This permit, issued on January 4, 2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Maintenance Excavation
1) Should excavation take place within the period of peak biological activity (1 April — 30 September)
of any year, to prevent unnecessary siltation into the adjacent water body, a turbidity curtain shall be
left between the area to be excavated and the existing canal for a 72-hour period after completion of
excavation or until the project areas has returned to ambient conditions, whichever is greater.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -3.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the. issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
January 4, 2028
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
7) This permit was issued based upon at determination that while the area to be excavated is immediately
adjacent to areas containing actively growing submerged aquatic vegetation (SAV) beds, the area of
proposed excavation would not directly impact actively growing SAV beds. During all authorized
excavation events, the permittee shall implement all available precautions to ensure that damage to SAV
beds does not occur. Should dredging outside the authorized template be proposed in the future, the
permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging
within SAV beds.
Dredge Material Disposal
8) No dredge material shall be placed within 30 feet of the normal water line, except that which will be
used to backfill the area behind the permitted bulkhead, once properly dried.
9) All excavated, materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
10) Dredge material from the authorized dredge footprint shall be dewatered before use as backfill. All
remaining backfill material shall be obtained from a high ground source and confined behind the
permitted bulkhead.
11) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
12) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge
material is properly contained during transport to the disposal site, and that all the proper coordination
has taken place with the local or state governments to ensure that any damage to public streets caused by
transport of the dredge material has been addressed.

13) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved
by a representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Shoreline Stabilization - Bulkhead
14) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
15) No vegetated wetlands shall be excavated or filled, even temporarily.
16) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
17) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
18) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
19) The bulkhead shall be constructed prior to any backfilling activities.
20) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
21) This permit does not, authorize any excavation waterward of the approved alignment.
22) The fill material shall be clean and free of any pollutants except in trace quantities.
23) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
24) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
25) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.

26) Unless specifically altered herein, this permit authorizes one concrete boat ramp, as indicated on the
attached workplan drawings.
27) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
28) Placement of fill materials below normal water level shall be limited to the ramp structure.
29) Excavation, fill and/or ground disturbing activities, associated with the placement of the boat ramp,
above and below the normal water line shall be limited to that absolutely necessary to establish adequate
ramp slope and provide a ramp no greater in size than specified in the attached permit application and
workplan drawings.
Marina Reconfiguration
30) This permit authorizes the demolition of the existing structure and the construction of the piers, finger
piers, tie pilings, and platform, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this marina without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
31) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharged at the marina shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
32) The marina shall display a sign showing the location of the nearest pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier(s).
33) The pemuttee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
34) This permit authorizes a maximum of 26 formalized boat slips.
35) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
36) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.

ADDITIONAL CONDITIONS
Navigational Aids
37) Unless specifically altered herein, this permit authorizes the installation of two (2) day marker type
navigational aids, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
38) The navigational aids shall conform with any and all appropriate regulations governing such structures,
including but not limited to marking and lighting requirements of the N.C. Wildlife Resources
Commission and/or the U.S. Coast Guard.
Upland Development
39) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the 2 multi -family
dwellings, pool, walkway and boardwalk, driveway, and other associated infrastructure, all as expressly
and specifically set forth in the attached permit application and workplan drawings.
Sedimentation and Erosion Control
40) An Erosion and Sedimentation Control Plan modification will be required for this project. If required,
this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity.
Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 943
Washington Square Mall, Washington, NC 27889.
41) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
42) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
43) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
ADDITIONAL CONDITIONS
Stormwater Management
44) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The pernuttee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral
and Land Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. Any
violation of the permit approved by DEMLR, shall be considered a violation of this CAMA permit.

45) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
46) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
47) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
48) The pemrittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2008-02683).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Water Quality
Certification No. 005302 and assigned the project DWR Project No. 2022-1205.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Uses will be consistent with vacation rental units. Visitors will have access to Pamlico Sound using the existing man made
basin.

Typical convential construction techniques will be employed. No equipment will be stored in wetlands. Dredge work will be
performed using long reach excavator or excavator on barge.

Water dependent infrastructure and development includes removing all existing dilapidated structures and construct 828 If of
bulkhead, 820 If of wooden boardwalk, construct 26 wet slips with 13 finger piers, 940 sf wooden dock/platform, reshape and
square up existing man made basin (2,065 sf of fill), maintenance dredgeof the exsiting basin and channel and excavation of
uplands around basin (+/• 1,238 cy), 50 sf no rap bulkhead return protection and install new 22' by 35' concrete boat ramp.
Construct two 12 unit buildings and all associated and necessary infrastructure along with a pool and pool house accessory
structure. Construct a 5141f boardwalk with 200 sf platform over uplands along north property boundary. See attached
narrative for full detailed scope of work.

The applicant; proposes to redevelop fan existing marina located at 27446 and 27478 NC
Hwy 12 in Salvo, Dare County,, adjacent a manmade basin and connected to the
Pamlico Sound. The project includes the demolition of existing structures and
improvements that comprise .of maintenance excavation of the access channel, canal,
and basin to a connecting depth of -3.5, two'12-unit multi -family dwellings, pool &
accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat
ramp, and associated infrastructure. The development proposed will: involve. the
Estuarine Waters (EW)„ Public Trust Area (PTA), and Coastal :Shoreline (CS) AECs.
I have reviewed the Rules of the" Coastal Resources_ Commission (CRC) as they pertain
to this project, and my findings are as follows:

(d) Use Standards. Suitable land%water uses shall be those consistent with the
management objectives in this Rule,_ Highest priority of use shall be allocated to the
conservation of estuarine waters and their vital components. Second priority of
estuarine waters use shall be given to those types of development activities that require
water access and use which cannot function elsewhere such as simple access
channels; structures to prevent erosion; navigation channels;boat docks, marinas,
piers, wharfs, and mooring pilings.
Consistent: The proposed redevelopment of an existing,marina meets the intent
of this rule.

(c) Management Objective. To protect public rights for navigation and recreation and to
conserve and manage the public trust areas so as to safeguard and perpetuate their
biological, economic and aesthetic value.
(d) Use Standards. Acceptable uses shall be those consistent with the management
objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any
use which jeopardizes the capability of the waters to be used by the public for
navigation or other public trust rights which the public may be. found to have in these
areas shall not be allowed. The development of navigational channels or drainage
ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or
marinas are examples of uses that may be acceptable within public trust areas,
provided that such uses shall not be detrimental `to the public trust rights and the
biological and physical functions of the estuary. Projects which would directly or
indirectly block or impair existing navigation channels, increase shoreline erosion,
deposit spoils below normal high water, cause adverse water circulation patterns,
violate water quality standards, or cause degradation of shellfish waters are considered
incompatible with the management policies of public trust areas. In every instance, the
particular location, use, and design characteristics shall be in accord with the general
use standards for coastal wetlands, estuarine waters, and public trust areas.
Consistent: The proposed redevelopment meets the intent of this rule.
15A NCAC 07H .0208 ' USE STANDARDS
(b) Specific. Use Standards
(1) Navigation channels, canals, and boat basins shall be aligned or located so as to
avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as
defined by the MFC, or areas of coastal wetlands except as otherwise allowed within
this Subchapter. Navigation channels, canals and boat basins shall also comply with the
following standards:
(A) Navigation channels and canals may be allowed through fringes of
regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no
significant adverse impacts on fishery resources, water quality or adjacent wetlands,
and if there is no reasonable alternative that would avoid the wetland losses;
(B) All dredged material shall be confined landward of regularly and irregularly
flooded coastal wetlands and 'stabilized to prevent entry of sediments into the adjacent
water bodies or coastal wetlands;
(C) Dredged material from maintenance of channels and canals through
irregularly flooded wetlands shall be placedon non wetland areas, remnant spoil piles,
or disposed of by a method having no significant, long-term wetland impacts. Under no
circumstances shall dredged material be placed on regularly flooded wetlands. New
dredged material disposal areas shall not be located in the buffer area as outlined in
15A NCAC 07H .0209(d)(10);

(D) Widths of excavated canals and channels shall be the minimum required
to meet the applicant's needs but not impairwater circulation;
(E) Boat basin design shall maximize water exchange by having the widest
possible opening and the shortest practical entrance canal. Depths of -boat basins shall
decrease from the waterward end, inland;
(F) Any canal or boat basin shall be excavated no, deeper than the depth of
the connecting waters;
(G) -- Construction of finger canal systems are not allowed. Canals shall be
either straight or meandering with no right angle corners;
(H) Canals shall be designed so as not to create an erosion hazard to
adjoining property. Design may include shoreline stabilization, vegetative stabilization,
or setbacks based on soil characteristics; and
(1) Maintenance excavation in canals, channels and boat basins within
primary nursery areas and areas of submerged aquatic vegetation as defined by the
MFC shall be avoided. However, when essential to maintain a traditional and
established use, maintenance excavation may be approved it the applicant meets all of
the following criteria:
(i) The applicant demonstrates and"documents that a water dependent
need exists for the excavation;
(ii) There exists a previously permitted channel that was constructed or
maintained under permits issued by the State or Federal government. If a natural
channel was in use, or if a human made channel was constructed before
permitting was necessary, there shall be evidence that the channel was
continuously: used for a specific purpose;
(iii) Excavated material can be, removed and placed in a disposal area in
accordance with Part (b)(1)(B) of this Rule without impacting adjacent, nursery areas
and submerged aquatic vegetation as, defined by the MFC; and
(iv) The original depth and width of a human made or natural channel shall not
be increased to allow a new or expanded use of the channel.
Consistent: The proposed redevelopment meets the intent of this rule.
(5) Marinas. Marinas are defined as any publicly or privately owned dock, basin or
wet boat storage facility constructed to accommodate more than.10 boats and providing
any of the; following services: permanent ortransient docking spaces, dry storage,
fueling facilities, haulout facilities, and repair service. Excluded from this definition are
boat ramp facilities allowing access only, temporary docking, and none of the preceding
services. Expansion of existing facilities shall comply with the standards of this
Subparagraph for all development other than maintenance and repair -necessary to
maintain previousservice levels. Marinas shall comply with the following standards:
(A) Marinas shall be sited in non wetland areas or in, deep waters (areas not
requiring dredging) and shall not disturb shellfish resources, submerged aquatic
vegetation as defined by the MFC, or wetland habitats, except for dred in necessa
for access to high ground sites. The following four alternatives for si

designed to have the highest of these four priorities that is deemed feasible by the
permit letting agency:
(i) an upland basin site requiring no alteration of wetland or estuarine
habitat and providing flushing by tidal or wind generated water circulation or
basin design characteristics;
(ii) an upland basin site requiring dredging for access when the
necessary dredging and operation of the marina will not result in significant
adverse impacts to existing fishery, shellfish, or wetland resources and the basin
design shall provide flushing by tidal or wind generated water circulation;
(iii) an open water site located outside a primary nursery area which
utilizes piers or docks rather than channels or canals to reach deeper water; and
(iv) an open water marina requiring excavation of no intertidal habitat,
and no dredging greater than the depth of the connecting channel.
(B) Marinas that require dredging shall not be located in primary nursery
areas nor in areas which require dredging through primary nursery areas for access.
Maintenance dredging in primary nursery areas for existing marinas shall comply with
the standards set out in Part (b)(1)(1) of this Rule;
(C) To minimize coverage of public trust areas by docks and moored vessels,
dry storage marinas shall be used where feasible;
(D) Marinas to be developed in waters subject to public trust rights (other than
those created by dredging upland basins or canals) for the purpose of providing docking
for residential developments shall be allowed no more than 27 square feet of public trust
areas for every one linear foot of shoreline adjacent to these public trust areas for
construction of docks and mooring facilities. The 27 square feet allocation does not
apply to fairway areas between parallel piers or any portion of the pier used only for
access from land to the docking spaces;
(E) To protect water quality in shellfishing areas, marinas shall not be located
within areas where shellfish harvesting for human consumption is a significant existing
use or adjacent to such areas if shellfish harvest closure is anticipated to result from the
location of the marina. In compliance with 33 U.S. Code Section 101(a)(2) of the Clean
Water Act and North Carolina Water Quality Standards (15A NCAC 02B .0200) adopted
pursuant to that section, shellfish harvesting is a significant existing use if it can be
established that shellfish have been regularly harvested for human consumption since
November 28, 1975 or that shellfish are propagating and surviving in a biologically
suitable habitat and are available and suitable for harvesting for the purpose of human
consumption, The Division of'Coastal Management shall consult with the Division of
Marine Fisheries regarding the significance of shellfish harvest as an existing use and
the magnitude of the quantities of shellfish that have been harvested or are available for
harvest in the area where harvest will be affected by the development;
(F) Marinas shall not be located without written consent from the leaseholders
or owners of submerged lands that have been leased from the s �e �i gP the
State; i E D
(G) Marina basins shall be designed to promote flushing through the following
design criteria:

(i) the basin and channel depths shall gradually increase toward open
water and shall never be deeper than the waters to which they connect; and
(ii) when possible, an opening shall be provided at opposite ends of
the basin to establish flow through circulation;
(H) Marinas shall be designed so that the capability of the waters to be used
for navigation or for other public trust rights in estuarine or public trust waters are not
jeopardized while allowing the applicant access to deep waters;
(1) Marinas shall be located and constructed so as to avoid adverse impacts
on navigation throughout all federally maintained channels and their boundaries
as designated by the US Army Corps of Engineers. This includes permanent or
temporary mooring sites; speed or traffic reductions; or any other device, either
physical or regulatory, that may cause a federally maintained channel to.be
restricted;
(J) Open water marinas shall not be enclosed within breakwaters that
preclude circulation sufficient to maintain water quality;
(K) Marinas that require dredging shall.provide areas in accordance with Part
(b)(1)(B) of this Rule to accommodate disposal needs for future maintenance dredging,
including the ability to remove the dredged material.from the marina site;
(L) Marina design shall comply with all applicable EMC requirements (15A
NCAC 02B .0200) for management of stormwater runoff. Stormwater management
systems shall not be located within the 30-foot buffer area outlined in 15A NCAC
07H .0209(d);
(M) Marinas shall post a notice prohibiting the discharge of any waste from
boat toilets and listing the availability of local pump out services;
(N) Boat maintenance areas shall be designed so that all scraping,
sandblasting, and painting will be done over dry land with collection and "containment
devices that prevent entry of waste materials into adjacent waters;
(0) All marinas shall comply with all applicable standards for docks and piers,
shoreline stabilization, dredging and dredged material disposal of this Rule;
(P) All applications for marinas shall be reviewed bythe,Division of Coastal
Management to determine their potential impact to coastal resources and compliance
with applicable -standards •of this Rule: Such review shall also consider the cumulative
impacts of marina development in accordance with G.S. 113A-120(a)(10); and
(Q) Replacement of existing marinas to maintain previous service levels shall
be allowed provided that the development complies with the standards for marina
development within this Section.
Consistent: The proposed redevelopment of an existing marina meets;the intent
of this rule.
(6) Piers and Docking Facilities.
(A) Piers shall not exceed six feet in width. Piers greater than six feet in width
shall be permitted only if the greater width is necessary for, safe use to im,�Rro�ve public
access,; or to support a water dependent use that cannot otherwise EQVC E

(B) The total square footage of shaded impact for docks and mooring facilities
(excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water
slips shall not be counted in the total. Projects requiring dimensions greater than those
stated in this Rule shall be permitted only if the greater dimensions are necessary for
safe use, to improve public access, or to support a water dependent use that cannot
otherwise occur. Size restrictions shall not apply to marinas;
(C) Piers and docking facilities over coastal wetlands shall be no wider than
six feet and shall be elevated at least three feet above any coastal wetland substrate as
measured from the bottom of the decking;
(D) A boathouse shall not exceed 400 square feet except to accommodate a
documented need for a larger boathouse and shall have sides extending no farther than
one-half the height of the walls as measured from the Normal Water Level or Normal
High Water and covering only the top half of the walls. Measurements of square footage
shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on
lots with less than 75 linear feet of shoreline, except that structural boat covers utilizing
a frame -supported fabric covering may be permitted on properties with less than 75
linear feet of shoreline when using screened fabric for side walls. Size restrictions do
not apply to marinas;
(E) The total area enclosed by an individual boat lift shall not exceed 400
square feet except to accommodate a documented need for a larger boat lift;
(F) Piers and docking facilities. shall be single story. They may be roofed but
shall not be designed to allow second story use;
(G) Pier and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length
along the same shoreline for similar use. This restriction does not apply to piers
100 feet or less in length unless necessary to avoid unreasonable interference
with navigation or other uses of the waters by the public;
(ii) not extending into the channel portion of the water body; and
(iii) not extending more than one-fourth the width of a natural water
body, or human -made canal or basin. Measurements to determine widths of the
water body, canals, or basins shall be made from the waterward edge of any
coastal wetland vegetation that borders the water body. The one-fourth length
limitation does not apply in areas where the U.S. Army Corps of Engineers, or a
local government in consultation with the Corps of Engineers, has established an
official pier head line. The one-fourth length limitation shall not apply when the
proposed pier is located between longer piers or docking facilities within 200 feet
of the applicant's property. However, the proposed pier or docking facility shall
not be longer than the pier head line established by the adjacent piers or docking
facilities, nor longer than one-third the width of the water body.
(H) Piers or docking facilities longer than 400 feet shall beitted only if the

proposed length gives access to deeper water at a rate of at least 1 -o increment of length longer than 400 feet, or, if the additional length is necessary to s "n
some obstruction to navigation. Measurements to determine lengths shall be made from
the waterward edge of any coastal wetland vegetation that borders thAkikeY bo�pi e

(1) Piers and docking facilities shall not interfere with the access to any
riparian property and shall have a,minimum setback of 15 feet between any part of the
pier or dockingfacility and the adjacent property owner's areas of riparian access. The
line of division of areas of riparian access shall.be established by drawing a line along
the channel or deep water in front of the properties, then drawing a line perpendicular to
the line of the channel so that it intersects with the shore at the point the upland
property line meets the water's edge. The minimum setback provided in the rule may be
waived by the written agreement of the Ladjacent. riparian owner(s) or when two adjoining
riparian owners are co applicants. If the adjacent property is sold before construction of
the pier or docking facility commences; the applicant shall obtain a written agreement
with the new owner waiving the minimum setback and submit it to the permitting agency
prior to initiating any development of the pier. Application of this Rule may be aided by
reference to the approved diagram in 15A NCAC 07H ,.1205(t) illustrating the rule as
applied to various shoreline configurations. When shoreline.configuration is such that a
perpendicular alignment cannot be achieved, the pier shall be aligned to meet the intent
of this Rule to thel maximum extent practicable as determined by the Director of the
Division of Coastal Management; and
(J) Applicants for authorization to construct pier or docking facility shall
provide notice of the permit application to the.owner of any part of a shellfish franchise
or lease over which the proposed dock or pier would extend. The applicant shall. allow
the lease holder the opportunity to mark a navigation route from the pier to the edge of
the lease.
Consistent: The proposed development meets the intent of this rule.
(7) Bulkheads
(A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate
the location of normal high water or normal water level;
(B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid
significant adverse impacts to the resources;
(C) Bulkhead backfill material shall be obtained from an upland source approved by
the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part
of a permitted project involving excavation from a non upland source, the material so
obtained may be contained behind the bulkhead;
(D) Bulkheads shall be permitted below normal high water or normal water level only
when the following standards are met:
(i) the property to be bulkheaded has: an identifiable erosion. problem,
whether it results from naturalcauses or adjacent bulkheads, or it has unusual
geographic or geologic features, e.g. steep grade bank; which will cause the applicant
unreasonable hardship under the' -other provisions of this Rule;
(ii) . the'bulkhead alignment extends no further below normal high water or
normal water level than necessary to allow recovery of the area eroded in the year prior
to the date of application, to align with adjacent bulkheads, or to iti ,tethqUED
unreasonable hardship resulting from the unusual -geographic or to , ea ures;
(iii) the bulkhead alignment will not adversely impact public trust rights or the

(iv) the need for a bulkhead below normal high water or normal water level is
documented by the Division of Coastal Management; and
(v) the property to be bulkheaded is in a non -oceanfront area.
(E) Where possible, sloping rip rap, gabions, or vegetation shall be used rather than
bulkheads.
Consistent: The proposed development meets the intent of this rule.
15A NCAC 07H .0209 COASTAL SHORELINES
(d) Use Standards. Acceptable uses shall be those consistent with the management
objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of
development activities that will not be detrimental to the public trust rights and the
biological and physical functions of the estuarine and ocean system. Every effort shall
be made by the permit applicant to avoid or minimize adverse impacts of development
to estuarine and coastal systems through the planning and design of the development
project. Development shall comply with the following standards:
(1) All development projects, proposals, and designs shall preserve natural barriers
to erosion, including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines.
(2) All development projects, proposals, and designs shall limit the construction of
impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to service the primary purpose or use for which the lot is to be developed.
Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the
applicant can demonstrate, through innovative design, that the protection provided by
the design would be equal to or exceed the protection by the 30 percent limitation.
Redevelopment of areas exceeding the 30 percent impervious surface limitation shall
be permitted if impervious areas are not increased and the applicant designs the project
to comply with the rule to the maximum extent feasible.
(3) All development projects, proposals, and designs shall comply with the following
mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals; and designs shall provide for a buffer
zone along the margin of the estuarine water that is sufficient to confine visible
siltation within 25 percent of the buffer zone nearest the land disturbing
development.
(B) No development project proposal or design shall propose an angle for
graded slopes or fill that is greater than an angle that can be retained by
vegetative cover or other erosion control devices or structures.
(C) All development projects, proposals, and designs that involve uncovering
more than one acre of land shall plant a ground cover sufficient to restrain
erosion within: 30 working days of completion of the grading; unless the project
involves clearing land for the purpose of forming a reservoir J,�ter to be inundated.
(4) Development shall not have a significant adverse impact on%'sW 'wCe# "2(&n
resources. Significant adverse impacts include development that would directly or
indirectly impair water ° quality increase shoreline erosion, alter coastal wetlands or
Submerged Aquatic Vegetation (SAV), deposit spoils waterward of ARaNaft2level or
normal high water, or cause degradation of'shellfish beds.

(5) Development shall not interfere with existing public rights of access to, or use of,
navigable waters or public resources.
(6) No public facility shall be permitted if such a facility is likely to require public
expenditures for maintenance and continued use, unless it can be shown that the public
purpose served by the facility outweighs the required public expenditures for
construction, maintenance, and continued use.
(7) Development shall not cause irreversible damage to valuable, historic
architectural or archaeological resources as documented by the local historic
commission or the North Carolina Department of Natural and Cultural Resources.
(8) Established common-law and statutory public rights of access to the public trust
lands and waters in estuarine areas shall not be eliminated or restricted. Development
shall not encroach upon public accessways, nor shall it limit the use of the accessways.
(9) Within the AECs for shorelines contiguous to waters classified as ORW by the
EMC, no CAMA permit shall be approved for any project that would be inconsistent with
rules adopted by the CRC, EMC or MFC for estuarine waters, public trust areas, or
coastal wetlands..For development activities not covered by specific use standards, no
permit shall be issued if the activity would, based on site -specific information, degrade
the water quality or outstanding resource values.
(10) Within the Coastal Shorelines category (estuarine and public trust shoreline
AECs), new development shall be located a distance of 30 feet landward of the normal
water level or normal high-water level, with the exception of the following:
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;
(B) Pile -supported signs (in accordance with local regulations);
(C) Post- or pile -supported fences;
(D) Elevated, slatted, wooden boardwalks exclusively for pedestrian use and six feet
in width or less. The boardwalk may be greater than six feet in width if it is to serve a
public use or need;
(E) Crab Shedders, if uncovered with elevated trays and no associated impervious
surfaces except those necessary to protect the pump;
(F) Decks/Observation Decks limited to slatted, wooden, elevated and unroofed
decks that shall not singularly or collectively exceed 200 square feet;
(G) Grading, excavation and landscaping with no wetland fill except when required
by a permitted shoreline stabilization project. Projects shall not increase stormwater
runoff to adjacent estuarine and public trust waters;
(H) Development over existing impervious surfaces, provided that the existing
impervious surface is not increased;
Consistent: The proposed development meets the intent of this rule.
Based on my review of the applicable subsections of the NC Administrative Code, the
permit application, and plans submitted on behalf of Salvo Marina ZT,_446PLC staff
recommends a Major Permit be issued to the applicant subj tApG��tand`Dpermit

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the permit application for proposed actions that may impact fish and/or fish habitats.
The proposed work is located at 27446 and 27448 NC Highway 12 in Salvo, within Dare
County. The applicant, Salvo Marina 27446, LLC, is proposing to demolish the existing
structures (boardwalk, finger piers, slips, boat ramp, and bulkhead) and install new structures on -
site. The proposed improvements include a marina, two 12-unit multi -family dwellings, pool and
accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and
associated infrastructure.
A new 34' by 22' boat ramp is proposed on the southeast side of the basin with a courtesy pier or
each side. The pier on the east side of the ramp is proposed at 15' by 4' and the pier on the west
side is proposed at 34' by 4'. A total of 13 finger piers with associated pilings are proposed in the
canal and boat basin. A 32' by 6' pier with a 20' by 20' T-head platform and two pilings is
proposed off the southwest shoreline of one of the lots. The finger piers and pilings will result in
creation of 26 slips. A 33.5" by 27.5" platform is proposed in the southeast corner of the basin
for kayak and paddle board launches.
The existing bulkhead will be replaced with a new 828 linear foot (LF) vinyl bulkhead,
transitioning from the north side of the basin to the east and ending at the southwest section of
the canal. Most of the replacement will be at an average of 0' waterward of the normal water line
(NWL). The maximum distance would be 15' waterward of NWL on the southwest side of the
canal. Proposed backfill material is clean sand, and about 2,065 square feet (SF) of fill material
will be placed below NWL.
Maintenance excavation of the access channel and areas in the middle and east side of the
canal/basin is proposed. A survey for submerged aquatic vegetation (SAV) was completed on
June 25, 2021 and found no rooted SAV within the areas of proposed excavation and
development. Beds of SAV were found outside of the mouth of the channel and boat basin. The
waters of the project area are classified as SA; HQW, do not have habitat desig�{a,ti ns d ar

DMF concerns are primarily regarding the SAV outside of the excavation area. The proposed
excavation and construction may result in impacts to SAV, primarily through increased turbidity
and direct impacts (i.e., removal). In order to minimize impacts to SAV, DMF would
recommend that the project either be required to install a turbidity curtain or adhere to a
moratorium. The turbidity curtain should be installed in the area of the proposed channel
marker/no wake signs (between the proposed dredging footprint and observed SAV) and should
be left in place for 72 hours after completion of in -water activities. Or, if a moratorium is
included, the moratorium should be from I April through 30 September and should be applied to
all in -water work.

above NWL. The property is primarily located in the AE (4) Floodzone to the west, with area east
of the canal/basin in the Shaded X Zone.
Existing site improvements consist of broken concrete driveways and parking, with some gravel
areas. Existing shoreline improvements are dilapidated and include approximately 800 linearfeet
of bulkhead, approximately 75 linear feet of 8 footwide boardwalk, a boat ramp and finger piers
for seven (7) slips. A.1 foot erosion escarpment is located where bulkhead has failed. A CAMA
General Permit was issued Iin April. of 1909. for repair and replacement of 5.00 linear feet of
bulkhead and repair of the boardwalk.

at NWL and a maximum distance of 15, feet waterward of NWL._ Bulkhead backfill will consist of
clean sand: Riprap revetment will be installed".waterward of Coastal Wetland fringe.' The
maximum distance of the toe of the revetment rock will be 3 feet waterward of the vegetation:
The waters of Pamlico Sound in this area are classified as Class SA and HQW waters: The
waters in'this.area are closed to shellfish taking. No submerged aquatic vegetation;(SAV) was
observed within the project area. A review of potential historic and archaeological resources was
not provided.
Anticipated Impacts resulting from this project are expected to include:. the dredging, of .35 acre
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 3,018 sq. ft.
Of Estuarine. Shoreline AEC;.the filling of 2,863 sq. ft. of Public TrustArea/Estuarine:Waters AEC
and 285 sq. ft. of Estuarine Shoreline AEC; the shading of 2,021 sq. ft; of Public Trust
Area/Estuarme Waters AEC; and; the disturbance of.64 acre of Estuarine Shoreline AEC and

The Dare County Land Classification Map identifies the subject property as "Transitional Corridor".
As indicated on Page 207, the purpose of the "Transition Corridor" category is to provide for more
intensive developed on lands that are suitable and will be provided with the necessary
infrastructure and services to support urban -style development.. As indicated on Page 208 for
Rodanthe, Waves and Salvo, central water from the Dare County water system is available and
wastewater is provided by individual on -site septic systems. Multi -family dwelling density
limitations for the 8-1 areas are. "a range of 3-5 units per acre depending on the soil composition
of individual sites. The higher.percentage of wetland soils on a tract, than the lower the dwelling
density for multifamily structures". The permit application indicates a total of 24 multi -family units
on the 6,06 acre property which contains 1.86 acres of Section 404 wetlands and some Coastal
Wetland vegetation.
Regarding Future Land Use Maps. and the narrative descriptions, as indicated on Page 206,
"(d)welling densities and compatible eland ;uses are discussed in each narrative description in
general terms. The Dare County Zoning Ordinance is the document that establishes specific
regulations for properties and should be consulted for site specific land • uses and dimensional
standards." The County Planning Director has provided the -following density approval based: on
the local zoning ordinance S-1 zoning (per9/27/2022 email):
"Per the S-1 .zoning ordinance Multi -Family structures. are calculated using
maximum flo, or.area ratio 0.4 of the gross area of the parcel to, date building
size then units per acre based on soil types is applied. Lot 1 R is 2 acres with 20%

As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of
Environmental Concern (AECs) and all federal lands except for the bombing ranges on the
Mainland: and some state-owned lands in Frisco. and Buxton. .As indicated on Page 217 for the
"Conservation" designation,."...development should be limited -to residential, development and
traditional accessory uses permitted in the CAMA AECs such as butnot limited to piers, docks,
and crab -shedders:" The purpose of the "Conservation".classification is to provide for the effective
long-term management and protection of significant, limited, or irreplaceable areas. Land
disturbing activities should not occur. unless in conjunction with an authorized development.
Authorized development should include provisions and conditions that minimize impacts to any

Attached hereto is a copy of Certification No. WQ0005302 issued to Bob Howsare and Salvo Marina
27446, LLC, dated November 3, 2022. This approval is for the purpose and design described in your
application. The plans and specifications forthis project are incorporated by reference as part of this
Water Quality Certification. If you change your project, you must notify the Division and you may be
required to submit a new application package with the appropriate fee. If the property is sold, the new
owner must be given a copy of this Certification and is responsible for complying with all conditions. [15A
NCAC 02H .0507(d)(2)].
This Water Quality Certification does not relieve the permittee of the responsibility to obtain all other
required Federal, State, or Local approvals before proceeding with the project, including those required
by, but not limited to, Sediment and Erosion Control, Non -Discharge, Water Supply Watershed, and
Trout Buffer regulations.
This Water Quality Certification neither grants nor affirms any property right, license, or privilege in any
lands or waters, or any right of use in any waters. This Water Quality Certification does not authorize
any person to interfere with the riparian rights, littoral rights, or water use rights of any other person
and does not create any prescriptive right or any right of priority regarding any usage of water. This
Water Quality Certification shall not be interposed as a defense in any action respecting the
determination of riparian or littoral rights or other rights to water use. No consumptive user is deemed
by virtue of this Water Quality Certification to possess any prescriptive or other right of priority with
respect to any other consumptive user.
Upon the presentation of proper credentials, the Division may inspect the property.
This Water Quality Certification shall expire on the same day as the expiration date of the corresponding
Section 404 Permit. The conditions shall remain in effect for the life of the project, regardless of the
expiration date of this Water Quality Certification.

Non-compliance with or violation of the conditions herein set forth may result in revocation of this
Water Quality Certification for the project and may also result in criminal and/or civil penalties.
If you are unable to comply with any of the conditions of this Water Quality Certification you must notify
the Washington Regional Office within 24 hours (or the next business day if a weekend or holiday) from
the time the permittee becomes aware of the circumstances.
The permittee shall report to the Washington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 028 .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.
This approval and its conditions are final and binding unless contested [G.S.143-215.5]. Please be aware
that impacting waters without first applying for and securing the issuance of a 401 Water Quality
Certification violates Title 15A of the North Carolina Administrative Code (NCAC) 2H .0500. Title 15A
NCAC 2H .0500 requires certifications pursuant to Section 401 of the Clean Water Act whenever
construction or operation of facilities will result in a discharge into navigable waters, including wetlands,
as described in 33 Code of Federal Regulations (CFR) Part 323. It also states any person desiring
issuance of the State certification or coverage under a general certification required by Section 401 of
the Federal Water Pollution Control Act shall file with the Director of the North Carolina Division of
Water Quality. Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a
civil penalty assessment of up to a maximum of $25,000.00 per day for each violation.
This Certification can be contested as provided in Chapter 150E of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirements forfiling a Petition are set forth in Chapter
150E of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.

Please reference the application of Mr. Bob Howsare and Salvo Marina 27446 LLC for
Department of the Army authorization and a State Water Quality Certification to conduct
maintenance dredging of an existing access channel and basin, construct a boat ramp, replace
existing bulkhead, and construct docks and other various marina infrastructure located at
27446 NC Highway 12, in Salvo, Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this
permit.
8. The permittee shall require its contractors and/or agents to comply with the terns and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
12. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
Permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly
adhere to all requirements therein. The guidelines can be found at

8. PROJECT SUMMARY: Demolition of dilapidated structures and construct a marina in
the existing basin, with improvements to include maintenance excavation of the
access channel, canal, and basin, two 12-unit multi -family dwellings, pool & accessory
building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and
associated infrastructure.
Proiect Settin
The two parcels (Lots I and 2r) are located at 27446 and 27478 NC Hwy 12 in Salvo, Dare
County, adjacent a manmade basin and connected to the Pamlico Sound. These two lots
equate to a total of 5.06-acres. Lot I (#27446) currently has an existing boat basin with
dilapidated structures, including a bulkhead, boat ramp, and finger piers, as well as upland
concrete and gravel. There are natural uplands with native grasses starting at the east side
of the bulkhead leading up to Hwy NC 12. Along the north side of the bulkhead, where the
elevation is 4-5' above normal water level (NWL), the upland area consists of natural grass,
salt meadow cordgrass, Atlantic cedar, wax myrtles, bayberry, and catbrier, then slopes
down to a Coastal Wetland (CW) and 404 Wetland area that includes Big cordgrass
(Sparfina cynosuroides), cattails, and Black needlerush (Juncus roemerianus). In that
northern section there is also a natural pond that opens to the next canal to the north.
There is a Coastal Wetland fringe along the non -hardened north side of the canal on Lot 1 r
that consists of Smooth cordgrass (Spartina a/temiflora), and Black needlerush, and the
wetlands extend to the northwest end of the lot. The water depth along the shoreline is -1'
NWL. As you cross the canal, the water depths range from A' to -4' NWL.
Transitioning to the south side of the canal, a small area of Common Three -square (Scirpus)
on an upland area southwest of the dilapidated bulkhead is not claimed as jurisdictional
Coastal or 404 wetlands. This upland area also has native grasses. The t1' erosion onsite
is noted to be where the bulkheading has failed due to storm and deterioration. On the west
side of the canal near the existing bulkhead return there is CW and 404 wetland vegetation
that includes Smooth cordgrass, and transitions to a marsh on Lot 2r that also includes
Black needlerush. Field indicators for the CW area also included the existence of periwinkle
and crab holes. An official USACE Jurisdictional Determination (JD) verifying 1.86 acres of
404 wetlands dated 01/21/22 was completed by Billy Standridge, and a copy of that JD is
included in the application package.
The permit history found for this property was General Permit (GP) #21808A, which was
issued to OBX LLB on 04/23/99 for the repair and replacement of 500' of bulkheading, as
well as repair of the existing boardwalk. This permit referenced Salvo Market and
Campground in the project location. Further research determined that GP #21808A was a
renewal for the original GP021261A issued on 11/18/95.
The riparian property to the north is developed with a single-family dwelling, utility shed,
detached garage, a bulkhead and docking facility. The riparian property to the south is
developed with a mobile home and utility shed. RECEIVED

An interagency scoping meeting was held on 07/29/21 to discuss the redevelopment of this
property. Representatives from Quible & Associates, SAGA Construction & Development,
USACE, National Marine Fisheries, US Fish & Wildlife Services, NC Wildlife Resources,
Marine Fisheries, Coastal Management, 401 Division of Water Resources, Stormwater, and
Land Quality were in attendance.
The waters of the Pamlico Sound are within the Pasquotank River Basin. These waters are
classified as Coastal by the NC Marine Fisheries Commission. The DWR water
classification for the Pamlico Sound is SA & HWQ. These areas are not designated as
Primary Nursery Areas and are closed to the harvesting of shellfish.
Development Proposal
The applicant is proposing the demolition of the existing structures (i.e. boardwalk, finger
piers [7 slips], boat ramp, bulkhead) and improvements for a marina, to include two, 12-unit
multi -family dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier,
platforms, riprap, boat ramp, and associated infrastructure.
Maintenance excavation of the access channel (entrance on the west side of the canal) and
areas in the middle and east side of the canal/basin is proposed. An SAV survey was
conducted on 06/25/21 by representatives of Quible & Associates. No rooted SAV was
found within the areas of the proposed excavation and development. Ruppia Maritima beds
were documented outside of the mouth of the channel and boat basin, and the area is
identified on Sheets 1 and 2 that were submitted with the major application. The water
bottom in the canal is sand and muck. The dimensions for the excavation starting at the
entrance are 246'x20'x-1', which will remove ±182 cubic yards (cy). The collective
dimensions for excavating the remaining areas of the canal/basin are 462'x22'.5"x-1', which
will remove ±385 cy. The total amount of material to be excavated from below NWL is 567
cy.
An upland area in the northwest section next to the basin is proposed to be excavated to
lengthen the current basin an additional 60'. A 3,018 square foot (sf) area will be removed,
resulting in 671 cy of high -ground excavation.
A 290'x25' (7,250 sf) dredge disposal area for the spoil is proposed on the southeast side of
the basin, outside of the 30' buffer. Silt fencing will be used to contain the dredge spoils.
After the spoil is dewatered and removed, that section of the site is proposed to be
asphalted for an access to the proposed boat ramp, pool house, and boat trailer parking
area.
A new 34'x22' boat ramp is proposed on the southeast side of the basin, with a courtesy
pier on each side. The pier on the east side of the ramp is proposed at 15'x4', and the pier
on the west side of the ramp is proposed at 34'x4'. A total of 13 finger piers (dimensions of
8'x3' equating 24 sf each) with associated pilings are proposed in the canal and boat basin.
A 32'x6' pier with a 20'x20' (400 sf) T-head platform and 2 pilings is proposed off the
southwest shoreline of Lot 1 r. The construction of finger piers and installation of 51 pilings
will create a total of 26 slips. A 33'.5"x27'.5" (921.25 sf) platform is proposed in the RECEIVED
southeast corner of the basin for kayak and paddle board launches.

Two channel marker/No Wake Signs are proposed at the entrance of the canal.
The existing bulkhead will be replaced with a new 828 linear foot (Ift) vinyl bulkhead,
transitioning from the north side of the basin to the east and ending at the southwest section
of the canal. Most of the replacement bulkhead will average 0' waterward of NWL, with a
maximum distance equaling 15' waterward of NWL on the southwest side of the canal.
Proposed backfill material is clean sand, and t2,065 sf of fill will be placed below NWL.
A small area (t50 so of riprap revetment is proposed at the end of the southwest bulkhead
return in front of a CW fringe. The maximum distance of the toe of the rock is t3' waterward
of the vegetation.
Upland fill is proposed to raise the existing site grade to accommodate the proposed
development and provide coastal flooding resilience. An estimated t2.7 acres will be filled,
with dimensions averaging 270'x450'. The majority of the western section of the parcel is
zoned AE(4), and the upland section to the east of the basin is zoned 'Shaded X'. The
proposed upland development on Lots 1 r and 2r includes two 12-unit, multi -family dwellings
with associated parking and septic system, a concrete pool with concrete decking and a
pool house accessory building, a 514'x6' walkway leading to a 200 sf overlook platform on
the north side of Lot 1 r, an 820'x5' boardwalk around the basin, 2 kayak stands/racks, a
walkway leading from the dwellings to the boardwalk, asphalt driveway and boat launch
drive. The north side access driveway, southern access driveway, septic systems, parking
for the multi -family dwellings, one-10'x12' dumpster pad, and the southern section of the
boat launch drive equate to t5,472 sf (approximate dimensions are 228'x24') and are sited
outside of the CAMA 75' AEC. A 92'x92' (t8,464 so stormwater basin is proposed between
the boat trailer parking area and the second multi -family dwelling to address surface runoff.
The applicant is also proposing 811 Ift of retaining wall to be constructed on Lot 2r along the
south side of the property between the upland development and the 404 wetlands.
The total impervious coverage proposed in the 75' CAMA AEC is ±20,659.2 sf (17.5%).
The total impervious coverage and/or built -upon surfaces of the entire tract(s) is ±60,975.4
sf (27.7%).
Anticipated Impacts
Estuarine Waters/Public Trust AEC = 20,199.25 sf
e The construction of the main pier, courtesy piers, finger piers, T-head platform, and
launch platform will result in t2,021.25 sf of shading of the Open Water Habitat.
e The construction of the boat ramp will result in the filling of 748 sf of Shallow Bottom
habitat.
e A total of t15,315 sf of Shallow Bottom habitat will be removed as a result of the
maintenance excavation of the access channel/canal and basin.
o A total of t567 cy of material is proposed to be excavated.
e The installation of replacement bulkheading and riprap, with associated backfill, will
result the filling of t2,115 sf of Shallow Bottom habitat.

Coastal Shoreline (Estuarine/Public Trust Shoreline) AEC = 31,264 sf
• Excavation of an upland area will result in the removal of 3,018 sf (671 cy) of shoreline.
• Construction of the swimming pool and associated decking, accessory pool house,
portion of the boat trailer parking area (BTPA), access drive(s) to the BTPA and boat
ramp, and portion of the multi -family dwellings will result in t20,289 of impervious
coverage in the ES AEC, outside of the 30-foot buffer.
• t7,672 sf of shading in the 30-foot buffer will result in the construction of the walkways,
overlook platform, and boardwalk.
• ±285 Ift of the total 811 Ift of retaining wall proposed along the southern border of Lot 2r
will fill t285 sf (285x1).
High ground (Upland development outside of the CAMA AEC) = t73,000 sf
• The remaining development, which includes the northern and southern access
driveways, septic systems, multi -family dwellings, parking associated with the
dwellings, dumpster pads, trailer parking area, boat launch drive, and associated filling
and grading, will disturb High Ground habitat.

PROJECT NARRATIVE
The Salvo Marina (see attached Relevant portion of USGS Quadrangle Rodanthe with the
Site Identified) is an existing +/- 5.06 -acre parcel located at 27446 & 27478 NC Hwy 12 in
Salvo, Dare County. The property has an existing boat basin with dilapidated bulkhead, boat
ramp and concrete slab foundations of previous structures (see aerial photograph from 2005
showing former improvements on the property), and concrete and gravel drives. The property
owners are interested in creating a marina using the existing basin and constructing two 12-unit
buildings with a swimming pool and all other associated and required infrastructure and utilities
as generally shown on the attached CAMA Plan.
The proposed project includes the following activities:

An SAV survey was conducted on June 25, 2021, by environmental scientists with Quible and
the attached plan shows the surveyed limits of SAV in the Pamlico Sound within the project
location and review area. No rooted SAV was identified within the areas of proposed
development. SAV beds of Ruppia Maritima (60%•80%) were delineated outside of the mouth
of the manmade channel and boat basin as shown.

now or forth rly owned by Payne, a distance of 1,029.6 feet to a point marked by an existing concrete
monument wh' orms the southern terminus of the tie line referred to hereinbelow; thence

On Thursday April 7, 2022 the Environmental Protection Agency's "Clean Water Act Section 401 Certification Rule"
("Federal Rule") was reinstated to its previous version which originally became effective on September 11, 2020. In
accordance with 40 C.F.R. Section 121.4(a) "At least 30 days prior to submitting a certification request, the project
proponent shall request a pre -filing meeting with the certifying agency". In accordance with 40 C.F.R Section 121.5(b)(7),
and (c)(5) all certification requests shall include documentation that a pre -filing meeting request was submitted to the
certifying authority at least 30 days prior to submitting the certification request. Please refer to the Federal Rule for

proposes the demolition of dilapidated structures at 27446 & 27478 NC Hwy 12, Salvo,
Dare County, & construct a marina in the existing basin, with improvements to include
maintenance excavation of the access channel, canal & basin, two 12-unit multi -family
dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier, platforms,
riprap, boat ramp, & associated infrastructure.

The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of property located at 27446 and 27478
NC Hwy 12, in Salvo, Dare County. It was received complete on August 10, 2022, and
appears to be adequate for processing at this time. The projected deadline for making
a decision is October 24, 2022. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th
day.
If this agency does not render a permit decision within 70 days from August 10, 2022,
you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post
this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or
tree along the road right-of-way fronting your property, or at a point along the road right-
of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.

mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection

way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an

Re: Review of Major Permit Application submitted for Salvo Marina
Dear Troy and Brian:
The NC Division of Coastal Management hereby acknowledges receipt of the
preliminary application submitted on behalf of Salvo Marina 27446, LLC, on June
14, 2022, for State approval for the development of property located at 27446 NC
Hwy 12 in Salvo, Dare County. An initial screening of the submittal package has
been conducted per 15A NCAC 073.0200 and has revealed certain deficiencies
which must be corrected before the application package can be accepted as
complete.
I am returning the original application package so that the needed changes can be
made and retain a copy. Please understand that the subsequent detailed review
may reveal additional areas where further information or documentation is
required to demonstrate compliance with the rules directly applicable to the
proposed development. If this occurs, you will be notified of such issues
separately. Our initial screening has identified the following issues that must be
addressed:
Form DCM MP-1:
3. Project location information needs to be updated. Per Dare GIS/tax
records, 27446 NC 12 is Lot 1r owned by the applicant; 27478 NC 12 is Lot
2r owned by the applicant; there is no notation of a 3rd lot. Street addresses
should be updated.
0 27412 NC 12,' the northern lot shown on Sheets 1 and 2 with the
marsh/pond noting ownership under Daniels Family, LLC, was
purchased by Salvo Marina 27446, LLC; deed date confirms purchase
on 06/02/22.

• 4.b. Please update sf of entire tract(s) of it & 2r without inclusion of basin;
the basin is not part of the tract of land as shown on Dare GIS.
• 4.e. During my site visit with Brian on 09/O1/21, it was noted that coastal
wetland vegetation on these two tracts also included spartina alterniflora,
cattails, Spartina cynosuroides, and Scirpus (bulrush). Please update.
• 4.m.(iii). You have indicated there are wetlands on site, and a delineation
was conducted. Please provide documentation of this delineation if
available.
• 5.a. Based on development, it appears that this project should be checked
as Commercial vs. private/community.
• 6.a. Narrative:

that involves the filling and/or excavation of more than one acre of wetlands
and/or open waters. Based upon the information provided, it appears that
$400 would be the correct permit fee. We are returning check #7160 and
request that you submit a new check for the correct amount.
• 6.f. You have listed the Daniels Family, LLC as a riparian landowner. Please
make a correction to note Salty Paws, LLC. You have provided
documentation of notification of riparian property owners through copies of
the notification letters and green and white certified mail receipts. Please
submit copies of the signed, green certified return cards, along with a copy
of any comments received in reply.
• 6.h. Please enter permit history that is General Permit (GP) No. 21808A
issued to OBX, LLB on 04123/1999. This GP was issued for repair and
replacement of bulkheading and boardwalk.
Form DMC MP-2:
Excavation and fill chart — please verify your dimensions for access channel
and boat basin. Your total cubic yards (cy) under #1 notes 567 cy, and
matches total shown on Sheet 2; however, they don't match up to chart
dimensions. I understand that your calculations are based on AutoCAD, but
there is a big difference between the cy using the dimensions given.

• 3.b. The dimensions entered match Sheet 2, with a total sf of 7,540 sf.
Sheet 2 shows 7,254 sf in comments, which would require correction.
• 3.f.(ii)... can you clarify the term epidocally? bid you mean to say,
episodically?
• 4.a.(iii). 'You must enter a dimension for fill area. You state the entire site
will be filled and graded, which is not accurate, as there are coastal and 404
wetlands on these tracts. .
Form DCM MP-3:
• a. Please enter type and number of all buildings and structures proposed;
use this area to list the pool house, overlook platform with boardwalk,
boardwalk around basin, kayak racks, etc. that are all upland structures.
• b. According to Dare GIS, there are 2 lots now, 1r and 2r.
• c. Is 4.7 units per acre based 'on 3 or 2 acres? ... please'verify.
Form DCM MP-4:
• l.c. Dock and Piers - You have noted 3. I would suggest removing the
numbers (1), (2) and (3) beside the numbers, and just separate by semi-
colon.
o I noticed on Sheet 2 that you have outlines of old, existing finger
piers/piers that were going'to be demolished. Since Sheet 1 is for
existing conditions, I would remove the outlines of the old 'piers to
eliminate potential confusion.
• 1.g. Platforms, as noted in V above, I would remove the numbers (1) and
(2), and just separate each dimension by semi -colon.
• 2.a. You checked Toilets; however, you neglected to put a number or
location.
• 2.h. You have noted '2' for channel markers and `no wake' signs proposed.
Please be sure to show those on Sheet 2.
• 6.e.(i)(ii) Please answer these questions.
• 8.a. You have listed kayak racks, which should be listed on MP-3 form for
upland development.

Work Plans/Drawings
• When drawings are larger than 11 inches by 17 inches, 27 copies must be
provided. For your consideration —we accept pdf scans of oversized
plans/colored drawings, as the application packages are currently emailed to
the review agencies. However, the Division would need --at a minimum-7
oversized copies for the Elizabeth City and Morehead City offices.
• Provide the date of plat preparation and any revisions.
Indicates approximate location of Normal Water Level (NWL).
• Sheet 2
o Remove notation of `Proposed 674 sf sunset deck over land'.
o Correct sf of dredge disposal stockpile area.
o Correct sf of proposed platform kayak/paddle board launch.
o Update northern riparian property ownership to show Daniels Family
LLC as owned by Salvo Marina 27446, LLC, and show the next riparian
property owner parcel for Salty Paws, LLC.
o Remove dilapidated finger piers/piers that are being demolished.
o Make sure that total cubic yards listed matches data on MP-2.
o Updated sf of dredge disposal stockpile area to match dimensions
entered on MP form, which is a total sf of 7,540 sf.
o Show location of proposed channel markers and `no wake' signs.
To expedite our response to your permitting request, we will commence the
detailed review of your application for a permit pending the receipt of the
additional information requested above. However, the statutorily provided 75/150
days allowed for review cannot commence until such time as we have received a
complete application package. Once your application has been accepted as
complete, you will receive a separate notification letter.

This looks good to me Gregg. Again as we discussed Mr. Lemme told me he had no objection to the
project. He was going to obtain a copy of the application from Tyrrell County. He has not sent any
