Bulkhead and Riprap Installation
1) The bulkhead and riprap will not extend waterward more than 6 feet from the mean high water level
at any point along its alignment at the time of construction.
2) The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction.
Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather
conditions, will require the alignment tobe re -staked by DCM within a maximum of thirty (30) days
prior to the new expected start of construction.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

United States in the public interest.
11) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
12) It is possible that the authorized structure may be damaged by wavewash from passing vessels.
The issuance of this permit does not relieve the permittee from taking all proper steps to ensure
the integrity of the permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
13) The permittee will maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without having the permit transferred to a third party.

8. PROJECT SUMMARY: The applicant is proposing to construct an office and machine repair
building, bulkhead and riprap the shoreline area and place a docking facility for five boats in the
Newport River at a site on the west side of Radio Island.

9. NARRATIVE DESCRIPTION: The applicant currently has made an offer to
purchase a ± .5 acre tract of land located on the west side of Radio Island, between
the Towns of Morehead City and Beaufort, in Carteret County. The property borders
the east side of the Newport River and North Shore Drive, which is an unimproved
sand road off Inlet Drive. The upland property consists of old dredge spoil material
and is sandy in nature. Various upland weeds, shrubs and grasses dominate the
vegetation on the tract. A one story framed dwelling with detached garage is also
located on the property but has been gutted by fire. The shoreline area is sandy and
has a large intertidal area on the Newport River. There are two isolated pockets of
spartina altemii fora which are located ± 14' beyond the normal high water line.
These marsh areas encompass a combined area of ± 140 ft.2 and have been severely
impacted by erosion over the years. There are also scattered amounts of concrete and
bricks were placed in the water in an attempt to stabilize the location of the previous
shoreline. The shoreline of the adjacent property to the north juts out considerably
farther than this property and has been previously stabilized with riprap. The adjacent
southern shoreline is sandy and is similar to the applicants property. There is evidence
of erosion along the shoreline with a ± 3' high erosion bank located just landward of
the beach area. The waters of the Newport River adjacent to this property have been
classified as SA and are closed to the harvesting of shellfish. While there are scattered
amounts of oysters along the shoreline but they do not appear to be in any harvestable
quality.
The applicant is requesting a permit to develop a docking facility with upland support
facilities for the pilot boats used in conjunction with the operation of the NC State
Ports Authority's Morehead City Terminal and other commercial traffic coming into
Beaufort Inlet. Plans included with the application shows the proposed construction of
a ± 170' long x 12' wide pier into the Newport River. At the waterward end of the
pier, a ± 120' long x 12' wide "T" platform is proposed with a series of three cluster
dolphins approx. 24' offshore of the platform. Four finger piers with associated
mooring dolphins are proposed to be constructed inshore of the main "T". Two of the
finger piers will be 24' long x 6' wide with the others being 48' long x 6' wide. In
order to provide a somewhat protective mooring area, a wavebreak is proposed to be
attached on the offshore edge of the "T". The wavebreak will be constructed of
wooden timbers and will extend ± 3' below the plane of mean low water (MLW).
The applicant is also proposing to stabilize the shoreline by the construction of a
wooden bulkhead which is to be located ± 8' waterward of the existing normal high
water line. Seaward of the bulkhead, the applicant is proposing to place riprap
material which will be 6' wide at its base. The dilapidated structure on highground
will be razed and a new 50' wide x 100' long, 2-story building is proposed to be
located ± 65' away from the existing normal high water level. The proposed parking
areas will be located outside of the Estuarine Shoreline Area of Environmental Concern
but an ± 12' wide soil packed or marl road will be located in this area in order to
provide vehicular access to the dock system.
10. ANTICIPATED IMPACTS: The project would result in the construction of a
docking facility which will extend t 215' beyond the existing normal high water level.
The docking facility would be away from the Morehead City Harbor Turning Basin
which is a federally authorized project. The docking facility would extend beyond the
applicants riparian corridor but a verbal agreement has been reached with the adjacent
riparian property owner (NC State Ports Authority). (A written agreement will also
follow.) There is no dredging proposed but some increase in turbidity levels will
increase during pile driving operations. Such increases should be short term in
duration and given the strong tidal flow in the area should not have any measurable
impacts. In addition, the proposed wave breaker which is to be attached to the dock
should not restrict water flow or circulation into the area. The docking area will
provide mooring areas for up to 6 boats and will have a f 14,325 ft.z footprint over
public trust waters. The applicant has indicated that a 12' wide dock is necessary so
that trucks may gain access to the pier for working on engines, etc. The proposed
bulkhead and riprap will result in t 1,625 ft.z of intertidal area being filled. The
riprap will be positioned at or above the areas of spartina alterniflora but it can be
excepted that this vegetated wetland area will be loss whether the shoreline is stabilized
or not. The construction of the building and driveway will increase the amount of
impermeable surfaces within the Estuarine Shoreline AEC. The applicant has indicated
that impervious surfaces within the Estuarine Shoreline would be 28% but it appears
this figure is higher than what is actually proposed.

and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by II" white paper. (Refer to
Coastal Resources Commission Rule 7.1.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant

means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for

I have no objections to the issuance of a permit with the following
conditions applying:
/ 1. The bulkhead and riprap will not extend waterward more than 6
feet from the mean high water level at any point along its
alignment at the time of construction.
2. The alignment of the proposed bulkhead must be staked by a
representative of the Division of Coastal Management (DCM)
within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty
(30) days, or erosion of the shoreline by adverse weather
conditions, will require the alignment to be re -staked by DCM
within a maximum of thirty (30) days prior to the new expected
start of construction.
3. The riprap material must be free from loose dirt or any other
pollutant. It must be of a size sufficient to prevent its
movement from the site by wave or current action.
4. The riprap material must consist of clean rock or masonry
materials such as, but not limited to, granite or broken

bodies, scra etal,
paper p oducts, ee limbs, ood debris, ganic teri or
sim ar erial, a not cons red riprap.
3 5. The bulkhead must be constructed prior to any backfilling
activities.
4 6. All backfill material will be obtained from a highground
source and confined behind the permitted bulkhead.
7. No attempt will be made by the permittee to prevent the full
and free use by the public of all navigable waters at or
adjacent to the authorized work.
J 8. The permittee must install and maintain, at his expense, any
signal lights and signals prescribed by the U.S. Coast Guard,
through regulations or otherwise, on authorized facilities.

Andrew A. Midgett (Morehead City Pilots Assoc., Inc.) is proposing
to construct an office and machine repair building, bulkhead and
riprap the shoreline area and place a docking facility for 5 boats
in the Newport River, at a site on the west side of Radio Island.
Areas of Environmental Concern (AECs) impacted by the proposed work
include the Estuarine Shoreline, Estuarine Waters and Public Trust
Areas. Waters at the site are classified as SA and are open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1991
Carteret County Land Use Plan (LUP) Update, as amended September
24, 1993, and offer the following comments.
The general area of the project is classified as Developed, while
the AECs impacted by the proposed work are classified as
Conservation.
The Carteret County Land Use Plan discusses the County's intentions
regarding development in Conservation classified areas in the
Resource Protection and Resource Production and Management Policy
sections of the Plan.
Applicable policies include those for Marine Resource Areas (Page
IV-11). With some exceptions, none of which appear to be applicable
to this project, Carteret County supports the use standards for
development in Estuarine Waters and Public Trust Areas.
Marina and Floating Home Development Policies also address
construction of docks and piers and are discussed on Pages IV-6 and
IV-7. These policies do not appear to preclude this project.
Bulkhead Construction Policies are discussed on Page IV-9. Carteret
County does not oppose bulkhead construction which satisfies the 7H
minimum use standards.
Carteret County's policies regarding Residential, Commercial, and
Industrial Development Impacts on Resources are discussed on Pages
IV-10 and IV-11. Carteret County restricts commercial uses in
Estuarine Shoreline areas to those which are water dependent or are
supportive of commercial fishing. Examples of allowed commercial
uses in these areas are provided in the Land Use Plan. Uses allowed
by the County include boat repair and construction facilities and
any business dependent upon natural salt water as a resource. Also,
restaurants which do not extend into or over the waters are
allowed. The Plan notes that where zoning exists, all uses must be
consistent with the established zoning. Based on the examples given
in the LUP, this proposal to construct an office and machine repair
building to support the pilot boats used in conjunction with the
operation of the North Carolina State Ports Authority's Morehead
City Terminal and other commercial traffic traveling through
Beaufort Inlet does not appear to be inconsistent with local land
use plan policies. Elsewhere in the Resource Protection Policy
section of the Plan, the discussion of Man -Made Hazards references
the County's support of expansion and growth by the NC State Port.
The importance of the continued growth and success of the port
facility to the County is also discussed on Pages I-36 through I-38
(Section I: Analysis of Existing Conditions, Economy).
Based on the above policies, this project appears to �be consisten
with the amended 1991 Carteret County Land Use P1 provided al
state and local requirements can be satisfied.

1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. The bulkhead will not be positioned farther waterward than 8 feet
from the mean low water elevation contour at any point along its alignment.
The rip -rap will not extend farther waterward than 6 feet from the bulkhead.
3. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
4. The fill material will be clean and free of any pollutants except in
�I trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
5. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
6. No vegetated wetlands will be excavated or filled.
7. This permit does not authorize the interference with any existing or
( O proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
8. No attempt will be made by the permittee to prevent the fril
free use by the public of all navigable waters at or adjacent to thauthorized work. Use of the permitted activity must not interfere public's right to free navigation on all navigable waters of the UnStates.

9. It is possible that the authorized structure may be damaged by
J 2 wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
3 10. The permittee will maintain the authorized work in good condition
and in conformance with the terms and conditions of this permit. The
permittee is not relieved of this requirement if he abandons the permitted
activity without having it transferred to a third party.
11. This Department of the Army permit does not obviate the need to
obtain other Federal, State, or local authorizations required by law.
12. This permit does not grant any property rights or exclusive
privileges.

Enclosed is the application of Andrew A. Midgett for Department of the
Army authorization and a State Water Quality Certification to place fill
material in 1,625 square feet of intertidal, non -vegetated wetlands, and
construct a docking facility over 14,325 square feet of open water, in the
Newport River, on Radio Island, in Beaufort, Carteret County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by August 7, 1996, the District Engineer will deem that
waiver has occurred.

Dear Mr. Midgett:
On February 11, 1991, we renewed general permit No. 198000291 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received May 29, 1996, for Department of
the Army authorization to place fill material in 1,625 square feet of
intertidal, non -vegetated wetlands, and construct a docking facility over
14,325 square feet of open water, in the Newport River, on Radio Islam, in
Beaufort, Carteret County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. only after receiving such
confirmation should you begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to reduce wetland losses. Please show all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to reduce adverse impacts.

c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please show your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by June 21, 1996. Also, a copy
of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199603542.
It will be coordinated by the undersigned in our Wilmington Field Office. I

the Newport River, in Carteret County. It was received on May 6, 1996, and appears to be adequate for
processing at this time. The projected deadline for making a decision is July 21, 1996. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point
along the road right -of --way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me
in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Plans for the LPP system shall be prepared by a Person having a demon-
strated knowledge of LPP's, such as an engineer licensed with the State of
North Carolina.
The system shall be designed according to Section .1900 of the State
Sewage Rules.
LPP plans shall be submitted to and approved by the Carteret County
Environmental Health Division. Other requirements such as fill and/or
grading may also be necessary.
A contract between the owner and a certified oneralor shall be required for
the purposes of malatenance and operation of ,he above septic system.

STANDARD PROCEDURES:
I. Fill material shall be applied in three states:
a. The fill area should be, cleared of any vegetative cover or organic
litter and disked to a.depth of six inches.
b.7Wo to three inches'of Group I Sand is placed in fill area and
disked or mixed In with the original soil to a depth of six inches.
We RECOMMEND having the rill area inspected prior to step c.
C. When It. is completed, the remainder of the Group I Sand can
be added to the specified area and then inspected by this office.
FILL MATERIAL SHALL NOT CONTAIN CONSTRUCTION
DEBRIS, TRASH, ROCK CLAY BALLS, HARD PAN
MATERIAL OR ANY OTHER THAN SAND.
2. Topsoil installation:
a. After the system is installed according to the IMPROVEMENT
PERMIT and inspccted by this office, the topsoil can be installed.
It. The topsoi! will be Group 11 Sandy Loam or Loam. The topsoil
shall be limed and/or fertilized if necessary to promote vigorous
growth of grass.
c. The entire filled area shall be seeded with perennial grass seed.
