be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The bridge must be redesigned so that the elevation of the bridge deck is three (3) feet above
marsh substrate.
2) The approved alignment of the proposed bridge abutment must be staked by a representative of
the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the
start of construction. Failure to initiate construction within thirty (30) days, or erosion of the
shoreline by adverse weather conditions, will require the alignment to be restaked by DCM
within a maximum of thirty (30) days prior to the new expected start of construction.
3) No marsh grass will be excavated and/or filled.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

The Chairman of the Coastal Resources Commission has decided to deny your request
for a contested case hearing concerning CAMA Major Development Permit No. 136-96 issued to
Edward L. Murrelle. You will receive an order, signed by the Chairman, setting out the grounds
for his decision.
You may appeal the Chairman's decision by filing a petition for judicial review in the
superior court pursuant to N.C.G.S. H 113A-123(a) and 150B-45 within thirty (30) days after
you receive the Chairman's order. Once the Chairman has denied a hearing request, the permit
again becomes active and the applicant may begin construction as authorized under the permit at
any time.

This is in reference to your letter of April 14, 1997 in which you furnished this office with a corrected plat
of your property located in the Deerfield Shores Subdivision, near the Town of Beaufort, Carteret County.
According to your letter, this plat represents the true dimensions of your lot which is slightly smaller than
the size shown on your CAMA permit application. This also increases the amount of permitted impervious
areas within the Estuarine Shoreline Area of Environmental Concern from 22.6% to 24.6%.
Please be advised that CAMA Permit No. 136-96 is hereby refined to allow for the corrected lot size as
indicated in your letter and accompany plat. Please attach a copy of this letter to your permit so that it may
be made available to Department personnel when making routine monitoring inspections of the project
site.

to a plat thereof in Map Book 28, Page 259 in Carteret County, North Carolina. The corrected
map shows the impervious surface cover to be 24.6% within the AEC rather than 22.6% as
shown on the previous map. The error resulted from utilizing the incorrect plat reference.
Please include in CAMA permit #136-96 the amended map dated April 8, 1997 by James
I. Phillips & Assoc. showing the impervious surface cover to be 24.6%.
Please notify me that the corrected map has been included in permit #136-96 and
construction in accordance with the permit with the correct map is permitted.

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

office and to advise you of the Division's action on an application for Mr. Edward Murrelle.
The staff carefully reviewed your letter, especially item No. 3 concerning the AEC
calculations. We understand the position you take on this item. We appreciate your interest in
area water quality maintenance. However, under the Rules of the Coastal Resources
Commission (CRC), we have determined the project should be authorized as requested, except
for the adjustment to the bridge height to help reduce shading impacts to the coastal marsh. The
related CRC Rule, incidentally reads .... "30 percent of the AEC area of the lot" .... for

Dear Mr. Pigott:
On or about May 31, 1996, I received a letter and a copy
of an application for a CAMA permit from Mr: Edward Murrelle.
In the letter, Mr. Murrelle asked me to sign a form indicating
that I did not object to the proposed improvements listed in
the CAMA application. I have not signed -the form and I am
strongely opposed to the issuance of the CAMA'permit. The
following is a list of my objections and concerns:
1. Before I purchased my present lot in Deerfield Shores, I
asked Mr. Ron Hardee (seller) if a house could be built
on the outer edge of lot #12. He stated that a house could
not be built on that portion of lot #12. A house located
on that section of the lot will block approximately 1/3
of my view of the water and my entire view of the
Intracoastal Waterway. This obstruction of view will
decrease my property value.
2. The bridge will destroy approximately 900 square feet of
marshland. This marsh is used extensively by many species
of wading birds, often with their offspring.
3. I believe that the area of coverage in the Area of
Environmental Concern (AEC) should be calculated as two
separate pieces of land. The fresh water runoff from
the section where the house is planned will not be
decreased by the section where the septic system is
located.
4. I am very concerned about the transport of sewage across
the marsh and the possibility of line rupture due to
environmental conditions (storms, frozen pipes, etc.).
5. The outer edge of lot #12 is highly susceptible to damage
during storms with a southwest wind. I am concerned that
pieces of the house and/or bridge will become battering
rams during such a storm.
Please, include this letter when the application is forwarded
to other agencies and notify me of the final disposition. Thank
you for your considerations.

8. PROJECT SUMMARY: The applicant proposes to bridge an area of Coastal Wetlands to gain access
to and build a house on high ground property.

9. NARRATIVE DESCRIPTION: The applicant's property is an approx. 3/4 acre lot
located adjacent to Dancer Court in the Deerfield Shores subdivision, north of the
Town of Beaufort, Carteret County. The lot borders the Newport River and is
separated into two distinct high ground tracts by a ± 90' wide border of Coastal
Wetlands (vegetated primarily by spartina alterniora and spartina patens). The
upland property consists primarily of a grassed lawn with elevations up to +5'. A
septic tank has been installed in the area adjacent to Dancer Court. The waters of the
Newport River are classified as SA and are open to the harvesting of shellfish.
The applicant proposes to construct a ± 90' long by 10' wide wooden timber bridge
over the Coastal Wetlands in order to get access to the high ground property adjacent
to the Newport River. A single family residence with approximately 3,000 sq. ft. of
impervious area would be constructed on this site. A pump tank would be installed
near the house to collect the waste water and the effluent would be pumped through a
force main suspended on the bridge to the existing septic system. Water lines and
other utility lines would also be suspended from the bridge. A 10' wide rock driveway
would lead off Dancer Court to the beginning of the bridge and continue on the other
side after exiting the bridge. Total impervious area would be approximately 5,145 sq.
ft or approximately 23 % of the total lot area within the Estuarine Shoreline AEC.
10. ANTICIPATED IMPACTS: The proposed bridge would be constructed 2.5' above
the marsh floor and would shade approximately 9,000 sq. ft. of Coastal Wetlands. The
bridge would begin and end on high ground at a vertical abutment placed 4' landward
of the Coastal Wetlands. There would be limited impacts to the wetlands during pile
driving and some negative impacts may be caused by the shading effects of the bridge
over the wetland plants. The bridge would not be located over any navigable waters.
The project (house and driveway construction) would result in approximately 23%
impervious coverage within the Estuarine Shoreline AEC.

Mr. Murrelle's property is located off Dancer Court in the
Deerfield Shores subdivision, adjacent the Newport River, north of
the Town of Beaufort, Carteret County. He proposes to construct a
wooden timber bridge over Coastal Wetlands to gain access to high
ground, where a house will be constructed.
In addition to Coastal Wetlands, Areas of Environmental Concern
(AECs) impacted by the project include Estuarine Waters and the
Estuarine Shoreline. Waters at the site are classified as SA and
are open to the harvesting of shellfish. The area is not a Primary
Nursery Area.
I have reviewed this proposal for consistency with the 1991
Carteret County Land Use Plan (LUP) Update, as amended September
24, 1993, and offer the following comments.
The general area of the project is classified as Limited
Transition, while the AECs impacted by the proposed work are
classified as Conservation.
Carteret County's intentions regarding development in Conservation
classified AECs are discussed in the Resource Protection and
Resource Production and Management Policy sections of the LUP.
Applicable policies include those for Marine Resource Areas (Page
IV-11). With certain exceptions, none of which appear to be
applicable to this proposal, Carteret County supports the use
standards for development in Estuarine Waters and Public Trust
Areas.
The Land Use Plan states that except as prohibited in the policies
section of the Plan, development allowed by the 7H Use Standards
will be allowed in those areas which are identified by the NC
Division of Coastal Management as Coastal Wetlands. I can find no
policy in the amended Plan regarding development in Coastal
Wetlands which would appear to preclude this nroiect.

SUBJECT: CAMA/Dredge and Fill Permit Application for Edward Murrelle, Deerfield Shores
S/D, Newport River, Carteret County.
Staff biologists with the Wildlife Resources Commission have completed a review of the
project with regards to associated impacts on wildlife and fishery resources in the area. A site
visit was conducted July 31, 1996. Our comments are provided in accordance with provisions of
the Fish and Wildlife Coordination Act (48 Star. 401, as amended; 16 U.S.C. 661 et. seq.) and the
Coastal Area Management Act (G. S. 113A-100 through 113A-128).
The applicant owns a 3/4 acre lot in the Deerfield Shores subdivision. The lot borders the
Newport River and is separated into two distinct high ground tracts by approximately 90 ft. of
regularly flooded salt marsh ( vegetated primarily with Distichlis spicata, Spartina alternij7ora,
Salicornia sp., Spartina patens, and Juncus roemerianus). The applicant proposes to construct a
90 ft. long x 10 ft. wide wooden bridge over the coastal wetlands in order to get access to the
high ground property adjacent to the Newport River. Waters at the project site are classified as
SA and are open to the harvest of shellfish.
Drift lines and debris on the site indicate that the "high ground" closest to the Newport
River floods during storm tides, therefore, the proposed residence, driveway, and sewage
pumping tank should be designed for flooded conditions. As proposed, the top of the bridge will
be elevated 2.5 ft. above the marsh substrate. To minimize tliefqossmarsh due to shading we
recommend the underneath side of the bridge be elevated at I !kst 3 ft. bove the marsh substrate
and that spacing be left between the planking boards to allow li etration beneath the
structure.
We will not oppose permit issuance if the above bridge modification is included in the
permit and if the applicant can show that the proposed development and sewage design will not
contaminate adjacent surface waters which are open to shellfishing.

processing at this time. The projected deadline for making a decision is October 1, 1996. An additional
75day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted

You have our approval to construct a bridge over 9,000 square feet of wetlands or waters at your lot
off of Dancer court, Deerfield Shores Subdivision, as you described in your application dated 30 July 1996.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead witli your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The Wilmington Regional Office received a copy of the CAMA Major permit application on August 6, 1996.
The application is for a bridge and dwelling within Deerfield Shores Subdivision. The subdivision received a revised
Certification of Compliance with Stormwater Regulations on May 3, 1995. The Certification provided a maximum
built -upon area per lot of 6,000 square feet, including buildings, driveways, patios of brick, stone or slate,
walkways, etc. It does not include uncovered wood decking or the water surface of a swimming pool. The proposal
for approximately 5,145 square feet of impervious area is well within the allowable built -upon area, therefore,
additional permits for stormwater will not be required.
Please note that the lot owner is responsible for meeting the built -upon area requirements of the Stormwater
Certification, and is not relieved of his/her legal responsibility to obtain other permits which may be required. Future
modifications to the project will require additional review from this Office to assure that stormwater impacts are not
an issue.

Dear Mr. Pigott:
As expressed in my letter to you June 24, 1996, I am
concerned about the feasibility of a house being built on
the outer edge of lot #12 as proposed in a CAMA application
by Mr. Edward L. Murrelle. During hurricane "Bertha", that
section of lot #12 was completely covered with water. The
lot was also submerged during the March storm of 1993. I
believe that to allow construction of a home on property
which has been completely flooded twice in approximately
three years would be irresponsible to the people of Carteret
County and undermine the intentions of the Coastal Area
Management Act.
Please forward this letter to other agencies which
review the CAMA application and notify me of the final
disposition of the application. Thank you for your
considerations.
