Docking Facility 1) This permit authorizes only the docks, piers, boatlifts, gazebo, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of 3 formalized boat slips. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 21, 2027 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Scott and Meredith Raney ADDITIONAL CONDITIONS Permit No. 137-22 Page 2 of 4 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the established Wrightsville Beach pier -head line. 4) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the eastern adjacent property owner's area of riparian access. 5) Should the western adjacent lot be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, the two existing concrete stanchions (2) identified in the attached workplan drawing, Sheet 3 of 4 dated 11/3/22, shall remain in place for the life of the permitted docking facility. 7) No. sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 11) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the gazebo shall not be designed for second story use. Bulkhead Replacement/Oyster Sill 13) The bulkhead shall be constructed in accordance with the alignment depicted on the attached revised workplan drawing, Sheet 3 of 4 dated 11/3/22. 14) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 15) The bulkhead shall be constructed prior to any backfilling activities. Scott and Meredith Raney ADDITIONAL CONDITIONS Permit No.137-22 Page 3 of 4 16) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 17) This permit does not authorize any excavation waterward of the approved alignment. 18) The fill material shall be clean and free of any pollutants except in trace quantities. 19) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 20) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will be used to backfill the area behind the permitted bulkhead. 21) All fill material to be placed below normal high-water level shall be confined behind the permitted bulkhead. 22) All oyster plantings associated with the proposed oyster sill shall take place in accordance with the project narrative dated 3/14/22 and the attached, revised workplan drawings. Sedimentation and Erosion Control 23) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 24) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 25) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 26) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 27) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. It appears that the project is also CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(7), including allowing the bulkhead alignment to be permitted below mean high water or normal high water if "the bulkhead alignment extends no further below approximate mean high water or normal high water than necessary ...to align with adjacent bulkheads...". This office has no objection to the proposed work, provided it is consistent with all other local, state, and federal permitting requirements. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 18 Pelican Drive in Wrightsville Beach adjacent to Lee's Cut. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to reconstruct a bulkhead a maximum 11.5' and average 7' waterward the NHW line. This alignment would connect to the comers of the adjacent properties' bulkheads and incorporate a 140 ftZ area of live oysters. In addition to the bulkhead replacement, the applicant proposes to establish a new three slip facility with gazebo, floating docks, and two boat lifts. Lee's Cut in this area is classified SB by the Environmental Management Commission. The NCWRC has reviewed the permit application and believes the project can demonstrate further avoidance and minimization of impacts to environmental resources. On April 29, 2022 the NCDCM, NCDMF, and NCDWR conduct a site visit and observed live oysters on the existing structure. To minimize the fill of shallow water habitats, the NCWRC recommends bulkhead alignments be as close to NWL or the existing bulkhead alignment as possible. Reduction in the distance waterward the existing structure would remove fill of shallow water habitat and avoid impacts to the live oyster area. Therefore, the NCWRC requests the alignment be reduced to 2' waterward the existing bulkhead alignment and that recommendations made by the NCDMF be incorporated into the project design to minimize impacts to live oyster resources. RAWLS Direcra MEMORANDUM: TO: Cameron Luck, Assistant Major Permits Coordinator FROM: Kimberlee Harding, NCDMF Fisheries Resource Specialist SUBJECT: Scott and Meredith Raney DATE: May 20, 2022 A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the CAMA Permit application for proposed actions that impact fish and fish habitats. The applicant is proposing to replace an existing bulkhead with realignment to connect to both adjacent properties by extending waterward a maximum of 11.5' and an average of 7' below NHW, remove the existing docking facility, and construct a new 3-slip docking facility with a covered gazebo, floating docks, and two (2) boat lifts. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. On April 29, 2022, DMF staff along with DCM and DWR conducted a site visit at low tide to evaluate impacts to fish and fish habitats. Division staff confirmed under the existing docking facility and along the existing bulkhead is an approximately 140 ftz area of live oysters. Shell bottom is an extremely productive self -building three-dimensional habitat that can be impacted long term through dredging and filling, pollution, and other contaminants. This vital estuarine habitat is very limited in North Carolina, and restoration and conservation of shellfish habitat is at the forefront. The presence of live shellfish that historically or currently survive due to favorable conditions is considered shellfish habitat. The proposed bulkhead replacement would adversely impact the oyster bed, therefore the NCDMF recommends the new bulkhead should not extend out more than 2' beyond the existing bulkhead. The proposed gazebo will be sited over the oyster bed, so the Division recommends the existing pilings should be used again, if possible, and if that is not possible the pilings should be cut to the substrate as to not impact the oyster bed. The new pilings should be spaced in a manner that does not impact the oyster bed. During construction if any live oysters must be impacted by construction, the Division recommends that the any live shellfish identified within this impact area should be relocated to a nearby area in the same vertical distribution along the water column. North Cardin 28557 252-72b-7021 past, shellfish are raked away from the impact area and transported to areas within the project area where live oysters are present or relocated to a natural shoreline where oysters are present have been utilized and proven effective. The division recommends an in -water -work moratorium of April 1 to September 30 to protect oysters from being covered in sedimentation during peak growing season. Waterward of the bulkhead a 2 feet wide by 58 feet The proposal is also to remove the existing docking facility and replace it with a new one. The new docking facility will include a 21 feet by 6 feet access pier that will extend from the new bulkhead into Lee's Cut. A 13 feet by 13 feet gazebo will be located on the east terminal shape. The applicant proposes two (2) boatlifts, one 12.6 feet by 12.6 feet boatlift will be feet of Estuarine Waters of the US. The applicant is proposing to replace an existing bulkhead with realignment to connect to both adjacent properties by extending waterward a maximum of 11.5' and an average of 7' below NHW, remove the existing docking facility, and construct a new 3-slip docking facility with a covered gazebo, floating docks, and two (2) boat lifts. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. On April 29, 2022, DMF staff along with DCM and DWR conducted a site visit at low tide to evaluate impacts to fish and fish habitats. Division staff confirmed under the existing docking facility and along the existing bulkhead is an approximately 140 ft2 area of live oysters. Shell bottom is an extremely productive self -building three-dimensional habitat that can be impacted long term through dredging and filling, pollution, and other contaminants. This vital estuarine habitat is very limited in North Carolina, and restoration and conservation of shellfish habitat is at the forefront. The presence of live shellfish that historically or currently survive due to favorable conditions is considered shellfish habitat. The proposed bulkhead replacement would adversely impact the oyster bed, therefore the NCDMF recommends the new bulkhead should not extend out more than 2' beyond the existing bulkhead. The proposed gazebo will be sited over the oyster bed, so the Division recommends the existing pilings should be used again, if possible, and if that is not possible the pilings should be cut to the substrate as to not impact the oyster bed. The new pilings should be spaced in a manner that does not impact the oyster bed. During construction if any live oysters must be impacted by construction, the Division recommends that the any live shellfish identified within this impact area should be relocated to a nearby area in the same vertical distribution along the water column. PROJECT DESCRIPTION The project site is located at 18 Pelican Drive, on the Lee's Cut, in Wrightsville Beach, New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and after approximately 0.3 miles bear left onto W. Salisbury Street. Travel approximately 0.13 miles and turn left to access Pelican Drive, and then turn right onto Pelican Drive. The subject property will be 0.39 miles down on the left. The property boarders Lee's Cut near the Atlantic Intracoastal Waterway (AIWW) in Wrightsville Beach. According to the applicant, the 0.21 acre parcel located at 18 Pelican has a maximum elevation of 0-10' above normal high water (NHW) and has approximately 77' of shoreline frontage, which is currently stabilized by a wooden bulkhead that approximates normal high water (NHW). The lot has an existing single-family home with the high ground vegetation consisting primarily of ornamental landscaping and maintained lawn grasses. Waterward of the existing bulkhead is an existing docking facility and open water. The existing 3-slip docking facility includes a 23' by 18' platform extending from the bulkhead. An access ramp located at the eastern end of the platform leads a 6' by 15' floating dock positioned perpendicular to the shoreline. Attached on the landward end extending west parallel with the shoreline is a 3' by 10.5; floating dock that also connects to another 6' by 19' floating dock positioned perpendicular to the shoreline creating a U-shaped floating dock. The current configuration appears between 2002 and 2004 but no permit history was found. A docking facility of similar size has been in place since before 1992. The Town of Wrightsville Beach Land Use Plan classes the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace the existing bulkhead by stepping out a max of 11.5' and an average of 7' below NHW to connect the comers of adjacent bulkheads, remove the existing docking facility, and construct a new 3-slip docking facility with a covered gazebo, floating docks, and two (2) boat lifts. The applicant proposes to replace the existing timber bulkhead with a vinyl sheet pile bulkhead that would step out between 3' and 11.5' (an average of 7') below NHW to connect the corners of the adjacent bulkheads, Walerward of the existing bulkhead consist of mud flats and open water. Live oysters were noted under the existing docking facility. Since the existing bulkhead approximates NHW the proposed step out would fill approximately 425 ftz of Estuarine / Public Trust Water and disturb approximately 486 ftz of high ground along the Estuarine Shoreline to Install tie -backs. The existing docking facility will be removed. The new docking facility would include a 21' by 6' access pier that would extend from the new bulkhead into Lee's Cut, A 13' by 13' gazebo is proposed to be located on the east terminal end of the access pier in a L-head configuration. An access ramp would lead onto a 35' long by 6' floating dock, positioned in - line with the fixed access pier, perpendicular to the shoreline. Additionally, a 16' by 6' float would be attached to the east landward side of the 35' float, positioned parallel to the shoreline. A 30' by 6' float would be attached to the east side of the 6' by 16' float, perpendicular to the shoreline, creating a U-shape. The applicant proposes two (2) boatlifts, one 12.5' by 12.5' boatlift would be positioned on the inside of the U-shaped float and one 12.5' by 12.5' lift is proposed for the west side of the 35' float. The boatlift on the west side of the 35' floating dock would be located approximately 12.5' inside the 15' riparian setback (see Sheet 3 of 4). A waiver was obtained by the applicant from the adjacent riparian property owner to the west located at 20 Pelican Drive. Water depths, submitted by the applicant, measuring approximately -3.4' and -2.5' on the waterward side of the existing float, were confirmed by DCM during a March 16, 2022 site visit. Live oysters were noted during the site visit under the existing platform, in an area approximately 140 V, which would be impacted by the proposed bulkhead alignment. The oysters are associated with the structure of the platform and are not found in the exposed mud flat area's on either side of the platform. As proposed, the new bulkhead and 3-slip docking facility would result in the incorporation of approximately 1,093.6 ft2 and the filling of approximately 425 1`12 of Public Trust Area and Estuarine Waters. Approximately 486 ft2 of high ground area within the Estuarine Shoreline AEC would be disturbed for installation of the tie backs associated with construction of the proposed bulkhead. There would be no impact to vegetated wetlands, however approximately 140 ft2 of live oyster existing under the fixed platform would be impacted by the proposed bulkhead replacement. The application indicates that the constructed features would encroach approximately 12.5' into the adjacent 15' riparian corridor setback on the western side, however, no encroachment into the eastern 15' riparian setback nor the established pierhead tine is proposed.
