Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.
River Basin Rules Applicable To Your Project:

Items of interest:
• All owners of property in Brantley Pointe should abide by the Covenants for the neighborhood as monitored and
enforced by the Architectural Committee of the BPPOA and the Board of Directors of the BPPOA. A copy of the
Covenants is readily available if requested.
• The BPPOA will contact you within 10 days by mail, phone or email of the receipt of this application. The
Architectural Committee will respond within 30 days from the acknowledged receipt date with either an
acceptance/rejection of the application or a description of further information needed prior to approval or
rejection of the approval.
Communications will be done according to the NC Uniform Electronic Transactions Act.
• Any decision may be appealed to the Architectural Committee of the BPPOA, to the Board of Directors of the
BPPOA, then to the full Association of the BPPOA according to the rules and timeline as specified in the BPPOA
Covenants and Bylaws (each readily available if requested).
• If you are tying to a neighbor's existing fence, then you must obtain their written approval to do so and provide
that approval to the BPPOA.
• Subject to NC law as specified in the NC Planned Community Act Chapter 47F, the BPPOA will exercise proper
approval, monitoring and enforcement obligations to assure that additions and changes to the neighborhood
are properly planned and executed.
