The permit had been amended by CRC variance to allow for non -conforming development over public trust waters. The permit expired on December 31, 1999. The applicant has had several delays in construction due to attempting to meet permit conditions. In keeping with the Division's informal policy of allowing for a 6 month grace period in making renewal requests, I recommend that a renewal be authorized for a 2 year period, as in T15A: 07J .0404(a). Additionally, as a housekeeping note, the NC Maritime Museum is no longer a underthe Department of Agriculture, but is now a Section of the NC Division of Archives and History, under the NC Department of Cultural Resources. RP The Major Development and Excavation permit had been held up over extensive deb U N 1 6 2000 concerning the design of the building, specifically concerning the possible impact of th on the Beaufort Historic District. The delay in the project has been primarily due to th lent y MORE EAD MI and meticulous process of bringing the project into compliance with Section 106 ofthe aUauta Historic Preservation Act as required by the permit amendment. After a lengthy period (perhaps two years or more) of redesign, further debate, and the loss of our original architect., we decided to place the permit on hold long enough to retain another architect and modify the design in attempts to satisfy all concerns. To date, a new architect has been retained, public and agency comments have been solicited and received, the design has been modified to reflect those concerns, and building design and development drawings have been resubmitted to State Construction and N.C. Department of Insurance. Upon approval, construction documents will be submitted to CRC to retrace the permit process once again. If approved, then the project will be let for construction bids. The design cannot be considered as final until it has cleared the internal State regulatory agencies, and then the State and Federal permitting process. Until the design is finalized, it is impossible to establish a construction schedule, and thus predict a completion date. We request that the existing permit be renewed to allow time for the process of design modification being done to meet the requirements of the original permit amendments. We have enclosed a $50 check with this letter, which we understand to be the proper method of requesting renewal of a permit. I just checked the file for the permit, which was originally issued on 10/21/96. In terms of the renewal, we have a somewhat unofficial rule that we will accept renewal requests for 6 months following the expiration of a permit (which in this case would be the end of this month). Therefore, if in the next 2 weeks or so you can get us a renewal request in to the Morehead City Office (along with an explanation of why the renewal is needed, anticipated completion dates, what has been done to date, and a $50 check), then we should be able to give a 2 year renewal to the permit. Maritime Museum's proposed Harbors'de building on Beaufort's Taylor Creek, an "anonymous" complaint was sent to the federal Environment Protection Agency alleging "toxic or hazardous" substances are in the submerged sediment on the water side of the construction site. Friday EPA official Phil Vorsatz, chief of the N.C. waste site management section of EPA's Atlanta regional office, said the agency received core samples results taken by an independent testing firm purporting to show contaminants such as lead, grease and oil in the sediment. Through the 1950s, a boatyard operated at the site and the suspect residue may be left over from engine repair and hull scraping operations in those days, say knowledgeable sources. Longtime Beaufort residents contend that since the seaport, until recently a working industrial waterfront, there's no telling what other toxins might be on the bottom of Taylor's Creek, which runs the length of Front Street. It was unclear Friday whether any EPA toxic material investigation of the Harborside site will be undertaken, and if so whether the tests might be expanded to include the entire waterfront, opening the possibility of costly removal efforts if contaminants are found. Mr. Vorsatz declined to disclose the identity of the private environmental testing firm or who forwarded the test results to the EPA. He said it would be necessary to go through the EPA's Freedom of Information officer to seek release of the information. Mr. Vorsatz said, however, that the information he received was forwarded to him by Kathy Matthews, a life sciences specialist with the EPA in Atlanta. Ms. Matthews similarly declined to disclose the identity of the environmental lab or who sent the test results, saying the party preferred to remain anonymous. Asked specifically whether she had spoken to or otherwise communicated on the matter with Linda Dark, lobbyist and owner of the Cedars Inn with her husband Sam, who until recently was point person leading opposition to the proposed Harborside educational and classroom complex, Ms. Matthews said, "I'd rather not answer that." Mr. Vorsatz said that his department has not yet had time to review the independent test results and therefore he doesn't know whether there is anything to be concerned about or whether the EPA plans to visit the site itself to conduct its own tests. "It all depends on the levels (of toxins) whether there is sufficient concern to go further into this and on who owns the adjacent property," he said. Also on Friday, Jeffrey Richter, with the Army Corps of Engineers, Wilmington, the permitting agency for the project, said he, too, had been made aware of the possibility of contaminants at the site and was consulting with staff lawyers whether to require government testing as a condition of granting a permit for construction of the proposed $473,900 office and classroom building. Mrs. Dark, who recently said she turned over leadership of the Harborside opposition to Beaufort 1 of 2 5/5/98 12:27 PM Headliner .r http://www.carteretnewstimes.com//headln l .htm shopkeeper Jay Bumpus, convinced the National Council on Historic Preservation in Washington, D.C., to oppose the museum's design plans to build Harborside parallel to Front Street and to favor her wish to have Harborside built perpendicular to Front Street on piers extending out into Taylor's Creek, with open decks on either side of the structure. Such a design would provide water views for the Cedars Inn and the adjacent Elizabeth Inn, owned by A.H. Woodard, who with Mrs. Dark and others have been in a long -running battle with the museum over its Harborside project. Both inns are directly across the street from the Harborside building site. The museum previously owned a rundown building there but razed it in the spring of 1997 for the proposed new building. Mrs. Dark is a professional lobbyist who has worked on other preservation issues with the National Historic Preservation Council, and particularly with Martha Catlin, the council staffer assigned to the Harborside project. Last summer, Mrs. Dark organized a group of West Front Streets merchants to delay the planned construction of Harborside from June until the end of tourist season in November to avoid disrupting business on the west end of Front Street. The museum accommodated that wish, but soon found the Darks had expanded their demands to include downsizing the original design and building the structure perpendicular to Front Street, thus providing the water views. Because of those bureaucratic delays, construction did not begin in November and probably won't until the controversy is settled. The museum in the meantime is running up expenses to rent space elsewhere in Beaufort to accommodate office workers displaced when the old office building was tom down to make way for Harborside. The museum, which is controlled by the N.C. Division of Archives and History, agreed to reduce the size of Harborside, as the Darks demanded, but said it couldn't build the structure perpendicular to Front Street because too much usable office and classroom space would be lost. Dr. Jeff Crow, director of the archives division, said there is no historical precedent for a perpendicular building, thus apparently rebutting Mrs. Dark's argument that it would "adversely" effect the historic district if the building were built horizontal to Front Street as other buildings are. Dr. Crow also asked the National Advisory Council to allow the Beaufort Historical Commission to review the Harborside building plans since both agencies work from the same set of federal historical building standards.
