This permit, issued on December 16, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the boatlift and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating
or stationary, shall become a permanent part of this docking facility without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) This permit authorizes 1 additional formalized boat slip for a maximum of 3 formalized boat slips at
this docking facility.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 16, 2027
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
7) Should the eastern lot be sold prior to the initiation of construction of the docking facility, the permittee
shall obtain a written agreement from the new owner(s) waiving the minimum setback, and
authorization to construct the portion of the docking facility within the property owner's riparian setback
and submit it to the Division of Coastal Management prior to initiating construction of the docking
facility.
8) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from the
normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water
body, whichever is more restrictive.
Sedimentation and Erosion Control
9) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2022-01840
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 20221207.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

RECOMMENDATIONS FOR 1853 Sea Aire Canal
The total area of platform was calculated as follows:
Shoreline length = 60 ft. x 8 ft. = 480 SF allowable
Existing Fixed Platform = 16 ft. x 18 ft. = 180 SF, (288SF minus 108 SFfor access credit)
Existing Floating Dock = 12 ft. x 16 ft. = 192 SF
Existing Boatlifts: 13 ft. x 13 ft. = 169 SF, not counted for shading
Proposed Boatlift = 13 ft. by 13 ft. = 169 SF, not counted for shading
Total Counted sq. ft. = 372 SF
The proposed boatlift would provide docking space for one additional vessel, increasing the slip count from 2 to
3 slips. The proposed docking expansion would extend approximately 40' into the waterbody, which measures
approximately 168' across. As proposed, the project would be CONSISTENT with the use standards set forth in
NCAC 07H .0208, including the docking facility length limitations, the eight square -foot shading rule. The
proposed constructed features would encroach into the 15ft. riparian setback for the adjacent riparian property
to the east, however the appropriate waiver has been obtained. The docking facility would be located entirely
over open water in water depths ranging from -2.08 to -3.0 @ NLW, according to the applicant.

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus
manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at
hftp://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.

Your work is authorized by the above referenced permit provided it is accomplished in strict
accordance with the attached conditions and your submitted application and attached
information and drawings dated July 20 and August 25, 2022 . Any violation of the attached
conditions or deviation from your submitted plans may subject the permittee to a stop work
order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide
and/or regional general permit authorization is modified, suspended or revoked. If, prior to the
expiration date identified below, the nationwide and/or regional general permit authorization is
reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or
regional general permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide and/or regional general permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case -
by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401
Water Quality Certification. You should contact the NC Division of Water Resources (telephone 919-
807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area
Management Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal

PROPOSED PROJECT: Expansion of an existing docking facility to provide mooring for three (3) vessels
The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request completed August 25, 2022 and received by this office on August 31, 2022. The waters of
the Atlantic Intracoastal Waterway in the project vicinity are classified as SA;HQW by the Division
of Water Resources (DWR).
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in
yourapplication do not require written authorization to utilize GC4497. However, you are required
to follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(but not limited to erosion and sedimentation control regulations and state stormwater
requirements before you proceed with your project). Also, the approval to proceed with your
proposed impacts to waters a depicted in your application shall expire upon expiration of the 404
or CAMA Permit.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby

Consistency Determination:
This project appears to be consistent with the Brunswick County -Land Use Plan.
The applicant proposes to expand a private docking facility on the parcel with a new boat
lift, increasing the slip count by one, for a total of 3 boat slips within the riparian corridor.
The project is located at 1853.East Sea Aire Canal SW, adjacent to the AIWW in
Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA and not open to the harvesting of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Brunswick County Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential while the AECs impacted by
the work are classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The
Brunswick County Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
This project appears to be consistent with the Brunswick County Land Use Plan

9. PROJECT DESCRIPTION:
The project site is located at 1853 Sea Aire Canal SW, on a canal adjacent to the AIW W, in Supply, Brunswick
County. The site, which was originally two lots, is approximately 0.28 acres, and is vegetated primarily with
manicured lawn grass. There is an existing single family residence on the parcel site and an existing bulkhead
(permit 80240D issued 2021) located landward of coastal wetlands. The project site has approximately 100ft. of
shoreline frontage along the AIWW. Then is a small strip of Coastal Wetlands along the bulkhead, comprised
solely of Smooth Cordgrass (Spartina alterniflora), measuring approximately 10 ft waterward in the eastern corner
of the lot. There is currently a two slip private docking facility on the parcel (GP 86004D issued 2022), which
consists of a fixed platform (18' x 16') which originates in the center of the parcel and extends waterward from
the bulkhead. From the fixed platform, a gangway extends waterward, landing on a floating dock (8' x 20', slip#
1) oriented parallel with the shoreline. To the immediate east of the floating dock, there is an existing boatlift,
serving as slip #2.
The Brunswick County Land Use Plan classifies the adjacent waters as Conservation. The waters of the AIW W
are classified SA by the Division of Water Resources. This area is IS designated as a Primary Nursery Area
(PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to expand an existing docking facility with the installation of a new boat lift, increasing
from two (2) existing slips to three (3) proposed slips. According to the application materials, the applicant is
proposing to construct a new boat lift (13'x 13') to the immediate east of the existing floating dock. According to
the agent, the boat lifts would be located in water depths ranging from-2.08'@ NLW on the landward side to -
3.0' @ NLW on the waterward side.
According to the work plan drawings, the applicant's proposal is located within their riparian corridor, and
landward of the %4 of the width of the waterbody, which measures approximately 170' across. The proposed
docking facility would encroach into the eastern riparian corridor setback, but the appropriate waiver has been
obtained (Sea Aire HOA).
10. ANTICIPATED IMPACTS
The proposed boat lift would incorporate an additional 169 sq. ft. of Estuarine Waters and Public Trust Area.
Currently, the existing facility incorporates 616 SF of Estuarine Waters and Public Trust Area. The proposed
boatlift would be landward of the '/, width. This area is not designated as Primary Nursery Area, and the
proposed lift would be located in water depths ranging from -2.0 to -3.0 at NLW according to the applicant.
Minor increases in turbidity should be expected during construction.

existing docking facility includes a fixed platform (16' x 18') , a floating dock (12' x 16'), and a boat lift
(14' x 17').The existing docking facility has 2 formalized slips and the proposed boat lift will increase
that to 3 formalized slips. The property has approximately 100' of shoreline (existing bulkhead). At NI, W
the most waterward depths of the docking facility are greater than -3.0 feet. The new boat lift landward
pilings are proposed in -2.08 feet of water at normal low water.

review period is provided by law when such time is necessary to complete the review. If you have not been notified
of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 25th 2022, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road fight -of -way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
