Protection of Cultural Resources
1) In order to.avoid an adverse impact to the Beaufort Historic District, and -to -bring the proposed
project into compliance with Section i-06 of the National Historic Preservation Act, the proposed
development must be revised to incorporate the recommendations of the attached 8/19/96 letter from
the N. C. Department, of Cultural Resources. Such recommendations are also required by the U. S.
Army Corps of Engineers in its 8/23/96 application review letter.
2) No sewage,, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the.docking facility shall be considered a violation of this
permit for which the permittee is responsible: ,,This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when.the-project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease, when the permit expires on

-the terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having the permit transferred to a third parry.

On July 22, 1996, the North Carolina Department of Agriculture applied
,for Department of the Army authorization to construct a bulkhead and backfill
142 square feet of shallow water bottom and construct a building and deck
covering 3,842 square feet of open water on Taylors Creek at 310 Front Street,
Beaufort, Carteret County, North Carolina.
After review of the proposal and related documentation, the Advisory
Council on Historic Preservation recommended modifications to the application
by letter dated February 27, 1998 (copy enclosed). These recommendations are
efforts to minimize or avoid anticipated adverse affects to the National
Register -listed Beaufort Historic District.
Our administrative process provides you the opportunity to propose a
resolution and/or to rebut any and all recommendations before a final decision
is made. In this regard, I would appreciate being made aware of your
intentions on or before March 27, 1998.

We are in receipt of your August 28, 1997, letter to Wayne Wright with the Wilmington
District of the Army Corps of Engineers (ACOE) concerning the North Carolina Maritime
Museum's permit for the Harborside Building. As noted in your August 28, 1997, letter to
the ACOE, we participated in the Section 106 consultation in the role of State Historic
Preservation Officer and provided final comments on the proposed undertaking on February
20, 1997.
Since then there have been several major changes in the circumstances involved in the project.
On August 28, 1997, the North Carolina General Assembly ratified the state budget bill,
which included the transfer of the Maritime Museum from the Department of Agriculture to
the Department of Cultural Resources' Division of Archives and History, of which I am the
director. In addition to the administrative change effective July 1, 1997, the General
Assembly provided funds to complete the purchase of thirty-six acres for future expansion of
the museum on Gallant's Channel outside the Beaufort Historic District.
Together these changes create a unique situation that we believe offers the opportunity to
address several of the concerns outlined in your letter to the ACOE. As the new owners of the
museum, we are very much aware of the conflict in interest created by our having become the
permit applicant and our role as SHPO. Given the conflict, we recognize the need to
relinquish our role as SHPO under the Advisory Council's (ACHP) regulations and are fully
prepared to participate in the Section 106 consultation as an applicant for the federal permit or
federal permittee, depending upon the ACOE's definition of the terms "suspended" and
"restored" in its August 5, 1997, letter to the museum. Further, we intend to explore possible
changes to the design of the building given the opportunities offered for expansion on Gallant's
Channel. In sum, we look forward to consulting further with the ACOE, the ACHP, the local
historic district commission, and other interested parties as outlined in the ACHP's
regulations.
By copy of this letter I provide this update to the appropriate parties and will contact you and
them once we have explored all our options for redesigning the Harborside Building. If we

Reference Department of the Army (DA) authorization for you to construct a building and

By letter of April 28, 1997 (copy enclosed), the Advisory Council on Historic Preservation
informed us that interested members of the public have expressed concerns and raised questions
whether appropriate consultation pursuant to Section 106 of the Historic Preservation Act has
been completed. A review of our files indicates that, although a permit condition was imposed at
the request of the North Carolina State Historic Preservation Officer, the permit does not benefit
from specific review by the Advisory Council. Therefore, the authorization provided to you by
our letter of October 31, 1996, is hereby suspended, and no construction activity may commence
until Federal permit is restored.
We are consulting with the Advisory Council, and we will assure full compliance with all
aspects of Section 106 review. You will be informed of the results of this consultation and the
further status of your Federal authorization as quickly as possible.

Management, we have learned of the amendment of your State permit that
authorizes you to construct a building and deck and construct and backfill a
bulkhead on Taylors Creek, Beaufort, Carteret County, North Carolina. This
amendment, by order of the Coastal Resources Commission (CRC), provided for
construction of an elevator shaft and mechanical room.
This additional work has been reviewed and is consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291. Your
work is authorized provided it is accomplished in strict accordance with your
amended State authorization and the recommendations of the North Carolina
Department of Cultural Resources found in their letter of August 19, 1996.
Failure to comply with the State authorization or conditions of the general
permit could result in civil and/or administrative penalties.
If there is a need to extend the duration of this Federal authorization,
or if any additional change in your work is required because of unforeseen or
altered conditions or for any other reason, a written request for renewal of
authorization or plans revised to show any change must be sent promptly to
this office and the North Carolina Division of Coastal Management before
continuing work or doing any change or alteration. Such action is necessary
as specific renewal of authorization must be obtained or revised plans must be
reviewed and the authorization modified. A request for extension of

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit farm. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work: done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources..

FINAL ORDER
This matter was heard on oral arguments and stipulated facts at the regularly scheduled
meeting of the North Carolina Coastal Resources Commission (hereinafter CRC) on January 23,
1997, in Atlantic Beach, North Carolina pursuant to N.C.G.S. § 113A-120.1 and T15A NCAC
7J.0700, et sea. Assistant Attorney General David Heeter appeared for the Department of
Environment, Health and Natural Resources, Division of Coastal Management; Rodney Barfield,
Director of the Maritime Museum, represented the North Carolina Department of Agriculture.
Upon consideration of the stipulated facts, record documents and the arguments of the
parties, the CRC adopts the following:
STIPULATED FINDINGS OF FACT
1. The N.C. Department of Agriculture (Agriculture) owns a three-story building located
at 310 Front Street off Taylors Creek in the Town of Beaufort, Carteret County. The building is
constructed on pilings, and the waterward or southern side of the building approximates the mean
high water (MHW) line. There is also a dock/deck system over the waters of Taylors Creek
which provides mooring facilities for approximately four boats. The building was originally
constructed in 1979. Prior to the State's acquisition of the property in 1989, the building was used
for commercial rental space and a hotel. The property is located within the Town of Beaufort's
Historic District.

2. The building has been used by Agriculture to provide office and classroom space for
the Maritime Museum. Due to the poor condition of the building and code violations, it is no
longer being used by the Museum. Agriculture wants to demolish the building and replace it with
a new one to be used by the Museum for the same purposes.
3. The proposed building will be three stories high, but slightly higher than the existing
one. Excluding the footprint of the proposed elevator shaft, associated mechanical room, and
entry way, the impervious footprint of the building (approximately 26' wide by 53' long) will be
slightly less than the footprint of the existing building as well as the total impervious surface.
The total square footage of the new building will be reduced from 4,508 sq. ft. to 3,584 sq. ft. A
three story observation deck system is proposed waterward of the building with a footprint of
3,782 sq. ft. which is slightly less than the footprint of the existing dock/deck system.
4. A bulkhead is proposed an average of two feet waterward of the MHW line. Except for
the elevator shaft, mechanical room, and entry way, the waterward or southern side of the
proposed building would approximate the MHW line.
5. The elevator shaft, mechanical room, and entry way would be located on the
southwestern side of the building waterward of the MHW line over the waters of Taylors Creek.
The elevator shaft, etc, would measure six by ten feet with a footprint of 60 sq. ft. The elevator
would give access to the second and third floors. The observation deck system would also be
located over the waters of Taylor's Creek.
6. The shoreline above the MHW line is within the Estuarine Shoreline Area of
Environmental Concern (AEC) designated by the CRC in Rule 15A NCAC 7H .0209. The

waters of Taylors Creek below the MHW line are within the Estuarine Waters and Public Trust
AECs designated by the CRC in Rules 15A NCAC 7H .0206 and .0207 respectively.
7. On October 21, 1996, the Division of Coastal Management issued CAMA Major
Development/Dredge and Fill Permit No. 144-96 to the Department of Agriculture authorizing
the removal of the existing building and construction of a new one with the exception of the
proposed elevator shaft, associated mechanical room and entry way. Condition (1) of Permit No.
144-96 deleted the elevator tower because of Rule 15A NCAC 7H .0208(a)(1) of the CRC which
prohibits non -water dependent uses within the Estuarine Waters and Public Trust AECs.
8. Agriculture filed a variance request on October 24, 1996, seeking a variance from Rule
15A NCAC 7H .0208(a)(1). Agriculture is not seeking a variance from any of the other
conditions attached to Permit No. 144-96.
9. Petitioner's architect has been informed by a representative of the Office of State
Construction that the elevator is required to comply with the Americans with Disabilities Act
(ADA) in order to provide handicap access to the second and third floors. However, based upon
conversations with representatives of the N.C. Department of Administration and Office of State
Construction, the Division of Coastal Management understands that there may be some relief
from the ADA elevator requirement that Petitioner has not fully explored.
10. The existing building and dock/deck system are not being used for any non -water
dependent uses.
Based on the foregoing Findings of Fact the Coastal Resources Commission makes the
following:

CONCLUSIONS OF LAW
1. The CRC has jurisdiction over the parties and the subject matter.
2. The parties have been correctly designated and there is no question of misjoinder
or nonjoinder of parties.
3. All notices for the variance proceeding were adequate and proper.
4. Application of T15A NCAC 7H.0208(a)(1) may result in practical difficulties and
unnecessary hardships to Petitioner in that the Americans with Disabilities Act requires an
elevator in the building and the elevator, associated mechanical room and entry way cannot be
located within the footprint of the new building without sacrificing necessary classroom space.
5. The hardships that Petitioner faces result from conditions peculiar to Petitioner's
property in that: (1) the existing classroom building can no longer be used by the Maritime
Museum due to poor condition and building code violations; and (2) site restrictions make it
difficult to design a new classroom building in compliance with coastal management standards,
local government ordinances, historic district restrictions and the ADA without locating the
elevator and associated service areas outside the footprint of the main building and over public
trust waters.
6. The Coastal Resources Commission did not anticipate these conditions when the
subject rules were adopted.
7. The proposed development will be consistent with the spirit, purpose and intent of
coastal management statutes and rules in that: (1) the new building will have a footprint
comparable to the existing building that it will replace, but will be more compatible with the

Beaufort waterfront; and (2) the proposed elevator tower will be located within the footprint of
the existing dock and deck system over the waters of Taylor's Creek.
Based on the foregoing Findings of Fact and Conclusions of Law, the Coastal Resources
Commission hereby GRANTS Petitioner's request for a variance from 15A NCAC
711.0208(a)(1).
