In addition to the completed application form, the
following items must be submitted:
• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2' by II* white paper. (Refer to
Coastal Resources Commission Rule 7I.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.

adjacent waterfront (riparian) landowners and

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require

I would have no objections to the proposed project however I would offer the following
recommendations:
1. The riprap material must be free from loose dirt or any other pollutant.
2. The riprap material must consist of clean rock or masonry materials such as, but not
limited to, granite or broken concrete. Materials such as tires, car bodies, scrap
metal, paper products, tree limbs, wood debris, organic material or similar material,
are not considered riprap.
3. The fill material will be clean and free of any pollutants, except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
No marsh grass will be excavated and/or filled.

May 2, 1996
The Town of Morehead City is proposing to expand water and sewer
services to the Mitchell Village area, a portion of which has
recently been annexed into the Town. The project area is located
adjacent Peletier Creek in Carteret County.
This project involves the placement of sewer and water lines within
existing street right of ways. Approximately 16 acres of land,
including approximately 0.5 acres within the Estuarine Shoreline
AEC, will be disturbed by the installation. There will be no impact
to coastal wetlands located in the vicinity of the project or to
the waters of Peletier Creek below the mean high water line.
I have reviewed this proposal for consistency with the 1991 Town of
Morehead City Land Use Plan (LUP) and offer the following comments.
A portion of the project area was outside the Town's planning
jurisdiction at the time of adoption of the current Plan and
therefore is not included on the Morehead City Land Classification
Map. However, the 1991 Carteret County Land Use Plan classified
this area, which was then in the County's planning jurisdiction, as
Developed. The remaining portion of the project area was under
Morehead City Planning jurisdiction in 1991 and was classified by
the Town as Developed. The provision of urban services, including
central water and sewer, is consistent with the intent of the
Developed class.
The Morehead City LUP discusses allowed uses in Conservation
classified areas on Page 71. Generally, the Town concurs with the
7H Use Standards for development in AECs. Morehead City imposes
certain restrictions which exceed the state minimum standards, but
none of these appear to be applicable to this proposal.
Resource Protection policies contained in the Plan repeat the
Town's acceptance of the 7H Use Standards. Policies on Page 50
discuss the Estuarine Shoreline AEC. This section of the Plan
contains no policy exceeding the state minimum standards which
appears to be applicable to this project. The LUP notes that any
development in the Estuarine Shoreline AEC must also be consistent
with local regulations.
Economic and Community Development Policies regarding the Local

Commitment to Providing Services to Development are found on Page
58. Morehead City requires any development occurring within the
corporate limits to be connected to the Town's water and sewer
systems. The Town also requires any annexed area to be connected to
these systems within one year of the availability of service. Other
policies in this section support expansion and improvements to the
water and sewer systems.
Based on the above policies, this proposal to extend Morehead City
water and sewer into the Mitchell Village area appears to be
consistent with the 1991 Morehead City Land Use Plan, provided all
stagy d local requirements can be satisfied.

8. PROJECT SUMMARY: The Town of Morehead City plans to expand water and sewer services to
the Mitchell Village area, which has recently been annexed into the Town.

9. NARRATIVE DESCRIPTION: The Town of Morehead City is proposing to extend
± 18,000 linear feet of water and sewer lines to service the Mitchell Village area
which has recently been annexed into the Town. Approximately 550 homes would be
connected to the new sewer and water system which are presently being served by
individual wells and septic tanks. A portion of the new lines (± 1100') will be within
the Estuarine Shoreline Area of Environmental Concern which exists along a tributary
of Pelliter Creek. This tributary crosses Mansfield Parkway (via 3, 36" concrete
pipes) and then travels westerly paralleling Bogue Avenue until it dissipates. The
creek is approx. 15' wide at its widest location and is bordered by coastal wetlands and
wooded wetlands. In some of the areas, the street pavement is very close to the edge
of either wetlands or surfaces waters. The sewer lines and lift stations will be on the
side of the street closest to the Creek, while the water line will be on the opposite side.
The lines would cross several ditches and rock riprap would be placed around the
sewer lines in those areas. Silt fence and or excelsior matting is being proposed to
stabilize all disturbed areas at the project site. Waters at the project site have been
classified as 'SB' and are closed to the harvesting of shellfish.
10. ANTICIPATED IMPACTS: This project would involve the placement of ± 168000'
of 10" sewer and 6" water lines within existing street right of ways. The project will
not cause any direct impact to any coastal wetlands or areas below the mean high water
line of Pelliter Creek. The project will involve the disturbance of ± 16 acres of land
area during the installation process. Extreme caution and proper sedimentation and
erosion control techniques will need to be utilized throughout the project to prevent
impacts from occurring to estuarine resources. Approximately 0.5 acres of land
disturbance would occur within the 75' Estuarine Shoreline AEC.

Division of Coastal Management, we have learned of your plans to expand water
and sewer services to the Mitchell Village, Morehead City, Carteret County,
North Carolina.
We understand that your plans include no construction waterward of the
MEW elevation contour and no placement of any excavated or fill materials in
any waters of the United States, including wetlands. Therefore, a DepartiOnt
of the Army (DA) permit will not be required. This does not relieve you of
the responsibility to obtain any other required approvals; and therefore, you
should complete coordination with Mr. Pigott before beginning work.

water and sewer lines as it will help improve water quality in the receiving streams by
eliminating existing septic tanks. Installation of the water and sewer lines will require
approximately one half acre of land disturbance within the Area of Environmental
Concern and the City will take adequate erosion control measures to prevent
sedimentation problems in the surface waters.

appears to be adequate for processing at this time. The projected deadline for making a decision is

above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right -of --way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any questions
and notify me in writing if you wish to receive a copy of my field report and/or comments from
reviewing agencies.
