Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Tara:
On behalf of Cape Fear Public Utility Authority (CFPUA), Davey Resource Group, Inc. is submitting a
CAMA General Permit application for the installation of rip rap within coastal wetlands and a Public
Trust waterbody, Burnt Mill Creek, in New Hanover County.
The Crosstown Feeder water transmission main was originally installed in the 1980's and is a critical
artery to the CFPUA water system. A portion of the 36-inch ductile iron water main crosses Burnt
Mill Creek and periodically becomes exposed due to on -going bank erosion in the area. CFPUA had
originally planned to replace the pipe with a similar sized inside diameter pipe of fusible material that
would have been installed under the creek via horizontal directional drill (CAMA GP issued for this
work last year). However, CFUPUA was not able to procure the pipe material and the project was
cancelled. It has recently been discovered that a portion of the water line has little to no cover over
the pipe. A recent site visit found about 6" of soft mud in this area. CFPUA proposes the installation
of riprap over the pipe in this section as a means of protection. The dimensions of the riprap are 60'
length x 10' width x 2' depth. All work will be done from uplands and/or the newly installed rip rap.
The line will be installed within an existing CFPUA utility easement.
This application requests CAMA General Permit 0.1600 to authorize the installation of riprap (an
attendant feature) within coastal wetlands and public trust waters. DRG delineated wetlands within
the project area. Note that the US Army Corps of Engineers has determined that the project is a non -
notifying activity under a Nationwide Permit 3 and NC Division of Water Resources states that the
project will be considered authorized once the CAMA GP is issued.
The adjacent riparian landowners to the crossings at the location of the public trust waters have been
notified and copies of the notification letters and green card receipts from these certified mail
