -1 to -2 feet and average -1.5 feet below Normal Water Level (NWL). The project area is located in the AE Floodzone. Existing site improvements near the project area consist of a clubhouse, boat sheds, outbuildings, impoundments, hunting blinds, rock and earthen roads and a series of 10 foot wide by 16 foot long timber mats connecting the clubhouse to an impoundment. The mats are located approximately 3 feet above Normal Water Level. The applicant's narrative indicates that they are in Coastal Wetlands. In 1991 a settlement agreement was reached between the applicant and the Division of Coastal Management allowing for continued use, maintenance and repair of the mats. No additional mats are allowed. Riprap changes will prevent further erosion and protect the timber mat path. The waters of Coinjock Bay are classified as Joint Waters and SC waters and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was observed near the project area. A review of historic resources and archaeological sites was not provided. Anticipated impacts resulting from this project are expected to include: the filling of .22 acre of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Basis for Determination: Proposed improvements are located in Coinjock Bay. Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial support". The following LUP policies may be applicable to this request: Land Use Compatibility: Policy ES5, Page 9-6. The proposed work is located at Parcel ID Number 006900000540000 Piney Island Road, Coinjock, within Currituck County, adjacent to Coinjock Bay and connecting to the Currituck Sound. The waters of the proposed work are classified as SC and are closed to shellfish harvesting. Water depths within the project site range from -1 to -2' with 1.5' being the average on -site. Submerged aquatic vegetation (SAV), per DMF's definition, was observed near the project area. The applicant is proposing measures to prevent further erosion of and to protect the timber mat path that provides access to the impoundment and the peninsula. The proposed work includes reconfiguring and adding to the height of an existing riprap shoreline. The proposed reconfiguration of the riprap will begin on the shoreline immediately adjacent to an existing impoundment and travel north following the shoreline's alignment. The proposed design will start with a 170' long revetment with a base 12' wide. The revetment will then leave a 5' gap followed by a 253' section. At this point, the base widens from 12' to 16' for a 234' section. The section with the 16' base will have a crest height of 4.5' above normal water level (NWL) and 1.5' above the existing riprap height. The revetment then narrows for the last 42' and returns to a 12' wide base. Finally, the applicant proposes to construct a sill 15 linear feet (LF) in length with a 10' base that will be positioned 5' waterward of the gap in the proposed revetment. DMF is concerned that the proposed work may result in impacts to SAV in the project area. In order to minimize potential impacts to SAV, DMF would recommend that the permit include the standard 1 April through 30 September moratorium. For in -water work. This will ensure that the in -water tasks associated with the project do not occur during the active growing season for SAV, which should minimize impacts to SAV. DMF is also concerned that the proposed position of the sill may be too close to the gap in the revetment. Incorporating gaps in revetment allows for better circulation of water and allows movement of fish and other species. There is the potential that the opening between the sill and the revetment could become filled with sediment or other material, negating the benefits of the opening. The parcel ID is listed as parcel # 006900000540000 Piney Island Road and can be accessed from SR 1142 (waterlity Road) Coinjock, Currituck County, and is adjacent to the Intracoastal Waterway (ICW) in Coinjock Bay. The vast majority of the 925 acre parcel is undeveloped, made up of several Coastal and non -coastal wetlands with areas of high ground. Man-made structures on the lot consist of a clubhouse, boat sheds, outbuildings, impoundments, rock and earthen roads, a boat basin, a boat ramp, and hunting blinds. Based on available information, no archaeological sites are on or near this property. Both adjacent riparian properties are undeveloped areas made up of coastal and non -Coastal Wetlands. The proposed project area is a narrow strip of land that is approximately 715' in length which parallels a non -coastal wetland area which is just south of the clubhouse. In this area there is a path made up of timber mats which allows access for members from the clubhouse area to travel to an existing impoundment and the peninsula of the property adjacent to Piney Island Bay. In 1991, there was a settlement agreement between the Piney Island Gun Club of Currituck and the North Carolina Division of Coastal Management which allows for the continuing use of 83 timber mats, 16' in length by 10' wide, provided the footprint remains constant (see attached settlement agreement). These mats can be seen from aerial imagery. This agreement does not allow for any additional timber mats but does allow for maintenance and repair to the existing mats. The elevation of this path is approximately 3' above NWL. The location of the proposed work is within Coinjock Bay which connects to the Currituck Sound, is immediately adjacent to the Intracoastal Waterway (AIWW) and is classified as Joint waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this area is SC and it is closed to shellfish taking. Water depths within the project site range from A' to -2' and average -1.5'. Submerged aquatic vegetation, as per DMF's definition, was observed near the project area (See attached SAV Survey conducted on 6-1-2022). Development Proposal To prevent further erosion and to protect the timber mat path providing access to the impoundment and the peninsula, the applicant proposes to reconfigure and add to the height of an existing riprap shoreline. The proposed reconfiguration of the riprap will begin on the shoreline immediately adjacent to an existing impoundment and travel north following the shorelines alignment. To begin, the proposed design will start with a 170' long revetment with a base 12' wide. The revetment will then leave a 5' gap before continuing for an additional 253'. Please note: this section of the shoreline had a 74' section (near the proposed gap area) that was not previously hardened. At this point the revetment base widens from 12' to 16' for 234'. This 16' wide section of riprap will have a crest hight of 4.5' above NWL and 1.5' above the existing riprap height. Anticipated Impacts The re -configuration of the riprap along the proposed alignment will result in the filling 9,324 ftz of the PTA and EW AEC 699' of the shoreline along the ES AEC. The riprap sill will fill 150 ftz within the PTA and EW AEC. This is an approximately 925-acre tract that is accessible from SR 1142 (Waterlily Road) and fronts on Coinjock Bay (Currituck Sound). The shoreline is immediately adjacent to the Atlantic Intracoastal Waterway (AIWW) which is utilized by vessels of all sizes, including power yachts that generate large wakes that cause erosion to the shoreline of the Site, including coastal wetland and upland areas. Sheet 1 of 4 in the CAMA Major Plan Set is an overview of the entire Site. The property includes large expanses of coastal marsh, waterfowl impoundments, upland areas (wooded and open), Section 404 non -coastal wetlands, a lodge, boat basin, the clubhouse, outbuildings, boat storage shed and earthen roads. The most recent CAMA permit is a CAMA Minor Permit (M22-18) that was for berm and water control structure repair in what is referred to as their Southern Impoundment that is partially within the 75 ft estuarine AEC. Other relatively recent CAMA Permits include CAMA General Permits (GPs) for shoreline stabilization rock work (revetments). Due to wind generated waves couple with the incessant boat wake from the AIWW, the shoreline needs to be protected. Much of the existing shoreline has rock rip rap and there are short timber groins along the shoreline than extends from the north side of the boat basin to the north (approximately 500 ft). There are also timber mat paths that have been allowed to be placed in a designated location to access the upland areas on the north side of the tract (along the shoreline) and another on to the south of the lodge area to the Southern Impoundment. There was a 1991 legal settlement agreement between NC Division of Coastal Management (NCDCM) and Club that has allowed these timber mat roads or paths to remain in the estuarine and coastal wetland AECs. That agreement does not allow additional timber mat roads, but does allow maintenance and upkeep to ensure access to the northern and southern portions of the Site along the shoreline. There is a Section of the southern shoreline that is in immediate need of additional stabilization for the erosion reasons indicated above and also due to sea level rise (and potentially subsidence) that has affected the property. Sheet 2 includes existing conditions and Sheet 3 includes the proposed rock enhancement in this area. The reason that this requires a CAMA Major Permit instead of a CAMA GP is due to the height of rock that is needed in the area where the timber mats are very close to the Sound (which is also coastal wetlands). The rest of the rock enhancement is not adjacent to coastal wetlands. The green shaded area is coastal wetland and the red is Section 404 non -coastal. A GP only allows rock to be 0.5' above the adjacent coastal wetland substrate and this has proven not to be sufficient due to waves, wake and high wind tides in general that batter this shoreline. The timber mats frequently become displaced in this area and there has been coastal wetland loss. The new rock would be in the same general alignment of the rock that already exists, but the height and width would be increased. Please refer to the second cross-section on Sheet 4 that depicts what this would look like. The upper cross-section is what the rest of the proposed rock enhancement work would look like. In June, 2022, we performed an SAV and water depth survey by developing transacts and utilizing the Braun-Blaunquet (B-B) method of sampling by estimating coverages. There is no SAV located in the footprint of the proposed rock. Our CAMA Plans show a line of the first occurrence of any SAV along this stretch of shoreline. The NOV (a copy of which is attached as Exhibit A) addresses 56 oak mats, 16 feet in length by to feet in width, placed by Piney Island across a coastal marsh on its property off S.R. 1145 in Currituck County, North Carolina. since the NOV was issued, it has been determined that there are 83 mats, 56 located in the northern impoundment, and 27 in the southern impoundment. The NOV alleges that the mats constitute development in an Area of Environmental Concern and excavation or filling of the marshland in question without a permit, which is a violation of the North Carolina Coastal Area Management Act and Dredge and Fill Act. Upon further discussion of the matter, DEHNR and Piney Island agree that the damage that could be caused to the marshes by removing the mats may be greater than the damage caused by allowing the mats to remain and therefore desire to make mutual concessions to settle the matter as hereinafter stated.
