This permit, issued on December 21, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation a mese terms may oe suoject to lines, imprisonment or civil action; or may cause the permit to oe null ano voto. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Austin Robinson Permit No. 139-22 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of one (1) formalized boat slips. 6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, electric limiter stop shall be placed on the boat lift at a minimum height of 18" above the bottom substrate to prevent the boat lift from disturbing the bottom substrate. The electrical limiter stop shall remain in place for the life of the permitted docking facility. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 9) Should either lot to the east or west sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) To reduce direct impacts to oyster resources, the permittee shall, in consultation with NC Division of Marine Fisheries, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. The permittee shall obtain any permits from the Town prior to the initiation of construction activities. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2022-02380). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4497 and assigned the project DWR Project No. 2022-1498. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 515-5400 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. Field Investigation Report: Robinson Paee 2 Narrative Description: The proposal is located adjacent to 1400 Cove Court within Dill Creek in Morehead City, Carteret County. This property is currently undeveloped. This proposal is for private use. The adjacent residential properties are developed with single family dwellings and docks. The elevation of the high ground on the property is approximately 3' above the normal high water level. Vegetation on the property mainly consists of lawn grasses, pine trees, and Coastal Wetlands. There is approximately 17' of shoreline on this 0.3-acre lot. Water depths in the project area range from —l' to —3' nlw. The subaqueous substrate is soft with shell. There is not a Federal Channel in the nearby vicinity of the project area. There is not a cultural resource in the project area. This waterbody is approximately 120' across at this location. These estuarine waters are classified as a Primary Nursery Area. Submerged aquatic vegetation (SAV) is not present at this location. This waterbody is closed to shellfish harvest and is classified as SA; HQW. Proposed Development: The applicant is proposing to construct a pier, floating platform, and boatlift within Dill Creek in Morehead City. The proposed development would take place adjacent to 1400 Cove Court, Carteret County. This proposal is for private use. The applicant is proposing to construct a fixed pier accessing a floating platform and a boat lift. The proposed pier would be 6' wide and 332' long beginning at the high ground on the property and traversing the Coastal Wetlands towards Dill Creek. At the pier's terminus, a 3' by 12' aluminum gangway would connect to a 6' by 20' proposed floating platform. A 15' by 13' boatlift is proposed on the east side of the proposed floating platform. The water depth in the project area ranges from - 2.1' to -2.6' nlw. Anticipated Impacts: This proposal appears to exceed the width of the applicant's riparian property area. This proposal should not pose a hazard to navigation. The proposal would shade 1,920 square feet of Coastal Wetlands and usurp 351 square feet of Public Trust Area. Traditional marine construction methodology would be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities within Dill Creek. This waterbody is classified as a Primary Nursery Area and there is no SAV present in the project area. There are oyster beds in the vicinity of the project area. Overview: The project is located adjacent to 1400 Cove Court which is part of the existing Mariners Point subdivision. The property is currently undeveloped. There is approximately 17' of shoreline on this 0.3- acre lot. The elevation of the high ground on the property is approximately 3' above the normal high water level. Vegetation on the property mainly consists of lawn grasses, pine trees, and Coastal Wetlands. The applicant is proposing to construct a pier, floating platform, and boatlift within Dill Creek in Morehead City. Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW) and Public Trust Areas (PTA). This section of Dill Creek is classified as SA/HQW, is a Primary Nursery Area, and is closed to shellfishing. There are Coastal Wetlands present and no SAV. Anticipated impacts: This proposal appears to exceed the width of the applicant's riparian property area. This proposal should not pose a hazard to navigation. The proposal would shade 1,920 square feet of Coastal Wetlands and usurp 351 square feet of Public Trust Area. Traditional marine construction methodology would be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities within Dill Creek. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The biggest issue I've got with not including stops on the lift is that there can be a failure with the limit switch. Also, I don't know how easily it can be adjusted by the owner to remove the 18" limitation. On the other hand, the stop provides a hard stop on the structure that I suspect would be more difficult to tamper with. Overall, the preference would be to include the stops on the lift, but incorporating the limit switch measures mentioned is acceptable. DMF would also prefer a stationary dock over a floating dock, particularly because it's PNA, but the water depths are consistent with the 2' depth in our guidance and in rules. Therefore, while it's our recommendation to use the stationary dock, a floating dock without stops is acceptable. So to sum it up, what is presented in the response email is acceptable. So the water depth at low tide is 2.1' or more where the floating dock and boat lift will be located. So it would naturally be about 20" off the bottom without the stops on the floating dock. The boat lift will have a limit switch which will be set to keep the cradle from ever hitting the bottom substrate and we are happy to set it so that it stays 18" off of the substrate. Stops are easy enough to deal with but I wanted to see if there was any interest in the fixed vs floater or sling vs stops since that would require updated plans. At minimum the stops would be conditioned on any final determination that resulted in a permit. Talk it over and let me know. The proposed work is located at 1400 Cove Court, Morehead City, within Carteret County. The applicant is proposing to construct a private docking facility within Dill Creek. The docking facility will consist of a pier, floating platform, and boatlift. The pier would be 6' wide and 332' long. At the terminus of the pier, a 3' by 12' aluminum gangway would connect to the proposed 6' by 20' floating platform. A 15' by 13' boatlift is proposed on the east side of the proposed floating platform. Water depths in the project area range from -2.1' to -2.6' normal low water (NLW). The waters at this site are classified as SA; HQW and are designated as a Primary Nursery Area (PNA). Oyster beds are in the vicinity of the project area, and the waterbody is closed to shellfish harvest. DMF is concerned with the proposed project, primarily as it relates to impacts to waters designated as PNA and to shellfish. Areas that are designated as PNA provide the (often very specific) habitat requirements needed for post -larval development of a variety of recreationally, commercially, and economically important finfish and shellfish species. These areas provide nursery, refuge, and foraging ground for these species during some of the most critical and vulnerable life history stages. As such, protection of these areas is of the utmost importance. Construction of the proposed structure will likely result in increased turbidity during the construction process, as well as during use of the structure. Increases in turbidity have the potential to result in impacts to fisheries resources, such as injury or mortality through clogged gills, diminished visibility, or smothering of prey. The construction of the proposed structure may also result in mortality of shellfish species through direct installation into shellfish beds. DMF has concerns with the proposal and recommends that the following conditions be included in any permit issued. The permit should include a I April through 30 September moratorium for all in -water work associated with the project. This includes any aspect of the project that may result in a disturbance to any portion of the water column and/or seafloor. Although no dredging was proposed, the permit should be conditioned on no new dredging (i.e., for maintenance of slip depth) being allowed in the future, as DMF is generally opposed to new dredgin in �attes. First, the floating dock should be replaced with a stationary structure. Floating docks have the potential to rest on the seafloor during shallow water conditions. This can result in continued increases in turbidity as well as create anoxic conditions if the structure remains on the bottom for extended periods. If a stationary structure is not a possibility, the floating dock should include stops located 18 inches above the substrate. DMF also recommends that the proposed boatlift design utilize a sling -style lift as opposed to a traditional lift. Sling -style lifts tend to be less impactful to substrate (i.e., cause less turbidity) during use. If sling -style lifts cannot be used, DMF recommends that the lift also include stops located 18 inches above the substrate. Finally, it was unclear based on the site plans if any part of the proposed project would be located directly over shellfish beds. DMF would recommend that shellfish in the project area be avoided to the fullest extent possible. This can be accomplished by avoiding installing pilings directly into shellfish beds. For any shellfish that cannot be avoided by design, DMF would recommend that these shellfish be relocated to outside the project area. In the past NCWRC has recommended the use of stops set at 18" above substrate on floating structures and lifts, not limit switches. Therefore, to be consistent with previous recommendations to minimize impacts to aquatic resources, the NCWRC requests stops on the floating structure set to 18" above substrate if the design is not changed to a stationary structure as well as stops set at 18" for the lift. The PNA status and significant oyster resource in this area are reasons why our agency has closely watched development in this system for the past 15 or so years. The project site is located at 1400 Cove Court adjacent to Dill Creek. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act-(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct 6' by 332' fixed pier, floating platform and boat lift. At the pier's terminus a 3' by 12' aluminum gangway would connect to a 6' by 20' proposedfloating platform. A 15' by 13' boatlift is proposed on the east side of the floating platform. Oyster beds are within the area. The substrate is thick organic mud. Dill Creek at this location is classified SA HQW bathe Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC is very familiar with the site and the Mariner's Point subdivision. The allowance of the multi -slip facility was to minimize impacts from individual lots developing water access and compromising environmental resources. The waters of Dill Creek are designated a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or j uvenile life stages of marine or estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As a designated PNA, the creek provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. Erosion of the marsh, sediment disturbance, turbidity,.and contamination collectively will.degrade vital habitat and forage for wildlife in.Dill Creek. Extensive beds of oysters are also present along the shoreline and would be vulnerable to continuous boating activity. To minimize the impacts this facility may have, we request the floating platform either be removed, stops incorporated, or changed to a fixed platform to prevent the structure from sitting on substrate. The thick organic material can cause significant turbidity when disturbed so consideration may need to be given to eliminate the slip, especially if the position of the slip is outside the applicant's riparian area and must be relocated to an area with lower water depths. The community has a multi -slip facility that can be utilized. No slips should be placed over oyster resources so if slip is permitted, verification of the slip and oyster resources should be presented. We also request a construction moratorium from April 1 — September 30 due to the designation of the water body, the SA HWQ water classification, the presence of oysters, and the importance of coastal marsh during the peak period of biological productivity. This includes in -water as well as over -wetland construction. Due to the designation of this waterbody as a PNA, the NCWRC would not support any future dredging requests. The NCWRC also supports the comments and concerns stated by NCDMF. Our agency would also like to note that the plans in this application indicate the adjacent property owner, Robert Levey, has a boat lift at his structure. During our review of his application, there was to be a kayak launch area, not a boat lift. If the permit has been modified, please let us know. We also request that any permits that are modified within Dill Creek are circulated to resource agencies for assessment and consideration of impacts.
