STRUCTURES - G.S. 113.103(5)(B)(5) and 15A NCAC 7K.0103(a)

AREA OF ENVIRONMENTAL CONCERN — OCEAN HAZARD
Dear Mr. Hartman:
I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application
for a minor development permit under the Coastal Area Management Act. Based on the information you provided in
your 9/1/2021 email correspondence, I have determined that the activity you propose on property located at 1238 New
River Inlet Road in the Town of North Topsail Beach, Onslow County is exempt from needing a CAMA minor
development permit provided it remains consistent with the information and drawings as described in your email
correspondence and meets the conditions specified below. If your plans should change and your project will no longer
meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR — [G.S. 113.103(5)(B)(5) and 15A NCAC 7K.0103(a)j - Maintenance and repairs
(excluding replacement) necessary to repair damage to structures caused by the elements are specifically excluded
from the definition of development under the conditions and in the circumstances set out in G.S.113A-103(5)(b)(5).
The repairs are limited to 50% of the framing members of the structure and the following specific conditions shall apply
to this project:
1. The project consists of the repair of two (2) stair stringers, two (2) floor joists, and associated deck boards
and exterior handrails as described in the 9/1/2021 email to DCM Field Representative Curt Weychert
2. The structure must be repaired in the similar manner, size, and location as the original structure.
3. No expansions, enlargements, or additions are permissible.
4. All work to remain within the existing structure footprint.
The proposed repairs shall be consistent and comply with all other applicable local ordinances and North
Carolina Building Code standards. Any other building and/or zoning permits must be obtained before
beginning work.
5. No other work in the AEC is authorized by this exemption. Only the repair work specified in Item No.1 above
is authorized. Any other work or changes in these plans must be reviewed by DCM before commencing work.

This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State,
Federal or Local authorization and N.C. Building Permits. This exemption expires 90 days from the date of this letter.

Hi Curt,
Confirming your conversation with Stephen Norris this morning, we respectfully submit our repair plan below foryour
consideration of a beach access repair waiver.
The existing structure consists of (4) 10' stair stringers. Our plan is to replace (2) of those stair stringers. The existing
structure has (4) 2'x12' floor joists. Our plan is to replace (2) of those floor joists.
This concludes the repair plans relative to the 50% retention/replacement conditions of the repair waiver.
Please let me know if you have any questions or concerns. As you know, we have a 2 1/2 day window to complete this
project. We would appreciate receiving a repair waiver as soon as possible.
