Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms may
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

This Agreement, entered into this day of July, 2000, by and between David D.
Harris and wife, Anne B. Hams, parties of the first part, and Iris B. Nalepa, party of the second
part; all of Onslow County, North Carolina;
WITNESSETH:
THAT WHEREAS, the said party of the second part are owners of a certain lot of land
located at 6099 Sixth Street, Surf City, North Carolina, the same being, the land conveyed to her
by Deed recorded in Book 469, Page 336 in the Office of the Register of Deeds of Onslow
County and also being identified as Onslow County Tax. Parcel ID No. 800172; and whereas,
.said parties of the first part are the owners of a certain lot of land located at 6097'Sixth Street,
Surf City, North Carolina, immediately South of and adjoining the land of the party of the second
part; the same being the land conveyed to them by Deed recorded in 469, Page 335 in the Office
of the Register of Deeds ofsaid County and also being identified as. Onslow County -Tax Parcel
ID No. 800 171; and whereas, all of said parties agree that it would'be for their mutual interest to
establish a joint easement for the common use of a boat ramp that adjoins both properties.
NOW, THEREFORE, it is mutually agreed that a joint easement be established for the
common use of the two lots bordering thereon, and which area of joint easement use is
approximately seventy-two (72) feet long, extending. westerly from a set iron stake in the right of
way of Canal Street, fora more specific description see the attached survey labeled "Exhibit A"
done by Lanier Surveying Company, entitled "Physical Survey: Property of Brian L. Lanier, Lot
42, Block 40,, Old Settlers Beach,.Extension to Sect. IV, Stump Sound Township, Orislow
• County, North Carolina" dated July 20, 2000, which survey is incorporated herein by reference,
and which survey should be consulted for a more particular description.
And in consideration of the mutual rights and advantages above.set out, each of the said
parties hereby gives, grants, and conveys unto the other party the perpetual right and easement of
egress; ingress, and regress over and upon said boat ramp as above described.
To have and to hold the rights' and, easements hereby granted to the respective grantees
and their successors in title forever; it being agreed that (lie rights and easement hereby granted
are for the common use of, are appurtenant to and run with the two parcels of land bordering
thereon and refenred' to above.
