This permit, issued on December 14, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the floating docks, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes 1 additional formalized boat slips for a maximum of 3 formalized boat slips at
this docking facility.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 14, 2027
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps�of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2022-01841).

Quality Certification 4497 and assigned the project DWR Project No. 20221208.
NOTE: Future development of the permittee's property may require a modification of this permit.

dependent activities are not authorized within 30 feet of the normal high-water level.

The proposed development would provide formalized dockage for a total of three (3) vessels. The proposed floating dock
would extend approximately 4' into a waterbody measuring 52', which is CONSISTENT with NCAC 071-1.0208 (b)(6)(G).
The application also appears to be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208(b)(6),
including those which dictate the maximum allowable platform area, the 15' riparian setback and federal channel setback.
There may be potential navigation concerns at lower tide cycles however the proposed floating dock will not encroach
further into the channel than the existing facility. To the west is a low clearance bridge that is impassible by vessel
around an average high tide and to the east is a large oyster bar that is impassible byvessel around an average low tide
(Please see attached DCM low tide site photos). As proposed, the 4' wide floating dock with inlayed pilings appears to
free up enough of the channel portion to allow for passage.

Consistency Determination:
This project appears to be consistent with the 2006 Wilmington -New Hanover County
Joint Land Use Plan.
The applicant proposes to expand a private docking facility on the parcel with a new
floating dock, increasing the slip count by one, for a total of 3 boat slips within the
riparian corridor. The project is located at 5401 Efrrd Rd in Wilmington, New Hanover
County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA and not open to the harvesting of shellfish.
The area is Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection while the AECs
impacted by the work are classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The 2006
Wilmington -New Hanover County Joint Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these standards appear to
be applicable to this proposal.

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus
manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at
hftp://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.

Your work is authorized by the above referenced permit provided it is accomplished in strict
accordance with the attached conditions and your submitted application and attached
information and drawings dated April 1 and July 11, 2022. Any violation of the attached
conditions or deviation from your submitted plans may subject the permittee to a stop work
order, a restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide
and/or regional general permit authorization is modified, suspended or revoked. If, prior to the
expiration date identified below, the nationwide and/or regional general permit authorization is
reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or
regional general permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide and/or regional general permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case -
by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401

PROPOSED PROJECT: Expansion of an existing docking facility to provide mooring for three (3) vessels
The Division of Water Resources (DWR) has received a copy of your CAMA Major permit application
request completed August 24, 2022 and received by this office on August 31, 2022. The waters of
the Hewletts Creek in the project vicinity are classified as SA;HQW by the Division of Water
Resources (DWR) and have been designated as Primary Nursery Area (PNA) by the Division of
Marine Fisheries (DMF). Please understand that the waters around your project area have been
identified as Primary Nursery Area and the DWR supports the concerns and recommendations of
the Division of Marine Fisheries and the Wildlife Resource Commission regarding dredging within
these designated areas. Requests to dredge within these areas must be consistent with 15A NCAC
02B .0220; 15A NCAC 02B .0222 which require that Surface water quality standards require that
conditions of waters be suitable for all best uses provided for in state rule (including, at minimum:
aquatic life propagation, survival, maintenance of biological integrity, and fishing, fish, and Primary
Nursery Area(PNAs) wildlife; secondary contact recreation; and that activities must not cause
water pollution that precludes any best use on a short-term or long-term basis. .
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in
your application do not require written authorization to utilize GC4497. However, you are required
to follow the conditions listed in the attached certification.
You should also obtain and comply with any other federal, state and local requirements including
(but not limited to erosion and sedimentation control regulations and state stormwater
requirements before you proceed with your project). Also, the approval to proceed with your
proposed impacts to waters a depicted in your application shall expire upon expiration of the 404
or LAMA Permit.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form may be obtained from the OAH at http://www.ncoah.COM/ or by
calling the OAH Clerk's Office at (919) 431-3000 for information.

9. PROJECT DESCRIPTION:
The project site is located at 5401 Efird Road, adjacent to Hewletts Creek, in Wilmington, New Hanover County. The
property consists of a 0.79-acre parcel that is situated on land that is approximately 15' above Normal High Water
(NHW) and vegetated with typical lawn grasses. A single-family residential home and driveway is under construction
on the high ground portion of the property authorized by New Hanover County Minor Permit 19-27. The
approximately 300' shoreline is natural (no man-made shoreline protection features) and the high ground transitions to
coastal wetlands which consist mostly of Smooth Cordgrass (SpartinaAltern j7ora) with Black Needle Rush (Juncos
roemarianus) existing on the northwest side ofthe property. The width of the waterbody in the location of the project
area is approximately 52' which was confirmed by DCM on 7/21 /2022. The Pine Grove Drive bridge extends over the
waterbody to the west of the property and to the east exists a single-family residence with a docking facility. An oyster
bar extends approximately 25' into the waterbody between the two existing docking facilities.
Currently, a pier, two fixed platforms, gazebo, finger pier, boat lift, and floating dock exist at the subject property.
General Permit #74310D was issued on 5/6/19 which authorized the construction of the pier, two fixed finger piers,
and two floating docks. Due to multiple navigation complaints, the eastern floating dock measuring 25' long by 6'
wide was removed by the property owner. General Permit #799421) was issued on 8/26/21 which authorized the
construction of a finger pier, side mount boat lift, and gazebo.
The Wilmington -New Hanover County Land Use Plan classifies the area as Conservation. The waters in this location
are classified as SA by the Division of Water Quality. The area IS designated as a Primary Nursery Area (PNA) by the
Division of Marine Fisheries and is CLOSED to the taking of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install a 14' x 4' floating dock at an existing two (2) slip facility to accommodate three
(3) vessels.
The applicant is proposing to install a 14' long by 4' wide floating dock to the eastern side of the existing facility,
waterward of the existing fixed finger pier in the same footprint as originally authorized by General Permit
#7431 OD (See Sheet I of 3). The application states that the width of the floating dock would be shrunk from the
originally authorized 6' to the proposed 4' and that the pilings would be located on the interior of the floating
dock so the proposed floating dock would extend approximately 4' into the waterbody to address navigation
concerns. According to the application, the water depth underneath the proposed floating dock is 2' at Normal
Low Water (NLW). DCM confirmed the depth under the proposed floating dock ranges from approximately 2.5'
to 4' 2". The channel in the area of the proposed floating dock is approximately 17' wide, with water depths
ranging from 2' 1" to 4' 11" deep at NL W. The proposed floating dock would be encroaching approximately 3'
into the channel portion of the waterbody with 14' of the channel remaining unobstructed. The deepest portion of
the channel appears to be located 2' waterward of the proposed floating dock. The cross section of the applicant
collected water depths in Appendix I appears to be inaccurate. Please refer to the attached "DCM Collected
Depths" which were collected on 8/8/2022 and corrected for Normal Low Water.
According to application materials, the current facility combined with the proposed floating dock would exceed
800 sq. ft., which is greater than the City of Wilmington's allowable square footage. Therefore, the applicant is
proposing to modify existing components to meet the 800 sq. ft. rule. The eastern 27' long x 6' wide fixed finger
pier would be reduced to 14' long x 4' wide. The faced 35' long by 4' wide finger pier would be roduced to 28'
long x 4' wide. These modifications are being proposed to meet the City of Wilmington's allowable 800 sq. ft.
requirements and the City of Wilmington verified that the proposed project would meet their square footage rule
(See Narrative and Appendix K).
As proposed, the floating dock would allow the facility to accommodate up to three (3) vessels. According to
application materials, the proposed floating dock would be located entirely within the applicant's riparian corridor
and would be located 24.5' from the eastern riparian corridor line. RECEIVED

11. ANTICIPATED IMPACTS:
The proposed floating dock would result in the additional incorporation of 56 sq. ft. of Estuarine Waters and
Public Trust Area. No coastal wetlands should be impacted as part of this project. The proposed development
would be located within the applicant's riparian corridor and outside each 15' riparian corridor setback. As
proposed the floating dock would extend approximately 4' into a waterbody measuring 52' which would be
within /. width of the waterbody. There is a potential for navigation impacts based on the placement of the
existing structures at this docking facility. Turbidity associated with this proposal would be minimal.

Introduction:
Southern Environmental Group, Inc. (SEGi) has been retained by Mr. John Drish, herein referred to as "Applicant", to
secure a CAMA Major Permit, to install a floating platform, which will serve as a third boat slip, at his property, located
at 5401 Efird Road (see Attachment A). The following information is being submitted in support of the NC Division of
Coastal Management's CAMA Major Permit Application.
Parcel Information and Project Location:
The project is located at 5401 Efird Road, within the incorporated area of the City of Wilmington, in New Hanover
County, North Carolina. The deed can be found at Book 6200 Page 2798 (see Attachment B). The lot encompasses
approximately 1.43-acres, has approximately 300 feet of shoreline, and is situated on an unnamed tributary to Hewlett
Creek (see Appendix C), which serves as the rear property line. The site property is zoned Residential (see Appendix D).

Site Information:
The project site abuts an unnamed tributary to Hewlett Creek, which is part of the White Oak River Basin and is classified
as SA;HQW, by the North Carolina Division of Water Resources (see Appendix Q. The N.C. Division of Marine
Fisheries has designated this area as Permanent Nursery Area (PNA) and a coastal waterbody (see Appendix E).
According to the North Carolina Division of Health, Shellfish Sanitation Section (1-IS9), waters are closed to harvesting
shellfish (see Appendix F). The tributary is approximately 52' wide, measured from edge of marsh to edge of marsh, and
the edge of the channel is located approximately 12 feet from the edge of marsh. An oyster bar is located downstream,
between the existing pier and the adjacent property dock, which directs the channel, during flowing tides, toward the
opposite side of the creek (see Appendix G for details).

Currently the dwelling is under construction, with the foundation of the dwelling being mostly completed, and the
following is a list of the components and their as built dimensions that are currently in place today:

Project Purpose and Need:
The purpose of this project is to install a second floating platform, which will provide one more wet, boat slip, to the
Applicant, who has two boats and a jet ski.
Project Description:
Work associated with this project consists of reconfiguring existing Components 3 & 7, to replace the previously
approved, 25' x 6% floating platform with a 15' x 4' floating platform. Under CAMA rules the Applicant is allowed up
to 8' for every linear foot of shoreline and a maximum of 2000 SF of platform area. However, the City of Wilmington's
PNA Conservation District restrictions, which limits platform area to 800 square feet and includes everything outside the
6' wide access dock. That being the case, Components 3 and 7 are being reduced, to meet the 800 SF threshold. The
Katharine Thurston, at the City of Wilmington, has reviewed and approved the proposed plan (see Appendix K.) The
following table summarizes the proposed changes and new components associated with this project:

Component 9, the Applicant reduced the width of the component, from 6' to 4', thereby increasing the navigable width
of the waterbody, during higher tides. This should provide for easier passage through the channel, while his boat is
docked at the slip.
Currently, the closest structure, to the east of Component 3, is approximately 45 LF away, while the closest structure, to
the west of Component 6, which is a NC DOT bridge, is approximately 180 LF. Component 9 will be attached to existing
pilings. Therefore, no new pilings are being proposed, with this application. Please refer to Appendix G for details of the
proposed work.
Adjacent Riparian Property Owners:
As part of the permit process, the adjacent riparian property owners (ARPOs) are to be notified of the proposed work.

Summary:
In summary, the Applicant is seeking approval, in the form of a CAMA Major Permit, to perform work that will take
place within the within and over Public Trust Waters and Lands. The proposed work consists of reconfiguring the existing
structure and adding a floating platform, which will provide a third boat slip at his residence. The proposed work is
consistent with the current rules and regulations of the NC Coastal Area Management Act, as well as the stalRee"S'19 D
Clean Water Act, and is considered the least environmentally damaging practicable alternative.

your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 24, 2022, you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.

You were correct, we were 65 SF over the city's maximum 800 SF platform area. To correct
that, John is proposing to reduce Components 3 and 7, and has reduced the proposed
floater, all of which will max his platform area at 799 SF (see attached plan).
