Museum Construction
1) The construction over the waters of Taylors Creek of the elevator shaft, associated mechanical room
and the 6' x 10' entry way is a non -water dependent activity under 15A NCAC 7H.0208(a)(1).
Therefore, these components are not authorized.
Protection of Cultural Resources
2) In order to avoid an adverse impact to the Beaufort Historic District, and to bring the proposed
project into compliance with Section 106 of the National Historic Preservation Act, the proposed
development must be revised to incorporate the recommendations of the attached 8/19/96 letter from
the N.C. Department of Cultural Resources. Such recommendations are also required by the U.S.
Army Corps of Engineers in its 8/23/96 application review letter.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

All work must cease when the permit expires on
December 31, 1999

that your project is consistent with the North Carolina
Coastal Management Program.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of
this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
4) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the pennit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.
Bulkhead Construction
5) The bulkhead will not extend waterward more than 2 feet from the normal water level at any
point along its alignment at the time of construction.
6) The bulkhead must be constructed prior to any backfilling activities.
7) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
8) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except
for that which may be required for the construction of the bulkhead wall, deadmen cables, etc.
This permit does not authorize any excavation waterward of the approved alignment.
9) The fill material will be clean and free of any pollutants except in trace quantities.
10) All back fill material will be obtained from a highground source and confined the permitted
bulkhead.
General
11) No vegetated wetlands may be excavated or filled.

12) No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
13) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having it transferred to a third party.
14) It is possible that the authorized structure may be damaged by wavewash from passing vessels.
The issuance of this permit does not relieve the permittee from taking all proper steps to ensure
the integrity of the permitted structure and the safety of moored boats. The permittee shall not
hold the United States liable for any such damage.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General
Water Quality Certification No. 3025 (DWQ Project No. 960688), which was issued on
10/8/96.

On July 31, 1996, we received the permit application for the above project from
the Division of Coastal Management and telephoned the Department of Agriculture
to request a set of plans for the project. A copy of the design development
drawings was delivered on August 9, 1996. We have reviewed the design
development plans for the new North Carolina Maritime Museum Harborside
Building and are still concerned about its compatibility with the National Register -
listed Beaufort Historic District. Specifically, our concerns are as follows.
Second floor setback. In the Beaufort Historic District, historic buildings have
traditionally been designed with flush facades for commercial and industrial
buildings or with flush facades and one-story or double -tier porches for residential
buildings.- Thus the second floor setback proposed for the new building is out of
character with historic district.
We recommend that the second floor setback be eliminated and the street front
elevation be designed with flush walls. We fail to see how the second floor
setback fulfills any functional requirements and note that a flush facade was
described as "uninteresting" in previous correspondence from the applicant's
architect. As discussed during our May 10, 1996 meeting with the architect, we
believe incorporating a wide second floor belt course in the trim color which
contrasts with the color of the fiber cement weatherboard siding. will enliven and
visually break the street facade while following traditional building characteristics.
A flush facade also eliminates roofing and other maintenance problems likely to
occur due to the second floor setback.

Front Street doors. Historic doors in the district consist of a variety of styles --flush,
paneled, louvered storm, or with full or half -glass. Doors which are camouflaged
with weatherboard siding were not used and are inconsistent with the characteristic
of the district. We recommend that the Front Street doors be changed to flush or
paneled doors which are more appropriate to historic commercial or industrial
buildings in Beaufort. Wood would be the preferred material, but metal is
acceptable. By not installing hardware on the exterior, the public would understand
these are not entrance doors.
Public entrance. Although the adjacent Watercraft Center and the Maritime
Museum buildings have rough, weathered shingles for exterior sheathing, shingles
are an inappropriate siding material for Beaufort's historic district. We recommend
that the public entrance be designed with a simple, recessed wooden panel with
wood trim more in keeping with the district.
Roof over waterside stair. The roof over the exterior waterside stair creates a
stand alone tower --an element that is not in keeping with historic buildings in the
historic district. On August 15, 1996 we spoke with the project architect who
stated that the North Carolina Department of Insurance (DOI) required that the stair
be of heavy timber construction and sprinkled because the building is three stories
tall. However, on August 13 the DOI staff member who reviewed the project
informed us that the three-story stair must be either sprinkled X of heavy timber
construction to meet Type III construction, non-combustible requirements. Based
upon information from DOI, we recommend that the stair be constructed of heavy
timber and the roof removed so the waterside elevation will be more compatible
with the district. Elimination of the roof and unnecessary sprinklers will also reduce
project costs.
Third floor windows. In our April 4, 1996 letter to the project architect, we
recommended that the height of the then proposed two-story building be minimized
as much as possible. We next received a revised design featuring a substantial
three-story tower. To mitigate the incompatibility of the tower, we recommend
that it more closely resemble a monitor roof --a traditional roof form for industrial
buildings on Beaufort's waterfront --by using a continuous band of windows on the
north and south sides. Single light windows, rather than divided lights, are the
appropriate style for this purpose and more closely reflect the treatment of
windows on the lifesaving station the architect showed us.
If the design for the new harborside building is revised to reflect the above
recommendations, we would be able to offer a finding of no adverse effect,
conditioned upon based on our review and approval of final construction
documents. On the other hand, if the design remains as proposed, we believe it
will adversely affect the Beaufort Historic District due to the use of architectural
and visual elements which are out of character with the district. An adverse effect
finding under Section 106 of the National Historic Preservation Act and the
regulations of the Advisory Council on Historic Preservation requires the Army
Corps of Engineers to notify the Advisory Council of the finding and begin
consultation with us and the interested parties to seek ways to avoid or reduce the
adverse effect on the Beaufort Historic District. Until the Section 106 review
process is concluded, the Army Corps of Engineers should not issue a permit for
the undertaking. Because the federal law sets a higher standard for compliance and
consultation for undertakings affecting historic property, conclusion of the Section
106 process will also ensure fulfillment of all state requirements for consideration
of the historic district.
The above comments are made pursuant to Section 106 of the National Historic
Preservation Act and the Advisory Council on Historic Preservation's Regulations
for Compliance with Section 106 codified at 36 CFR Part 800.

The applicant is proposing to replace an existing building with a
new one at their property located adjacent to Taylors Creek and
Front Street in the Town of Beaufort. The present building is a
non -conforming structure since it is presently inconsistent with
Coastal Resource Commission's standard for Development in Areas of
Environmental Concern (15A NCAC 7H) which limit the amount of
impervious surfaces within the Estuarine Shoreline AEC. The
existing building received a CAMA Permit in 1980 which was
apparently prior to the CRC adopting the impervious coverage rule.
The previous land owner did receive a declaratory ruling from the
CRC (through an appeal of a permit decision) that a proposed 600
ft.2 building which would house ships stores, ice machine, tool
box, etc. was a water dependent structure and could be constructed
on an existing wharf located over the waters of Taylors Creek.
This building was never constructed.
The project is also located within the Beaufort Historic District
which is listed in the National Register of Historic Places. The
applicant was been in contact with the NC Department of Cultural
Resources concerning an appropriate design but unfortunately this
remains an unresolved issue. The NC Department of Cultural
Resources has officially commented that if the design remains as
proposed, the development will adversely effect the Beaufort
Historic District.
Based upon the above and a review of the CRC's rules, I would
recommend that the project be denied for the following reasons:
1. The construction of the 6' x 10' entry way, elevator
shaft/mechanical room(s) over the waters of Taylors Creek is
a non -water dependent activity under 15A NCAC 7H.0208(a)(1).
2. According to the August 19, 1996 Memorandum from David Brook
to John Parker and Lt. Colonel Youngbluth, the proposed design
would adversely effect the Beaufort Historic District which
would be in conflict with 15A NCAC 7H.0209(e)(7).
I would have no objections to the construction of the building on
the adjacent high ground (even though the impervious coverage is
greater than 30k) and decks (I doubt that a 3-story deck is truly
water dependent) since the development would appear to be

consistent with the non -conforming development rule 15A NCAC
7J.0211. I would also have no objections to the issuance of a
permit for the construction of a bulkhead and if we do issue a
permit, I would recommend the following conditions:
1. The bulkhead will not extend waterward more than an average of
2' feet from the mean high water level at any point along its
alignment at the time of construction.
2. The bulkhead must be constructed prior to any backfilling
activities.
3. The bulkhead must be structurally tight so as to prevent
seepage of backfill materials through the structure.
4. All backfill material will be obtained from a highground
source and confined behind the permitted bulkhead.

The NC Department of Agriculture (Harborside Maritime Museum) is
proposing to demolish an existing building and replace it with a
new 3-story structure with observation decks at 310 Front Street,
in the Town of Beaufort, on Taylors Creek, Carteret County. The
project site is located within the Historic District of the Town.
The Beaufort Historic District is listed in the National Register
of Historic Places.
Areas of Environmental Concern (AECs) impacted by the proposal
include the Estuarine Shoreline, Estuarine Waters and Public Trust
Areas. Waters at the site are classified as SC and are closed to
the harvesting of shellfish. The area is not a Primary Nursery
Area.
The proposed building replacement project will result in
approximately 80%; impervious coverage of the Estuarine Shoreline at
the site. (The impervious cover created by the existing structure
is also 80`s). Additionally, a portion of the building containing
the entry way, elevator shaft and mechanical equipment room is
proposed to be located over the Estuarine Waters of Taylors Creek.
I have reviewed this proposal for consistency with the 1990 Town of
Beaufort Land Use Plan (LUP) Update and offer the following
comments.
The general area of the project is classified as Developed, while
the AECs impacted by the work are classified as Conservation.
Policies adopted by the Town of Beaufort for development in
Conservation classified AECs are summarized on Page V-2. The Land
Use Plan states that "Development in the estuarine system should be
restricted 'to uses which satisfy the ISA NCAC 7H Use Standards."
The only local policy which exceeds the state standards prohibits
floating structures and does not appear to be applicable to this
proposal.
Specifically, Resource Production and Management Policies for
Marine Resource Areas (Page IV-7) repeat the Town's support for the
7H Use Standards for development in Estuarine Waters and Public
Trust Areas.
Cultural/Historic Resources Policies are located on Page IV-4. The
Town of Beaufort intends to support and protect the Historic
District. Development in the Historic District requires approval
from the Beaufort Historic Preservation Commission.
Since the existing building on the site provides approximately 80%
impervious coverage of the Estuarine Shoreline AEC, the CRC's
nonconforming rules allow the replacement structure to cover the
same percentage of the site. However, the portion of the building
to be constructed over Taylors Creek is not water dependent and
does not meet the 7H Use Standards for development in AECs.
with the exception of the portion of the building proposed for
construction over Taylors Creek, this project appears to be
consistent with the 1990 Town of Beaufort Land Use Plan, provided
all other state requirements are satisfied and local approval from
the Beaufort Historic Preservation Commission is granted to the
applicant.

The application states: these components of the building are not water
dependent and therefor not consistent with Coastal Resources Commission's
rules for development within Areas of Environmental Concern. Thus, the
use of the property is nonconforming with CRC rules. If the project is
approved, then the Commission will be continuing a nonconformity albeit
slightly less in total area. I wouldn't think that staff could authorize
this. Add since there is no such thing as a "use variance", would it take
a special exception to the Commission's rules?

You have our approval to place fill material in 142 square feet of waters for the purpose of replacing
an existing building with a new building at Harborside Maritime Museum, as you described in your
application dated 23 July 1996. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mr. Parker:
Reference the application of the NC Department of Agriculture for a
Department of the Army permit to construct a bulkhead and backfill 142 square
feet of shallow water bottom and construct a building and deck covering
3,842 square feet of open water on Taylors Creek at 310 Front Street,
Beaufort, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
�. compliance with the permit plans.
2. The bulkhead will be positioned an average of 2 feet waterward of
the mean high water (MEW) elevation contour.
3. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.

4. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be sed.
5. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
6. it is possible that the authorized structure may be damaged by
wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
7. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party. ,lyi'l
8. This Department of the Army permit does not obviate the n to
obtain other Federal, State, or local authorizations required by 1

9. All design elements recommended in the April 4, 1996, and June 11,
1996, letters from the North Carolina Department of Cultural Resources
(attached) will be incorporated into the design and construction of the
project in order to avoid adversely affecting the National Register -listed
Beaufort Historic District.

Thank you for your letter of May 22, 1996 transmitting the revised schematic
drawings for the above project.
We h.eive reviewed the revised plans and elevations dated May 15, 1996 for the
new Harborside Building and are pleased that some of our recommendations--
spec fically, th:lse concerning site placement, windows, materials, and details —have
been Incorporated into the design. Based upon the plans and elevations, we believe
the fallowing design elements should also be revised to better reflect Beaufort's
historic waterfront architecture and avoid adversely affecting the National Register -
listed Beaufort Historic District.
Strue.t front elevation. We note that the revised design retains a second floor
seam.-k. Other than for ,aesthetic preference, we fail to see how the setback fulfills
any lunctioned requirements. Since the setback is inconsistent and inappropriate for
the I- istoric district, we! recommend that the street front elevation be designed with
flush walls.
Doslrs;. Rather than trying to camouflage the two doors facing Front Street, use
flush or paneled wood doors which are consistent with Beaufort's historic
comrrrereial cr industrial buildings.
Public: Entrance. Eliminate the shingles from the posts of the public entrance
walkaway. The shingles are an inappropriate siding material for Beaufort's historic
district. With time the camouflage doors will be more rather than less prominent.
Thud floor windows. To make the third floor tower more in keeping with
Bezufort's historic waterfront architecture, it should more closely resemble a
monitor roof, as illustrated by the roof for the Maritime Museum's Watercraft
Center. Rather than having only three windows on the north and south elevations
of the: third floor, use a continuous band of windows on each side to mimic the
mo,itor roof form, as vrell optimize spectacular waterside views.

Roof over wahirside stair. Since the elevator has been moved to the building's
interi,ar, we feel there is no reason to roof the .exterior stair. By placing a roof over
the s-:air, you create a tower element that is out of character with the historic
wate -front:. Because the view and character of historic Beaufort from the water are
as intr:ortant a:. they are from the street, we strongly recommend removal of the
roof over the Stair.
We believe a building design which incorporates these recommendations will better
meet the Se,:,etary of the Interior's Standards —as well as the Design Guidelines of
the Befaufor-; 14 storic Preservation Commission --and will have no adverse effect on
the Be:aufon H storic District. Please note that we need to review and approve the
color ;:>alet:te -ror the building, as well as the revised plans and specifications prior to
unda:-?ai<ing construction to ensure they include the above recommendations to
avoid an advwse effect on the historic district.

cha•,-3ed or extended waterward, but the drawings show the building's footprint set
bad< i-rom the sidewalk. The new building should maintain the existing building's
site placernent which is similar to contributing historic buildings on the south side
of Front Street. Also, the landscape planting features along the sidewalk are not in
keeping with the character of Beaufort's waterfront or the historic district. Other
site features --such as lighting, paving materials, decks, and fencing —should also be
corrig,atible with Beaufort's historic character and provided for our review.

Form ;and rhyttrun. Design the new building to reflect the basic shapes and forms
found an Beaufot's historic industrial and commercial architecture. The historic
buildings along Beaufort's waterfront were usually rectangular, oriented with their
gable roofs stretching fronn Front Street to the water's edge. Additions to the
original building were covered with gable or shed roofs. While the rectangular
footprint of the proposed design is in keeping with Beaufort's historic architecture,
its sr,-cond floor setback, !sower, and roof form are not and should be revised as
folio n':::;
m_f��ejfration. 'The street front elevation should be designed so the walls
are flush. This is more oc:risistent with Beaufort's historic industrial and commercial
architecture.
Z=ef. The tower on the; Front Street elevation is not compatible with the historic
chars ter of t'10 waterfront. Also, by creating a tall central element on the street
side. ': reads s; the entrance to the building, which it is not. We recommend
moving the me--hanical room to the second level and eliminating the tower. By
doing this, the building will be more in keeping with Beaufort's historic character
and the public: uvill be more likely to read the ramped entrance between the
buildings as ti:<3 point of r•)ntry.
As for the stair and elevator tower on the waterfront side, it should be covered
witt, _i gable roof rather than a hip. It would be helpful to see.sketches of the
waterfront: elevation --one illustrating the elevator tower with a front gable and one
with ai side -gable roof.
Fist. Although hip roofs are found on some residential dwellings in the historic
distri,t, buildings on the south side of Front Street typically were and are sheltered
wilt) gable, monitor, or flat roofs. Either a gable or monitor roof would be
appropriate fot the new building and would function as well as a hip roof. It would
be tie 1pful to sae sketches showing a monitor roof and a gable roof, both with
ridges parallel to Front Street, With the elimination of the tower, another option
would be a pair of gables facing Front Street. This may help break up the mass of
the facade and would be reminiscent of the historic gable front buildings on the
walw front.
Height/scale. roiven'tha -the first floor. level must be approximately forty-two
inches above the street level, we understand it is difficult to keep the building at a
hunrzn•) scale and at a height that is consistent with the historic architecture.
Howinrer, efforts should be made to minimize the building's height as much as
pos.aible. By eliminating •the tower and lowering the first floor ceiling height to 8'-
0"1 the overall height will be less overbearing and more compatible with Beaufort's
historic industrial and commercial architecture.
Windows/Doors. Usewindows and doors in the new building that are compatible
in proportion, :size, material, location, shape, and pattern with windows and doors
of Seaufort's historic Nrai:erfront architecture. Rather than a four -over -four pane
confi-luration, a more appropriate configuration would be six -over -six. The fire exit
door acing Front Street should be a simple, one -and -one -half-hour rated wood
door. Also, maintain similar percentages and patterns of window and door
open ngs. Replace the false door on Front Street with a window and position
second level windows directly above.the center bay first level openings.

Ma':erials. Keep the siding and trim material of the new building consistent with
materials traditionally used on Beaufort's historic industrial and commercial
buildings. Wood siding, board -and -batten, and corrugated metal were common
materials. The use of shingles should be minimized to be more in keeping with
Beaufort's historic chara<:ter, as well as to offer some variety to the museum
complex. Eithar a met.ai or asphalt shingle roof would be appropriate.
Details. Use architectural details on the new building that complement the details
of tn: historic; industrial and commercial buildings. These should be simple like the
cons,:ruction details on tize museum's watercraft center.
Color. Choose exterior colors for the new building that are within the established
pale-!= of colex-s typically found on Beaufort's historic industrial buildings. The
corm=nation of gray and white as featured on the neighboring museum buildings Is
acce p-Mble.
We b=:lieve: a building design and site plan which reflect these recommendations
and take into a -count the Secretary of the Interior's Standards will have no adverse
effecl: on the Beaufort Historic District. if the North Carolina Maritime Museum is
willing to consider revisions to its current plans, and to accept and carry out the
following conditions, we believe the project will not adversely affect the National
Register -listed historic district.
Using the above: comments, the museum will revise the plans for the
harborside building to make the exterior of the new building more
compatible with Beaufort's historic architecture.
The museum wiil submit the revised plans for the project to the North
Carolina State Historic Preservation Office (HPO) for.review and approval
prior 5o undertaking construction.
We will be haply to meet with you and representatives of the museum, as well as
a reprasentative:: of the Beaufort Historic District Commission, to further discuss our
comments. We: area available to review and comment on revised sketches so that
the pr.!ject design can move forward. We took forward to working with you and
representatives of the museum on the project.

The U.S. Fish and Wildlife Service (Service) has reviewed the
project plans and field investigation report for permit application
Action I.D. No. 199603925. The applicant, the North Carolina
Department of Agriculture, proposes to demolish and replace the
building which houses the North Carolina Maritime Museum on Taylors
Creek. It is located at Front Street, in the Town of Beaufort,
Carteret County, North Carolina. The proposed activities include
bulkheading the shoreline (average 2' waterward of the plane of
mean high water (MHWJ), locating an elevator, shaft, and support
pilings waterward of MHW (the elevator is to connect the existing
mooring facilities with the replacement building), and constructing
a 61' wide deck over the water (the deck is to be adjacent to the
first floor of the replacement building; two smaller decks are
proposed for the second and third floors).
This is the report of the Service submitted pursuant to, and in
accordance with, provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the
Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C.
1531 et seq.).
The Service recommends that the applicant modify the application to
minimize any potential adverse impacts related to the non -water
dependant aspects of the proposal. We believe that two
$modifications (changing the bulkhead alignment and moving the lower
1deck off the water) will suffice.
The bulkhead should be installed landward of MHW. This will limit
the fill required, avoid any loss of wetlands, and may reduce the
frequency and magnitude of future in -water repair
rehabilitation work. Further, the first floor deck shoulA\,—�ll�`
eliminated to minimize shading of aquatic habitat. Shading' "cat
inhibit primary production in nearshore waters, and reducitoleeX
�:�
available habitat and the forage base. A patio constructed in an
upland location along the bulkhead is our recommended alternative.
An upland patio would avoid adverse impacts to fish and wildlife
resources while providing the same degree of access to Taylors
Creek as a deck.

On February 11, 1991, we renewed general permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received July 22, 1996, for Department of
the Army authorization to construct a bulkhead and backfill 142 square feet of
shallow water bottom and construct a building and deck covering 3,842 square
feet of open water on Taylors Creek at 310 Front Street, Beaufort, Carteret
County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review. -agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to reduce wetland losses. Please show all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to reduce adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please show your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by August 12, 1996. Also, a copy
of this information must be sent to the North Carolina Division of Water
Quality to enable them to adequately evaluate your application for a Water
Quality Certification pursuant to Section 401 of the Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199603925.

reviewed the hold -tip of the CAMA Application with Ray Forrest. Mr. Forrest requested that we
provide you with information regarding efforts to comply with the design review comments as
generated by David Brooks of the N.C. Department of Cultural Resources.
Enclosed for your review is Cultural Resources' letter of April 4 and our answer to each comment.
Please note that the building design was revised to comply with their review comments with few
exceptions. Exceptions include:
1. Stair Tower - Required by Building Code to exit from Third Floor Conference Room.
2. Street Front Elevation - Second Floor was set back to reduce the overall height and scale
of the building.
We have also researched and paid close attention to the commercial architecture of Beaufort. As
design professionals, we are keenly interested in all design issues including historic preservation. We
feel strongly that the design is sensitive and compatible with the historic architecture of Beaufort.
The building design also addresses the Owner's program, budget and building code requirements.

Thank you for meeting with Renee Gledhill -Earley and Robin Stancil on March 7,
1996, to discuss the above project and explain its purpose and the proposed
design.
Based upon our review of the design development drawings (dated March 25,
O 1996), we believe the new building should more closely reflect the historic
1 industrial and commercial architecture which was located along Beaufort's
waterfront. A move towards a more industrial or commercial design, compatible
with the town's historic character, will better meet the Secretary of the Interior's
Standards and avoid adversely affecting the National Register -listed Beaufort
Historic District.
Although the three buildings of the North Carolina Maritime Museum complex
should be recognizable as a related group, we feel this can be accomplished in a
manner that is compatible with Beaufort's historic architecture. Further, it seems
appropriate that a building associated with the North Carolina Maritime Museum --
especially one located on the waterfront--shouid reflect the historic waterfront
architecture of Beaufort, a town known for its fishing industries and shipbuilding.
We recommend that the following design elements be revised:
Site placement/design. We understand the footprint of the building cannot be
O changed or extended waterward, but the drawings show the building's footprint set
back from the sidewalk. The new building should maintain the existing building's
site placement which is similar to contributing historic buildings on the south side
of Front Street. Also, the landscape planting features along the sidewalk are not in
keeping with the character. of Beaufort's waterfront or the historic district. Other
site features --such as lighting, paving materials, decks, and fencing --should also be
compatible with Beaufort's historic character and provided for our review.

Form and rhythm. Design the new building to reflect the basic shapes and forms
O found on Beaufort's historic industrial and commercial architecture. The historic
buildings along Beaufort's waterfront were usually rectangular, oriented with their
gable roofs stretching from Front Street to the water's edge. Additions to the
original building were covered with gable or shed roofs. While the rectangular
footprint of the proposed design is in keeping with Beaufort's historic architecture,
its second floor setback, tower, and roof form are not and should be revised as
follows:
Street front elevation. The street front elevation should be designed so the walls
are flush. This is more consistent with Beaufort's historic industrial and commercial
architecture.
Tower. The tower on the Front Street elevation is not compatible with the historic
character of the waterfront. Also, by creating a tall central element on the street
side, it reads as the entrance to the building, which it is not. We recommend
moving —the — mechanical room to the second level and eliminating the tower. By
doing this, the building will be more in keeping with Beaufort's historic character
and the public will be more likely to read the ramped entrance between the
buildings as the point of entry.
As for the stair and elevator tower on the waterfront side, it should be covered
with a gable roof rather than a hip. It would be helpful to see sketches of the
waterfront elevation --one illustrating the elevator tower with a front gable and one
with a side -gable roof.
Roof. Although hip roofs are found on some residential dwellings in the historic
district, buildings on the south side of Front Street typically were and are sheltered
with _gable, monitor, or flat roofs. Either a gable or monitor roof would be
appropriate for the new building and would function as well as a hip roof. It would
be helpful to see sketches showing a monitor roof and a gable roof, both with
ridges parallel to Front Street. With the elimination of the tower, another option
would be a pair of -gables facing Front Street. This may help break up the mass of
t e facade and would be reminiscent of the historic gable front buildings on the
waterfront.
Height/scale. Given that the first floor level must be approximately forty-two
Oinches above the street level, we understand it is difficult to keep the building at a
`} human 'scale and at a height that is consistent with the historic architecture.
However, efforts should be made to minimize the building's height as much as
possible. By eliminating the tower and lowering the first floor ceiling height to 8'-
0"; the overall height will be less overbearing and more compatible with Beaufort's
historic industrial and commercial architecture.
Windows/Doors. Use windows and doors in the new building that are compatible
in proportion, size, material, location, shape, and pattern with windows and doors
O of Beaufort's historic waterfront architecture. Rather than a four -over -four pane
configuration, a more appropriate configuration would be six_oyer-six. The fire exit
door facing Front Street should be a simple, one -and -one -half-hour rated wood
door. Also, maintain similar percentages and patterns of window and door
openings. Replace the false door on Front Street with a window and position
second level windows directly above the center bay first level openings.

Materials. Keep the siding and trim material of the new building consistent with
O materials traditionally used on Beaufort's historic industrial and commercial
buildings. Wood siding, board -and -batten, and corrugated metal were common
materials. The use of shingles should be minimized to be more in keeping with
Beaufort's historic character, as well as to offer some variety to the museum
complex. Either a metal or asphalt shingle roof would be appropriate.
Details. Use architectural details on the new building that complement the details
O of the historic industrial and commercial buildings. These should be simple like the
construction details on the museum's watercraft center.
Color. Choose exterior colors for the new building that are within the established
® palette of colors typically found on Beaufort's historic industrial buildings. The
combination of gray and white as featured on the neighboring museum buildings is
acceptable.
We believe a building design and site plan which reflect these recommendations
and take into account the Secretary of the interior's Standards will have no adverse
effect on the Beaufort Historic District. If the North Carolina Maritime Museum is
willing to consider revisions to its current plans, and to accept and carry out the
following conditions, we believe the project will not adversely affect the National
Register -listed historic district.
0 Using the above comments, the museum will revise the plans for the
harborside building to make the exterior of the new building more
compatible with Beaufort's historic architecture.
0 The museum will submit the revised plans for the project to the North
Carolina State Historic Preservation Office (HPO) for review and approval
prior to undertaking construction.
We will be happy to meet with you and representatives of the museum, as well as
a representative of the Beaufort Historic District Commission, to further discuss our
comments. We are available to review and comment on revised sketches so that
the project design can move forward. We look forward to working with you and
representatives of the museum on the project.
By copy of -this letter we are notifying the Division of Coastal Management, the
U.S. Army Corps of Engineers, and the Beaufort Historic District Commission of the
potential adverse effect of the project as currently proposed; of our efforts to work
with you to avoid,an adverse effect; and of the need to complete the Section 1,06
process prior to issuance of the necessary permits for construction.
The above comments are made pursuant to Section 106 of the National Historic
Preservation Act and the Advisory Council on Historic Preservation's Regulations
for Compliance with Section 106 codified at 36 CFR Part 800.

We feel that the design is "commercial" and compatible with the historic character of
Beaufort.
2. Site Placement/Design
The building has been moved forward to align with sidewalk line.
The planters have been removed.
Lighting, paving and all materials will be selected carefully to reflect the character of the
Historic District.
3. Form and Rhythm
The basic design does reflect the basic shapes and forms found in the area.
Roof Lines - Considering using a shed and gable in lieu of a hip roof. See elevations.
Street Front Elevation - Second floor set back needed to reduce the overall height and scale
of the structure. A "flush" facade would also be uninteresting.
Tower - The building code requires an exit stair from the upper floors. The "tower" contains
the stair and is used as the central element of the overall design. It should not read as the
entrance to the building - the stair door would be an exit only (no hardware on outside) and
be concealed by facing the door with the selected building material - either horizontal siding,
shingles or board and batten.
The ramped entrance will be highlighted as the entrance to the complex. Appropriate signage
will also be used. The public should have no difficulty in identifying the entrance. See
elevations.
Roof - Hip roof has been revised to a gable or shed/gable combination. See elevations.
4. Height/Scale
The height and scale of the building has been minimized by the setback of the second floor
from the street line. Floor -to -floor heights will provide finish ceiling heights of 8'-6".

Elimination of the stair "tower" is not an option unless the building program is revised.
We are sensitive to the scale of the building and will refine the massing by careful selection
of materials, such as width of siding, shingle exposure, window size, etc.
5. Windows/Doors
We will use six -over -six pane windows, however, our research indicates a variety of pane
configurations previously used including nine -over -nine and four -over -four.
The exit stair door will be integrated and concealed into the front elevation as much as
possible.
6. Materials
Building materials will be carefully selected to be consistent with the traditional Beaufort
palette of materials. A combination of horizontal wood siding with wood shingles and/or
board and batten would be appropriate. The roof will be an asphalt shingle type.
Details
It is our intent to keep all detailing basic and simple, interior and exterior, to compliment the
details of historic commercial construction.
8. Color
Will be selected carefully within the established palette of Beaufort's colors. A combination
of gray and white for the exterior is our first choice at this time.
Interior colors are perceived to be muted and non -aggressive.
The above response to review comments should demonstrate that we are very much aware
of the historic nature of Beaufort's architecture and would not propose a design that would
have adverse effect on the historic district.
We look forward to working with the North Carolina Historic Preservation Officer and the
Beaufort Historic District Commission to achieve a project that is aesthetically correct and
acceptable to all and in consideration of the building program requirements of the Owner.

9. NARRATIVE DESCRIPTION: The NC Department of Agriculture (NC Maritime
Museum) is proposing to demolish an existing building and replace it with a new
structure at a site located adjacent to Front Street and Taylors Creek, in the Town of
Beaufort, Carteret County. The site is ± .29 acres in size and has in the past few
years served as office and classroom space for the NC Maritime Museum. A
dock/deck system provides mooring facilities in Taylors Creek for ± 4 boats. Prior to
the State's acquisition of the property, the building was used for commercial rental
space and as a motel. The 3-story building was originally constructed around 1979 on
a site where a boat railways facility once was. The property owner received a variance
from the Coastal Resource Commission for the building and adjacent deck structure.
The variance concerned the building exceeding the 30% impervious rule and the
construction and enclosure of a portion of a 3 story deck system. The waterward
footprint of the building was (and presently is) located approximately at the mean high
water (MHW) line. The building is constructed on pilings which are in various states
of deterioration. The property is located within the Historic District of the Town of
Beaufort which is listed in the National Register of Historic Places. The waters of
Taylors Creek are classified as SC waters and are closed to the harvesting of shellfish.
The Maritime Museum is proposing to replace the old structure with a new one which
will retain its use as office and classroom spaces. Plans submitted with the application
shows that the shoreline of the property is proposed to be bulkhead an average of 2'
waterward of the MHW line. The proposed building will be 3 stories but will be
higher in elevation than the previous structure. Excluding the elevator shaft and entry
way, the proposed building will be ± 26' in width x 53' length x 39' high and will be
located landward of the proposed bulkhead. The proposed building will generate an
impervious footprint coverage of the Estuarine Shoreline of ± 80% which is slightly
less than the existing structure. Total square footage of the building is, however,
slightly greater than the present structure. The applicant is proposing to located the ±
6' wide x 10' long elevator/shaft and entry way component of the building below the
mean high water line of Taylors Creek. The support for the elevator as well as the
remaining building will be on pilings. Waterward of the building, a 3 story deck
system is proposed. The first floor level will be up to ± 62' long x ± 61' wide with
the upper two floors being ± 14' x 20'. Two condenser units are proposed to be
located on the second deck.
10. ANTICIPATED IMPACTS: The project as proposed will result in the filling in of ±
142 ft.z of shallow water bottom area with ± 5 yds.' of upland fill material being
placed below the MHW line. The proposed building replacement will result in a total
footprint coverage of ± 1,438 ft.z with ± 80% of the Estuarine Shoreline AEC being
covered with impervious coverage. This would represent a slight reduction in the
amount of impervious coverage created by the existing building. A component of the
building would, however, be located over the Estuarine Waters of Taylors Creek with
the entry way, elevator shaft and mechanical equipment room being located over the
water. These component of the building are not water dependent and therefor not
consistent with Coastal Resource Commission's rules for development within Areas of
Environmental Concern. The proposed observation decks will result in a footprint
coverage of ± 3,782 ft.z with a total square footage coverage being slightly less than
the existing decks. The project is located with the Beaufort Historic District and the
applicant has been in contact with the Division of Archives and History in the
Department of Cultural Resources concerning a design compatible with the Historic
District.

This letter is in response to your application request under the Coastal Area Management
Act (CAMA) to replace the existing N.C. Maritime Museum adjacent to Taylors Creek in
Beaufort, Carteret County. The application was received by the Division's Morehead City office
on June 28, 1996, at which time a coordinated state and federal review of the proposed project
was initiated. During the course of this review, comments were received from the N.C.
Department of Cultural Resources (NCDCR), in which concerns were expressed over potential
impacts the proposed development may have on the Beaufort Historic District. Because of the
seriousness of these concerns, and the emphasis the rules of the Coastal Resources Commission
place on the protection of historic resources, it has been determined that a response to the
NCDCR concerns is necessary in order to adequately review the proposed project.
In accordance with T15A:07J.0204(d), which states that processing of an application may
be placed on hold if additional information from the applicant is necessary to adequately assess
the project, processing of your application must be terminated until such time as a response to the
attached August 19, 1996 NCDCR memo is provided to both this office and the Department of
Cultural Resources. As required by T15A:07J.0204(d), during the pendency of any termination
of processing, the permit processing period will not run. Upon notification that the requested
information has been provided, the Division of Coastal Management will resume processing of
the application at the point where it was terminated. If you have any questions concerning this

County, North Carolina, by and through his.Attorney-In-Fact,
MARGARET.ANN P. MERRICK, of Carteret County, North Carolina,
party of the first part, hereinafter called "Grantor", and the
State of North Carolina, c/o State Property Office, 116 W. Jones

acceptance of the gift by the State of North Carolina for the

acknowledged, has bargained and sold and, by these presents, does

part, its successors and :assigns,all of that certain tract or
parcel of land lying and being in the Town of Beaufort, Carteret

being part of Lots 243 and 244, Old Town, a
Beaufort, North Cdrolina, and beginning on

known as W. S. Chadwick's northwest corner,

56-23 W 211.59 feet from the intersection of .
the center line of Turner Street and the
south right of way line of Front Street; and
(Irunning thence S 33-37 W 93.24 feet to a
point in Taylor's Creek;, thence with Taylor's
Creek N 56-23 W 71.25 feet to a point; thence
N 33-37 E 93.24 feet to'the southern margin
of Front" Street; thence with the southern
