Coastal Wetlands is accurate based on multiple indicators of current site Conditions (See.attached. Coastal Wetland DCM
JD). Starting on the west corner of the property; there are 5 pink DCM marking the landward extent of. Coastal Wetlands.
The .flags then transition to wood:stakes.for the remainder of the boundary.

After speaking with Robb and Tara, DCM has.agreed that if DCM: can receive verification .from the USACE that 404
wetlands. onsite will.not be more restrictive than the'coastal wetland boundary in the'area of the proposed bulkhead,
DCM would issue the bulkhead modification to allow the north side -of the property to be'stabilized: The.bulkhead
alignment. would be located no further waterward than the -stakes onsite. Any filling of wetlands following the
modificationissuance would result in 'a Notice of Violation. Please keep in mind that this would just be the issuance of
the modification to the CAMA General Permit and would.not alleviate Mr. Bageant from any requirements from New.
Hanoyer County in regards to the build ing"permit or the upland development that has -taken place. If you have any

Location description: The project area is legally described as Lot 1 Baileywick on the Pointe (802 Bailev Harbor Lane) adiacent
to marsh along the upper reaches of Pages Creek.

® There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404
of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The
waters, including wetlands have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate
and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map dated 11/29/2022. Therefore
this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory
mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection
measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any
way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an
appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). However, you may
request an approved JD, which is an appealable action, by contacting the Corps district for further instruction.
❑ There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404

is not sufficiently accurate and reliable to support an enforceable permit decision. We recommend that you have the waters,
including wetlands on your project area/property delineated. As the Corps may not be able to accomplish this wetland
delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can be verified by the Corps.

requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water Act

a period not to exceed five years from the date of this notification.

Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).

ASCE 7. THE DESIGN WIND SPEED IS 150 MPH.
% ALL WOOD MEMBERS SHALL BE SOUTHERN PINE MIN. GRADE 140 2. TREATED IN ACCORDANCE
WITH AWPA FOR GROUND CONTACT EXCEPT THAT 6X8 WATER SHALL BE SEA -TREATED (2.5 CCA).
11. ALL FASTENERS, HARDWARE, ANCHORITIE RODS, ETC. SHALL BE MIN. GRADE A36 HOT -DIP
GALVANIZED STEEL OR STAINLESS STEEL AT CONTRACTORS OPTION,
12. BACKFILL FOR BULKHEAD SHALL BE CLEAN GRANULAR FILL AND SHALL BE WASHED IN TO FILL
ALL VOIDS BETWEEN EXISTING AND NEW WALLS. CONTRACTOR MUST NOT USE HEAVY EQUIPMENT
SUCH AS VIBRATORY ROLLERS TO COMPACT SOIL WITHIN 1V OF BULKHEAD. CONTRACTOR MAY USE
HANG, P TED COMPACTION EQUIPMENT SUCH AS RATE TAMPS, JUMPING JACKS, ETC. TO
ACHEVE REOD. COMPACTION WITHIN 15' OF BU K EAD. CONTRACTOR SHALL TAKE SPECIAL CARE
TO ENSURE THAT TIE ROOSIANCHOR RODS ARE NOT DAMAGED DURING BACKFILLING OPERATIONS.
HACKFILL TESTING IS NOT REQUIRED.
